1 ALPENA COUNTY SHERIFF S OFFICE REQUEST FOR BIDS INMATE FOOD SERVICES PURPOSE OF REQUEST FOR BIDS: The purpose of this request for bids is to enter into a three-year and 8 month contract for inmate food services. The anticipated effective date of this contract is May 1, 2016 and to expire on December 31, BID SUBMISSION INFORMATION: Appropriately marked sealed bids will be accepted no later than 10:00 a.m. Wednesday, March 9th, Bid packages should be submitted to: Alpena County Board of Commissioners 720 W. Chisholm Street, Suite 7 Alpena, MI Sealed bids will be opened at the Wednesday, March 9 th 2016 at 10:30 a.m. in the Commissioners Conference Room located in the lower level of the court house. ed bids will also be accepted and should be forwarded to: bids@alpenacounty.org In the Subject box type in Sealed Bids for. SERVICES TO BE PROVIDED: Vendor will be responsible for the overall operation of the kitchen facilities within the Alpena County Jail, specifically: 1. Menu supervision, including periodic and annual review by a registered dietitian in accordance with the requirements of the Michigan Department of Corrections. 2. Employment of appropriate kitchen staff to prepare and serve food. 3. Supervision of kitchen staff. 4. Purchasing of all food and food related supplies.
2 Page Purchasing of all cleaning supplies related to food service operation, excluding floorcleaning supplies. 6. Maintaining documentation of temperatures of food, freezer, cooler, dishwater, and sanitation inspections as required by the Michigan Department of Corrections. 7. Vendor shall prepare and serve three (3) meals per day for each day of the calendar year. Meals are to be served at the times specified by the Jail Administrator and are required to meet all standards of the Michigan Department of Corrections and the Michigan Department of Health. In addition, inmates on work release and/or attending education facilities will be provided a sack lunch for meals that will be taken outside of the jail. 8. Vendor shall post a four (4) week menu and shall endeavor to adhere to said menu. Necessary changes in the menu shall be in writing to the Jail Administrator a minimum of three (3) hours before the change occurs. 9. All meals shall be appropriate for the specific time of day. Dietary allowances shall meet the nationally recommended dietary allowances for basic nutrition for appropriate age groups. Meals shall pass a periodic review by a registered dietitian as provided by the Vendor with a copy of the review supplied to the Jail Administrator. 10. Vendor shall accommodate special diets as mandated by MDOC. Such diets shall serve the special needs of diabetics, inmates with other documented medical requirements, and/or approved religious diets. This shall include supplemental meals after the designated meal passes. OTHER CONSIDERATIONS: 1. Vendor shall be entitled to the use of all County owned equipment in the jail kitchen. 2. The County shall provide appropriate gas and electric service for the operation of the jail kitchen. 3. The County shall be responsible for any repairs to County owned equipment, with the exception in the case of obvious neglect or willful misuse by the Vendor. 4. The County will NOT be liable for spoilage to perishables in the event of a failure of coolers or freezers. In the event of failure of any County owned kitchen equipment, that piece of equipment shall be replaced with like kind.
3 Page The County will provide inmate workers to provide daily mopping and cleaning of kitchen floors and mats, and will provide cleaning solutions and supplies for that purpose only. 6. The County will provide and maintain a restroom for kitchen employees. 7. Any vendor or service facility accepting an agreement with Alpena County under this request for bids should be prepared to present appropriate proof of liability and workers compensation insurance coverage quarterly. A Minimum Certificate Insurance requirement form is attached to this RFB. 8. Any agreement entered into as a result of this request for bids will not create an employment relationship between any individuals and Alpena County. 9. The Vendor/Contractor represents and warrants that: i) The Services shall be performed in accordance with, and shall not violate, applicable laws, rules or regulations, and standards prevailing in the industry and the Vendor/Contractor shall obtain all permits or permissions required to comply with such laws, rules or regulations, where applicable; ii) The Vendor/ Contractor will perform the Services in accordance with the specifications established by the County. 10. The Vendor/Contractor shall comply with all of the County s standards and procedures when working on-site at the County. 11. The County shall not be liable for injury or death occurring to the Vendor/ Contractor or any of its employees or other assistants in the course of performing this Agreement. 12. The Vendor/ Contractor hereby indemnifies and holds harmless the County, its board of commissioners, employees, agents or underwriters from any damages, claims, liabilities, and costs, including reasonable attorney's fees, or losses of any kind or nature whatsoever ("Loss") which may in any way arise from the Services performed by the Vendor/ Contractor hereunder, the work of employees of the Vendor/Contractor while performing the Services of the Vendor/ Contractor hereunder, or any breach or alleged breach by Contractor of this Agreement, including the warranties set forth herein. The County shall retain control over the defense of, and any resolution or settlement relating to, such Loss. The Vendor/ Contractor will cooperate with the County and provide reasonable assistance in defending any such claim.
4 Page The Vendor/ Contractor will carry applicable liability insurance (including malpractice or professional insurance, when warranted) relative to any service that [he or she] performs for the County with limits of liability not less than $1,000,000 per occurrence with an Aggregate limit of liability and not less than $2,000,000 during the entire term of the Agreement. It is further agreed and understood the Contractor will name the County as an Additional Insured (Owner, Lessees or Contractors-Completed Operation form CG ), as their interests appear. Where applicable, the Vendor/ Contractor will furthermore comply with the State of Michigan Workers Compensation Act. SECURITY RESTRICTIONS Inasmuch as the kitchen facility is located within the Alpena County Jail, the vendor agrees to adhere to the following: 1. Follow all security rules as contained in the Policy and Procedure manual of the Alpena County Jail. 2. Coordinate daily kitchen operations with the Jail Administrator, or senior officer on duty. 3. Submit for approval, names and dates of birth for all prospective kitchen employees prior to their employment at the Alpena County Jail. Such prospective employees shall be required to sign a written document allowing a LEIN criminal history check. The Sheriff reserves the right to refuse admittance to any person or persons, who may, in his /her sole opinion, constitute a security risk to the Alpena County Jail. RIGHTS AND RESERVATIONS OF ALPENA COUNTY: The County of Alpena and the Alpena County Sheriff s Office reserve the right to reject any and all bids submitted as a result of the issuance of this request for bids. Furthermore, neither the County of Alpena nor the Alpena County Sheriff s Office shall be required to accept the lowest financial bid. All bids shall be reviewed with due consideration for the best interest of the inmates at the Alpena County Sheriff s Office. Prior to the awarding of any contracts, the Alpena County Sheriff s Office may negotiate individual specific items of a bid package, presuming that such negotiations do not result in any major change in the nature of the original bid package. The issuance of this request for bids does not commit the Alpena County Sheriff or the County of Alpena to any expenses or reimbursement of fees to any vendors submitting bid packages. Furthermore, no expenses or fees for the proposed services shall be duly compensated until such time that the Alpena County Board of Commissioners and the Alpena County Sheriff has appropriately entered into a written contract with the designated vendor.
