1 TITLE: Establishing Child Care/Enrichment Programs ROUTING NUMBER: ISSUER: BUL DATE: June 16, 2008 Alvaro Cortés, Assistant Superintendent Local District Superintendents Administrators of Instruction Principals School Administrative Assistants PURPOSE: This Bulletin replaces Bulletin No. BUL of the same subject dated July 13, The content reflects the updated format and current procedures. INSTRUCTIONS: A. Background The YMCA, YWCA, PTSA and other community organizations or agencies (collectively, agencies ) are only permitted to operate child care programs and/or enrichment programs that comply with this Bulletin on District school sites. Such authorization has been granted in response to the recognized need for well-supervised, low-cost, and convenient programs for children. Privately operated sports/athletic camps conducted exclusively during summer and/or other school break periods are not considered enrichment programs. These programs are distinct from the District s Child Development, LA s BEST programs, Ready-Set-Go! Youth Development Program and Youth Services Programs. B. Policy Nonprofit and for profit organizations and agencies, including but not limited to the YMCA, YWCA and PTSA, can be authorized to use available District facilities under a License Agreement ( Agreement ) issued by the Leasing & Asset Management Branch and may qualify for cost incurred rates under the conditions stated in the Agreement. Contact sports programs such as, but not limited to, Karate and Tae Kwon Do are prohibited by District policy. Also, high risk activities should be evaluated by Risk Management and Insurance Services with the Office of Environmental Health and Safety for risk and safety. Programs operated by nonprofit and for profit organizations and agencies that use District facilities under a License Agreement must comply with Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act of 1990, Title VI of the Civil Rights Act of 1964 and Title IX BUL Page 1 of 5 June 16, 2008
2 of the Education Amendments of 1972, as well as all other federal and state laws prohibiting discrimination against individuals based on the following protected categories: sex (including sexual orientation or gender identity, pregnancy, childbirth, or related medical condition); ethnicity (such as race, color, national origin, and ancestry); religion (including religious accommodation); disability (mental or physical disability or reasonable accommodation); age; marital status; or any other basis protected by federal, state, local law, ordinance, or regulation. 1. Child Care Programs may be approved under these conditions: a. Space is projected to be available for the school year in which the use is desired as determined and authorized by the school principal and Local District Superintendent or his/her designee. b. The Agreement for the use of the school(s) must be executed by the Leasing & Asset Management Branch prior to the occupancy of the requested school. To start this process, please contact the Leasing & Asset Management Branch at Telephone (213) or Facsimile (213) c. A 30-day cancellation notice is included in the Agreement, if space becomes unavailable during the school year. d. Agreements must be renewed annually. e. Fees collected by the agencies operating the program are to be used only for the operation of the program and for any fees imposed for the school use, if applicable, and are not otherwise to be used for the regular school or for any other use beyond the child care program. f. Agencies desiring to provide a private building facility on LAUSD property must process an application for this purpose through the Leasing & Asset Management Branch. This process will require several levels of review and approvals, and will take approximately three to six months or longer dependent upon the scope of the project. Approval is discretionary and may not be granted. g. Agencies must be licensed appropriately by the State Department of Social Services. h. Agencies must adhere to the State requirement for signing children in and out. BUL Page 2 of 5 June 16, 2008

Agencies must meet District insurance coverage and limit requirements, Commercial General Liability Insurance, Commerical Auto, Workers Compensation, Professional Liability, and Sexual Abuse and Molestation Coverage. In addition, the Los Angeles Unified School District and its Board Members must be named as additional insured. For coverage limits, please contact the Division of Risk Management and Insurance Services at (213) Enrichment Programs may be approved if child care conditions are met and the following are also addressed: a. Agencies shall be required to waive the student fee for at least 25 percent of the participating students per session. Students are eligible for a fee waiver because of financial hardship upon recommendation and approval of the school principal. b. Information disseminated regarding agencies program shall include notice of a fee waiver option for 25 percent of the students per session. Documentation of reasonableness to implement these guidelines includes a report of student enrollment, designating ethnicity for all students and indicating students on fee waivers 1. By no later than the end of the first session of after-school enrichment, the agency shall submit to the District evidence that the requirements have been met. If the District determines, in its sole discretion, that the agency has not complied with this requirement, the District may terminate the Agreement immediately. 2. If the 25 percent fee waiver is not accomplished, the following information must be provided prior to any renewal of the program: a. to adhere to the guidelines, including advertising process used to select students b. program scheduling does not limit participation by interested students c. principal s review of procedures to assure diligent effort to enroll those needing fee waiver BUL Page 3 of 5 June 16, 2008
4 3. Procedures The has the responsibility for maintaining records of requests and approvals for various child care and enrichment programs. The Leasing & Asset Management Branch has the responsibility to prepare the Agreement and collect all fees, as applicable. The Division of Risk Management and Insurance Services has the responsibility to review and approve the insurance submitted by the agency. 1. New Applications The application (Attachment A) is to be completed on both sides by the requesting agency. New requests must be submitted for approval at least 60 days prior to the proposed start date. a. The following documentation is to be included with application: 1. Evidence of advertisement of student fee waiver for at least 25 percent of participants 2. Fee schedule 3. Copy of nonprofit designation 4. Certificate of Insurance meeting insurance coverage and limits with named additional insured status. 5. Copy of Department of Social Services license (for child care programs only) 6. Agency operation rules and regulations, including signin/sign-out requirements 7. Incorporation papers (for parent groups only) b. The application and documentation are then reviewed and approved by the following personnel: 1. School Principal approves and sends to the Local District Superintendent 2. Local District Superintendent or designee office approves and sends to the Assistant Superintendent 3. Assistant Superintendent or designee approves and sends to the Leasing & Asset Management Branch Director 4. Leasing & Asset Management Branch Director or Designee approves and sends to the Division of Risk Management and Insurance Services Director BUL Page 4 of 5 June 16, 2008
5 5. Division of Risk Management and Insurance Services Director or Designee approves and advises Leasing & Asset Management Branch Director or Designee 4. Application Renewal Requests for continuing programs must be submitted at least 60 days prior to the proposed start date. The Agreement for the use of the school must be issued and executed by the Leasing & Asset Management Branch prior to occupancy of the requested school. Insurance compliance must be met and approval obtained from the Division of Risk Management and Insurance Services Director. a. The following documentation is to be included with application: 1. 7 BULLETIN TERMS AND CONDITIONS OF USE NOTE: SUBMITTAL OF THIS APPLICATION DOES NOT GRANT YOUR AGENCY A LICENSE TO BE ON CAMPUS. NO GROUP CAN OCCUPY AN LAUSD CAMPUS WITHOUT FIRST OBTAINING A LICENSE AGREEMENT ISSUED BY THE LEASING & ASSET MANAGEMENT BRANCH OF THE LOS ANGELES UNIFIED SCHOOL DISTRICT. This is a cost-incurred license based upon certain assumptions related to the cost of the program. The Los Angeles Unified School District requires the following certification: I certify that any money derived in excess of the cost of operation of the child care or enrichment program for which I have applied shall be returned to the program to reduce the cost to participants. District-sponsored programs, including but not limited to intervention, summer school, tutoring and national school lunch program, will supersede these terms and conditions.
