1 experts (Australia) Terms and Conditions eff. 01APR13 The Program experts (Australia) is the information and service program ( Program ) operated by Austrian Airlines, Lufthansa German Airlines & Swiss International Air Lines ( Austrian, Lufthansa & SWISS, we/us ). Details of the Program can be found at the portal / Australia ( the Site ). The Program provides fast, objective-orientated communication with Australian travel agents. The following terms and conditions shall apply ( Terms and Conditions ) to every member ( You ) of the Program. 1. Membership of the Program 1.1 In order to be eligible for membership, you must be a natural person and be either a manager or a member of staff at a travel agency or consolidator based in Australia. 1.2 Admissions to membership will be considered in accordance with an application for membership which has been duly completed and signed. 1.3 Admission to membership of the Program is entirely at the discretion of Austrian, Lufthansa & SWISS. Austrian, Lufthansa & SWISS reserve the right to not accept any application for membership, and may do so without justification. 1.4 In consideration for Austrian, Lufthansa & SWISS assessing your application for membership, you waive any claim you may have against Austrian, Lufthansa & SWISS for non-acceptance of your application. 1.5 Membership shall commence upon notification to you of the acceptance by Austrian, Lufthansa & SWISS of your application for membership and is free of charge. 1.6 Membership will be subject to the experts (Australia) Terms and Conditions at all times. 1.7 A significant part of the communication process within the Program is handled via online media (e.g. the online expertsexpress newsletter). You agree, when applying to join the Program, to receive Program communications (whether by way of a newsletter, offer, information or otherwise) via , sms, via the internet or by post. You may decline at any time to receive Program communications. 1.8 Membership is not capable of being transferred or redeemed for cash. 2. Services 2.1 Austrian, Lufthansa & SWISS will offer members exclusive services. These services may include (but not be limited to): information which is individually tailored to meet your own requirements within your sphere of activity; and various incentive offers. 2.2 Members will be notified about items of information and incentive offers, together with full details, by , sms, via the internet or by post. There may be a charge for the provision of some of the services.

2 3. Duration and Amendment 3.1 The Program shall run for an indefinite period. Austrian, Lufthansa & SWISS reserve the right at any time to terminate the Program or to replace it with another program at any time. 3.2 Austrian, Lufthansa & SWISS reserve the right to amend these Terms and Conditions at any time. Such amendments will be notified in writing in advance. If you do not to accept such amendments, Austrian, Lufthansa & SWISS shall be entitled to cancel your membership. By continuing to use the Site, you will be deemed to accept any such amendments. 3.3 Subject to applicable laws, Austrian, Lufthansa & SWISS will not be liable for any loss or damage suffered by you or a third party as a result of amendment, termination or replacement of the Program. 4. Data Protection and Privacy 4.1 Reasonable care is to be taken that the Site complies with the requirements of Australian privacy laws and regulations relating to any personal information and data you may supply to us. A security system is used on the Site that is designed to protect your information and data from unauthorized use. However, as no data transmissions over the Internet can be guaranteed to be completely secure, we cannot ensure or warrant the security of any information and data you transmit to us, and you do so at your own risk. 4.2 As a condition of membership of the Program, you consent to personal information relating to participation in the Program being processed and used for purposes serving the Program implementation. Save as provided below, we will not sell, distribute or disclose information about you as an individual or your personal usage of the Site information without your consent or unless required or permitted to do so by law. The information we gather may include name, address, address, telephone number, and any personal preferences. If you subscribe to our mailing lists for new releases and other information, we may also ask you to answer various general questions about yourself. You may be asked to specify the areas in which you are interested so that we can tailor the information which we send to you to cover the topics and services which we believe you might be interested in. 4.3 Please note that we provide links to other sites, which may not be governed by these Terms and Conditions. You should view the particular privacy policies of those sites for further information. 4.4 We would like you to keep your profile information up-to-date. You may change any of the basic information we keep about you at any time by visiting My Profile after login. 4.5 In addition to the information which you supply to us, information and data may be automatically collected through the use of cookies. Cookies are small text files that are used on the Site to recognize repeat users and allow us to observe behaviour and compile aggregate data in order to improve the Site experience for you. For example, by use of cookies we can tell whether you viewed the Site with sound or with text on your last visit. Our use of cookies also allows us to count the number of unique and return visitors to our Site. Some of our associated companies may themselves use cookies on their own websites and we have no access to, or control of such cookies, should this occur. 4.6 We may monitor customer traffic patterns, Site usage and related Site information in order to optimise your use of the Site and we may give aggregated statistics to a reputable third-party, but these statistics will include no information personally identifying you. 4.7 We may also use the information and data we gather to notify you about important functionality changes and alterations to the Site, or offers of products, services or information that might be of particular interest to you. This may involve transferring or selling your information and data to other companies, inside or outside Australia. Your information and data may also be transferred to another company in the event of sale of our company to a third party or the merger of our company with another company. By submitting your information and ticking the requisite boxes on any order form or when subscribing to the services available on our Site, you consent to such use and transfer.

