4 Terms and Conditions 1. Please read these terms and conditions carefully before completing and returning your booking form. Once a completed booking form has been accepted in writing by Pathfinder-UK all persons (here after are to be known as participants) named on the booking form will have entered into a binding contract on the basis of these terms and conditions. If you have any questions please do not hesitate to contact us. 2. Pathfinder-UK courses/team-building/workshops/training/camps/events/excursions and demonstration (s) here after are to be known as courses. 3. Whilst Pathfinder-UK uses its best endeavours to ensure the accuracy of all information supplied, details of all courses are given in good faith, Pathfinder- UK gives no warranty as to their accuracy and does not accept any responsibility or liability for any loss or damage resulting from information given or statements made weather orally or in writing. 4. Pathfinder-UK gives no guarantee/warranty to the state/condition of the land owner s property on which Pathfinder-UK conducts its courses. Nor will Pathfinder-UK be liable either for any act/default on part of the owner (s) or any other person (s) or breakdown of any property (ies), nor for any accident (s), damage, loss, injury (s), expense or inconvenience whether to person/property which the participant (s) or any other person (s) may suffer/incur. 5. Pathfinder-UK states that woodlands and other habitats are potentially dangerous places and it is the responsibility of Pathfinder-UK to alert the participant (s) to these possible dangers. Whilst it is impossible to list all such hazards and dangers. Pathfinder-UK have detailed below those, which, in the opinion of Pathfinder-UK require the most specific care and attention. i. Falling deadwood. There may be a risk of falling deadwood, especially in windy and/or wet weather conditions. ii. Pathfinder-UK, further points out the potential dangers of some other creatures such as insects and some plants. No plant shall be touched or eaten by the participant (s) without the express permission of Pathfinder-UK. iii. Many twigs/branches are at eye level and can be overlooked, particularly in dense conditions/especially in poor light. iv. Log piles should not be moved, clambered upon or interfered with in any way whatsoever as they can become unstable and fall without warning, causing server injury and risk of death. v. Burrows can cause unexpected subsidence of the forest floor. Tree roots/stumps protrude above ground which may cause injury. vi. No unauthorised fires are allowed without the express permission of Pathfinder-UK. Even if authorised by Pathfinder-UK, no fire shall be left unattended at any time and adequate means of fire fighting must be provided and available at the site of any such fire at all times. vii. Pathfinder-UK insists that only knives that have a fixed blade may be used. All other knives are not to be used whilst under instruction of Pathfinder-UK, under instruction shall be deemed from the start time and the end time of a course run by and as detailed by Pathfinder in the course joining instructions. viii. Pathfinder-UK recommends that the participant (s) seek to attend a recognised first aid course and provide themselves some personal accident insurance. 6. Participant (s), state they are fully aware that courses even under the safest conditions possible, may present a risk (s). Whilst Pathfinder-UK will take every precaution possible to ensure a safe environment as is reasonably possible the participant (s) hereby agree to accept full responsibility and assume all risk including those caused by his/her person and/or property, knowingly and voluntarily. 7. The participant (s) agrees to obey the rules & regulations put into effect by Pathfinder-UK to minimise risk to Health & Safety. 8. Pathfinder-UK reserves the right to remove any participant (s) from its courses, if the participant (s) conduct is abusive or deemed inappropriate or they present a risk to Health and Safety. 9. The participant (s) knowingly, voluntarily and irrevocably waives any and all past, present and/or future claims, demands and courses of action which the participant (s) now has or may have in the future against all officers, employees, agents, instructors, and/or other participants while on the premises of Pathfinder-UK or premises hired to Pathfinder-UK for the purposes of instruction, for any and all past, present, and/or future injuries, death, loss including those received while participating in activities conducted by Pathfinder-UK, as a student, participant, spectator, and/or visitor, or in any other manner or form, taking part in courses. 10. The participant (s) certifies that he/she is physically capable to participate in courses run by Pathfinder-UK despite the rigours and risks that may be inherent in such an undertaking. 11. Pathfinder-UK reserves the right to alter dates and or location of courses if this becomes necessary, Pathfinder-UK will endeavour to inform relevant parties as soon as possible. 12. The participant (s) accepts that the balance of all fees must be paid in full 4 weeks prior to any courses commencement date. Bookings made within this period must be accompanied by payment in full, unless otherwise agreed by Pathfinder-UK in writing. 13. If full payment is not received Pathfinder-UK reserves the right to treat the agreement as cancelled by the participant (s) pursuant to clause The participant (s) is/are aware, that cancellation by the participant (s), for any reason, will incur the forfeit of the agreed deposit in full. The deposit can be reallocated to another course if the cancellation is made 4 weeks prior to the course for which it was originally intended. A cancellation of the second course where the deposit has been reallocated will forfeit the deposit. The participant (s) acknowledges that it is reasonable for such penalties to arise, given the need for Pathfinder-UK to make preparations for the course in advance of any courses. 15. A cancellation after 4 weeks prior to the commencement of a course will incur a charge of 100% of the course fee. 16. Whilst every effort is made to limit prices to those given in the booking form and or other documentation, Pathfinder-UK reserves the right to alter prices should costs in hosting courses increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport and materials). In the event that a price is altered the participant (s) will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as was the original price. In the event of a price increase the participant(s) may opt to cancel the booking and will then be entitled to a full refund of all monies paid to Pathfinder-UK. 17. In the unlikely event that a participant (s) has cause for complaint, Pathfinder-UK would appreciate that it is brought to the attention of a Pathfinder-UK representative during the course attended in order that corrective action can be taken. However, should a problem not be resolved, a complaint should be made in writing within 28 days of the course completion date. To the extent permitted by law Pathfinder-UK will not be liable in respect of claims first intimated later than 28 days from the close of the relevant course. 18. The person signing the booking form shall be deemed to sign that form for his/herself and as an agent for all others persons/parties listed on that form/nominal roll and is acting for and on behalf of all persons including those substituted or who join the party at a later date as participant (s) and or visitor (s) and warrants that he/she is appointed agent for that purpose. 19. The person signing the booking form is responsible for ensuring that all persons in the package comply with the terms and conditions in all aspects. 20. Any dispute arising out of these terms and conditions shall be dealt with exclusively under and subject only to English Law.
