3 Page 3 BENEFITS, ENTITLEMENTS, INSURANCE RELATED TO SERVICE INCURRED INJURY, ILLNESS DEATH AND DISABILITY IN THE UN SYSTEM 1. Purpose of the survey 1. At the 19 th session of the High Level Committee on Management (HLCM) in February , it was agreed that the CEB Secretariat would undertake a comprehensive review of all current benefits, entitlements, insurances related to service incurred injury, illness death and disability (for brevity service-incurred injury from this point forward) in the event of a malicious act as well as outside the specific circumstance of malicious act in the UN common system. The aim of the exercise was to take an inventory on the practices adopted across the UN system on issues concerning compensation to staff members and non staff personnel. 2. The results of this review are contained in this document. The goal of the exercise was to provide an insight into what is being undertaken system-wide and what organizations are doing individually, leading to the identification of gaps and overlaps to better evaluate if and how to invest or restructure the compensation system for service-incurred injury. The review covers all personnel categories: 1) international staff, 2) national and locally-recruited staff, and 3) international and locally-recruited non-staff personnel. 2. Definitions and context a. Staff member 3. There is a generally accepted definition of staff member. It can be generally said that [ ] the expression refers to any individual who has received a formal letter of appointment under the Staff Regulations and Rules from an organization of the UN common system, or who has otherwise been determined by the employer organization to be subject to that organization s Staff Regulations and Rules 2. b. Non-staff member 4. Non-staff is defined differently across the United Nations systems organizations. For reference purposes the list of categories in the MAIP (Malicious Acts Insurance Policy) schedule can be used, this list can be found in Annex I. 1 CEB/2010/3, para.29, pg CEB/2010/ HLCM/HR/26, pg. 5, para. 16.

4 Page 4 c. Service incurred 5. There is no common specific definition of what constitutes a service incurred injury (a review of appendix D done by PriceWaterhouseCooper 3, comes to the same conclusions and makes specific recommendations to this effect.) Service incurred injury is generally described by surveyed organizations as any injury happening while on duty on behalf of the organization Coverage for service incurred injury is offered through three different types of tools: 1. Special Provisions under the organizations Staff Rules and Regulations (i.e. UN Secretariat (UN-SR 6.4), Appendix D from now on UN Appendix D); in this case coverage is provided to staff members but can be extended to cover non-staff members through inclusion in the terms of contract. Amounts payable vary from organization to organization. NOTE: Many organizations adopt the tool and the administration mechanism of Appendix D, to provide coverage for service-incurred injury to staff members. In this case claims are adjudicated by the Advisory Board on Compensation Claims (ABCC) for all subscribing organizations (see a list of subscribing organizations in Table 2 in Annex II). A list of the organizations subscribing the UN Appendix D and its adjudication mechanisms can be found in table 2 Annex UN pension Fund for staff members: compensation under special provisions of the Staff Rules and Regulations (such as UN Appendix D) are normally subject to the condition that the amount of benefits payable to the staff member or to the beneficiary under the Regulations of the United Nations Joint Staff Pension Fund (UNJSPF), shall be deducted from the entitlement awarded under the special provision of the Staff Rules and Regulations. NOTE: Benefits provided under the Pension Fund are not considered in this review nor included in the tables as the provision is automatically applicable to all staff members under the Staff Rules and Regulations of each organization. 3. Commercial Insurance: coverage varies according to the plan adopted (i.e. MAIP ), in the majority of cases this can overlap with compensation under the Staff Rules and Regulations. NOTE: The majority of surveyed UN system organizations have separate MAIP coverage. Many organizations subscribe to the UN Malicious Acts Insurance Policy sponsored by the UN Secretariat (from this point forward UN sponsored MAIP ), which defines malicious acts as [ ]hostilities, revolution, rebellion, insurrection, riots or civil commotion, sabotage, explosion of war weapons, terrorism, murder or assault by foreign enemies or an attempt thereat A summary of the benefits and entitlements under UN Appendix D and UN sponsored MAIP is provided below for ease of reference. 3 Phase 1 Report, Dec. 15, 2009, PriceWaterhouseCooper. 4 The text of UN appendix D states: The event leading to injury, illness, or death must have occurred during the normal course and scope of the staff member s duties or otherwise be directly related to the staff members employment by the United Nations. 5 Consolidated document 27 Apr

