(1) Section 32-7A-4, Code of Ala. 1975, provides an alternative to motor vehicle liability insurance requirements for motor vehicles covered by a motor vehicle liability bond and states the bond shall be in the amount of not less than the minimum amounts of liability coverage for bodily injury or death and for destruction of property under subsection (c) of Section Supp. 3/31/

2 Chapter Revenue (2) The Motor Vehicle Liability Bond (Form MV-MLI-004) shall be filed with the Department of Revenue s Motor Vehicle Division. The bond must be executed by a company qualified to conduct a surety business in Alabama, and shall be conditioned on the payment of the amount of any judgment rendered against the principal in the bond or any person responsible for the operation of the principal s motor vehicle with his or her express or implied consent, arising from injury, death, or damage sustained through the use, operation, maintenance, or control of the motor vehicle within the State of Alabama. (3) In order to prove their coverage, persons who purchase a motor vehicle liability bond, shall carry within each vehicle the Motor Vehicle Liability Bond Certificate (Form MV-MLI-005) (or legible copy thereof) as issued by the Department of Revenue. The Motor Vehicle Liability Bond Certificate shall contain the vehicle identification number. (4) The Motor Vehicle Liability Bond Certificate (or legible copy thereof) shall be displayed upon request by any law enforcement officer as provided under Section 32-7A-6(h) in order for the officer to ascertain that the vehicle owner or operator is covered under the provisions of Chapter 7A of Title 32. If the owner refuses or fails to provide proof of exemption as provided in this rule, the person shall be in violation of Section 32-7A-16. (5) In the event that the person to whom a Motor Vehicle Liability Bond Certificate is issued, elects to and does terminate the bond, the person is canceled by the surety, or the bond otherwise becomes invalid, the owner or operator shall obtain insurance coverage as provided by Chapter 7A of Title 32. Anyone who cancels or has his/her liability bond canceled shall not display the Motor Vehicle Liability Bond Certificate (or legible copy thereof). Anyone displaying a Motor Vehicle Liability Bond Certificate knowing the Certificate has been canceled or knowing the Certificate is illegally altered, counterfeit or otherwise invalid, is in violation of Section 32-7A-16. 3 Revenue Chapter (1) Section 32-7A-4, Code of Ala. 1975, provides an alternative to motor vehicle liability insurance requirements for motor vehicles covered by a deposit of cash with the State Treasurer and states the cash bond "shall be in the amount of not less than the minimum amounts of liability coverage for bodily injury or death and for destruction of property as detailed in Section " The Application for Cash Bond Certificate (Form MV-MLI-001) shall be submitted to the department specifying the owner s name, Alabama certificate of title number, if applicable, and vehicle identification number. (2) Persons who deposit cash with the department in the amount of not less than the minimum amounts of liability coverage for bodily injury or death and for destruction of property ad detailed in Section to be covered by a certificate of cash bond shall carry within each vehicle the Cash Bond Certificate (Form MV-MLI-002) (or legible copy thereof) as issued by the Department of Revenue in order to prove their coverage. The Cash Bond Certificate shall contain the vehicle identification number. (3) The Cash Bond Certificate (or legible copy thereof) shall be displayed upon request by any law enforcement officer as provided under Section 32-7A-6 in order for the officer to ascertain that the vehicle owner or operator is covered under the provisions of Chapter 7A of Title 32. If the owner refuses or fails to provide proof of exemption as provided in this rule, the person shall be deemed in violation of Section 32-7A-16. (4) In the event that the person to whom a Cash Bond Certificate is issued elects to and does withdraw his/her cash deposit from the department, the owner or operator shall obtain insurance coverage as required by Chapter 7A of Title 32. Anyone who withdraws his/her cash deposit from the department shall not display the Cash Bond Certificate (or legible copy thereof). Anyone displaying a Motor Vehicle Liability Bond Certificate knowing the Certificate has been canceled or knowing the Certificate is illegally altered, counterfeit or otherwise invalid, is in violation of Section 32-7A-16. (5) In the event that the minimum principal on deposit is drawn upon as a result of any judgment rendered against the principal in the cash bond or any person responsible for the operation of the principal s motor vehicle with his or her express or implied consent, arising from injury, death, or damage sustained through the use, operation, maintenance, or control of the motor vehicle within the State of Alabama; and the principal is reduced to an amount less Supp. 3/31/

