3 1. Background Request for Proposal E-Rate WAN/Internet Batavia is among the oldest communities in the Fox Valley, having been settled in 1833, a full year before the City of Chicago. Once considered the fringe of the Chicago metro area, Batavia has matured into one of the premier communities of the western suburbs. Batavia Public School District 101 was founded in 1911 when the east side and west side school districts of Batavia consolidated. In recent years, District has received recognition for outstanding performance from Chicago Magazine, the Chicago Sun-Times, and the College Board. It has a well-deserved reputation for excellence and is recognized as one of the primary reasons for residential housing growth within the community Definitions: District refers to Batavia Public School District Vendor, Bidder, or Proposer refers to a firm or organization submitting a proposal for this project Contractor refers to the proposer who is awarded the contract for this engagement RFP refers to this Request for Proposals Proposal Deadlines Electronic proposals should be submitted via to Don Seawall at don.seawall@bps101.net, not later than 12:00 pm CT, March 8, Scanned copies of certifications are acceptable Any questions on the services requested through this document should be ed to Craig Williams at cwilliams@clientfirstcg.com no later than 5:00 pm CT, February 18, Responses will be posted on the District s Web site and the USAC E-Rate portal afterward The District will evaluate all responses to this document based on the following criteria: Total cost of ownership Technical configuration Provider references Service and support Provider implementation plan Page 2 of 11

4 1.4. Vendors shall be prepared to answer questions from the District and Consultant and enter into a contract with the District the week of March 11, E-Rate Compliance 2.1. The District may leverage E-Rate funding, for financial assistance in the procurement of some of this equipment and services Service Providers are required to be in full compliance with all current requirements and future requirements issued by the SLD throughout the contractual period of any contract entered into as a result of this RFP Service providers must comply with the FCC rules for Lowest Corresponding Price (LCP) Service providers are responsible for providing a valid SPIN and filing all required annual registration and compliance forms. To obtain a SPIN number, see Goods and services provided shall be clearly designated as E-Rate Eligible. Non-eligible goods and services shall be clearly called out as 100% non-eligible or shall be cost allocated to show the percentage of eligible costs per SLC guidelines In the event of questions during an E-Rate pre-commitment review, post commitment review and/or audit inquiry, the awarded Service Provider is expected to reply within 3 days to questions associated with its proposal The District will elect the Service Provider Invoicing (SPI) method of reimbursement from USAC. 3. WAN Services 3.1. Batavia is looking for ethernet transport between the District s Administrative Office and Batavia High School. To establish WAN infrastructure connecting the two locations, the District desires to consider Leased Lit Fiber Service for connections between the sites The primary District data center is located at the Rosalie Jones Administration Center and the secondary data center is located at Batavia High School. Wilson Street, Batavia IL Batavia High School Location B 1201 Main Street, Batavia IL Proposed WAN Network Summary The District requires fully managed Leased Lit Fiber Service, where the Service Provider would provide a fully managed service at the level of bandwidth stated by the District over Service Provider-owned or -controlled fiber. The Leased Lit Fiber Service should include all equipment, maintenance of equipment, and maintenance and operations of the fiber infrastructure Please complete the pricing worksheet of the Batavia 101 WAN Internet Pricing spreadsheet, Attachment A General Configuration & Requirements Under each of the requirements of Section 3.3 provide a brief description of the method(s) by which the proposer will provide for the District s requirement Wide Area Network Locations Batavia Public School District 101 has a requirement for a flexible, high bandwidth, highly reliable, and resilient ethernet transport link between the locations listed in Table 1. The District is seeking pricing on 40Gb, and 100Gb access sizing for the two locations with term options of 3, 5, and 10-year terms A service-level agreement (SLA) for network availability of at least 99.99% The District desires a diverse route from the City of Batavia Fiber Network. Please confirm whether your WAN offering utilizes any portion of the City of Batavia Fiber Network Describe the network s resiliency characteristics if the link from the provider network core to any of the District s two hubs were to fail The vendor shall state whether the service at these locations can be installed, tested and accepted by the District by June 30, Provide a discussion of the implementation and testing process, including the latest possible agreement date from which the provider will guarantee service availability by June 30, Page 4 of 11

6 The WAN must be a turnkey offering. The vendor must provide complete installation of the WAN, including extending the WAN inside District buildings from any entry or demarcation point to the designated District communications room. Vendor will be responsible for all building penetrations, interior conduit, interior pull boxes, computer room racking, fiber enclosures and fiber terminations Describe how the proposed services will be deployed, specifically the process of conversion from the existing to the new network. If new construction of entry facilities or backbone network is required, describe the process to implement the services. Specifically, comment on the use of any sub-contractors in the provision of the services Growth Flexibility Given the extended term of this agreement, the District has a requirement for growth flexibility. Describe the process for expansion of bandwidth for all the facilities sizes listed in the Pricing section of this document. Be specific about timing, downtime, and cost of moving to larger access facilities. The District will not extend the period of the initial contract to secure these expanded facilities, nor will the District accept financial penalties for increasing bandwidth WAN/Internet Service Agreement - the vendor must provide ongoing maintenance and repair of the WAN and Internet service, on a 24/7/365 basis, for the term of the agreement. Pricing for this service is to be included in the proposed costs detailed in Batavia 101 WAN Internet Pricing spreadsheet, Attachment A. Provide a copy of a sample Service Agreement. The agreement must include an SLA for a major outage response time not to exceed fourhours. Repeated violation of this SLA will allow the District to cancel the agreement. Repeated violation is defined as 3 or more outages of a least 30 minutes in a 30-day period or 6 outages of at least 30 minutes in any 180-day period. Any violation will allow the District to receive invoice relief commensurate with impact from service outage Vendor to provide table of service outage impact and associated invoice relief The District is interested in a 4-hour response time. Contractor shall respond whether it can provide this response time Provide detail on the timing and method of payment from the District for the WAN services up-front construction and/or installation costs, annual or monthly payments for service, annual or monthly payment for maintenance and repair, etc. Page 5 of 11

