PURPOSE To minimize damage and risk from nuisance birds and provide vector control at the Regional District of Nanaimo (RDN) Regional Landfill (Landfill), located at 1105 Cedar Road, Nanaimo, BC. 2. BACKGROUND The Regional Landfill attracts large numbers of nuisance birds, mostly seagulls and crows, due to the presence of residual food waste. The number of birds is seasonal, fluctuating depending on the availability of natural food sources. The birds create a number of problems, including risks to human and ecological health due to direct exposure to flying birds or from droppings, damage to equipment and the facility and a potential hazard to aircraft using the nearby Nanaimo Airport. Efficient bird control minimizes the spreading of litter on the landfill and adjacent properties. Operational procedures such as minimizing the size of the open working face, diverting food waste from the landfill, covering waste on a daily basis and a progressive closure helps reduce the numbers of birds populating the site; however, these measures are inadequate to significantly reduce the number of birds to eliminate the problem. The use of trained raptors (hawks and falcons) at the Regional Landfill to discourage large numbers of nuisance birds has been used successfully since To achieve the goal of making the landfill less attractive for birds and to reduce the numbers of birds on the landfill and surrounding area, bird control needs to be integrated in the landfill operation and must also include a variety of deterrents. The RDN has constructed a three-building aviary and storage shed for use by the bird control contractor to overnight and care for birds, please refer to the attached photographs in Section 7. While it is not a contractual requirement to use the on-site facilities, an opportunity to adjust the cost is included in the Cost Proposal Form, should the Proponent intend to use them. Please note it is the Contractor s responsibility to clean the aviaries as required. The RDN provides a John Deere utility vehicle for bird control personnel on site transportation. 3. SCOPE OF WORK It is anticipated the bird control contract will be awarded for a period of thirty-six (36) months, starting August 2, The scope of work is as follows: a. Provide suitable bird(s) of prey to harass and deter seagulls, crows and other birds from using the site as a food source and settle ground; Regional District of Nanaimo Page 3

4 b. Use a variety of deterrents to prevent the birds from becoming accustomed to any one method of harassment; c. Interact with landfill operations to settle bird control activities on a regular basis and adjust the level of coverage as required; d. Support RDN with Damage Permit application; e. Provide monthly reports about bird control activities and results; f. Provide an annual report about bird control activities and results ; g. Provide annual Damage Report; h. Maintain all required licensing permits and certificates in order to operate a business using birds; i. Provide bird control service four days per week; however an adjustment to site hours and days per week may be increased or decreased over the life of the contract; j. Provide a detailed Health and Safety Plan for falconers on site, including contact names and telephone numbers in the event of injuries. 4. RFP PROCESS AND EVALUATION 4.1 Proposal Submittal Three copies of the Proponent s proposal must be delivered by hand or courier service only, in a sealed envelope or package, marked in clear bold lettering: RESPONSE TO BIRD CONTROL RFP no later than 2 PM PDT on Friday July 10 attention to: Curtis Hansen, Acting Superintendent Landfill Operations Regional District of Nanaimo 1105 Cedar Road Nanaimo, BC, V9X 1K9 Faxed or ed proposals will not be accepted. Responses may be withdrawn before the deadline upon written notice to the Superintendent of Landfill Disposal Operations at the address noted above or to Fax Number Responses may be replaced by alternative responses providing written notice (facsimiles of notice will be accepted) is delivered to the Superintendent of Landfill Disposal Operations at least twenty four (24) hours before the deadline for closing noted herein. Responses must remain valid for fourteen (14) days following the closing time and date. Responses are irrevocable after the closing time and date. Regional District of Nanaimo Page 4