4 Chapter Revenue than the minimum amount required by Section 32-7A-4, he/she will, within 30 calendar days, deposit cash with the department in an amount sufficient to meet the requirements of Section 32-7A-4. (6) In the event that the person to whom a Cash Bond Certificate is issued elects to withdraw the funds deposited with the department, that person will do so on the Cash Bond Withdrawal Request (Form MV-MLI-003). These funds will be held for a period of sixty (60) calendar days prior to the release of the funds. If during this sixty day period, the department is notified of pending legation of judgment rendered against the principal in the cash bond or any person responsible for the operation of the principal s motor vehicle with his or her express or implied consent, arising from injury, death, or damage sustained through the use, operation, maintenance, or control of the motor vehicle, said funds will be held until such time that all pending claims against the fund has been resolved. Section 32-7A-6(b)(3) and (f)(8), Code of Ala. 1975, requires the Vehicle Identification Number to be shown on insurance cards, insurance binders, certificates of liability insurance, and premium receipts. However, as vehicle manufacturers have not always placed vehicle identification numbers on motor vehicles, and motor numbers were used as the vehicle identifier for many decades, the motor number may be used in lieu of the Vehicle Identification Number if the insured vehicle does not have a Vehicle Identification Number and the vehicle is not subject to the provisions of the Alabama Certificate of Title and Antitheft Act. 5 Revenue Chapter (1) If a vehicle owner(s), or someone authorized to register a motor vehicle on behalf of the owner(s), informs the license plate issuing official that the vehicle is not insured pursuant to Section 32-7A-4, Code of Ala. 1975, (and the vehicle is not exempt from insurance requirements), the license plate issuing official shall refuse to register the motor vehicle(s). (2) If a vehicle owner(s) or someone authorized to register a motor vehicle on behalf of the owner(s), submits a renewal application through the mail, in person or via the internet (online) without evidence of insurance, the license plate issuing official shall refuse to register the motor vehicle. (3) In the event that a vehicle owner(s), or someone authorized to register a motor vehicle on behalf of the vehicle owner(s), informs the license plate issuing official that the motor vehicle is insured by an insurer not authorized to do business in Alabama, the license plate issuing official shall refuse to register the vehicle. (4) If a license plate issuing official denies registration, and subsequently the vehicle owner(s), or someone authorized to register a motor vehicle on behalf of the vehicle owner(s), provides evidence that the vehicle is insured to the satisfaction of the official, then the official may issue the registration. If the delay in registering the vehicle places the vehicle owner(s) into a delinquency situation, the appropriate penalties, interest, etc., must be collected as a prerequisite to the issuance of the registration. Furthermore, if the registration is denied, the vehicle owner(s) may incur law enforcement sanctions if the vehicle is operated with an expired registration or without registration credentials. (5) If a vehicle owner(s), or someone authorized to register a motor vehicle on behalf of the owner(s), is unable or refuses to provide the valid unexpired state issued driver s license number, non-driver s identification number, national driver s license number, federal employer identification number or department assigned number for each vehicle owner reflected on the vehicle title or vehicle registration if the vehicle is exempt from titling, the license plate issuing official shall refuse to register the vehicle as requested. (6) License plate issuing officials shall deny registration or transfer of any license plate when the registration has been suspended. The license plate issuing official is not Supp. 3/31/

6 Chapter Revenue authorized to issue a new license plate or replacement license plate to the vehicle until the registration is reinstated. (7) License plate issuing officials shall deny registration to any vehicle owner(s) who attempts to avoid the registration suspension and payment of reinstatement fees by transferring vehicle ownership to another entity, such as a corporation or one s spouse or dependent. (8) The decision by the license plate issuing official to deny registration which has been suspended by the Department for failing to maintain motor vehicle liability insurance may not be appealed. This is because the vehicle owner(s) has already been afforded the opportunity to appeal the decision by the Department to suspend the registration as provided under Section 32-7A-3(d), which allows the owner(s) a 30 calendar day period to appeal a suspension after the rendition of any suspension. (1) License plate issuing officials shall not process a vehicle registration transaction without receipt of satisfactory evidence of Alabama insurance or verification of Alabama mandatory liability insurance (MLI) through the online insurance verification system (OIVS), liability insurance bond, or deposit of cash ( 32-7A-17(c)). A vehicle registration transaction includes registering, re-registering, transferring registration, and issuing replacement credentials. (2) Evidence of insurance shall be presented upon request made by any law enforcement officer ( 32-7A-16). (3) If evidence of insurance cannot be verified through the OIVS, the vehicle owner/ operator must provide evidence of insurance by means of one of the following acceptable forms: (a) (b) an Alabama insurance card, temporary Alabama insurance card, Supp. 3/31/

