Onsite parking lot RFP SUBMITTAL DUE DATE Date / Time: December 3, 2018 at 2:00 p.m. PST Submit to: Planning & Construction Department Location: North of the River Recreation and Park District 3825 Riverlakes Drive Bakersfield, California PROFESSIONAL LAND SURVEYER: Service Providers wishing to submit a proposal in response to this RFP must have appropriate licensure as a Licensed Surveyor or Registered Civil Engineer pursuant to the requirements of Chapter 15, California Business and Professions Code, beginning at section 8700 et. seq., as well as any other license(s) required under law to provide the contractual relationship between the District and the service provider has been posted along with this RFP and contain additional licensing obligations. Prospective Service Providers are urged to familiarize themselves with these obligations.

3 DEFINITION OF TERMS NOR or District: NOR is North of the River Recreation and Park District, it s staff, representatives and/or Board of Directors of Kern County, California. NOR is the Owner whenever Owner is used in request for proposal, request for qualification, bid documents, specifications, contract language and/or on plans. Contractor: The term Contractor used herein or in other sections of the Contract Documents means the person, firm or corporation with whom the Contract Agreement is made by NOR for the performance of work herein described. Subcontractor: Any person, firm, or corporation other than an employee of the Contractor, supplying, for and under agreement with either the Contractor or any subcontractor of the Contractor, labor or materials or both, on or off the site of the Project in connection with this Contract. Interested Entity: A corporation, limited liability company, partnership, joint venture or other legal entity that is able to provide appropriately licensed contracting, architectural and engineering services as needed pursuant to a designated contract. Request for Proposal (RFP): The document and process requesting contractors and/or qualified bidders to submit pricing and required documentation to fit the scope as defined in project specific contract documents. Best Value: a value determined by evaluation of objective criteria that may include, but not limited to price, features, functions, life-cycle costs, experience, past performance and references. A best value determination may or may not involve the selection of the lowest cost proposal meeting the interests of the local agency and meeting the objectives of the project, selection of the best proposal for a stipulated sum established by the procuring agency, or a tradeoff between price and other specified factors. Project: The scope as outlined by the District; in this case, land surveying + civil engineering for the preliminary layout and planning of a park site. SUMMARY PROJECT DESCRIPTION North of the River Recreation & Park District ( NOR ) is requesting proposals from surveying/engineering firms ( Consultant ) for professional land surveying services ( Consultant Services ) for the RiverLakes Ranch Community Park Expansion Project ( Project ). The areas to be surveyed consist of approximately 20 acres adjacent to the existing RiverLakes Ranch Community Park, the existing developed RiverLakes Ranch Community Park at approximately 8 acres (3825 Riverlakes Drive) and approximately 14 acres of Kern High School District ( KHSD ) property known as the southerly portion of Centennial High School (8601 Hageman Rd) located (nearest cross streets being Riverlakes Drive at Coffee Rd and Hageman Rd). The topographic survey data obtained will be utilized by NOR Planning staff to prepare design plans and specifications for the Project. Consultant must be able to demonstrate previous experience with the type of work described herein. The submitted Proposal should include the firm s qualifications, project team, resumes, detailed scope of services/tasks, schedule and not-to-exceed costs for completing the tasks specified below as described in the Scope of Services/Tasks.

4 Background: The property that is held by North of the River Recreation and Park District (NOR) was acquired in April 2000 and had been part of many community park discussions as early as As part of the Laborde Master Plan, renamed RiverLakes Ranch, multiple public spaces including a golf course, interconnected lakes, community center, pool and a large community park were, and are, the heart of a 1,900 acre master planned community. The first phase of RiverLakes Ranch Community Center and Park was originally completed and open to public use in June The North of River Recreation and Park District Administrative Complex broke ground in January 2017 as a building expansion on the existing community center, completing a 36,000 square foot building footprint. The relocation of all administrative activities to one central site in November 2017 optimizes District operations and centralizes the main office within the District. For the last ten years, NOR has analyzed and planned for the development of the whole RiverLakes Ranch property, serving community interests, recreational needs and planning for future District activities. With the passing of Proposition 68, The California Drought, Water, Parks, Climate, Coastal Protection and Outdoor Access for All Act of 2018, the opportunity has presented itself for park expansion. An initial concept has been formulated and shall be refined within the next few months guided by community meetings, recreational needs and the NOR Master Plan. As part of this process, the need for an updated map of the entire park site and the potential for a joint-use agreement between NOR and the Kern High School District warrants a complete site survey for use in the improvement of the land. An exhibit indicating the extent of the required survey and the required NOR insurance policies with coverage limits are included in the Appendix. The selected Consultant will have to provide a Certificate of Insurance in conformance with these requirements. All RFP recipients are encouraged to visit the Project Site to gain a better understanding of the current conditions, constraints, etc. and to verify that no tasks have been omitted. Scope of Services/Tasks: The following services/tasks at a minimum, but not limited to, will need to be provided: 1. The written legal description of the property and Exhibit for recording purpose, separated by property owner (i.e. one legal description for NOR, one for KHSD). 2. Legal description and Exhibits for any easements where required. 3. The date or time period of the survey. 4. Show boundary lines and found property corners necessary for boundary tracing. Provide and install missing, damaged or displaced monuments and tag them. Do not move, remove or replace any monuments or benchmarks before notifying the project manager and prior approval. 5. Show dimensions and bearings of property boundaries, and plot all locatable title exceptions and easements on the survey map. Show existence or non-existence of any encroachments and right-of-way. 6. Show location of above and below grade utilities including field-measured elevations of sanitary sewer and storm drains manholes, gas lines, electrical, communications, etc. 7. Show significant trees and shrubs. 8. Provide planning and zoning overlays.

