3 PART I GENERAL INFORMATION 1.1 Purpose Seacoast Utility Authority (SUA) desires to retain a licensed, qualified industrial construction General Contractor to provide the scope of work described below. General Contractors that are limited to underground utilities, vertical construction, residential and commercial construction shall not submit. This Request for Qualifications (RFQ) provides guidelines for the submission of letters of interest and Statement of Qualifications (SOQ) information. The RFQ is the first of a two-step procurement process that is intended to identify and prequalify firms that will be eligible to receive an Invitation to Bid (ITB) based on their respective SOQ. Only respondents who are deemed, in the sole discretion of SUA, to be qualified through this RFQ process will be invited to provide a bid for the construction of the Hood Road Membrane Water Treatment Plant Project (Project). Bids received by those who have not been prequalified under the terms of this RFQ will not be considered and will be returned unopened. SUA s point of contact for this Project is SUA Water Department Manager Vince Mollo. All questions about the meaning or intent of this RFQ shall be submitted in writing to the attention of Mr. Mollo. Questions received less than seven (7) calendar days prior to the due date of the SOQ package will not be answered. Oral and other interpretations or clarifications should not be relied upon and will not be binding upon SUA. SUA responses to such written inquiries will be mailed to all entities that have requested RFQ packages and will be available for public inspection until the close of the period for this RFQ process in the lobby of SUA s administrative offices at 4200 Hood Road, Palm Beach Gardens, Florida. 1.2 Definitions For the purposes of this RFQ, a Respondent shall mean a licensed general contractor in the State of Florida, submitting a response to this RFQ. SUA shall mean Seacoast Utility Authority. The Project is the construction of the Hood Road Membrane Water Treatment Plant for which the prequalified Contractors will be invited to respond to the ITB in accordance with the Contract Documents, including all services, labor, materials and equipment used or incorporated in such construction. 1.3 Addendum Should revisions to the RFQ become necessary, SUA will provide a written Addendum to all Respondents who requested the RFQ from SUA s Purchasing Agent. It is the responsibility of each Respondent to this RFQ to acknowledge in their response the receipt of any/all addenda. All Respondents should contact SUA within five (5) calendar days before the date fixed for receiving SOQ to ascertain whether any Addenda have been issued. SUA will not be bound by any oral communications, or written interpretations or clarifications that are not set forth in an Addendum. 1.4 Award The Respondent understands that this RFQ does not constitute an agreement or a contract with the Respondent. Upon completion of the RFQ process, all prequalified Respondents will be invited to participate in the ITB process for the construction contract of the Hood Road Membrane Water Treatment Plant Project.
4 PART II REQUESTED SERVICES 2.1 Project and Scope of Work Hood Road Membrane Water Treatment Plant: a) Construction of a new 30.5 million gallon per day (MGD) finished water treatment plant comprised of the following: 26.0 MGD of nanofiltration (NF) 3.5 MGD of low pressure reverse osmosis (LPRO) 1.0 MGD pretreated local surficial aquifer blend water b) Plant Location: 4200 Hood Road in Palm Beach Gardens, Florida. c) Anticipated Project advertisement date is May 10 th, d) Anticipated opening of Project bids: 45 days from advertisement date. Work includes construction of new structures and/or areas of work including: a pretreatment system, one (1) membrane process and administration building including NF and LPRO equipment and pumps, one (1) degasification complex with six (6) blowers and three (3) odor control scrubbers, clearwell complex, chemical feed systems with associated storage and pumps, concentrate booster pump station, deep injection well (well drilling by others), three (3) Floridan Aquifer wells (well drilling by others), and modifications to the high service pump station. Work also includes all architectural, structural, civil, HVAC, plumbing, mechanical, electrical, instrumentation and site work. In general, the Work includes, but is not limited to, new construction, improvements to the site, installation of equipment as follows: 1. Site clearing, site preparation, access drives, excavation, hauling, dewatering, demolition, and stormwater conveyance systems 2. Yard piping including: raw water, feed water, permeate, potable water, stormwater, irrigation, concentrate, and chemical trenches/piping. 3. Pretreatment system including: cartridge filter housings and elements, chemical injection points and vaults, flow meter vault, and static mixer and appurtenances. 4. Membrane process and administration building including: architectural, structural, mechanical, electrical, HVAC, fire detection, and plumbing. 5. Membrane process equipment including: membrane feed pumps; membrane skids; and feed, permeate, and concentrate piping, valves, and appurtenances. 6. Degasification (post-treatment) complex including: clearwell with inlet piping, chemical injection points; degasification towers and odor control systems. 7. Bulk chemical storage area including: chemical storage for sulfuric acid, sodium hydroxide, corrosion inhibitor and antiscalant and storage tanks for diesel fuel. 8. Ammonia system, including 1,000 gallon anhydrous ammonia storage tanks, ammoniators, and a leak detection system. 9. Carbon dioxide system, including a 120-ton refrigerated carbon dioxide storage tank and a carbon dioxide solution make-up and feed system. 10. Modifications to piping and electrical system including upgrades to the existing motor control centers (MCC) and variable frequency drives (VFD). 11. Electrical system including: FPL transformers and primary feeds sized for plant capacity, backup emergency generators with switchgear, and diesel fuel storage. 12. Instrumentation and control system for the entire plant including: a control system with programmable logic controllers, input/output cards, and software.
