1 I, the undersigned, hereby acknowledge and agree that: I have entered into this agreement by virtue of my participation in the Momentum Multiply administered by MMI Multiply (PTY) LTD programme a subsidiary of MMI Holdings Limited I have familiarised myself with the rules of the benefit as they appear on and will adhere to them. I understand that the benefit rules may change from time to time. This agreement is subject to the terms and conditions entered into Planet Fitness Holdings (Pty) LTD 2002/006750/07, JustGym (Pty) LTD 2013/039152/07 and JustGym and MMI Multiply (PTY) LTD I will be entitled to use and access the facilities of Planet Fitness/ JustGym subject to: Payment of the access tag fee Signature of this agreement Payment of my monthly debit orders My compliance with the rules and regulations of Planet Fitness/ JustGym including the rules of the benefit and the terms and conditions of this agreement. I acknowledge that I am not entitled to suspend my gym membership. I accept that my membership will be transferred to Planet Fitness/ JustGym if my medical aid benefit is cancelled. I am aware that I am still be required to honour the contract for the full 12-month fixed term (effective from the date that I initially activated the contract) my monthly fees will be adjusted to the full relevant monthly Club Rate of the membership I have join. After which it will continue on a month-to-month until I give one calendar month s written notification to cancel by contacting customerservice@planetfitness.co.za. I accept that if I am billed at the relevant monthly Club Rate that Planet Fitness/ JustGym reserve the right to increase my Monthly Membership Fee at any time for reasonable commercial purposes and that the T&C s for Planet Fitness/ JustGym will apply as they appear on This includes the applicable annual levy.

2 I accept that an early cancelation penalty will apply as per CPA Act Section 14, should I cancel my membership before end of 12-month fixed term. I will ensure that my visits to Planet Fitness/ JustGym are recorded accurately by using my access tag. It is my responsibility to ensure that my visits are recorded in the manual register should the system used for recording points not be operational. I am physically and medically fit to proceed with the normal routine of exercise and acknowledge that Planet Fitness/ JustGym and their directors/ employees/ tenants, as well as Momentum Multiply and any member of the MMI Group of companies will not be held responsible for any injury, loss, including loss of life suffered by me and/or my dependants and/or junior member(s) and children. Whether through any negligence and/or omission on the part of Planet Fitness/ JustGym or for any reason whatsoever. In the event of my signing this agreement as the guardian of a minor, I hereby consent to the minor being bound by the terms and conditions of this agreement. I indemnify Momentum Multiply, the MMI Group of Companies, Planet Fitness, JustGym and/or any employees and tenants for any loss including loss of life or damages arising from any claim resulting from the minor s use of and access to the facilities. Planet Fitness/ JustGym require you to pay for use of additional services and facilities specified from time to time and will charge the same general tariffs charged to ordinary members of the public for such additional services and facilities. The terms of this agreement do not pertain to such additional services and/or facilities. Access to the Planet Fitness/ JustGym s facilities will be denied should any fees be outstanding Planet Fitness/ JustGym and Momentum Multiply reserve the right to cancel my access if I breach any of the terms and conditions of this agreement or any rules and regulations applicable at the facility. In the event of one or more of these terms, conditions, rules and/or regulations being unenforceable, the same will be deemed to be severable from the remainder of this agreement. I confirm that the information contained herein is true and correct. I understand that I cannot cede or assign any of the rights or obligations in this agreement to any third party.

3 Momentum Multiply and Planet Fitness/ JustGym reserve the right to cancel this agreement if the information supplied is incorrect. I accept that Momentum Multiply, Planet Fitness/ JustGym will be entitled to amend the terms and conditions of the benefit and this agreement at any time on the provision that the amendments are communicated to me in writing and were furnished to me timeously. I authorise both Momentum Multiply and Planet Fitness/ JustGym to disclose/ transmit to one another personal information pertaining to my membership and my access to the facilities from time to time on the provision that such information is kept confidential. I accept that I cannot freeze or suspend my membership with Planet Fitness or JustGym. I accept that I will pay a fee if I transfer my membership from one club to another. Full club rules and regulations can be found at I have read this entire agreement inclusive of the rules and regulations applicable at the facility and I agree to be bound by them. RULES AND REGULATIONS: You are required at all times to comply with the rules and regulations, policies and procedures as established by Planet Fitness and JustGym regarding access, use and enjoyment of the club and which are considered to form part of the terms and conditions of this agreement. Planet Fitness and JustGym reserve the right to amend or add any of such rules, regulations and procedures at any time at our discretion. You confirm that you will read and comply with the Rules and Regulations and Polices and Procedures. 4 Should you have require any assistance with your CASH BACKS contact Momentum call centre ACCESS TAG Access tags (referred to as the tag ) are for the sole exclusive use of the client. No client will gain access to the facility without a tag. CLOSURE OF FACILITY AND/OR ALTERATION OF HOURS In the event of the facility, in its discretion, deciding that necessary maintenance work should be done on the premises, the facility can close its doors for the period required for completion of the necessary maintenance. If, at the discretion of management and due to unforeseen circumstances, a facility has to be closed on a permanent basis, Planet Fitness and JustGym reserves the right to provide an alternative facility, within a 10km radius. The business hours will be displayed and management reserves the right to change the business hours from time to time, as necessary. Equipment and classes are available subject to demand. The classes may be discontinued or the time altered at the sole discretion of management. LIMITATION OF LIABILITIES Planet Fitness/ JustGym and Momentum Multipy will not be responsible for any injury, harm, accident, loss of life or damage suffered by the client and/ or their dependants or children that occurs while the client and/or their dependants/and children use the facilities. It is the client s sole responsibility to ensure that they are sufficiently fit to take part in any exercise or activity offered by Planet Fitness and JustGym. The client indemnifies Planet Fitness,JustGym & Momentum Multipy for any injury suffered due to faulty equipment and/or injury sustained by the client either inside or outside of the facility, including loss of life. VALUABLES AND PERSONAL PROPERTY Planet Fitness/ JustGym will not be responsible for any loss, theft or damage to personal property of the members, dependant/and children or guests. NON-VARIATION OF AGREEMENT This is the entire agreement between the parties and no representation, promise, warranty and/or agreement not contained here will be of any force and effect between the parties. CHILDREN Certain restrictions apply to children under the age of 18.