3 4.8 We will ensure compliance with Industry Standards to handle, store and transmit the information and data that we gather with due regard to the security of the data to ensure that your rights and freedoms in respect of the processing of your personal information are adequately and appropriately protected. 4.9 We continually aim to improve the services we offer. As a result, we occasionally canvass our customers using surveys. Participation in surveys is voluntary, and you are under no obligation to reply to any survey you might receive from us. Should you choose to do so, we will treat the information and data you provide with the same high standard of care as all other customer information and data we gather. 5. experts (Australia) Incentive Program :experts plus program 5.1 General Your membership of experts (Australia) may mean that we also offer you the opportunity to join the experts (Australia) Incentive Program that we operate ( experts plus program ). The experts plus program does not form part of any sales or agency agreement with any travel agency or travel agent. Entry to the experts plus program is voluntary, and you are under no obligation to take up an invitation from us to enter. Should you choose to enter the experts plus program, we will treat the information you provide with the same high standard of care as all other customer information we gather, and use the information you have provided strictly within the entry terms of the program and this privacy statement Agents which are prohibited under a chain or head office agreement in taking part in an industry Incentive Program are required to observe their agreements or contracts with their governing body and not take up the invitation to enter the experts plus program Austrian, Lufthansa & SWISS take no responsibility for your obtaining company permission to participate in the experts plus program, in circumstances where company policy allows participation subject to obtaining permission, and we can act on the assumption that you have done so When joining the experts plus program you must ensure that you inform your employer/agency owner of your participation and of the potential resulting Fringe Benefit Tax ( FBT ) liabilities. Any FBT implications which arise for you or your employer/agency owner due to your participation in the experts plus program remain your responsibility and no recourse will lie against Austrian, Lufthansa & SWISS for payment, contribution or reimbursement of FBT. Further information on FBT can be found at: You warrant and undertake that all information you provide to Austrian, Lufthansa & SWISS in respect to the experts plus program and your continued participation will be true, complete and correct at all times Austrian, Lufthansa & SWISS shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the application for membership, or your membership or participation in the experts plus program, or the awards, or the inability to book or enjoy the use of any awards, or for any products or services offered or promised from other parties to members of the experts plus program Austrian, Lufthansa & SWISS reserve the right to change or amend the rules of the experts plus program at any time without prior notice Austrian, Lufthansa & SWISS reserve the right to terminate the experts plus program and to cancel all accounts with three months advance notice.

4 5.1.9 Austrian, Lufthansa & SWISS reserve the right to replace the experts plus program and to invite the transfer of your account with three months advance notice. 5.2 experts plus program account & PIN code Your experts (Australia) PIN code and password are the means for you to make use of your experts plus program account. You are obliged to protect and keep your PIN code and password secret. You acknowledge and agree that Austrian, Lufthansa & SWISS is under no obligation or duty to verify the authenticity of any person who performs transactions through the use of a valid PIN code Austrian, Lufthansa & SWISS shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting, how-so-ever caused, through any unauthorised disclosure or unauthorised use of your PIN code Austrian, Lufthansa & SWISS reserve the right to terminate your experts plus program account if it has been found that you have accumulated points in violation of the rules or by fraudulent means If you change the agency you are working for, you can take your points to the new agency as your experts (Australia) membership is personal. However, it is your responsibility to ensure that clause is adhered to. The existing PIN code and password will remain valid. You must update your personal profile within the My Profile page at If you leave your position permanently and are not re-employed within the travel industry at a company falling within the categories listed in clause 1.1, then the points earned must be redeemed prior to the last day of your employment. Following this date all your experts (Australia) points will be deemed void and your experts plus program account will be cancelled The experts (Australia) PIN code, experts plus program account and accrued points are personal and non-transferable. 5.3 Points Accrual Only flights which are booked and ticketed in Australia, plated to Austrian, Lufthansa or SWISS and flown on Austrian, Lufthansa or SWISS operated flights are eligible for points in the experts plus program The number of points credited will be based on the defined point structure created by Austrian, Lufthansa & SWISS and will be credited in accordance with the defined point structure which applies at the time the flight was flown. Points may take between 8 to 10 weeks, after the passenger has flown the last flight sector, to appear in the account For points accrual, your personal PIN code must be entered correctly by way of an OSI element in each reservation prior to the first departure on a multiple sector flight. Failure to enter the OSI element correctly will result in no points accrual. Retroactive crediting of points will only be considered if points have not been accrued due to technical reasons In the event that two different PIN numbers are entered by way of an OSI element into a reservation, then the system may reject the processing of points. As a result, Austrian, Lufthansa & SWISS cannot be held responsible for the rejection of the processing of points or the crediting of points to the incorrect account The crediting of points for a flight is subject to the ticket being paid for and utilised by the person in whose name the ticket has been issued.

