1 BEST OF WINDSOR & ESSEX COUNTY WINE, CRAFT BEER & SPIRITS RAFFLE JUNE TO SEPTEMBER 16, 2016 CONTEST RULES 1. DESCRIPTION OF DRAW United Way/Centraide Windsor-Essex County ( UWWEC ) will administer a Best of Windsor & Essex County Wine, Craft Beer and Spirits Raffle ( Raffle ) for the purpose of fundraising towards our funded investments. This raffle is a stub draw for three main prizes: 1. Wine, Craft Beer, Spirts Package; 2. Trolley Tour for 16; 3. Dinner Package for 8. An Early Bird Draw will include 1 bottle of wine or spirit or a gift certificate paired with an EPIC Passport to be drawn daily between August 1 and 31. The prizes are referenced on the ticket. Tickets will be available for purchase from, June 15, 2016 until 12:00pm on Friday, September 16, HOW TO ENTER Upon purchasing a ticket/s, the purchaser shall retain the paper ticket portion and the stub portion shall be placed into the ballot drum located at the United Way office, by a United Way staff/representative. All stubs must be received by 12:00 pm on Friday, September 16, 2016 for the 12:30pm Draw Time. The draw will take place at the United Way Windsor office. In order to participate in this draw, a person must not be otherwise excluded from the Raffle pursuant to the restrictions described in Section 7.1 of the Rules of Draw herein. Entrants must present acceptable identification upon request (see Section 6 herein). UWWEC takes no responsibility for lost, delayed, stolen, destroyed or misdirected tickets, as more fully described in Section 7.5(c) herein. 3. PRIZE DRAW DATE The Draw shall be held on Friday, September 16, 2016 at 12:30 p.m. ( Draw Time ), at United Way, 300 Giles Blvd. East, Windsor, ON ( Draw Site ), at which time a United Way Volunteer Representative will randomly draw three (3) stubs from the ballot drum, located at the Draw Site. The selected entrant need not be present to win. The winners of the prizes shall be determined by reference to the Name, Address and Telephone Number on the stubs drawn. The selected entrant will be announced at the Draw Site and will be publicized on the United Way web site and on all social media sites/pages/accounts administered by UWWEC. 1

2 2 A News Release shall be sent out and the coverage received via this media release shall also reflect further announcements of the selected entrants. See Section 7.3 herein regarding Privacy/Use of Personal Information. If the selected entrant is not present, he/she will be notified by telephone or by letter to the number and/or address provided on the ticket stub. 4. PRIZES Prize/s shall be accepted as awarded on the draw date. No cash option will be offered for any of the prizes. Prizes are limited solely to those items explicitly set forth herein and any and all other expenses not provided for shall be the sole responsibility of the selected entrant. Substitution or modifications of the prize shall not be permitted. The decision of UWWEC shall be final on all matters concerning the raffle. All prizes must be claimed within two (2) months of the draw date, namely November 16, The following prizes will be available to be won (collectively the Prizes and individually the Prize ): 4.1 Grand Prize: Wine, Spirits and Craft Beer worth a total maximum value of $4, CDN, which includes: A selection of wines, spirts and gift certificates from 10 participating Wineries, 2 Distilleries and 3 Craft Breweries in the Essex County Region The Grand Prize is subject to the following: a. The wine, spirits and gift certificates is not subject to an exchange or to be returned for a cash value. b. Winner must be 19 years of age or older. 4.2 Second Prize: Trolley Tour for 16 organized by W.E Trolley Wine Tours located at 44 Sinasac St W, Harrow, ON N0R 1G0 valued at a maximum of $825 CDN. A gift certificate will be provided for the Trolley Tour Package. The Second Prize is subject to the following: Trolley Tour Reservation a. The date of the tour is subject to availability. b. The winner can use the certificate only on a Sunday. c. The Winner has 1 year from the time the prize is won to redeem the package. d. A booking must be made by calling the W.E Trolley Wine Tours at (519) e. Winner and guest/s must be 19 years of age or older to participate in the tour. 4.3 Third Prize: Dinner Package for 8 at The Willistead Restaurant with a Gift certificate valued at $400CDN for a 6 course meal paired with wine. The Third Prize is subject to the following: a. Gift certificate is subject to availability b. Any restrictions imposed by The Willistead Restaurant on the gift card, shall apply

