1 TERMS AND CONDITIONS FOR VISITORS By purchasing an admission ticket, you agree to the Holland Open Air Museum s General Terms and Conditions for Visitors. These set out the rights and obligations that apply to the museum and its visitors. You can also consult the Terms and Conditions for Visitors at our ticket office and information desk. >> Download the Terms and Conditions for Visitors The Holland Open Air Museum will make every reasonable effort to ensure that a visit to the museum complex and to the exhibitions and activities organised by the Holland Open Air Museum satisfies the wishes of the visitor. The museum will do everything it can to minimise any disruption or inconvenience for visitors and to guarantee the safety of visitors as far as possible. GENERAL PROVISIONS: DEFINITIONS Article 1.1 Open Air Museum: the Open Air Museum refers to Stichting het Nederlands Openluchtmuseum, Nationaal Museum voor Nederlandse Volkskunde (Holland Open Air Museum Foundation, National Museum for Dutch Folklore), which maintains and operates the museum complex. Officials from Stichting het Nederlands Openluchtmuseum (Holland Open Air Museum Foundation), Stichting de Oude Bijenkorf (de Oude Bijenkorf Foundation) and the Nederlands Centrum voor Volkscultuur en Immaterieel Erfgoed (Dutch Centre for Folk Culture and Intangible Cultural Heritage) work within this organisation and are authorised to act on its behalf. Article 1.2 Museum Complex: all the areas (developed and undeveloped) that fall under the legal or managerial competence of the Management of the Open Air Museum, including, but not limited to, the Entrance Building, exhibition rooms, museum buildings, catering outlets, terraces, gardens and other outside areas. Article 1.3 The Visitor: anyone who enters the Museum Complex, with or without a valid admission ticket, for the purposes of study, education or pleasure. Article 1.4 Admission Ticket: a ticket that grants the Visitor access to the Museum Complex during the museum s regular opening times. Article 1.5 Pass: an Admission Ticket (whether or not combined with a discount card) or similar document (e.g. a written invitation, voucher, annual Museum Card, etc.) that grants the holder access to ((a) specified area(s) within) the Museum Complex.

2 Article 1.6 Goods: all goods, including cash and objects and papers with a cash value. APPLICABILITY Article 2.1 These Terms and Conditions apply to all visitors to the Museum Complex. Article 2.2 These Terms and Conditions also apply to all natural persons and/or legal entities engaged by the Open Air Museum in pursuance of its object. Article 2.3 Deviations from these Terms and Conditions are only valid if expressly agreed upon in writing. ACCESS TO THE MUSEUM COMPLEX Article 3.1 The Visitor is only entitled to access the Museum Complex upon presentation of a valid Pass. Article 3.2 The Visitor will be denied (further) access to the Museum Complex if it becomes apparent that: a. the Pass has not been issued by the Open Air Museum or another body authorised to do so by the Open Air Museum; b.the Visitor is clearly under the influence of alcohol, drugs or similar substances; c. the Visitor is clearly creating a disturbance or clearly intends to do so. Article 3.3 An Admission Ticket that has been purchased in advance will become invalid if the date indicated on the ticket expires. Article 3.4 Within the Museum Complex visitors and their bags are subject to (entry) checks. The Visitor may therefore be asked to cooperate with a search of his/her bags and similar items carried out by or on behalf of the Open Air Museum s employees. Any visitors who refuse to cooperate with such a search may be denied access to the Museum Complex and are not entitled to a refund. Article 3.5 The Visitor is prohibited from bringing items or substances into the Museum Complex that an official of the Open Air Museum, who is recognisable as such, deems to be dangerous. If these