The benefit is a lump sum payment based on a percentage of twice the annual amount of pensionable remuneration at grade P-4, for professional staff. In the United States, the P4 Step V remuneration is $150,104. Payment is a lump sum in addition to the other benefits of Appendix D**. Notes: * The extent of disability is determined by the United Nations Medical Service, utilizing current American Medical Association Guidelines (AMA). ** Benefits for general service staff members vary by country, and are lower than benefits provided to professional staff. e. Amounts payable under UN sponsored MAIP Categories 1, 2, 3, Staff members and non-staff personnel whilst on travel and on mission

Organizations that do not subscribe to the UN sponsored plans generally use commercial insurance plans and calculate compensation for death benefit as a multiplier of the annual salary or as a percentage of the pensionable remuneration. Maximum amounts payable to dependants in case of death vary from 500,000 to 1,000,000 USD for staff members and from 25,000 to 500,000 USD for non staff members (see details in table 3 Annex 1). 3. Methodology 9. To gain insight into the diversity of benefits and entitlements, a set of questions was sent to the members of the HR Network 6 in June These questions were followed-up by interviews with informed respondents and an opportunity for respondents to validate responses. 6 The Human Resources Network gathers the directors of HR departments of the UN common system. It currently comprises: FAO, IAEA, ICAO, IFAD, ILO, IMF, IMO, ITC, ITU, PAHO, UN, UNAIDS, UNDP, UNESCO, UNFPA, UNHCR, UNICEF, UNIDO, UNOPS, UNRWA, UNWTO, UPU, WFP, WHO, WIPO, WMO, WTO.

7 Page Participants were asked about: i. Benefits, entitlements, insurances related to service incurred injury, illness death and disability provided in their organization to three categories of personnel: Locally recruited staff, internationally recruited staff and non-staff personnel. ii. Tools used to guarantee coverage to staff and non-staff personnel against service-incurred injury. iii. Relationship and interactions between the different tools used. iv. Maximum and minimum amounts payable under each tool. 11. Recent data collected for a report evaluating UN secretariat s Appendix D 7, added to the information gained from the questionnaire. To validate some of the responses received interviews were conducted with the majority of the responding organizations (see Table 1 in Annex II). 12. All the information was collated in a set of tables, which were returned to the respondents in the various organisations to be validated. A full set of tables is provided in Annex II. Twenty-six HR Network member organizations responded (see a list in Table 1 in Annex II). 4. Summary of results 13. Summary of results would indicate the following: Service-incurred death, injury and disability in the event of Malicious Acts 1. Internationally and locally recruited staff members: 14. Of the 26 responding organizations, 65% indicated that they subscribe to the UN MAIP for coverage to internationally and locally recruited staff members; 31% provide coverage through a commercial insurance, overall 96% of organizations provide coverage under the UN MAIP or similar commercial schemes. 2. Non staff personnel 15. Of the 26 responding organizations, 65% of organizations provide coverage to non staff personnel through the MAIP;15% through similar commercial insurance;19% provide no coverage; overall 81% provide coverage through MAIP or similar schemes. Service-incurred death, injury and disability in the event of other incidents than Malicious Acts 1. Internationally and locally recruited staff members: 16. Of the 26 responding organizations, 92% of organizations provide coverage under Appendix D or equivalent schemes; 4% provide some coverage through commercial insurances; 4% provide no coverage. Of the 26 responding organizations, 38% of organizations provide coverage under Appendix D or equivalent schemes; 42% provide some coverage through commercial insurances; 19% provide no coverage. Overall 80% are providing coverage to internationally and locally recruited consultants. 3. All non-staff personnel 18. Of the 26 responding organizations, no organization provide coverage under UN Appendix D; 15% provide coverage under similar schemes to Appendix D; 19% provide some coverage through commercial insurance; 66% provide no coverage; overall 34% of organizations provide some coverage to non staff personnel while 66% provide no coverage. 19. Table 1 below, shows the distribution of the different coverage mechanisms used in the UN common system. Also table 13 in Annex II provides more detailed information by organizations. 20. A list of the organizations subscribing to the UN sponsored MAIP and Appendix D can be found in Table 2 of Annex II. Locally recruited staff members generally have access to less benefits and entitlements than Internationally recruited staff members, except for death and disability benefits that remain the same independently from the type of contract (Local or International). 