3 c. Winner and guest/s must be 19 years of age or older to use the certificate d. Bookings must be made by calling The Willistead Restaurant at (519) ; subject to availability. 4.4 Fourth Prize: Bed & Breakfast Staycation at The Bondy House B&B, located at 199 Dalhousie St., Amherstburg, ON N9V 1W5 valued at a maximum of $200 CDN. A gift certificate will be provided for a 2 night stay in the Dream Catcher or Victorian Room or a 1 night stay in the Executive Suite. 5. TICKET PRICE The Fourth Prize shall be subject to the following: B&B Reservation a. The rooms are subject to availability. b. The winner can use the certificate for a 2 night stay consecutively or a 1 night stay. c. Should the winner choose to stay for a longer period than the allowable stays, the additional charges shall become his/her sole responsibility. d. Reservations must be made by calling Bondy House B&B at (519) ; subject to availability. Ticket price is $10.00 CDN each. The maximum number of tickets available for sale will be 3,500. Tickets will be sold in advance of the draw. There is no limit on the number of tickets purchased by any one individual. 6. PRIZE CLAIM: Early Bird Draw To claim a Prize, the selected entrant must attend, in person, at the offices of United Way Centraide Windsor-Essex County, 300 Giles Blvd. E., Windsor, ON no later than September 30, 2015 (the Prize Claim Deadline ) at 4:30 p.m. EST. Prize claims will take place only during business hours of 8:30 a.m. EST to 4:30 p.m. EST Monday to Friday. In order to claim a Prize, the selected entrant will be required to present valid, government issued, photo ID and sign a standard declaration and release form, confirming: (1) compliance with the contest rules; (2) acceptance of the Prize/s as awarded; and (3) release of UWWEC and the Prize sponsors (the Sponsors ) and each of their employees, directors, officers, suppliers, agents, sponsors, administrators licensees, affiliates, representatives, advertising media buying and promotional agencies (the Releasees ) from any and all loss, harm, liability, damage and expense arising out of participation in the Raffle, participation in any Raffle-related activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom. Failure to comply will result in forfeiture of the Prize/s. Once this requirement has been fulfilled, the selected entrant shall then be declared the winner. Failure to sign and return said documents in a timely fashion (within 24 hours upon receipt of the release) or if Prize/s is/are returned nondeliverable, may result in Prize forfeiture and awarded to the winner of the Grand Prize. 3

PRIZE CLAIM: Grand Prize, 2nd Prize, 3rd Prize, 4th Prize To claim a Prize, the selected entrant must attend, in person, at the offices of United Way Centraide Windsor-Essex, 300 Giles Blvd. E., Windsor, ON no later than November 16, 2016 (the Prize Claim Deadline ) at 4:30 p.m. EST. RULES OF DRAW 8.1 Eligibility. a. To be eligible for this Raffle or any Prize, an individual must be of 19 years of age or older. b. To be eligible for this Raffle or any Prize, an individual must reside in the province of Ontario. c. UWWEC staff, Board members and immediate families of staff and Board members residing in the same household are not eligible to participate in this Raffle and win the Prize. Immediate family shall include spouse, parents, children, siblings, grandparents, grandchildren and any other person residing within the same household. UWWEC volunteers, friends and family (not residing in the same household), are eligible to participate in the raffle and win the Prize/s. d. Cheque or money order used for the purchase of the ticket/s must be made payable to United Way/Centraide Windsor-Essex County. If an entrant s cheque is dishonoured by the bank, or payment by credit card is dishonoured by the card merchant, the entry will be declared invalid unless full payment is received and cleared, prior to the draw. 4