3 items are discovered during the entry check, they may be left in a location designated for this purpose by the Open Air Museum at the Visitor s own risk. Items prohibited by law that are discovered during the entry check will be handed over to the police. Visitors in possession of these items may be detained and handed over to the police. They will also be denied access to the Open Air Museum. ACCESSIBILITY Article 4.1 The Museum Complex includes historic buildings. Exhibitions and activities are spread over various locations, with some being held in the open air. The Open Air Museum endeavours to make the site fully accessible, as far as possible. Circumstances that can affect personal accessibility need to be taken into account, both inside and outside the buildings. Individual circumstances and/or the weather conditions can have a significant impact in this regard. Article 4.2 The Visitor is advised to find out about any restrictions that apply in the area of personal accessibility. In particular, the potential impact of weather conditions should be taken into account when accessing the outdoor areas of the museum. Article 4.3 Upon entering the Museum Complex the Visitor is advised to find out the escape routes that should be used in the event of an emergency situation or the threat of such a situation. The use of lifts is prohibited in the event of an emergency. Article 4.4 For information on the circumstances that could restrict personal accessibility and the possibilities for individual assistance that are available, the Visitor is advised to contact the information desk. PARKING Article 5.1 The same traffic regulations that are in force on public roads also apply to the Open Air Museum s parking area. The maximum speed on the site is fifteen kilometres per hour and traffic coming from the right has priority. Instructions given by parking attendants must always be followed. Parking a car, bicycle, moped or motorbike in a place other than that indicated by the parking attendants is prohibited. If the Visitor fails to follow the traffic regulations and/or instructions of the parking attendants, or fails to do so correctly, the Open Air Museum is authorised to remove the vehicle from the site at the Visitor s risk and expense. Article 5.2 The Visitor is advised to lock the vehicle and close the windows securely. No valuables should be left inside. The Open Air Museum accepts no liability for any theft or vandalism. This also applies in the event that damage is caused by storms, fire, hail, explosions or other unusual

4 circumstances. Vehicles are parked in the parking area or outside the park (Cattepoelseweg, Deelenseweg, Schelmseweg, etc.) at the Visitor s own risk. THE VISITOR S STAY WITHIN THE MUSEUM COMPLEX Article 6.1 The Visitor is only permitted to enter publicly accessible locations and must not enter areas that are closed to the public. Article 6.2 Due to potential risks and to ensure the safety of employees and visitors, access to a location may be (temporarily) prohibited and the presentation and communication of the subject matter may be adapted to the situation at that time. Article 6.3 In the event of extreme weather conditions that result in a warning being issued by the police or Royal Dutch Meteorological Institute (KNMI), the Open Air Museum will initiate its Severe Weather Warning protocol. The decision may then be taken to evacuate all or part of the Museum Complex. Article 6.4 The Visitor is obliged to comply with these General Terms and Conditions for Visitors and any directions and instructions given by employees of the Open Air Museum who are recognisable as such. If, in the opinion of employees of the Open Air Museum, a visitor is contravening, in any way, the Terms and Conditions for Visitors or any directions or instructions given, he or she may be denied further access to the Museum Complex, without the Open Air Museum being obliged to pay compensation for any damage or issue a refund. Article 6.5 If the Visitor repeatedly contravenes provisions of the General Terms and Conditions for Visitors or directions or instructions given by employees, the Open Air Museum may deny him/her access to the Museum Complex for a certain period of time. The Open Air Museum is also authorised to deny the Visitor access to the Museum Complex for a certain period of time if he/she has damaged an object as a result of (gross) negligence and/or intent during one or more previous visits to the Museum Complex or to other museums, or if there is otherwise a justified fear that the Visitor will cause such damage. In any case, the Open Air Museum may subject this visitor to the measures referred to in Article 3.4 during all of his/her visits. The decision to deny the Visitor access will be communicated to him/her without delay, if possible in writing. Article 6.6 In the event of emergencies, such as the sudden disappearance of an object or work of art, a terrorist attack or violence of another kind, the Open Air Museum is authorised to close its doors and lead any visitors on the site outside one by one. In such a case the Visitor may be asked to cooperate with a search of his/her bags and other items carried out by or on behalf of the employees of the Open Air Museum. Any visitor who refuses to cooperate with such a search will be asked to hand over proof of identity before leaving the Museum Complex.

