2 MCC15-03CM PURPOSE: The Community College System of New Hampshire is seeking qualifications/proposals from qualified, interested parties to provide Construction Management Services involving the construction of a NEW HVAC/ELECTRICAL TECHNOLOGY LABORATORY BUILDING at Manchester Community College, 1066 Front Street, Manchester, NH The project will include: A new stand-alone three level approximately 24,900 sq. ft. building at Manchester Community College, 1066 Front Street, Manchester, NH The nature of the project is a teaching environment for HVAC technicians and Electricians. The environment will be constructed and installed as a model for the proper installation of mechanical, plumbing, and electrical systems. This will include MEP equipment for teaching within the labs; as well as MEP equipment to operate the new building. In addition, we understand the building will house new technologies within the MEP market, including renewable energy and high-efficiency systems. The laboratory building will serve as a place for students to engage in real life, hands on applications in HVAC/ELECTRICAL TECHNOLOGY. The HVAC program (heating, ventilation, air conditioning) includes commercial and institutional applications, to include chillers, various heat pump applications, commercial boilers, and state of the art large scale air handling systems. The ELECTRICAL TECHNOLOGY program includes residential, commercial, high and low voltage, communications, building automation, programmable logic controllers (PLG), motors, and transformers. The facility will also have: a) classrooms and laboratory spaces for the teaching of renewable resources systems including geothermal, variable refrigerant flow building systems, and solar, etc.; b) classrooms and laboratory spaces for Industry related safety training to include OSHA, NFPA 70.5, and confined space training, and c) Storage for pipes, wire, equipment, and related supplies. Construction Budget to be approximately $5,500,000 for the building and site work. Project construction for the HVAC/ELECTRICAL TECHNOLOGY Building to start on or about June 1, 2016 and achieve substantial completion by June 1, Lavallee/Brensinger Architects, Manchester, NH is the architect assisting the Community College System of New Hampshire in developing, planning & design, performance criteria, specifications, construction management bid documents and construction administration according to the Community College System of New Hampshire requirements, administration needs and all applicable code requirements. 3 The Construction Manager will assist the Community College System of New Hampshire at Manchester Community College, and the designer in developing construction bid documents, bidding, contracting, quality control and quality assurance and managing all phases of construction. QUALIFICATION/PROPOSAL FORM for CONSTRUCTION MANAGEMENT SERVICES TO: Manchester Community College HVAC and Electrical Technology Building 1066 Front Street Manchester NH SUBMITTED BY: (Company Name) I have received the Request for Qualifications/Proposal for Construction Management Services required for the construction of Manchester Community College Advanced HVAC and Electrical Technology Building. I have examined the Request, and wish to submit the following Qualifications/Proposal. This Qualification/Proposal Form shall serve as a summary of our key qualifications, as presented more comprehensively in our bound Proposal dated. 1. The following shall serve as my key personnel to be assigned to the Project: Project Executive Project Manager Site Superintendent Estimator Mechanical/Electrical Coordinator(s) 2. We understand the Project Scope to be conceptually defined as follows: a. The new 24,900 square-foot, three level building will be sited on a sloped site along the Front Street entrance drive to the College. b. The new building will be Type IIIB unprotected steel framed construction set into the sloped site. The construction will involve working during college operations and the building site is located adjacent to an active student parking lot. 4 We understand the critical nature of ensuring existing infrastructure remains active and scheduling of utility and road interruptions around the college daily, nightly, and weekend schedule. We understand working within limited site areas for material storage and the critical nature of securing the work site. c. We understand the Construction Budget to be approximately $5,500,000 for the building and site work. NOTE: We understand for this Project, the Owner will be responsible for the construction contingency. d. We understand the nature of the project is a teaching environment for Advanced courses in HVAC and Electrical education. NOTE: We understand the environment will be a constructed and installed as a model for the proper installation of mechanical, plumbing, and electrical systems. This will include MEP equipment for teaching within the labs; as well as MEP equipment to operate the new building. In addition, we understand the building will house new technologies within the MEP market, including renewable energy and high-efficiency systems connected to an advanced Building Automation System. e. We understand the CM Services schedule to start in early April 2016 with a Review of Competed Construction Documents ready for bidding. NOTE: We understand no pre-bid estimating or budgeting is required. f. The first task will be Document Review and Bidding. We understand our task will be to review the construction documents with the design team; as the Project is advertised for public bidding. The following Bid services will be included: BIDDING SERVICES a. Review the Bid Documents and request information for any questions, as noted in the instruction to bidders; to clarify any information within the Documents. b. Work closely with the Owner and design team to understand the Vision and purpose of the project during the Bid Process. c. Provide constructability review of the Bid Documents during the bidding process. d. Provide assessments and evaluations on material and system options during the bidding process. e. The construction documents will be sent out to all sub-contractors and suppliers through a public notice. POST-BIDDING SERVICES a. Participate in option and alternative material and system evaluations as need to achieve the construction budget. b. Review the scope of work descriptions for all trades and bid the Project for the Owner; creating any necessary post-bid addenda for use in negotiating with lowest 2 or 3 responsible bidders in each trade. c. Share all trade and supplier bids with the Owner. d. Participate in sub-contractor qualification requests with the Owner and design team; relating to the MEP trades, to selected the most-responsive bidder. 