In general, the minimum qualification criteria for interested Residential Construction Contractors is as follows: Minimum Bonding Capacity: $2 million Project Description: 2 story, brick, approximately 5,200 gsf residence with functional and support spaces. Standard 40 year construction; Job Site Access: Dense residential location. The Owner will require Payment and Performance Bonds. In order to receive consideration, Residential Construction Contractor Submittals must be received by the Issuing Agency, at the address above, no later than 4:00 PM local time on March 24, Submittals must reach the above address by the deadline stated. Submissions time stamped 4:01 or later will be late and will not be accepted. The entrance to the Department of Materiel Management and the reception area for receipt and time-stamping of submissions is on the north side of the Facilities Management Building. This entrance is immediately adjacent to the parking lot on the north side of the building. Persons delivering submissions should use this side entrance, which is marked Materiel Management, NOT the entrance to the building which fronts Powhatan Avenue. Respondents are advised that parking near the entrance to Material Management is limited. Additional parking is located on the south side of the building in the adjacent golf course parking area. Respondents should allow adequate time to find parking prior to the closing time of the RFQ. Residential Construction Contractors shall submit one (1) original signed in BLUE INK, and seven (7) copies for a total of eight (8) bound sets (no 3-ring binders) to include the following: 1. This completed and signed cover sheet. 2. Signed acknowledgement copies of all addenda. 2. Submittal materials as described in Attachment B of this RFQ. 3 I. OVERVIEW A. Background. The Old Dominion University Real Estate Foundation (the Owner) wishes to retain the services of a qualified Residential Construction Contractor to construct the new President s House. The purpose of this Request for Qualifications (RFQ) is to establish a short-list of three to five qualified Residential Construction Contractors to receive the RFP. The Owner intends to issue the RFP to the short-listed Residential Construction Contractors only. B. Project Description. The Owner desires to construct a new two story, brick, approximately 5,200 gsf residence and 2 car garage for the University s incoming President. The President s House will provide private residential spaces for the President and family members, as well as spaces for official University entertainment. Demolition of the existing structure and garage will be a part of this project, as will site work to reconfigure parking, physical repairs to the pool house, sewer repair, and fence replacement. C. Project Site. On the site of the existing President s House, 5000 Edgewater Drive, Norfolk, Virginia The site is located within a residential neighborhood adjacent to the Norfolk campus and the Elizabeth River. D. Project Financing. This project is funded by the Old Dominion University Real Estate Foundation, and is fully funded. II. THE RESIDENTIAL CONSTRUCTION CONTRACTOR SELECTION PROCESS A. Owner The Owner will be the Old Dominion University Real Estate Foundation. The Owner s procurement officer and sole designated correspondent for the project will be: Mr. Dwayne A. 4 B. Owner s Architect The Owner s Architect for the project is: Tymoff + Moss Architects Attention: Barry E. Moss, AIA 512 Botetourt St. Norfolk, Virginia Tymoff + Moss has been contracted to provide design and construction administration services for this project, and to act as the Owner s technical consultant during the RFQ and RFP evaluation processes. C. The Residential Construction Contractor Selection Process 1. The President s House will blend the needs of a private residence with the functional requirements of hosting formal University sanctioned events. This unique blend of requirements will require the skills and experience of a highly qualified Residential Construction Contractor. The selection process will focus on qualifications and project requirements to short-list those three to five Residential Construction Contractors deemed most capable of delivering the President s House on time and within budget. The Residential Construction Contractors will be responsible for selecting their own subcontractors. The Owner reserves the right to reject any subcontractor. 2. The project schedule calls for execution of the contract for construction services no later than June 30, 2009; mobilization no later July 15, 2009; Substantial Completion no later than June 15, 2010; and Final Completion no later than July 15, The University Real Estate Foundation has established an Evaluation Committee that will serve throughout the selection process. This selection process will consist of two distinct parts: Step 1 of the selection process is the Request for Qualifications (RFQ) Submittal, evaluation and short-listing; Step 2 of the selection process is the Request for Proposals (RFP) response, evaluation, negotiations, and contract award for The President s House. 4. In the RFQ Phase, Step 1, Residential Construction Contractors interested in being considered for this project must submit their qualifications in strict accord with Attachment B. The committee will review, evaluate and rank Respondents submittals and identify a short-list of three to five qualified Residential Construction Contractors. In Step 2, those three to five short-listed Residential Construction Contractors will receive copies of the RFP. Only those firms short-listed will receive the RFP. Proposal evaluation and award criteria will be discussed in the RFP document. RFQ Page 4 of 19