7 Revenue Chapter (c) the combination of proof of purchase of the motor vehicle within the previous 20 calendar days and a current and valid Alabama insurance card issued for the motor vehicle replaced by such purchase, (d) current declarations page of an Alabama liability insurance policy, (e) thereof, an Alabama liability insurance binder or legible copy (f) a certificate of Alabama liability insurance or legible copy thereof, or (g) a current motor vehicle rental agreement for the vehicle which specifies minimum insurance coverage on the vehicle. (4) In addition to the forms detailed in item #3 above, evidence of insurance may be provided in either a tangible or in an electronic format as provided in Section 32-7A-6. This includes but is not limited to: electronic mail sent from registrant s insurer, computer printout from insurer, facsimile of proof of insurance, insurer providing electronic image/proof on registrant s cellular phone, lap top, or other portable type of electronic device. (5) Evidence of insurance is acceptable in a name other than the registered owner name(s) if the vehicle identification number (VIN) on the motor vehicle and on the evidence of insurance match and the evidence is currently in effect. (1) The term official includes any official authorized to collect MLI reinstatement fees, as provided in 32-7A-12, Code of Ala Supp. 3/31/

8 Chapter Revenue (2) The Department will provide a current list of registrations that have been suspended pursuant to 32-7A-12 to any official authorized to collect MLI reinstatement fees. This listing may be provided electronically or through other procedures as prescribed by the Department. These officials, at their discretion, may forward the list to the office responsible for assessing and collecting ad valorem taxes on motor vehicles in their respective county. Officials may register, renew or transfer registrations appearing on the list of suspended registrations only if the suspended registration has been reinstated. (3) Alabama vehicle owners whose motor vehicle registrations have been suspended pursuant to 32-7A-3 may apply to have their vehicle registrations reinstated by an official. The registration shall be reinstated upon confirmation of insurance coverage utilizing the Online Insurance Verification System (OIVS). If the official cannot confirm insurance coverage utilizing OIVS, the official may accept evidence of insurance pursuant to 32-7A-17. Once evidence of insurance is provided and applicable reinstatement fees are collected, the vehicle owner shall be issued a MLI registration reinstatement pending the confirmation of vehicle insurance coverage by the Department. If evidence of insurance coverage is provided for the insurance verification date, the official may then remove the suspension without requiring the payment of the reinstatement fee provided in 32-7A-12. (4) Until the official reinstates the suspended vehicle registration, the vehicle may not be operated on the streets or highways. (5) The following information and/or documents are required in order for a reinstatement to be issued: (a) In cases where a vehicle owner affirms that the vehicle, for which the registration has been suspended, had insurance with an Alabama-licensed insurance company on the ADOR specified insurance verification date, the owner must provide evidence of said insurance coverage for the insurance verification date that includes: 1. the insurance company name; 2. the insurance company NAIC number; 3. the insurance company telephone number and address, including city, state, and zip code; and Supp. 3/31/