7 Neither the District nor the vendor can submit invoices for service to USAC prior to July 1, The District and vendor may submit invoices for one-time installation cost starting after January 1, However, the District would prefer to minimize one-time installation cost Installation considerations Service must be extended and terminated in the main network room of each facility. 4. Internet Services 4.1. As part of this RFP, the District wishes to procure Internet bandwidth with terminations at one or both data centers; Batavia High School and/or the Rosalie Jones Administration Center. Provide separate proposals for the Internet bandwidth of 1Gb, 2Gb, 3Gb and 5Gb for each of the locations The WAN may be purchased with or without Internet bandwidth The District may award contracts for internet service separately for each location Provide a Service Level Agreement for network availability of at least percent The District desires diverse connectivity to the two District termination points. Specifically, we wish to avoid circuit paths that follow the same physical route to minimize outages that might arise from accidental, malicious or natural causes Please provide a complete description showing diversification of the two routes If possible, the District desires that the two circuits be provisioned out of separate Service Provider Points of Presence (POP). Please provide details of the POP terminations for the proposed service Comply with the requirements of the WAN/Internet Maintenance section for the Maintenance Agreement for Internet Service. 8 5. Pricing 5.1. Pricing for the services applicable to your proposal should be included in the Batavia 101 WAN Internet Pricing spreadsheet, Attachment A The District will evaluate 3-year, 5-year, and 10-year agreements for WAN services. Proposers are required to provide ongoing maintenance and support, when providing network services (Network Operations Center services) throughout the term of the agreement. The 5-year agreement will require five one-year options for renewal, at the same rate, at the sole discretion of the District The District will evaluate 3-year and 5-year agreements for Internet service Alternate Pricing For Internet Service: provide alternate pricing for upline Threat Management System or Distributed Denial of Service (DDoS) Defense. The service should provide a proactive and unlimited mitigation response when DDoS attack traffic levels exceed pre-set thresholds of high severity rate and duration. 6. WAN / Internet References Provides a robust, all-inclusive information security portal Notifies via and/or Pager on critical alerts, advisories and attacks Provides anomaly detection, packet scrubbing, traffic analysis and trap alerts Includes equipment, monitoring and management Monitors a specified IP address range Includes web portal access for service and status reporting information, including anomaly reporting, historical archival, dark address analysis and status page 6.1. Using the following tables, provide three references for WAN and Internet services like those being proposed. 10 7. Bonding and Insurance 7.1. Bonding is required for Self-Provisioned Network proposals only Within seven days of the date of the Notice of Award, the successful contractor shall sign a formal contract with the Board of Education and shall provide a Performance Bond, in the full amount of the contract. The bond shall be in accordance with AIA Document A311. The contractor shall pay the cost of premiums for said bond. The bond shall be signed and sealed by an authorized representative of the bonding company and authorized officer or representative of the contractor, and a certificate of the authority of those signing the bond, if not officers, shall be attached thereto The Performance Bond shall guarantee the performance of the duties placed on the contractor by the Prevailing Wage Act, as well as all other duties undertaken pursuant to the contract with the Board of Education and shall indemnify the Board of Education from any liability or loss resulting to the Board of Education from any failure of the contractor fully to perform each or all said duties Insurance Requirements The contractor shall provide and maintain insurance in the amounts outlined below with companies acceptable to the Board of Education: MINIMUM INSURANCE REQUIREMENTS General Liability General Aggregate $2,000,000 Products-Comp/OP Agg 2,000,000 Personal Injury 1,000,000 Each Occurrence 1,000,000 Fire Damage (Any one fire) 50,000 Medical Exp. The contractor shall also purchase and maintain such insurance as will protect the institution from and against all claims, damages, loss and expenses, including attorney s fees arising out of or resulting from the performance of the work, provided that any such claim, damage, loss or expense, (1) is attributable to bodily injury to or destruction of tangible property (other than the work itself), including the loss of use resulting there from, and (2) is caused in whole or in part by a negligent act or omission of the contractor, subcontractor, anyone directly or indirectly employed by any of them or anyone for whose acts they may be liable, regardless of whether or not it is caused in part by a party to whom insurance is afforded pursuant to this paragraph It is MANDATORY within ten (10) days after the bid award, that the Certificate(s) of Insurance shall be submitted to the insurance agent for the Board of Education.
