1 Coca-Cola Colour Your Summer Contest GAME OF SKILL PROMOTION TERMS & CONDITIONS 1. Information on how to enter and the prizes form part of the terms and conditions of entry to this game of skill promotion (the "Competition"). Entry into the Competition is deemed acceptance of these terms and conditions. 2. The Promoter is Ziff Davis Australia Pty Ltd, Jones Bay Wharf, Suite 60, Pirrama Road, Pyrmont Road, Pyrmont NSW ABN: Permit Number: LTPM/ ( The Promoter ). The Sponsor is Coca-Cola ( The Sponsor ). 3. The promotion commences at 9AM AEST on Monday 24 th November and closes at 5PM AEST on Friday 5 th December ( The Promotion Period ). There will be 215 winners for the Promotion Period ( Prize Winners ). 4. Entry is open to users who are legally resident in Australia and eighteen (18) years of age or over. ( Eligible Entrants ) 5. Directors, management, employees and officers of the Promoter and Coca-Cola and their respective related bodies corporate, employees of associated agencies involved in this Competition and their immediate families are ineligible to enter this Competition. 6. To enter the Competition, entrants must, in the embedded form: Enter their name, address and daytime mailing address; and enter an answer to the following question: In 25 words or less, tell us how you plan to colour your summer?

2 Entries submitted by any other means will not be accepted: only those submitted via the official method of entry. Use of script, macro or any automated system to enter the Competition is prohibited and entries made (or which appear to have been made) using any such system may be treated as void. Any illegible, incomplete or fraudulent entries will be rejected. Entrants may enter as many times as they like. Participants may only win one prize per person irrespective of the number of entries submitted. 7. A panel of judges will be appointed to judge all complete, eligible, properly submitted entries received during the Promotion Period at the offices of the Promoter on Monday 8 th December. The entries will be judged for creativity and the most creative entries will be selected to win the Competition. 8. The decision of the judges is final and no correspondence will be entered into. This is a game of skill and chance plays no part in determining the winner. 9. One Major Prize Winner will be selected to receive one (1) Gaming night at IGN HQ which includes: 5x hours at IGN HQ for the winner and 11 guests playing the games of your choice (subject to availability) Pizza and Coca Cola products for all guests Ground transportation, flights and accommodation are not included with this prize and all associated costs of attending will be at each winner s expense. The Major Prize is transferrable should the winner not be able to make it to Sydney to take advantage of the prize. There are also 214 runner up prizes to be awarded individually with the distribution as follows: 12 runner up prize winners will be selected to each receive: one (1) package of AAA titles from Ubisoft RRP $ runner up prize winner will receive: one (1) PS4 console RRP $ runner up prize winner will receive: one (1) Xbox One console RRP $ runner up prize winners will be selected to each receive: one (1) IGN T-shirt RRP $ runner up prize winners will be selected to each receive: one (1) IGN Prime 1 year subscription RRP $ runner up prize winners will be selected to each receive: one (1) IGN Prime 3 month subscriptions RRP $14.95

3 The total retail value of the all prizes is estimated at AU$6, Only one (1) prize per person, regardless of the number of entries submitted. The prize must be taken by the winner as stated and cannot be transferred to another person, exchanged for other goods and services or redeemed as cash in whole or in part. Any element of the prize which is unused will be forfeited and no compensation will be paid in lieu of that element of the prize. Participants agree that the prize is awarded on an "as is" basis and that neither Promoter nor any of subsidiary or affiliated companies make any representations or warranties of any nature with respect to the prizes. Any complaints or queries relating to the prizes should be directed to IGN via 10. Except for any liability for death or personal injury caused by its negligence, fraud or any other liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability, for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way (directly or indirectly) out of the Competition, including, but not limited to, where arising out of the following: any theft, unauthorised access or third party interference; or any tax liability incurred by the winner. 11. The Promoter accepts no responsibility for any variation of the prize or any aspect of the prize, due to circumstances outside its reasonable control. In any such event, an alternative prize or element of the prize of a similar value will be arranged. 12. The Prize Winners will be notified by on Monday 8 th December. If a Prize Winner does not reply to this acknowledging receipt of their prize by 8 th March 2015, they will forfeit their prize. Any prizes that have not been claimed by the winner by 9 th March 2015 will be reallocated to the next best eligible entry as determined by the judges ( Alternative Winner ). An Alternative Winner has two weeks from the day of notification in which to claim their prize or another Alternative Winner will be selected.

The Promoter is not responsible for any problem or technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry beyond its or their reasonable control whether due to error, transmission interruption or otherwise. The Promoter reserves the right to disqualify any entrant submitting an entry which, in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The Promoter s decision is final and no correspondence will be entered into. If for any reason this Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its or their sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries beyond its reasonable control. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, where this is beyond its reasonable control, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Competition. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER AND THE

5 SPONSOR RESERVE THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. 14. Entry details become the property of the Promoter. Eligible Entrants consent to the Promoter and the Sponsor using their names, country of residence and entry details for promotional and/or marketing purposes. The Winner agrees to participate in reasonable publicity activities surrounding the Competition as requested by the Promoter. 15. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to the Sponsor and agents, contractors and prize suppliers. 16. Eligible Entrants personal information provided in connection with this Competition will be handled in accordance with data protection legislation and in accordance with the Promoter s privacy policy (see terms and conditions are governed by the laws of Victoria, Australia. The courts of Victoria shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Competition or these terms and conditions.
