Terms and conditions of entry for the Face of Cairns Central Model Search at Cairns Central ( Competition )

1 1. Information on how to enter forms part of these terms and conditions. 2. Entrants may only enter the competition once. Professional paid models are not eligible to enter the competition. Entry is only open to residents of Australia aged between 5 and 25 years as at 27 June Employees of the Promoter and their immediate families and retailers within Cairns Central and the retailers employees and their immediate families are ineligible to enter. Entries for the Competition can be submitted from 9am on Friday 16 June Entries close at 5.00pm on Monday 26 June 2017 or such earlier time and date as 200 valid entries have been received (see paragraph 3 below). 3. To enter for your chance to participate and proceed to the final round you must complete the entry form. A maximum of 200 entrants will be allowed to enter the Competition. Upon receiving 200 valid entries, no further entries will be accepted and any subsequent entry forms will be destroyed. The eligible entrants for the Competition will be notified by phone and The entry fee is $10 to be paid to the customer service desk on the day of entering. All monies from the entry fee will be donated to Headspace Cairns. Monies must be paid in order to compete. 5. The Competition will be held at Centre Stage at Cairns Central between 27 June 2017 and 1 July 2017 as follows: Minis category heats (for entrants aged between 5 years and 8 years) from Tuesday 27 June 2017 to Wednesday 28 June 2017 daily at 11.00am, Junior category heats (for entrants aged between 9 years and 12 years) from Tuesday 27 June 2017 to Wednesday 28 June 2017 daily at 11.00am and Senior category heats (for entrants aged between 13 years and 25 years) from Thursday 29 June 2017 to Friday 30 June 2017 daily at 11.00am. The final round of the Competition (Minis, Junior and Senior categories) will take place on Saturday 1 July 2017 at 11.00am. 6. All Competition entrants prior to participating are required to sign a waiver and release in favour of the Promoter in the form attached. If the Entrant is under the age of 18, the Entrant s parent or guardian over the age of 18 must fill out the entry form and sign the waiver and release on behalf of the Entrant. 7. If the entrant is under the age of 18, the Entrant s parent or guardian over the age of 18 is required to be present with the entrant backstage prior to the commencement of the heat, be present for the duration of the heat at centre court, and collect the entrant backstage at the conclusion of the heat. 8. Up to eight from each of the daily Minis, Junior and Senior categories of the heats will be selected to proceed to the final round of the Competition and those finalists will be announced at the conclusion of each daily heat. The judges also reserve the right in their absolute discretion to select an additional or fewer finalists from any of the heats so that a maximum of ten finalists and minimum of one finalist from each of the Minis, Junior and Senior categories of the heats proceed to the final round of the Competition. Three overall winners one from the Senior category and one winner from each of the Minis and Junior categories at the final round of the Competition will be announced at the conclusion of the final round of the Competition. The names and ages of the winner from each category will be published on Cairns Central s website no later than 30 July Senior heat winners will be required on Friday 30 July at 4:00pm for approximately one hour at the Cairns Central Centre Management office for an interview with the judging panel. 10. The Judging panel will consist of a representative of Chic Management, a representative of the Promoter and a guest judge.