5 D. Communications Any and all communication and requests for information or clarification concerning the project shall be addressed to Mr. Dwayne Young. Specifically, except as provided for during the RFQ Phase Pre-Submittal Conference and the RFP Phase Pre-Proposal Conference, Respondents shall refrain from contacting the Old Dominion University Real Estate Foundation, the Director of Design and Construction, Tymoff + Moss, or staff members of Old Dominion University involved in this project, including members of the Evaluation Committee or other participants responding to either the RFQ or the RFP. Any unauthorized communication or attempt at communication may result in non-consideration of a Respondent s submittal. E. Small, Woman and Minority (SWAM) and Service Disabled Veteran Owned Business Participation as Adopted by the Old Dominion University Real Estate Foundation 1. The University is committed to increasing participation of certified small businesses, womanowned businesses, minority-owned businesses, and businesses owned by service disabled veterans in the procurement process and contract awards. The University also encourages Contractors to provide for participation of small businesses, businesses owned by women and minorities, and businesses owned by disabled veterans through partnerships, joint ventures, subcontracts, or other contractual opportunities. Prior to award, submission of a report of past efforts to utilize the goods and services of such businesses, and plans for involvement on this contract are required. By submitting a response, Proposers certify that all information provided in response to this Request for Qualifications (RFQ) is true and accurate. Failure to provide the information required by this RFQ may ultimately result in the response being deemed non-responsive, and ultimately rejected. 2. While it is the University s intent to enter into an exclusive agreement with one Contractor, whenever possible, all potential Proposers are encouraged to subcontract any applicable services by partnering with qualified vendors that have also been certified as small, small woman-owned, small minority-owned, or service disabled veteran owned businesses through the Commonwealth of Virginia s Department of Minority Business Enterprise (DMBE). 3. Any Proposer that can qualify for certification through DMBE must do so prior to the award of any contract. The qualification information shall be evidenced by that information specified in the Proposer s completed and submitted W-9 form. RFQ Page 5 of 19

Regardless of whether or not the Proposer is able to become certified as a SWAM/service disabled veteran firm, selected Proposer shall also agree to provide to the Owner on a monthly basis in conjunction with pay requests, a report of subcontractor activity indicating for each valid SWAM/service disabled veteran firm the following information: Firm Name; DMBE Certification Number; DMBE SWAM Designation (Small, Woman, Minority, Service Disabled Veteran); Value of Subcontractor s Contract; Value as % of Total Contract; Amount Paid Current Invoice; Amount Paid Current Quarter; Amount Paid to Date; % of Contract Paid this Invoice; % of Contract Paid this Quarter; % of Contract Paid to Date. Should the Proposer fail to provide the required subcontractor data, Proposer may be deemed in breach, and the contract and/or purchase order may be cancelled. 5. Proposer shall agree that when proposing subcontractors that are not certified through DMBE, it shall become the responsibility of the Proposer to ensure those proposed subcontractors become certified through DMBE, when applicable. Failure on the part of the Proposer to agree to this responsibility will result in the response being deemed nonresponsive and rejected. Prior to the issuance of any contract and/or purchase order, the successful Proposer shall provide support documentation to the University validating the efforts of the Proposer to get the proposed subcontractors certified. Should the Proposer fail to get certified through DMBE those proposed subcontractors that qualify, Proposer may be deemed in breach, and the contract and/or purchase order may be cancelled. 6. The Old Dominion University Real Estate Foundation has adopted these requirements as part of its Residential Construction Contractor selection process. RFQ Page 6 of 19