5 e. Review sub-contractor qualifications and bid prices for presentation to the Owner and design team. f. Begin Construction in early 2016 with a final completion date of June 30, Substantial Completion shall be 30 days prior to final completion. Early site, foundation, and steel bids may be required. Notes: 1. All bid breakdowns will be detailed in material and labor costs by trade using the traditional CSI Division of the Work; within reasonable amounts, in no case greater than $200, A CPM Project Schedule will be developed and submitted after the Bid Results, and before the start of Construction. THE PROCESS Construction Managers are being invited to participate in the following selection process. Each is expected to prepare a written qualification and proposal. Six (6) copies required (and one (1) electronic proposal (ex. Flash drive), to be submitted to the Owner not later than: Submissions Due at three (3pm) on Wednesday March 9 th, Among all other documents and information, each submission shall include a fully executed copy of the attached Proposal Form, signed by an authorized agent of the proposing company. Each Construction Manager's submission shall address the following: a. Identification of principal Owners of the firm. b. We understand the above submission of names shall be a commitment on the part of the Construction Manager to retain the listed personnel on the Project throughout its duration. c. Specific construction management experience, on projects of similar program and scope. Experience in College Campus work is of primary interest. A complete list of related construction management projects of $5,000,000 to $40,000,000 completed during the past five years shall be submitted, along with Owner and Architect references. Additionally, not less than three completed project examples, of similar type (college campus) and scope (higher-ed educational building), including budget performance and schedule performance (actual vs. bid costs and completion dates), close out performance and warranty performance. Provide a detailed description of the firm s experience with Construction Management delivery and sharing costs and timelines with the Owner and Architect. d. Total dollar volume of work completed during each of the past three (3) years. e. Narrative description of the firm's philosophy of Construction Management. 6 f. Demonstration of successful management systems for the planning, organizing and monitoring of similar construction projects. Among these are scheduling and cost controls. A Building Information Model (BIM) will be developed by the design team. This Project resource will be shared with the Construction Manager throughout the pre-bid, post-bid, and construction phases in the Project. The Construction Manager will be expected to utilize the BIM Model as an important management tool. Please describe your firm s related capabilities. g. Identification of Work, if any, proposed to be performed by the Construction Manager's own work forces. h. Identification of Work, if any, proposed to be performed using union labor. i. Certificate of good standing from the NH Secretary of State and current bonding limitations as 100% bond will be required. j. Written description of any action against your firm by an Owner or sub-contractor / supplier, including any current involvement in, or anticipated, litigation, arbitration or mediation with any party relating to a previous or current Project. k. Description of the firm's construction safety program and safety record. l. It is intended to use the Community College System of New Hampshire s standard Construction Management Agreement modified to reflect the Pre-bid and Post-bid activities described above. m. Other information, qualifications and/or exceptions as each Construction Manager may consider appropriate to the selection process. Following the submission of qualifications/proposal, the Owner will consider all available information and select one Construction Manager with whom it will make a good faith effort to negotiate a Construction Agreement. In the event such an agreement cannot be reached to the satisfaction of the Owner, it reserves the right to terminate negotiations with no obligation to the apparently selected Construction Manager, and to proceed with negotiations with the next ranked firm. RESPONSIBILITIES 1. The Construction Manager shall be expected to perform all professional services consistent with the industry accepted roles of a Construction Manager; specifically, for bidding, post-bid value engineering, and construction. In general they shall include, but shall not necessarily be limited to: SITE VISITS: The project area, which is planned to be at the top of the entrance driveway on the east side of the parking lot, is available to visit at any time. 7 After the execution of the Agreement, the Construction Manager shall prepare a Schedule of Values based on agreed-upon bid amounts for the entire scope of the Work and upon the Owner s acceptance of the final Bid Amount, it shall be included within the Agreement. The Construction Manager will be expected to work closely with the Owner and Architect and will be encouraged to propose value-added cost and schedule alternatives. Attending meetings with the Owner and/or Architect as necessary, throughout the pre-bid, bid, and construction processes. Applicants are responsible for having ascertained pertinent local conditions, such as equipment, conditions, locations, accessibility, and general character of the site, knowledge of conditions affecting