2 11. Entrants will be individually judged based on merit and chance plays no part in determining the winner. Judge s decision is final and no correspondence will be entered in to. The Promoter reserves the right to disqualify any Entrant displaying demeanor inappropriate or unsuitable for an event viewed by all age groups. 12. Nothing in these terms and conditions is intended to exclude, restrict or modify rights which you may have under any law (including the Australian Consumer Law ( ACL ), and consumer guarantees relating to goods or services under the ACL) which may not be excluded, restricted or modified by agreement ( Your Consumer Rights ). Subject to Your Consumer Rights, the Promoter is not liable for any loss or damage however caused (including by negligence), suffered or incurred in connection with the Promotion or the prize. Any condition or warranty which would be implied by law into these terms and conditions is excluded. 13. As a condition of accepting a prize, the winner, and any other person(s) sharing the prize with the winner, may be required to sign legal documentation as and in the form required by the Promoter including but not limited to a further agreement to exclude liability of the Promoter for certain loss, damage or injury arising from the use or participation in a prize to the extent the prize is or includes a recreational service or activity. 14. The prizes detailed below will be awarded in the Competition (Prize Pool). In respect of the Chic Package prizes detailed below, Lend Lease is the Promoter only. Chic Management Pty Ltd ACN (Chic Management) is the supplier of the Chic Package prizes to the winner and runner up in the Senior category of the Competition as detailed below, and the terms and conditions of Chic Management apply to the supply of the Chic Package prizes. Each finalist at the grand final will receive (a) a Hairhouse Warehouse Davroe travel size shampoo and conditioner valued at $17; (b) a Hairhouse Warehouse Agadir travel size shampoo and conditions valued at $11.98; (c) a Boost boost discount card valued at $5; and (d) a Wallace Bishop complimentary jewelry clean valued at $20. The winner of the Senior category of the final round of the Competition will win a Chic Package comprising: (a) return economy flight Cairns to Sydney on Virgin Australia or a similar carrier for 1 adult valued at $500; (b) Two nights accommodation in a 3-star hotel in Sydney selected by Chic Management subject to availability valued at $300; (c) a test shoot in Sydney arranged by Chic Management valued at $700; and (d) a one year modelling contract with Chic Management Sydney. The winner of the Senior category of the final round will featured in one of Cairns Central s fashion campaigns valued at $500, a Ella Bach signature facial valued at $100, a one hour Cherries naturopathic consultation valued at $120, a $100 Cairns Central voucher, a 1300SMILES check-up and clean valued at $275, a 1300SMILES whitening kit valued at $199, a tote bag by the beach people valued at $22, a Ally Fashion gift voucher valued at $30, a Hairhouse Warehouse silver bullet titanium copper straightener valued at $215, a Boost gift card valued at $50, a Wallace Bishop ladies loyal quartz leather strap watch valued at $259, a Laser Clinics gift voucher valued at $350 and a Myer Mac Cosmetics lipstick and lip liner valued at $66. The runner up of the Senior category of the final round of the Competition will win a Chic Package comprising: (a) return economy flight Cairns to Brisbane on Virgin Australia or a similar carrier for 1 adult valued at $400; (b) Two nights accommodation in a 3-star hotel in Brisbane selected by Chic Management subject to availability valued at $300; (c) a test shoot in Brisbane arranged by Chic Model Management Brisbane valued at $600; and (d) a one year modelling contract with Chic Model Management Brisbane.

3 The runner up of the Senior category of the final round will also receive a Hairhouse Warehouse gift voucher valued at $100, a Cairns Central gift voucher valued at $100, a tote bag by the beach people valued at $22, an Ally Fashion gift voucher valued at $22, a Boost gift card valued at $50, a Laser Clinics gift voucher valued at $150 and a Myer Mac Cosmetics lipstick and lip liner valued at $66. Times and dates of the flights and accommodation comprising part of the Chic Package prizes are to be agreed between Chic Management and the prize winners directly and are always subject to availability and to be determined at the discretion of Chic Management. No guarantee is given that the prize winner s preferred times and dates will be available. Flights and accommodation are non-changeable, nontransferable, nonrefundable and cannot be redeemed for cash. Flights are valid for a one year period and are subject to availability and have no restricted travel dates. Any additional incidental charges such as airport transfers and destination travel expenses, meals, mini-bar, laundry, room service, telephone calls, etc, charged to the room are at the prize winner s expense and should be settled prior to departure from the destination. If the winner is under the age of 18 years the winner must be accompanied by an adult or guardian over the age of 18 years, at their cost. The Promotor, on its own behalf, its agents and the owners of Cairns Central, do not accept any liability or responsibility whatsoever arising out of any alleged reliance on any prize awarded by Chic Management. The winner of the Junior category of the final round of the Competition will receive a cover shoot for Pakmag with the Minnie s winner valued at $600, Cairns Central gift voucher valued at $100, a tote bag by the beach people valued at $22, an Ally Fashion voucher valued at $30, a Boost gift voucher valued at $50, a pack of assorted toys from Kmart valued at $10 and an Event Cinemas beauty and the beast notepad valued at $15. The winner of the Minnie s category will receive a cover shoot for Pakmag with the Junior winner valued at $600, a Cairns Central gift voucher valued at $100, a tote bag by the beach people valued at $22, an Event Cinemas sofia the first skye the dragon toy valued at $49, a Boost gift card valued at $50, a pack of assorted toys from Kmart valued at $9 and an Event Cinemas beauty and the beast notepad valued at $15. The total retail value of the Prize Pool for the winners and runner-ups is $ The prize(s) is/are not redeemable for cash and cannot be transferred or exchanged. 16. All store gift cards and vouchers awarded as part of the Prize Pool are issued subject to the issuing retailer s own terms and conditions. 17. All entries become the property of the Promoter. As detailed in the privacy statement which accompanies these terms and conditions, all entries will be entered in to a database and the entrants names and addresses may be used for future promotional, marketing and publicity purposes. 18. Participation in the Competition implies acceptance of all conditions of entry. 19. The Promoter may cancel the Competition and not award the prizes where circumstances beyond the Promoter s control prevent the Promoter from providing the prizes or proceeding with the Competition. Should the Promoter cancel the Competition the Promoter will: (i) advertise that the Competition has been cancelled by placing a notice at the customer service desk in the shopping centre;