5 13. Concentrate booster pump station, connection to a new deep injection well (well to be installed by others), and a surge control tank. 14. Mechanical, electrical and instrumentation to three (3) new Upper Floridan Aquifer wells. (Floridan Aquifer wells to be installed by others) 15. Lime slurry system including two (2) storage tanks, mixer and chemical feed pumps. 16. Demolition of the existing lime softening plant, backwash basin, sludge stockpile area and sludge lagoons after successful operation of the new membrane facility. Respondents found qualified through this RFQ process will be invited to provide bids for the Project. SUA reserves the right to award the work either in part or in total and reserves the right to reject any and all bids. PART III QUALIFICATIONS PACKAGE DUE DATE A sealed Letter of Interest and SOQ package and two (2) complete originals each must be received at SUA no later than 2:00 p.m., local time, on Monday, the 18th day of May, 2009 addressed and delivered to: Purchasing Agent Seacoast Utility Authority 4200 Hood Road Palm Beach Gardens, Florida Letter of Interest and SOQ package shall be sealed in envelopes plainly marked on the outside: Seacoast Utility Authority Hood Road Membrane Water Treatment Plant General Contractor SOQ Package The envelope must also include the Respondent s name and return address. SOQ packages received by SUA after the time specified for receipt will not be considered. Respondents shall assume full responsibility for timely delivery at the location designated for receipt of SOQ packages. PART IV SUBMISSION OF QUALIFICATIONS PACKAGE 4.1 Requirements of Respondents Respondents interested in performing the Work must exhibit relevant experience or qualifications in the following water/wastewater treatment plant/facility construction: Water/Wastewater treatment plant/facility construction while maintaining the operation of the existing facilities. Water/Wastewater treatment plant/facility construction with individual contract values of at least $15 million. Water treatment plant/facility construction of large structures. Poured in place concrete above grade and water retaining structure.
6 Respondents should emphasize both the experience and capability of particular personnel who will actually manage and perform the Work. Respondents should indicate any major sub-contractors proposed to be utilized on the Project. Respondents must be fully licensed for the type of work to be performed in the State of Florida at the time of RFQ receipt or a proof of application to the State of Florida for required licenses submitted prior to May 10 th, Respondents that are not fully licensed and certified shall not be found qualified. The Project will require the Contractor to provide Commercial General Liability having limits of at least 1 million per occurrence, 2 million aggregate, Umbrella Liability of at least 2 million, Commercial Auto (including owned, leased, non-owned and hired) having limits of at least $500,000, Workers Compensation Insurance in the statutory amount and a bonding capacity equal to at least $70,000,000. These are not required to be submitted with the SOQ package. 4.2 Incurred Expenses SUA is not responsible for any expenses which Respondents may incur preparing and submitting letters of interest and SOQ Packages called for in this RFQ. 4.3 SOQ Package Acknowledgement By submitting an SOQ Package, Respondents certify that they have fully read and understand the qualifications instructions and have full knowledge of the scope, nature, and quality of the Work to be performed. Submission of a response to this RFQ indicates Respondent s acceptance of the evaluation techniques and the recognition that subjective judgments may be made by SUA during the evaluation process. Submission also indicates that Respondent certifies that all parties included on their team are properly licensed by all applicable agencies to complete all required services. 4.4 Request for Additional Information Respondents shall furnish such additional information as SUA may reasonably require. This includes information that indicates financial resources as well as ability to complete the Work. SUA reserves the right to make investigations of the qualifications of the Respondents as it deems appropriate. 4.5 Signature Requirements SOQ package must be signed by duly authorized official(s) of the Respondents. Joint ventures or teams submitting SOQ packages, although permitted and encouraged, will not be considered responsive unless it is established that all contractual responsibility rests solely with one Respondent or legal entity which shall not be a subsidiary or affiliate with limited resources. Each SOQ package shall indicate the entity responsible for execution on behalf of the Respondent. 4.6 Public Entity Crime A person or affiliate who has been placed on the convicted vendor list following a conviction for a public entity crime may not submit a bid on a contract to provide any goods or services to a public entity, may not submit a bid on a contract with a public entity for the construction