9 Revenue Chapter the policy holder s insurance policy/binder number and policy effective and expiration dates. (b) When a vehicle owner affirms that the vehicle with the suspended registration was stored or inoperable on the ADOR specified insurance verification date, the owner must provide to the official, a response specifying that the suspended vehicle was stored or inoperable on the insurance verification date. The suspension may then be removed without the payment of the reinstatement fee; however, the registration will be revoked for the remainder of the registration period. In the event the vehicle is no longer stored, inoperable, or unused, a new license plate/ registration must be obtained prior to operating the vehicle. In order to obtain a new license plate/registration, in accordance with administrative rule , the registrant must provide evidence of the vehicle s non-use to the licensing official prior to re-registering the vehicle. Failure to provide acceptable evidence of non-use will result in the suspension of the vehicle registration as provided in subsection (c) below. (c) If a vehicle owner affirms that the vehicle with the suspended registration did not have liability insurance coverage on the ADOR specified insurance verification date and the vehicle does not qualify as an MLI exempt vehicle, as defined under 32-7A-5, in addition to payment of any required reinstatement fee(s), the vehicle owner must provide to the official evidence of current insurance coverage that includes the information as detailed in 5 (a) (1) through (4). (6) Any required reinstatement fees due shall be paid using certified funds. Certified funds may include, but are not limited to the following if allowed by the official: (a) (b) (c) (d) (e) (f) Cashier s check; Money order; Certified bank check; Credit card; Debit card; or Cash. Cash payments should only be made in person. No additional fee may be collected by the official for processing the reinstatement. Supp. 3/31/

10 Chapter Revenue (7) The reinstatement will be on a form and in the format prescribed by ADOR and shall contain the following information: (a) The reinstatement issue and expiration dates. (b) Vehicle registrant s name, address, and driver license number. (c) (d) (e) address. (f) number. (g) Vehicle s VIN, year, make, and model. Vehicle s current Alabama license plate number. Vehicle insuring company s name, NAIC number, and Insurance policy holder s binder number or policy Identification of issuing clerk. (8) A reinstatement is valid up to sixty (60) days from the date it is issued pending confirmation of liability insurance coverage on the insurance verification date, provided, that if ADOR does not receive verification of insurance coverage for the specified date from the insurance company reported by the motor vehicle owner, the reinstatement shall be revoked by ADOR. A notice of suspension will be issued to owners of vehicles for which a reinstatement has been revoked. Vehicle operators that operate the vehicle with a suspension will be subject to the penalties addressed by 32-7A-21. (9) Pending confirmation of vehicle liability insurance coverage, the reinstatement shall be retained within the motor vehicle operating with the reinstated registration. A reinstatement cannot be transferred to another vehicle or vehicle owner. (10) The reinstatement shall be presented, on demand, by the vehicle operator, for inspection by law enforcement officers. A copy of the reinstatement is acceptable as evidence of the registration reinstatement for law enforcement purposes, if the information contained on the document is legible, unaltered, and has not been revoked by ADOR. Any erasures or other alterations of the information required on a reinstatement will render it void, and of no value to the person or vehicle described thereon. (11) The reinstatement is not acceptable as a substitute for a valid Alabama Motor Vehicle Registration Tag and Tax Receipt. Supp. 3/31/