5 Evaluation Criteria Proposals will be evaluated based on the following categories: a. Experience of the Proponent b. Experience of the bird of prey handler c. Ability of the Proponent to substitute or replace an unsatisfactory bird of prey d. Organization of bird control services including back up plans for staff e. Communication strategy for interaction with landfill operations f. Collaboration in the testing or use of a variety of deterrents by the contractor or directly by RDN landfill staff g. Price to supply the proposed service h. Satisfactory references from other clients using the Proponent s service 4.2 General Terms of RFP Process All expenses for making proposals to the RDN will be borne by the Proponent, with the express understanding that no claims against the RDN for reimbursement will be accepted. All proposals will become property of the RDN and will not be returned to the Proponent. The RDN shall not be responsible for any costs involved in or associated with the preparation and submission of this proposal, the Proponent s site visit costs, or contract negotiations. a. The RDN reserves the right to:issue addenda to this RFP; b. Decline to award a contract or contracts for services; c. Contact references provided by the Proponent; d. Request further information from the Proponent; e. Retain independent consultants for assistance in evaluating proposals; f. Request points of clarification to assist the RDN in evaluating proposals; g. Require changes in the scope of work, such as hours of coverage, as deemed necessary by the RDN; h. Discontinue negotiations with the preferred or any Proponent and commence discussions with any other Proponent; i. Withdraw the RFP; or j. Not award to any Proponent and issue a subsequent RFP based on refinements of concepts proposed in response to this RFP. The Regional District of Nanaimo reserves the right to accept or reject any and all proposals for any reason or to accept any proposal which the Regional District in its sole unrestricted direction deems most advantageous to itself. The lowest or any proposal may not necessarily be accepted. The proponent acknowledges the Regional District s rights under this clause and absolutely waives any right of action against the Regional District for the Regional District s failure to accept its proposal whether such right of action arises in Regional District of Nanaimo Page 5

6 contract, negligence, bad faith or any cause of action. The acceptance of any proposal is subject to funds being legally available to complete this transaction and approval by the Board of the Regional District. Unless otherwise requested in writing by the herein designated Regional District employee, a proponent must not contact or communicate with any elected or appointed officer or employee of the Regional District other than the designated employee in relation to the proposal prior to the award of such proposal by the Regional Board. Any such communication will result in disqualification of the proposal from further consideration. The Regional District of Nanaimo is subject to the provision of the Freedom of Information and Protection of Privacy Act. As a result, while Section 20 of the Act does offer some protection for third party business interests, the Regional District cannot guarantee that any information provided to the Regional District can or will be held in confidence. PROPOSAL PREPARATION GUIDELINES AND FORMAT These instructions are the guidelines governing the formation and content of the proposal. Proposals must be stapled or bound, sealed, typed and prepared on both sides of standard 8 1/2 by 11 recycled content paper. Oversized documents must be folded to size and secured in the proposal. All pages of the proposal must be numbered and sections clearly identified. The proposal shall follow the format outlined below and must include a price for each of the options listed below in sequential format. 5.1 Project Organization and Qualification of Proponent a. Proponent s experience; b. Personal experience of key personnel including lead hands on site; c. Birds of prey available, substitute and replacement procedures; d. Proposed concept and methodologies for efficient bird control including back up plans, proposed schedules, etc.; e. Interaction with landfill operations; f. Stated commitment to work in collaboration in the testing or use of a variety of deterrents by the Contractor or directly by RDN landfill staff; and g. Licencing Permits and Certificates. 7 5.2 Financial Proposal a. Hourly rates for bird control services including all labour, material, and equipment necessary to provide the bird control service and to support the birds and maintain equipment. Radios will be provided by the RDN; b. Hourly rate for second person on site; c. Total cost, Tuesday to Friday excluding Statutory Holidays based on proposed schedule; d. Hourly rates for additional coverage on Statutory Holidays if needed; e. The cost to include additional means of bird control not listed or included in this RFP. Inclusive with this option must be a detailed description of what the additional forms of bird control will be; f. Additional cost to transport/overnight birds if on-site aviary is not used. 5.3 Liability Insurance, Bonding and Licenses The proposal will address the following issues to the satisfaction of the RDN: a. Indemnification The Contractor will be required to indemnify and save harmless the RDN for all liability arising from the contract, including all liability arising from environmental claims under statute or common law of any applicable jurisdiction, including a spill or deposit of special hazardous waste. b. Insurance The Contractor will be required to provide the following types of insurance: Employers liability, general liability, automobile and motor vehicle liability with limits of $2,000,000 per occurrence. c. Permits, Licenses, Certificates The Contractor will be required to provide all required licensing permits and certificates to operate a business using birds of prey and to handle birds of prey.