7 or repair of a public building or public work, may not submit bids on leases of real property to a public entity, may not be awarded or perform work as a contractor, supplier, subcontractor, or consultant under a contract with any public entity, and may not transact business with any public entity in excess of the threshold amount provided in Section , Florida Statutes, for CATEGORY TWO for a period of 36 months from the date of being placed on the convicted vendor list. 4.7 Acceptance/Rejection/Modifications to Qualifications Package SUA reserves the right to negotiate modifications to SOQ packages that it deems acceptable, reject any and all SOQ packages, and to waive minor irregularities in the evaluation process. PART V INFORMATION REQUIRED OF PROPOSER In order to ensure a uniform review process and to obtain the maximum degree of comparability, it is required that the SOQ packages be organized and assembled in the manner and in the order listed below utilizing the headings given. A. Title Page B. Table of Contents C. Letter of Interest Letter of Interest is limited to two pages and should include the name of the person(s) who will be authorized to make representations for the Respondent, their title(s), telephone number(s), and address. D. Section 1 Team This section should identify the prime General Contractor, proposed subcontractors, project staffing plan, and resumes. An organization chart of the Respondent should be included that identifies those individuals that will be most directly involved with the Project. Identify the Project Manager, and the Site Superintendent that will be responsible for day-to-day communication and coordination with the SUA. E. Section 2 Respondent s Qualifications, Experience, and References Respondents should present recent (within the last 7 years), relative experience for the Contractor and subcontractors that is most similar to the Project summarized in the Project and Scope of Work Section. Respondent should provide at least three (3) water/wastewater treatment plant/facility projects with individual contract values of at least $15,000,000 within the continental United States. Include a summary of each project, including original contract amount, project duration, total change orders, final contract amount and final duration. A list of client references for the Respondent should include name, address, telephone number, and contact person. Respondents must complete the Qualification Forms provided in Attachment A. The
8 forms can be copied for typed information or reproduced in word processing format. Forms may be submitted in duplicate, as needed, to present all relevant information. F. Section 3 Respondent s General Contractor License Respondent should present a copy of its current and valid State of Florida General Contractor s License or proof of application in lieu of a license. G. Section 4 Office Location Descriptions of primary project office location, address, and phone numbers should include the Respondent and all subconsultants. H. Section 5 Other Information This section should include the Debarred Respondents Form, Public Entity Crimes affidavit, applicable business and licenses and other information the Respondent considers pertinent for consideration as detailed in Attachment B. PART VI SOQ PACKAGE EVALUATION AND REVIEW PROCEDURE Review of the SOQ packages will be performed as determined by the SUA Governing Board. Respondents must complete the Qualification Forms provided in Attachment A. The areas of consideration for determining the best Respondents for construction of the Project include, but are not limited to the following: Qualifications and Expertise of Respondent with Similar Work Qualifications and Expertise of Respondent s Assigned Staff with Similar Projects Respondent s Past Performance History Respondent s References Respondent s Prior Work History with SUA SUA will evaluate the submittals and develop a list of qualified Contractors. PART VII QUESTIONS REGARDING THE QUALIFICATIONS PACKAGE PROCESS Inquiries regarding this RFQ should be directed in writing to: Vince Mollo, Water Department Manager Seacoast Utility Authority 4200 Hood Road Palm Beach Gardens, Florida Requests for clarification will be received until five (5) days prior to the SOQ submittal date. Interested Respondents may conduct site inspections prior to submitting a SOQ if an appointment is made.

16 Seacoast Utility Authority Request for Qualifications General Contractor Hood Road Membrane Water Treatment Plant Indemnity, Liability, and Insurance Requirements INDEMNIFICATION AND HOLD HARMLESS As part of the Invitation to Bid (ITB), the Contractor shall agree to indemnify and hold harmless Seacoast Utility Authority (SUA) from any and all claims for liabilities, damages, losses and costs, including, but not limited to, reasonable attorney's fees, to the extent caused by the negligence, recklessness, or intentional wrongful misconduct of the Contractor and persons employed or utilized by the Contractor in the performance of the Work. GENERAL INSURANCE REQUIREMENTS As part of the ITB, the Contractor shall be responsible for purchasing and maintaining such commercial general liability and other insurance as is appropriate for the Work being performed and furnished and as will provide protection from claims which may arise out of or result from the Contractor s performance and furnishing of the Work, whether the performance is to be performed or furnished by the Contractor, by any Subcontractor Respondent, by anyone directly or indirectly employed by any of them to perform or furnish any of the Work, or by anyone for whose acts any of them may be liable. Proof of insurance is not required with the SOQ package. This will only be required of the awarded Contractor. SUA, at its sole discretion, has the right to request a certified copy of any or all insurance policies required by this section. Required insurance with the SUA as the certificate holder must be provided prior to commencement of work.