11 Revenue Chapter The reinstatement is valid only for indicating that a motor vehicle MLI registration suspension has been reinstated, pending confirmation of vehicle liability insurance coverage in accordance with the MLI law. (12) Officials shall provide registration reinstatement and insurance information to ADOR no later than the next business day through electronic means. (13) All reinstatement fees collected by each official less the amount to be retained as provided by 32-7A-12, shall be remitted to ADOR by the tenth day of the month following the month that the reinstatement fees were collected along with a form prescribed by ADOR. Funds may be deposited directly to an ADOR designated account and the deposit slip for each deposit forwarded to ADOR, or the funds may be remitted by check or Electronic Funds Transfer (EFT) to the ADOR. (14) Officials are not authorized to issue consecutive reinstatements for a motor vehicle, unless the preceding reinstatement for the vehicle has been voided due to clerical error and the replacement reinstatement is issued. (15) In cases where an official has processed a reinstatement in error, ADOR, or its designee, must be notified no later than the close of business following the day that the reinstatement was processed. (1) The vehicles listed in Section 32-7A-5, Code of Ala. 1975, are exempt from the Mandatory Liability Insurance Law. (2) Under the authority granted to the commissioner by 32-7A-5(13), any vehicle covered by a blanket liability insurance policy or commercial automobile liability insurance policy is exempt from the Mandatory Liability Insurance Law. 12 Chapter Revenue (3) The terms blanket liability insurance policy and commercial automobile liability insurance policy may be used interchangeably. (4) Section 32-7A-2 (2), Code of Ala. 1975, defines a commercial automobile liability insurance policy as a policy that: (a) Is written on either a commercial coverage or other commercially rated personal policy form, including, but not limited to, a commercial auto, garage, or truckers form, and is not dependent on the type, number, or ownership of vehicle or entity covered or insured. (b) Insures vehicles that are not identified individually by vehicle identification number on the policy. (5) Vehicles insured under a blanket or commercial automobile liability insurance policy are not subject to the department insurance verification process; however, every operator of a motor vehicle subject to 32-7A-4, shall carry within the vehicle evidence of insurance. (6) In accordance with 32-7A-6, if the insurance card is issued for a blanket or commercial automobile liability insurance policy, the insurance card may state FLEET, COMMERCIAL, COMMERCIAL POLICY, or COMMERCIAL EXEMPT in lieu of vehicle years, makes, and VINs if vehicles years, makes, and VINs are not captured by the insurer. If the vehicle years, makes, and VINs are captured by the insurer, then the insurer may provide such information on the insurance card, but must state FLEET, COMMERCIAL, COMMERCIAL POLICY, or COMMERCIAL EXEMPT on the insurance card. If the insurance card is issued for a non-owner policy, the card may state NONOWNER POLICY in lieu of the vehicle year, make, and VIN. (7) In accordance with 32-7A-4(b)(1), vehicles insured under a blanket or commercial automobile liability insurance policy are required to be insured by a policy issued in amounts no less than the minimum amounts set for bodily injury or death and for destruction of property as provided in (c). 13 Revenue Chapter Refunds Of Mandatory Liability Insurance (MLI) Reinstatement Fees. (1) Section 32-7A-12, Code of Ala. 1975, states in part: Refunds of reinstatement fees, less the retained fees, shall be granted in cases of duplicate payment, or as approved by the department. Anyone who is denied a refund of the reinstatement fee may appeal the denial pursuant to 40-2A-7, Code of Ala (2) Anyone seeking the refund of reinstatement fees paid shall complete a Petition for Refund of Mandatory Liability Insurance (MLI) Reinstatement Fees (Form MV-MLI-008) and submit the form to the Department for processing. In completing the Form, detail must be provided as to the reason the requester believes that he/she is entitled to the refund and any supporting evidence must be provided (for example, provide copies of two separate remittances for the reinstatement of the same vehicle). (3) The Department shall deny requests for refunds of reinstatement fees if the reinstatement fee was due for the verification date. (4) If the Department denies the refund request, the petitioner shall be informed in writing of the denial. The petitioner may then appeal the denial by filing a notice of appeal pursuant to 40-2A-7. (1) In accordance with 32-7A-17(d), Code of Ala. 1975, all officials authorized by law to issue motor vehicle license plates shall obtain, when issuing or transferring motor vehicle registrations, the registrant s valid, unexpired state issued driver s license or identification card number, a department approved federal identifying number, national driver s license, or for a company, or other entity, the federal employer identification number (FEIN), for inclusion within the motor vehicle registration Supp. 3/31/

14 Chapter Revenue records in the state and county databases provided these numbers shall not be included on the motor vehicle registration receipts. For registration renewals, the identifying document is required for only one individual or entity listed as a registrant of the motor vehicle. (2) A driver s license or identification card is considered valid if it is unexpired. (3) Under the authority granted to the department by 32-7A-17(d), the department may assign an identifying number to vehicle registrants in order to document compliance with the mandatory liability insurance law. County license plate issuing officials, as designated agents of the department ( ), are authorized to assign an identifying number on behalf of the department. (4) License plate issuing officials shall collect and provide one of the following document types and supporting information to the department with the motor vehicle registration record: Document Type DL State DL Number Expiration Date Driver s license postal code DL number MM/YYYY (ex. AL) (max. 20 digits) FEIN FE FEIN (9 digits) blank Dept. assigned RD max. 20 digits blank ID number Exempt vehicle ZZ blank blank ( 32-7A-5) (5) Section 32-7A-2(24) defines a state as any state, territory or possession of the United States, the District of Columbia, any province or territory of the Dominion of Canada, or a state of the Republic of Mexico. (6) A department assigned identifying number may be assigned to the registrant upon presentation of other evidence of identity when the registrant cannot provide a valid, unexpired state Supp. 3/31/