5 5.3.6 Reservations amended directly with the airline may result in points not being credited. Retroactive crediting of points, for this reason will not be allowed No points are credited for certain booking or service classes, special tariffs, award tickets, free flights or services for which the member receives benefits under another bonus or rewards program. These programs include, but are not limited to; Booking classes not specified in the points table Infant fares Industry Discount fares Upgrade vouchers VMPDs, MPDs Reservations made directly with Austrian, Lufthansa or SWISS Austrian, Lufthansa or SWISS code-share flights Certain other exclusions from points accrual may apply following an announcement in the experts (Australia) communication media All points are the property of Austrian, Lufthansa & SWISS and cannot be sold, bartered or refunded The points are valid for a period of 12 months after the passenger has flown each individual flight sector and will expire at the end of this period. The points will expire without notification and if there is a choice, the first points earned will expire first. There can be no extension of the period of time for which points are valid Points may only be accumulated in one account by an individual booking agent. Consolidation or pooling of points, in any form, is not permitted. Points accumulated through bookings made by automated on-line booking engines are not able to be accumulated or credited Austrian, Lufthansa & SWISS reserve the right to change the credit/award levels at any time without prior notice Points are not transferable or redeemable for cash. 5.4 Point Redemption You will be entitled to redeem the cash value of your accrued points in accordance with the prevailing exchange rate as determined by Austrian, Lufthansa & SWISS. Austrian, Lufthansa & SWISS reserve the right to amend the prevailing exchange rate without notice You must have accrued a minimum number of 3000 points before an expertsplus prepaid MasterCard ( expertsplus MasterCard ) will be issued to you in your name. You must use the expertsplus MasterCard for your own personal use. You must not use the card in connection with the sale of airfares on our behalf to any customer of the travel agent or consolidator of which you are a manager or a member of staff. Austrian, Lufthansa & SWISS reserve the right to amend the sufficient number of points required for card issuance. Points cannot be counted for flights that have either not been flown by the passenger or have yet to be credited into your account Provided you have accrued the minimum number of points as stated in 5.4.2, the cash value of your points will be automatically transferred to your expertsplus MasterCard on a monthly basis. At the discretion of Austrian, Lufthansa & SWISS value transfer may be processed earlier.

6 6. Liability The expertsplus MasterCard is managed by CitiGroup Pty Ltd. By participating in experts plus and activating your expertsplus MasterCard, you agree to the Terms & Conditions of CitiGroup Pty Ltd which are available for download from In the event that you choose to opt-out of the experts plus program and the expertsplus prepaid MasterCard, you are eligible to redeem all points that you have earned up to the date of opting-out provided you have accrued the required number of points as determined in clause If you choose to opt-out of the expertsplus prepaid MasterCard, provided you have accrued the minimum number of points required as determined in clause 5.4.2, you may redeem the cash value of your points on a Myer voucher. You should us should you wish to opt-out of experts plus and the expertsplus prepaid MasterCard: info.au@lufthansaexperts.com 6.1 Except in the case of death or personal injury caused by negligence, or fraudulent misrepresentation, neither party shall be liable to the other party in connection with these Terms and Conditions by reason of any representation, implied warranty, condition or other term, any duty at common law, or these Terms and Conditions, for any loss of profit or contracts, goodwill or anticipated savings or wasted expenditure, or any indirect, special or consequential loss or damages (including costs), whether caused by its negligence or that of its servants or agents or otherwise. 6.2 Neither party shall be in breach of these Terms and Conditions, nor have any liability to the other, to the extent that it is prevented from carrying out its obligations under these Terms and Conditions by reason of any circumstances beyond its reasonable control. 7. Conditions of Use 7.1 You may access the Site solely for your own personal use. You must not use any content of the Site for any commercial or illegal purpose. 7.2 By submitting any material to us (Material), you acknowledge that we may copy, modify, distribute or create a derivative work from the Material in any manner that we shall determine. By submitting the Material, you will release to us and not claim copyright or moral rights in the Material. Termination shall be without prejudice to any services which Austrian, Lufthansa & SWISS may be in the process of providing to you, which shall continue (in exchange for payment, where applicable). 8.2 Austrian, Lufthansa & SWISS shall be entitled to terminate your membership of the Program, upon written notice, on the happening of the following events: If your contract of employment or services with the organisation referred to in clause 1.1 ceases, unless you enter into a contract of employment or services with another organisation of the kind referred to in clause 1.1 within one (1) month after the cessation; or 8.3 These Terms and Conditions shall continue to govern the conclusion of the contractual relationship after the termination. 9. General Information 9.1 These Terms and Conditions constitute the entire agreement between you and us and supersede any previous agreement between us relating to their subject matter. 9.2 Any failure by us to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. 9.3 These Terms and Conditions and the relationship between you and us shall be governed by the laws of New South Wales.