5 Article 6.7 CCTV surveillance is in operation within the Museum Complex. Camera images are stored in accordance with the statutory provisions (Personal Data Protection Act) and will be made available to the police where necessary. Article 6.8 The Open Air Museum has photo and film reports produced at the Museum Complex on a regular basis. This material may be used for publicity purposes on its website, in leaflets, etc. By accessing the Museum Complex, the Visitor agrees to the publication of this material. If the Visitor has any objection to the publication of image material in which he/she can be recognised, he/she can inform the Open Air Museum. The Open Air Museum will then endeavour to avoid publishing the material in question. INTERNAL RULES AND REGULATIONS Article 7.1 Within the Museum Complex the Visitor is prohibited from, amongst other things: a. touching exhibits, unless explicitly indicated otherwise; b. offering goods of any kind for sale to third parties or supplying them free of charge without the express written consent of the Management; c. inconveniencing other visitors, including, but not limited to, blocking their view of exhibits for long periods or causing excessive noise; d. bringing pets/animals onto the site, with the exception of dogs on a lead. Dogs are not permitted in catering outlets or exhibition areas. They are, however, allowed on the terraces. Assistance and guide dogs are permitted throughout the Museum Complex, provided that they are reported to the information desk on arrival. e. using private means of transport (such as bicycles, skateboards, waveboards, segways, scooters and inline skates), with the exception of wheelchairs, pushchairs, buggies, walking frames, rollators and other generally accepted aids. f. smoking in any enclosed spaces and on board trams. In periods of severe drought, specific instructions may be in force on (parts of) the site, in accordance with the code issued by the Safety Region; g. consuming food or drinks on board the trams and in enclosed spaces. This does not apply to catering outlets, although any food and drink consumed there must be purchased from these outlets; h. taking photographs or making video or audio recordings within the Museum Complex, unless these are exclusively for private use. It is not permitted to use visual or audio material for commercial purposes without the express written consent of the Management. Such consent will set out more detailed conditions and may impose an obligation to pay location or other charges. Article 7.2 For visits by primary or secondary schools, there must be at least one supervisor for every 8 pupils. The Open Air Museum reserves the right to refuse access to groups who do not meet this requirement.

6 Article 7.3 Parents, teachers and other supervisors are responsible and accountable at all times for the behaviour of the minors, individuals or groups who they have brought to the museum or are under their supervision. Article 7.4 Special guidelines for very young visitors and their parents/supervisors apply in a number of locations. Children under 12 may only access these locations under supervision. Article 7.5 Tours are subject to a maximum number of 20 people. Article 7.6 All other persons who access the Museum Complex on the instructions of the Open Air Museum are also subject to the regulations applicable to third parties on the site. LOST PROPERTY Article 8.1 Any items of lost property that the Visitor finds within the Museum Complex can be handed to an employee or the information desk in the Entrance Building. Article 8.2 If a person who claims to be the owner of an item of lost property comes forward, he/she may choose to collect the item in person or have it sent to him/her cash on delivery. In both cases the owner will be required to prove his/her identity satisfactorily. If the Open Air Museum has any doubts about the status of the person who claims to be the owner, it may demand proof of ownership. Article 8.3 The Open Air Museum will make every possible effort to find out the identity of the owner or person entitled to the item of lost property. If the owner of or person entitled to an item of lost property has not requested its return within three months (or one year in the case of valuable items) of this item entering the Open Air Museum s possession, the museum may act as it sees fit and reserves the right to destroy any items that have not been collected. REFUND Article 9.1 The Open Air Museum is not obliged to refund the cost of an unused Admission Ticket. Article 9.2 The Open Air Museum will on no account be obliged to refund sums paid to the Visitor or compensate him/her in any other way if:

7 a. objects from the Open Air Museum s collection are not on display; b. the Museum Complex is partially closed, including, but not limited to, partial closure as a result of exhibitions being set up or taken down; c. the regular opening times are changed due to emergency response drills or, in the event of an emergency, any full or partial evacuation of the Museum Complex that the Open Air Museum deems necessary; d. damage, disruption or inconvenience is caused by other visitors, including, but not limited to, excessive noise, inappropriate behaviour (including harassment) or theft; e. disruption or inconvenience is caused by events and maintenance work, including, but not limited to, the renovation or (re)arrangement of rooms; f. disruption or inconvenience is caused by failure of facilities within the Museum Complex to function properly; g. access is denied to the Museum Complex; h. the Pass is lost. LIABILITY OF THE OPEN AIR MUSEUM Article 10.1 The Visitor accesses the Museum Complex at his/her own expense and risk. Article 10.2 All prices, communications and other forms of information issued by the Open Air Museum are binding. The Open Air Museum accepts liability for any errors it has made itself in prices, communications and other forms of information issued to the Visitor. Such liability only applies to the museum s own information material that is available within the museum at the time of the claim or has recently been distributed by or on behalf of the Open Air Museum. Article 10.3 The Open Air Museum on no account accepts liability for any damage resulting from prices, communications and other forms of information issued to the Visitor by third parties. Article 10.4 The Open Air Museum is liable only for damage that the Visitor suffers as a direct consequence of gross negligence or intent on the part of the Open Air Museum or its officials, with the proviso that only damage for which the Open Air Museum is insured, or should have been