16 Chapter Revenue Mandatory Liability Insurance (MLI) Questionnaire And Notice Of Suspension. (1) In accordance with Section 32-7A-7, Code of Ala. 1975, the Department of Revenue, or its designee, may review registrations of motor vehicles subject to 32-7A-4, or owners thereof to verify whether the motor vehicles are insured. (2) The Department may send MLI questionnaires to owners/registrants to be completed and returned to the Department within 30 calendar days after the department mails a request. [ 32-7A-7] (3) Section 32-7A-8 provides, in part, that the Department shall notify the owner that such owner s vehicle registration shall be suspended 30 calendar days after the date of mailing the notice unless the owner furnishes evidence of insurance in effect on the verification date, as prescribed by the department. The notice shall be in writing and shall be mailed by the U.S. Postal Service to the registrant s last known address as reflected on the Department s motor vehicle registration records. The Department will provide a Notice of Suspension to anyone whose registration is to be suspended pursuant to Chapter 7A of Title 32. The notice includes information regarding the suspension, including the reason for the suspension, the effective date of the suspension, and the earliest date the suspension may be removed. The notice provides additional information as to what procedures the vehicle owner must follow to prevent registration suspension or to have his or her vehicle registration reinstated. (4) If the vehicle owner receives a Questionnaire or Notice of Suspension (NOS) and the subject vehicle was insured by an Alabama liability insurance policy on the insurance verification date shown on the questionnaire or NOS for the vehicle and vehicle license plate identified, the vehicle owner is required to provide the following information by one of the methods provided in this rule: (a) The name of the Alabama insurance company that issued the Alabama liability insurance policy; (b) NAIC Number of the insurance company; (c) The address of the insurance company, including city, state, and zip code; Supp. 3/31/

17 Revenue Chapter (d) (e) (f) (g) The insurance company telephone number; The insurance policy number issued to the vehicle; The effective date of the insurance policy; The policy expiration date. (5) If the vehicle listed on the questionnaire or NOS was not insured on the insurance verification date shown on the questionnaire or NOS because the vehicle was stored, inoperable, or otherwise unused, the vehicle owner must indicate this exemption reason on the questionnaire or NOS and provide evidence of the vehicle s non-use to the licensing official prior to re-registering the vehicle, as provided in administrative rule The current vehicle registration will be revoked for the remainder of the registration period. In the event the vehicle is no longer stored, inoperable, or unused, a new license plate/registration must be obtained prior to operating the vehicle. Failure to provide acceptable evidence of non-use will result in the suspension of the vehicle registration as provided in subsection (6). (6) If the vehicle listed on the questionnaire or NOS was not insured on the insurance verification date shown on the questionnaire or NOS in violation of 32-7A-4, the department shall suspend the registration. The registrant must serve any required suspension period, remit reinstatement fees and provide current evidence of insurance in order to reinstate the registration. (7) The vehicle owner, or his/her authorized representative, is required to sign the questionnaire or NOS in the place provided on the questionnaire or NOS if mailed or faxed to the Department. (8) The Department must receive the required questionnaire or NOS information within 30 calendar days of the date of correspondence shown on the questionnaire or NOS form by one of the following methods: (a) By entering information on-line at the Department s website and electronically transmitting it to the Department; or (b) Faxing the questionnaire or NOS to the fax number shown on the questionnaire or NOS; or Supp. 3/31/

18 Chapter Revenue (c) Mailing the questionnaire or NOS to the department address indicated in the correspondence. (9) In accordance with 32-7A-7, any vehicle owner failing to respond to the questionnaire or NOS shall be deemed to have registered or maintained registration of a motor vehicle in violation of 32-7A-4, and the Department shall suspend the registration. (10) In accordance with 32-7A-7, if the vehicle owner responds to the questionnaire or NOS by asserting that his or her vehicle was covered by a liability insurance policy on the verification date stated in the department s request, the department may conduct a verification of the response through the Online Insurance Verification System (OIVS) or by furnishing necessary information to the insurer named in the response. Insurance information received from vehicle owners at the time of reinstatement should be processed the same as information received from insurance questionnaires or NOS. (11) If the insurer fails to respond within 30 calendar days to the NOS, the Department shall suspend the registration. (12) In accordance with Section 32-7A-26, the Department may send notices in an electronic format, instead of mailing such notices, when an electronic mail address is available.