5 5 8.2 Winner Selection and Communication a. The Prizes will be drawn in the following order: Early Bird Draw August 1 to 31; (1) Fourth Prize; (2) Third Prize; (3) Second Prize; and (4) Grand Prize. b. The Early Bird Draw winners will be announced on United Way s Facebook and Twitter Page, between August c. UWWEC shall be responsible for awarding the Prize and making all reasonable efforts to contact the selected entrants. d. The paper stubs from the draw drum shall be secured or placed in safekeeping for a period of one year following the draw date, namely September 16, If one or more of the Prizes are not claimed by the Prize Claim Deadline, it/they will be disqualified and another entrant will be drawn for that prize. e. Prizes shall be accepted by selected entrant and in the process outlined herein. Once declared the winner, he/she may transfer any or all of the Prize/s won at their discretion to an eligible person. Prizes are not transferrable to a United Way staff member or Board member or any members of their immediate family, residing in the same household. f. UWWEC shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the UWWEC for the purpose of the Raffle must be truthful, complete, accurate and in no way misleading. UWWEC reserves the right, in their sole discretion; to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information. g. The odds of being selected depend on the total number of eligible entries accumulated for the draws. h. The paper stubs from the draw drum shall become the sole property of UWWEC and will not be returned. 8.3 Privacy/ Use of Personal Information. a. The personal information collected in the course of the Raffle will be used for the purposes of identifying selected Prize entrants and administering the Prizes. b. By accepting the Prize, the winner agrees to the use of his/her name, address, photograph, videotape, voice, signature and any likeness for advertising or publicity purposes and to the use of statement made by or attributed to the winner, provided same are true, relating to the UWWEC, and any and all rights to said use without further compensation, except where prohibited by law. 8.4 Indemnification by Entrant. By entering the Raffle, entrant releases and holds the Releasees (as defined in Section 6) harmless from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, disappointment or inconvenience resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in the Contest, any breach of the Contest Rules, or in any Prize-related activity. The entrant agrees to fully indemnify Releasees from any and all claims by third parties relating to the Raffle, without limitation. 8.5 Limitation of Liability.

6 By participating in this Raffle, entrants agree that: 6 a. UWWEC or any of the Sponsors of the Prizes are not responsible for any incorrect or inaccurate information associated with or utilized in the Raffle or by any technical or human error which may occur in the administration of the Raffle. UWWEC or any of the Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. b. UWWEC assumes no responsibility for late, incomplete, damaged, lost, delayed, stolen, destroyed or misdirected entry stubs. All Prize claim information is subject to verification and will be void if not obtained through legitimate channels, or if not original, or if illegible, altered, forged, garbled, defaced, mutilated, mechanically or electronically reproduced or tampered with in any way, or if the ticket/s contain/s printing or production errors or if not obtained in accordance with these Rules. c. If the Raffle is interfered with, or it is impractical to conduct or continue to conduct, in whole or in part, as a result of fire, explosion, power failure, acts of God, civil commotion and/or labour unrest, including but not limited to strikes, slow-downs, lock-outs, picketing or boycotts, UWWEC and their respective officers, directors and employees shall be released from any and all responsibility and/or liability arising from such interference or impracticability and UWWEC shall have the option, at its sole discretion, to cancel, extend or reschedule the Raffle without liability. 8.6 Conduct. By entering this Raffle, entrants agree to be bound by the Contest Rules and decisions of UWWEC or the Sponsors, which decisions shall be final and binding in all matters related to this Raffle. The UWWEC reserves the right to declare any entry void and award the Prize to the next drawn entrant if a selected entrant is found to be: (a) violating the Contest Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest; and/or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE UWWEC RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION. 8.7 Law. a. This Raffle is subject to all federal, provincial and municipal laws of Canada. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the entrant and the UWWEC in connection with the Raffle shall be governed by and construed in accordance with the laws of the province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction s laws. b. All times stated are local Windsor, Ontario times and all values stated are in Canadian Dollars.

7 c. This Raffle is being held pursuant to a lottery licence issued by the City of Windsor, in accordance with the requirements of the Alcohol and Gaming Commission of Ontario. A copy of the licence may be obtained by calling the UWWEC office in Windsor. 8.8 Intellectual Property. All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the UWWEC, the Sponsors and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited. 8.9 Language Discrepancy. In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contestrelated materials, including but not limited to the ticket, or television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control Administration of Raffle.