8 insured in accordance with the requirements of reasonableness and fairness, qualifies for compensation. Any liability on the part of the Open Air Museum is excluded if, amongst other things: a. damage results from actions of third parties, including persons engaged by the Open Air Museum and parties who hire (rooms within) the building and persons engaged by these third parties; b. damage results from failure to follow instructions given by the Open Air Museum s officials and from failure to observe prevailing standards of decency; c. damage is caused in any way by other visitors; d. goods are accepted or goods are deposited, stored and/or left in any way, in any location and by anyone without the Open Air Museum demanding any payment for this. Article 10.5 Any claim will in any case be limited to the lowest of the following two amounts: a. the amount paid out to the Open Air Museum by its insurer in connection with the individual claim concerned; or b. the compensation paid to the Open Air Museum by a third party in connection with the individual claim concerned. Article 10.6 In the event of a claim resulting from death or personal injury, the total liability of the Open Air Museum will on no account exceed the sums referred to in the compensation arrangement set out in Article Article 10.7 Any liability on the part of the Open Air Museum for indirect damage, including consequential damage, lost profits or earnings, lost savings, etc., is excluded at all times. LIABILITY OF THE VISITOR Article 11.1 The Visitor to the Museum Complex is liable for any direct or indirect damage that he/she causes, whether or not as a result of failure to comply with these Terms and Conditions for Visitors, and indemnifies the Open Air Museum against any associated third-party claims. Article 11.2 The (original) person entitled to the Pass is jointly responsible and jointly liable for any damage

9 caused by the holder of this Pass. Article 11.3 Organisations that organise meetings, events and/or parties within the Museum Complex (or arrange for such to be organised) are responsible and liable at all times for the behaviour of the guests they invite, without prejudice to the personal responsibility and liability of these guests. FORCE MAJEURE Article 12.1 The Open Air Museum will on no account be liable for any damage suffered by the Visitor as a result of circumstances beyond the Open Air Museum s control (force majeure). Force majeure is understood to include any foreseeable or unforeseeable circumstance beyond the Open Air Museum s control that temporarily or permanently prevents or impedes the performance of the agreement. Article 12.2 Force majeure is also understood to include the following, insofar as these are not already covered by the term: riot, disturbance, terrorism, action by the police and/or fire service, industrial action, transport problems, fire and other serious disruptions within the Museum Complex, adverse weather conditions and disruptions to public transport for whatever reason. Article 12.3 Such circumstances will also be deemed to include circumstances affecting persons, services and/or institutions that the Open Air Museum wishes to call on for the performance of the visitor agreement, as well as any circumstance regarded as force majeure or a resolutive or suspensory condition for such parties, or any breaches of obligations attributable to such parties. COMPLAINTS PROCEDURE Article 13.1 The Visitor can inform the museum of any complaints via the Open Air Museum s website or by completing the appropriate form, which is available from the information desk. Article 13.2 Any complaints connected with the visitor agreement must be lodged with the Open Air Museum in writing within 6 weeks of the date of the visit. In principle, the Open Air Museum will not process any complaints lodged after this period. The Open Air Museum will investigate the complaint and will endeavour to process it within 10 working days of receipt. If the investigation has not been completed within this period, this will be notified to the complainant and an indication will be given of the expected completion date. OTHER TERMS AND CONDITIONS AND APPLICABLE LAW

10 Article 14.1 The applicability of these General Terms and Conditions for Visitors does not affect the applicability of any other contractual conditions and/or regulations of the Open Air Museum, including, but not limited to, the Additional Terms and Conditions for Bookings and the Uniform Terms and Conditions for the Hotel and Catering Industry. Article 14.2 These General Terms and Conditions for Visitors and the agreement between the Visitor and the Open Air Museum are governed by Dutch law. FINAL PROVISIONS If one or more of the above articles are or become legally invalid, this will not affect the legal validity of the other provisions. In such a case the invalid provision will be replaced with a new provision that corresponds as closely as possible with the old invalid provision in terms of its content, scope and/or purpose.
