2 Introduction Thank you for your interest in using the SAFE satellite centre service. To apply to be a satellite of SAFE you need to submit the following documentation; This completed agreement. CV s and certificates of your training staff. If you are currently approved as a centre with another awarding body, you will need to send your certificate of approval and copies of your last two EV reports. Company policies; health and safety, diversity and equality, malpractice, appeals. On receipt of the above documentation, we will review your application within 5 working days. If there are documents missing or you cannot be approved for whatever reason, this will be communicated to you at the earliest opportunity. If we feel you meet the standard to become a SAFE/IQ accredited centre, we will levy an approval charge of 350+vat and forward your application onto IQ. This approval fee will include your first visit on course 1 and payment must be received upfront. Once approved, you will be issued with the relevant documentation and procedures for running the courses you have gained approval for. You must read these carefully and follow the directions contained within them in full and without variation. You will also need to purchase the appropriate training materials from SAFE. For current prices, please refer to the appropriate license agreement. SAFE s Internal Verification Procedures As part of this satellite service, SAFE will act as your centre s internal verifier. We will IV the first course of every new trainer approved, and a visit on the second course is subject to the outcome of the first but is usually not required if the training and assessment is deemed satisfactory*. We will then visit once per year or after 200 learners have been processed by your centre, whichever is soonest (this visit is usually unannounced). Current fees for these visits can be found in appendix 2. *If after two IV visits in a row, the training, assessment or any other element of the courses you are running are still deemed unsatisfactory, SAFE has the discretion to terminate this satellite agreement. 4 Appendix 1 Introduction AGREEMENT FOR THE PROVISION OF ASSESSMENT SERVICES 1.1 The parties to this agreement are Security and Facilities Education Ltd (SAFE), Grosvenor House, Suite 4.02, Central Park, Telford, Shropshire TF2 9TW which will be referred to as the Contractor for the purpose of this agreement, and..., referred to as the Centre for the purpose of this agreement. It is effective from.. until terminated by either party. 1.2 The Centre is a registered centre with the regulated awarding organisation Industry Qualifications for the provision of the qualifications detailed in appendix 4, and wishes to engage the Contractor to undertake a range of services detailed in appendix 2, in support of its operation as an approved awarding organisation centre. 1.3 The Contractor is an approved awarding organisation centre in its own right, and will use its experience and resources in support of the centre. Responsibilities of the Contractor (SAFE) 2.1 The Contractor is responsible for the following activities relating to the provision of examinations: a. Booking exams with the awarding body on the Centre s behalf; b. The provision of examination papers to the Centre; c. The receipt of completed examination papers and associated identification documents returned from the Centre to the Contractor; d. The scanning and dispatch of information to the awarding body for marking; e. Dispatching results and certificates to the Centre; f. Dealing with queries relating to examinations. 2.2 The Contractor is responsible for managing the quality assurance arrangements associated with the provision of examinations by the Centre. Specifically, the Contractor will: a. Check examination documentation for compliance with the awarding bodies requirements; b. Undertake a minimum of one centre visit per year plus any additional internal verifications visits if required; c. Monitor the statistical performance of the Centre in relation to examination performance. 2.3 The Contractor will liaise with awarding bodies and ensure that the Centre is kept abreast of developments. Responsibilities of the Centre 3.1 In respect to awards that are the subject of this agreement, the Centre agrees to use the appropriate training materials purchased and produced by the Contractor. 3.2 The Centre warrants that they will comply with the requirements of the Contractor s procedures without variation, and confirms receipt of a copy of these procedures. The Centre also commits to operate in accordance with awarding organisation requirements. 3.3 The Centre agrees to send all completed examination paper to the Contractor by recorded delivery or courier service. 3.4 The Centre agrees to provide the Contractor with accurate information on examination timetabling and agrees to allow the Contractor s staff unrestricted access to examinations, and the documentation associated with those examinations. 5 3.5 The Centre will ensure that it maintains the levels of insurance required by the awarding organization. 3.6 The Centre agrees to pay to the Contractor, the Contractor s and awarding organisation s fees due for quality assurance and certification in accordance with the terms and conditions of these organisations. 3.7 The Centre will only use trainers that have been approved by SAFE for the delivery of these qualifications. Warranties and Limitations 4.1 The Centre warrants that it will not engage in any activity that will undermine or call this agreement into disrepute. 4.2 The Centre warrants that it accepts liability for any losses or costs incurred by the Contractor as a result of malpractice or negligence in discharging the obligations defined in the satellite procedures. For avoidance of doubt, the fees charged by the Contractor for dealing with complaints concerning malpractice are 300 per day + VAT. Losses relate to any consequential loss resulting from the actions or inaction of the Centre. 4.3 Whilst the Contractor accepts no responsibility for: a. Documentation lost in the post; b. Delays in the publication of results; c. Errors in the results caused by the awarding bodies or its agents; It will work with Centres to resolve issues that arise. 4.4 Any claim that the Centre might have in relation to the actions or omissions of the Contractor will be limited to the sum invoiced by the Contractor in relation to the affected candidates. 4.5 The Contractor is not responsible for any claims against the Centre by suppliers or customers, and the Centre warrants that it maintains Professional Indemnity Insurance of not less than 2 million. Payments 5.1 The fees associated with the provision of this arrangement are defined in Appendix 2. Fees will be periodically reviewed, with no less than one month s written notice given of any changes. 5.2 A Centre approval fee is chargeable on commencement of this agreement; this is defined in Appendix 2. Centres must also purchase the appropriate training materials before commencement of their first course. 5.3 The Centre commits to pay the Contractor s invoices strictly in accordance with the stated terms and conditions. 5.4 The Contractor reserves the right not to supply examination papers, or to process papers, should a Centre fail to comply with payment terms or breach its credit limit. General 6.1 This agreement is intended to constitute a legal commercial relationship. It does not create a legal partnership between the parties hereto. 6.2 Both parties agree to co-operate with each other in discharging obligations to the awarding organisation. 6.3 The parties agree to adhere to all relevant laws and regulations when carrying out work as part of this agreement. 6 6.4 Nothing in this agreement will constrain the Contractor from reporting malpractice to the awarding organisation. 6.5 Both parties agree to use their best endeavors to promote the terms of this agreement. 6.6 This agreement is governed under English Law and any proceedings arising under it will be conducted in the courts of England and according to English Law. 6.7 The Centres agrees that information relating to malpractice or failure to honour invoices can be shared with other awarding bodies and training organisations as appropriate. 6.8 Every member of staff involved in delivery of training in the Centre under the constraints of this agreement will be required to carry out continuous professional development. A record of this must be kept, and made available to the Contractor when requested which will usually be on an annual basis. Termination 7.1 The contract can be terminated by either party giving written notice to the other of its intent to do so, to the address provided in the introduction. 7.2 On termination, the centre will refrain from using materials and systems where the copyright is retained by the contractor.