the work. The act of submitting a proposal is to be considered as full acknowledgment that the applicant inspected the site and is familiar with the conditions and requirements of these specifications. The College reserves the right to make a written request for additional information from a Designer/Vendor to assist in understanding or clarifying a proposal. The responses are to be provided in writing. All local, state and federal regulations are to be followed. Any fines assessed to the College due to the lack of these regulations being followed will be the responsibility of the successful Construction Manager Firm. If applicable, vendor is responsible for calling Dig Safe System, Inc., a private locating service. Any fines, damages, etc. assessed to the College due to failure to obtain a Dig Safe permit and to have utilities located by a private company will be the responsibility of the successful Construction Manager. Shirts are required to be worn at all times on the work site, smoking is allowed only in designated areas. The College reserves the right to request a criminal background check on any employee of Construction Manager Firm. The College also in its discretion may decide that anyone with a criminal history, other than traffic violations that have not been annulled, will not be allowed to work at the project site. Assuming charge of, and responsibility for all Project management and scheduling, including but not limited to, all construction activities as well as integrating the schedules related to cabling, furniture, and equipment systems as provided by the Owner s independent vendors. The Construction Manager's preparation and maintenance of a master project schedule shall not imply responsibility for the performance of contractors separately employed by the Owner. NOTE: It may be necessary to construct portions of the work outside of normal business hours. It shall be the Construction Manager's responsibility to satisfy himself that he has acquired an understanding of the Project adequate for the proper presentation of received bids to present to the Owner; with recommendations on value. 8 Using the BIM Model and the other information/communications to conduct constructability reviews, providing recommendations regarding constructability strategies, materials, equipment selections, and value assessments. Obtaining State and Local site and building permits, coordination with the State Fire Marshal s Office. Pricing of alternates; base bid and post bid items, as needed. Construction Sub-bidding and Sub-contracting. Construction coordination, inspection, supervision, safety and quality control services. Review and verification of additional costs, if any, as may be requested by subcontractors. Construction phase submittal/shop drawing review, approval, processing and coordination. Construction phase records and accounting, including the preparation of electronic Record Drawings and As-builts for use by the College in their educational programs. Project close-out, and building start-up management and coordination. COMPLIANCE BY CONSTRUCTION MANAGER WITH LAWS AND REGULATIONS - EQUAL EMPLOYMENT OPPORTUNITY In connection with the performance of the Services, the Construction Manager shall comply with all statutes, laws, regulations, and orders of federal, state, county or municipal authorities which impose any obligation or duty upon the Construction Manager, including, but not limited to, civil rights and equal opportunity laws. In addition, the Construction Manager Firm shall comply with all applicable copyright laws. During the term of any contract, the Construction Manager shall not discriminate against employees or applicants for employment because of race, color, religion, creed, age, sex, handicap, sexual orientation, or national origin and will take affirmative action to prevent such discrimination. If the contract is funded in any part by monies of the United States, the Construction Manager shall comply with all the provisions of Executive Order No ( Equal Employment Opportunity ), as supplemented by the regulations of the United States Department of Labor (41C.F.R. Part 60), and with any rules, regulations and guidelines as the State of New Hampshire or the United States shall issue to implement these regulations. The Construction Manager further agrees to permit the State or United States access to any of the Construction Manager s books, records and accounts for the purpose of ascertaining compliance with all rules, regulations and orders, and the covenants, terms and conditions of a proposed contract. SELECTION CRITERIA/ AWARD PROCESS: All responses will be reviewed by the Selection Committee. The Selection Committee shall evaluate the proposals and shall be composed of Manchester Community College Representatives and a Community College System of New Hampshire Representative, and Architect s Representative. 9 The RFQ/RFP process is a procedure allowing the Community College System of New Hampshire to award this contract for Construction Management Services to the firm whose submittal best meets the interests of Community College System of New Hampshire. The Construction Manager Firm shall not begin work until a fully executed contract has been received and the Construction Management Firm has received the notice to proceed. Anticipated Contract to be executed the end of March Proposal Inquires: all inquiries concerning this request shall be made in writing ( acceptable) and shall be submitted to Matthew Moore, P.E., Director of Capital Planning and Development, 26 College Drive Concord, NH 03301, phone (603) , cell (603) , memoore@ccsnh.edu. If necessary any updated information (addendums) regarding the RFQ/RFP will be posted at Selection criteria to be used by the Owner shall include, but not necessarily be limited to, personnel assigned to the project, general experience and qualifications, Construction Manager's Fee, costs of General Conditions (see the attached Table of Fees and Costs, under the General Conditions column), as well as any and all other considerations which the Owner may determine to be in the best interest of the Owner. The Owner's decision