7 F. Owner s Rights and Obligations The Owner shall have the following rights and obligations with respect to the selection process: 1. The Owner will not assume any liability for loss of or damage to Submittals in transit from Respondents. 2. All materials submitted for consideration in response to this RFQ will become the property of the Owner. Submissions will not be returned to the Respondents. 3. The Owner reserves the right to suspend or discontinue the selection process at any time and to return or reject any or all Submittals of qualifications without obligation to the Respondent. 4. In all questions regarding the selection procedure, interpretation shall be by and through the designated correspondent, Mr. Dwayne Young. All such interpretations will be binding. G. Eligibility Eligible firms shall be Residential Construction Contractors licensed for work in the Commonwealth of Virginia. 1. If a Joint Venture, a copy of the joint venture agreement, which states specifically each party s role in the project, must be submitted with the Team s qualification submittal. Any associations forming a Joint venture must be by legally binding means. 2. If a corporation, the corporation must be licensed to transact business in the Commonwealth of Virginia. 3. All persons or firms working on this project that are required by the Commonwealth of Virginia to be licensed in their discipline shall be so licensed. H. 8 Once evaluation begins, the Owner intends that the Evaluation Committee will serve throughout the selection process. The Owner, however, reserves the right to change the Evaluation Committee composition for any reason prior to the start of evaluation; or during that process, should unforeseen circumstances dictate such a change. I. Evaluation and Scoring The Evaluation Committee will score each Residential Construction Contractor s response to the RFQ in accord with predetermined evaluation criteria. The Owner will short-list three to five Residential Construction Contractors which will then receive the RFP. Evaluation criteria for reviewing qualifications will include, but are not limited to: 1. Experience with construction of high profile, high-end, custom built, residential home projects similar in scope and site constraints to this project. 2. The financial capability and insurance history of the Residential Construction Contractor. 3. The overall experience and ability of the Residential Construction Contractor. 4. The experience of the Residential Construction Contractor with green or LEED initiatives. 5. The Residential Construction Contractor s demonstrated ability in the areas of cost and quality and achievement of project schedules. 6. The expertise of the personnel who will make up the Residential Construction Contractor s Team with particular emphasis on the Project Manager and Project Superintendent. 7. Proximity of the Residential Construction Contractor s headquarters to the project. J. Optional Pre-Submittal Conference Interested Residential Construction Contractors may attend a Pre-Submittal Conference being held at 10:00 A.M. in the existing President s House, 5000 Edgewater Drive, Norfolk, Virginia 23529, on Monday, March 9, 2009, to review the scope and requirements of this project. (Those unfamiliar with the campus should proceed to the Old Dominion web page ( About ODU/Campus Map ) for information as to the location of the President s House. 9 K. Submittal Requirements 1. One (1) original, signed in blue ink, and seven (7) copies for a total of eight (8) bound sets (no 3-ring binders) of the required information for the RFQ shall be submitted to the attention of Mr. Dwayne Young, Material Management, Old Dominion University, 4401 Powhatan Avenue, Suite 111, Norfolk, Virginia 23529, no later than 4:00 P.M. local time, Tuesday, March 24, 2009 as determined by the procurement officer. Submittals timestamped 4:01 PM or later will be late and will not be accepted. Identify the Original as such on the front cover of the proposal. Submit one (1) copy of the proposal on compact disk (CD). Form 2. Submittals shall be sealed and clearly marked with the name and address of the Respondent and the title and solicitation number of this RFQ. Facsimile (FAX) submittals are not acceptable and will not be considered. The submittal shall consist of the following: a. A completed and signed copy of the cover sheet to this RFQ. b. Signed acknowledgement copies of any addenda. c. A completed copy of the Commonwealth of Virginia Standard Form for Contracting Qualifications, DGS (ODU Amendment August 2007) accompanying this RFQ as Attachment B. Respondents may not use the form found at the BCOM website; the Owner has amended Attachment B to this RFQ to reflect the requirements of the Owner and is the only acceptable form for use by Respondents. 3. Responses to the items listed in Attachment B shall be tabbed and numbered in accordance with the numbering scheme of the attachment. That is, each Alphabetically Captioned section of the Statement of Qualifications shall be a separate tab within the bound submittal. Items within that section will be numbered and arranged as on the attachment, e.g.: Tab A: SECTION A - GENERAL INFORMATION A.1. (Response) A.2. The Owner requires that this person have the authority to negotiate change orders on behalf of the Respondent. The Superintendent most likely to be assigned to this project has served as Superintendent on at least three (3) residential construction projects of comparable scope, involving similar facilities and within the past eighteen months to two years. Equivalent or comparable experience may be considered, at the Owner s sole discretion; however, it shall be sufficiently similar so that the Owner may conclude that the proposed Superintendent is familiar with and capable of handling the project described in the RFQ.
