1 ONTARIO PROCESSING VEGETABLE GROWERS REGULATION # 2 Regulation #2 - Page - 1 CARROTS FOR PROCESSING Application of Regulation 1. (1) This Regulation provides for the control and regulation in any or all respects of the marketing of carrots, including the prohibition of such marketing, in whole or in part. (2) In the event of any conflict between the provisions of this Regulation and the provisions of other regulations of the local board, the provisions of this Regulation shall prevail and apply accordingly. Licence to Market Carrots 2. (1) No producer shall market carrots except under the authority of a licence and except in accordance with the terms and conditions of the licence. (2) The provisions of section 17 (a) of General Regulations 2006 to be enacted by the local board respecting a deemed licence to market do not apply to producers marketing carrots. 3. Every processor of carrots shall complete and file with the local board a Contract Schedule for Carrots in Form C-1 attached hereto together with a true copy of each contract for the marketing of carrots between the processor and each producer on or before the 15 th day of May in each year. 4. (1) A licence to market carrots may be issued by the local board to a producer of carrots upon the local board receiving no later than May 15 th in each year at its office from a processor of carrots a Contract Schedule in Form C-1 and a true copy of the contract between that processor and the producer in accordance with section 3. (2) The local board will issue the licences under subsection (1) within 15 days of receiving the Contract Schedule in Form C A licence issued by the local board to a producer for the marketing of carrots under section 4 is subject to the following terms and conditions: (i) (ii) it shall be for the marketing to the processor for the tonnage of carrots specified in the contract between that processor and the producer as filed with the local board by the processor pursuant to section 3. it authorizes the producer to market up to a maximum of 110% of the quantity of carrots specified in the contract between the producer and the processor filed with the local board pursuant to section 3.

2 Regulation #2 - Page - 2 (iii) (iv) the marketing of any carrots by the producer in excess of 110% of the quantity of the carrots specified is prohibited except under the authority of a supplemental licence issued under section 6 or 7. all obligations of the producer in accordance with the applicable Agreement or Award shall apply. Supplemental Licences 6. A producer desirous of marketing in excess of 110% of the quantity of carrots specified in the contract between the producer and the processor filed with the local board pursuant to section 3 shall file an application in Form C-2 with the local board at its office signed by both the producer and the processor to whom the additional quantity of carrots is to be marketed. 7. A producer who has not been issued a licence to market carrots under section 4 in respect of the current crop year may upon application in Form C-3 to the local board, at its office, request a licence to market a specified quantity of carrots to a specified processor. 8. An application in Form C-3 shall be signed by both the producer and by the processor requesting the carrots from the producer and the quantity of carrots required by that processor. 9. A supplemental licence issued by the local board pursuant to section 6 or 7 shall be subject to the same terms and conditions as provided in section 5 of this Regulation and may be subject to such additional terms and conditions as determined by the local board. Exemption Provision 10. The local board may upon application, exempt any persons from any provision in this regulation. Revocation 11.