22. Injuries caused by Malicious Acts are on average covered for a wider range of personnel categories than injuries caused by other circumstances. 23. Non staff members are awarded a limited number of benefits compared to staff members (see tables 5 to 10 in Annex 1). 24. The following table shows the percentage of organizations that provide benefits to the three categories of personnel. In the analysis of the current benefits, entitlements, insurance related to service incurred injury, illness death and disability in the UN common system, the following patterns can be discerned: (a) (b) (c) Organisations that have a broad field presence with many duty stations or high number of non-staff personnel (such as the UN Peace Keeping Operations, ILO, WHO, UNHCR, UNICEF, WFP, UNDP) 8 tend to subscribe to the UN Appendix D to provide coverage to staff members and to use commercial policies to cover non-staff personnel (with the exception of UNRWA which covers non-staff personnel only for injury caused by malicious acts); Smaller organizations (such as UPU, WMO, IMO, UNAIDS, UNWTO) tend to use their Staff Rules and regulations provisions administered internally to adjudicate serviceincurred injury cases. Headquarters-based organisations (such as WMO, ILO, UPU, ICAO, IAEA, WIPO, UNU, UNIDO) tend not to cover non-staff members through a commercial insurance; 26. 11 Page 11 Categories covered under MAIP: Annex I MALICIOUS ACTS INSURANCE POLICY (MAIP) The Malicious Acts Insurance is applicable worldwide and provides coverage for all Insured Persons for 24 hours a day, against injuries resulting in permanent partial disablement, permanent total disablement or death caused directly or indirectly by a war or a malicious act, for all staff members and consultants. Category 1 Professional categories: Internationally and locally recruited Professional Staff (permanent, indefinite, continuing appointments, Agreements of limited duration, short term appointments, Junior Professional Officers (JPOs) and Associate Professional Officers (APOs), USD1 a year appointments, Individuals appointed and compensated for official duties); Other members of the workforce internationally recruited (consultants, Service Contractors SCs-, Special Service Agreements SSA-, technical cooperation experts, Fellows. Associate Experts, Gratis Personnel); Other (individuals under reimbursable and non reimbursable loan to the organization and assigned to the duty station, Staff on secondment from governments). Max: USD Category 2 General Service, Field Service, National Professional Officers : Internationally and locally recruited Professional Staff (permanent, indefinite, continuing appointments, Agreements of limited duration, short term appointments, fixed term appointments, temporary fixed term appointments, Short term appointments); Other members of the workforce internationally recruited (consultants, SC, SSA and similar class of contracts, Gratis Personnel). 35 Page 35 Notes: Disclaimer: The data received by the CEB Secretariat from HR Network members regarding personnel on non-staff contracts (Annex 3 of CEB/2010/HLCM/HR/26) shows a total of 122,976 individuals who served in UN organizations in 2009 in such capacity. 10 This is a striking figure, especially when compared to 82,737 staff members with an appointment of one year or longer as of 31 December The total shown in Annex 3, however, needs to be qualified. First, it is not complete because not all organizations responded to the request for data from the CEB Secretariat. Second, several of the organizations who did respond qualified their answers on several grounds: (i) there were data collection problems due to decentralization and separate databases, (ii) some data collection systems counted the number of contracts per year, not the number of individuals concerned, thus inflating the numbers, and (iii) the categories or labels used for the collection of data by the CEB Secretariat did not always coincide with the various types of arrangements used by each of the organizations. For instance, some organizations have streamlined their system by reducing all forms of remunerated non-staff service to one type of arrangement, as was done by ILO with its External Collaboration Contract or by UNOPS with its Individual Contractor Agreement. Other organizations use multiple arrangements which are not immediately classifiable under the categories used in Annex 3, as is the case for UNESCO for example, which uses Supernumerary Contracts, Special Service Agreements (SSAs), Service Contracts, and Individual Consultants/Specialists. 1) UN: Headcount of personnel (not # of contracts) as of 31/12/2009, as registered/managed in IMIS system. The number does not include locally recruited personnel or contracts in Field Missions that are not registered/managed in IMIS system. 2) WHO: Numbers above may not show all contracts in At the launch of our administrative system only Headquarters and one of our regions were in the system. In January 2010, three other regions were incorporated. Our last region will join us later this year. 3) UNWTO: Figures are based on contracts prepared, not consultants or collaborators.