4 (ii) (iii) promptly destroy all entries received; and not use the personal information you have provided on the entry form. 20. This may be by any means of communication including telephone and electronic messages (e.g. ). If the information requested is not provided, you may not enter the competition. From time to time this information may be used by and disclosed to our service providers (such as mail houses, delivery companies, market research) or our related companies. The owners of Cairns Central and the operating entities which are listed at are referred to in this Privacy Statement as we, our and us. ENTRY FORM TICK-BOXES I agree to the Terms and Conditions including the Privacy Statement. I agree to allow use and disclosure by the Owner and LLPMA of that my Personal Information for marketing activities related to the Centre. I agree to the use and disclosure of my Personal Information by the Owner, LLPMA and each of their Related Bodies Corporate on an ongoing basis (even if the Owner is no longer an owner of the Centre) for marketing activities related to the products and services offered by those entities. ANNEXURE A - LIMITATION OF LIABILITY AND RELEASE DEED POLL Promotion: Face of Cairns Central 2016 Suppliers: Lend Lease Property Management (Australia) Pty Ltd ABN , Level 4, 30 The Bond, 30 Hickson Road, Millers Point, NSW, Sydney 2000 and any of its employees, officers, contractors, volunteers or agents. 1. RISK WARNING: Participating in the Promotion and/or acceptance of and use of the Prize involves the risk of physical injury, death or damage to property.

To the extent that the Promotion or the prize involves the supply of recreational services as defined by the Competition and Consumer Act 2010 (Cth), or equivalent state or territory legislation (as applicable) other than the Australian Consumer Law and Fair Trading Act 2012 (Vic), the Suppliers are not liable in respect of any consumer guarantee relating to the supply of the services under the Australian Consumer Law for: a) death; b) physical or mental injury (including the aggravation, acceleration or recurrence of such an injury) suffered by an entrant; c) the contraction, aggravation or acceleration of a disease; d) the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs: I. that is or may be harmful or disadvantageous to an entrant; or II. that may result in harm or disadvantage to an entrant, arising from the undersigned s participation in the Promotion or acceptance or use of the prize. If the Civil Liability Act 2002 (WA) applies to the Promotion, the limitation in this clause 2 does not apply to significant personal injury suffered by the undersigned that is caused by the reckless conduct of a Supplier of the recreational services. If the Australian Consumer Law and Fair Trading Act 2012 (Vic) and Australian Consumer Law and Fair Trading Regulations 2012 (Vic) applies to the Promotion, the following clause 3 applies: 3. WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012 (VIC): If you participate in these activities your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 (Vic) if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in these Terms and Conditions. NOTE: The change to your rights, as set out in these Terms and Conditions, does not apply if your death or injury is due to gross negligence on the supplier's part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 (Vic) and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012 (Vic). 4. You are responsible for obtaining a duly signed Limitation of Liability and Release Deed Poll from each person who uses the prize. If you do not deliver to the Suppliers a duly signed Limitation of Liability and Release Deed Poll from a person who uses the prize you indemnify the Suppliers against all claims, liabilities or costs which a Supplier may suffer or incur which arise out of or in connection with any matter for which a Supplier would have been released if a duly signed Limitation of Liability and Release Deed poll had been received.