with regard to the selection of a Construction Manager shall be considered final. FORM OF AGREEMENT The form of agreement between Owner and Construction Manager shall be AIA A133 (Latest Edition) modified for this delivery system starting Construction Management services at 90% Construction Document preparation. General Conditions shall be AIA-201, General Conditions of the Contract for Construction (Compatible Edition) modified, with Supplementary Conditions to be prepared by the Owner and prepared by the Owner and Architect. Should the proposing Construction Manager require any modifications to this Form of Agreement or General Conditions, all such modifications shall be provided to the Owner prior to execution of the Agreement. CONTRACT INFORMATION FORM OF CONTRACT The Construction Manager Firm who is awarded the contract will need to complete an AIA 133 modified and AIA A201 modified contract (sample to be provided to those short listed) and provide the required Corporate Resolution (corporations/llc) or Partnership Certificate of Authority or Sole Proprietor Certification of Authority, whichever applies, to show the individual signing the contract is authorized to do so. BONDS and INSURANCE: The Construction Manager Firm awarded the contract is required to furnish 100% Performance and Payment bonds, and will need to furnish an insurance certificate which includes the following: See attached Exhibit A INSURANCE REQUIREMENTS. 10 The Community College System of New Hampshire shall have the right to terminate the contract at any time by giving the Construction Manager a thirty (30) day written notice. PAYMENT AND COMPENSATION: Payment terms: Partial payments are allowed once the work has been invoiced, approved, and accepted by the Community College System of New Hampshire. Retainage of 5% will be withheld from each payment. Monthly "Waiver of Liens" will be required prior to payment of the following month's invoice. SCHEDULE Construction shall be 100% complete and in receipt of Occupancy Permit on June 30, 2017, so the Owner may start move-in of furniture and equipment. Educational electrical and mechanical equipment will be connected by the Contractor between June 1, 2017 and July 30, QUALIFICATIONS/PROPOSAL 1. The Owner retains the right to waive any informalities, to reject any or all Proposals, or to accept any Proposal he may determine to be in his best interest. 2. It is the Owner's intent to bid this project publically, and advertise for sub-bids to be submitted to the Construction Manager. It is intended that the Construction Manager receive not less than three (3) sub-bidders for each trade or bid package. All subcontractors shall be subject to the acceptance of the Owner. All sub-bids shall be delivered in sealed, labeled envelopes and opened in the presence of the Owner and Architect. 3. All designs, concepts, information and value-added alternatives presented by the Construction Manager during the selection process shall become the property of the Owner and shall thereafter be used at its sole discretion. 4. The Construction Manager Request for Qualifications, Selection Process, and Schedule as outlined herein shall be considered subject to change as determined by the Owner. Terms and conditions of the Agreement between Owner and Construction Manager shall take precedence over all prior understandings and/or Agreements, if any, including this Request for Qualifications. 5. The Owner may at any time terminate the services and/or contract with the Construction Manager for the Owner's convenience and without cause. See AIA Documents. 6. It is expected that the Construction Manager will submit requisitions for completed work on a monthly basis and that a 5% retainage will be withheld from each payment. Monthly "Waiver of Liens" will be required prior to payment of the following month's invoice. 7. The Owner will access Liquidated Damages per AIA Documents. 8. 12 I understand that the intent of the Table of Fees and Costs provided with this RFQ/RFP is to assist the Owner in objectively comparing my fees and probable costs to those of others submitting Proposals. 17 owned, non-owned, and hired vehicles/trucks. The minimum limit of liability shall be $1,000,000 each accident, combined single limit for Bodily Injury and Property Damage. Workers Compensation Insurance: Contractor agrees to maintain in full force and effect Workers Compensation insurance which provides statutory coverage for Workers Compensation claims and Employers Liability insurance subject to minimum limits of: $500,000 each accident Bodily injury by accident $500,000 each employee Bodily injury by disease $500,000 policy limit Bodily injury by disease or the minimum limits required by Contractor s Umbrella insurer. Workers compensation requirements as required by NH law must be followed, and includes, in part, providing proof by the Contractor of workers compensation insurance coverage for all of its employees on this site. The Contractor awarded the work is also to submit information as required under RSA 21-I: 81 B. This law requires, among other things, the Contractor to provide timely information on employee and subcontractor identity, including all CFOs and principals on a log for this purpose, and for the College to post this information on a publicly accessible website. (Note: Any exemptions demonstrated by the Contractor can be noted in the contract in Exhibit C.) Umbrella Liability Insurance: Contractor agrees to maintain in full force and affect Umbrella Liability insurance which provides excess following form coverage over the underlying Commercial General Liability, Automobile Liability, and Employers Liability policies previously described. The Umbrella/Excess policy will provide minimum limits of liability of $5,000,000 per occurrence and aggregate - and the aggregate limit should be provided on a per project or job or location basis. Note: The scope of coverage and limit provided by the policy shall encompass the Architect/Engineers obligations as defined in the project agreement. Personal Property Insurance: CCSNH will provide Builder s Risk coverage insuring the structure during construction.