5 9. Provide floodplan, landslide or liquefaction zone overlays. 10. Provide an area measurement within boundary lines. 11. All measurement tolerances provided on such surveys must be within readings for Urban Survey as specified on Accuracy Standards for ALTA/ASSM Land Title Surveys. 12. Show Parking spaces count and types, road mapping, bore holes locations. 13. When a significant discrepancy with the record maps and documents are found or if compliant with Section 8762 of the Land Surveyors Act (Chapter 15 of the State Business and Professions Code). 14. Final Survey Report with 1 hard copy and a soft copy on CD, USB flash drive or approved digital format in Auto-CAD format. 15. Final documents shall include all of the required information and be certified in and where by law and/or requested by the Owner, recorded with the County Recorder. 16. All Land Surveyors must be performed by, or under the direct supervision and with the review and approval of, a registered professional land surveyor who must at all times during which a survey is being performed be licensed in the State of California by the board for Professional Engineers and Land Surveyors Act amended and effective as of January 1, Prospective Service Providers shall provide a list of the names of all licensed individuals currently on its staff that prospective Service Provider intends to use to provide Land Surveys or any of the other related services cited in your Proposal. 17. If applicable law dictates that the selected Service Provider itself be licensed in any form for the provision of any service contemplated under this RFP and proposed to NOR via its Proposal, the selected Service Provider is required to provide proof of such licensing in its Proposal (see Attachment B). Validity of licensing will be checked prior to entry into a contract with NOR. 18. A draft format of all documents shall be issued for customer s review and approval. a. All firms may not be capable of providing the above noted services. If your firm is capable and willing to provide any of the above services, a complete description of the nature of the service you provide must be provided in your Proposal. b. All Selected Service Providers shall in addition be responsible: c. 1. For coordinating work with NOR. 2. For keeping Owner s Representative informed of all the activities being undertaken under a survey. 3. For minimizing disturbance to the users of the site surveyed throughout the survey process. 4. For providing the Services in a safe manner and in accordance with Cal-OSHA guidelines. d. The selected Service Provider shall provide the services hereunder in accordance with the requirements of the following agencies, laws, rules and regulations. In the event of conflict between the requirements, the most stringent requirement shall prevail: ALTA (American Land Title Association, 2005)/ ACSM (American Congress on Surveying and Mapping, 2005) NSPS (National Society of Professional Surveyors) CAL OSHA (Occupational Safety & Health Administration) CALTRANS (California Department of Transportation) DCA (California Department of Consumer Affairs)

6 FGCS (Federal Geodetic Control Subcommittee) FEMA (Federal Emergency Management Agency) TSSS (Total Station Survey System-Caltrans) Professional Land Surveyors Act, State of California, Amended 2010 Project Schedule: It is anticipated that this contract will be awarded at the December 17, 2018 NOR Board of Directors meeting. It is anticipated the agreement between the selected Consultant and NOR will be executed to allow for commencement of work on or around December 19, The contract completion date shall be no later than January 31, Anticipated Target dates for various tasks are listed below: December 19, 2018 Anticipated executed contract date and notice to proceed January 18, % final draft CAD drawings to NOR for NOR review January 18 th 23 rd, 2019 NOR review of CAD drawings/survey data January 23 rd 30 th, 2019 Consultant addresses NOR review comments January 31, 2019 Contract completion date. Final CAD drawings due to NOR Owner The contract will be jointly administered through North of the River Recreation and Park District and the Kern High School District. General Information NOR shall not be held responsible for any oral instructions. Any changes to this RFQ will be in the form of an addendum, which will be furnished on the NOR website: Print copies are available by contacting Ryan La Febre at NOR reserves the right to reject any or all proposals/rfps, to waive any informality or irregularity in any RFP received, and to be the sole judge of the merits of the respective RFPs received. RFP SUBMITTAL REQUIREMENTS The interested entities are hereby notified of requirements by California Department of Industrial Relations for the registration of contractors and subcontractors; project compliance monitoring and enforcement by the Department of Industrial Relations; as well as posting of job site notices prescribed by regulation, pursuant to California Labor Code part 7, Chapter 1, Article 2, Sections , and In order to be considered responsive to the RFP, firms interested in providing surveying and engineering services must submit all the information requested below. Any portion of an NOR submittal considered exempt from disclosure under the Public Records Act should be clearly marked and accompanied with an explanation of the legal authority supporting this assertion. Preparation of Proposals All proposals must be signed by an authorized official. Proposals that contain omissions, erasures, alterations, or additions not called for, conditional or alternate bids unless called for, or that contain irregularities of any kind may be rejected. All reimbursable expenses including office supplies and travel expenses as well as a schedule of estimated man-hours/rates shall be included within the overall not-to-exceed cost.

7 The RFP shall include a one-page cover letter plus a maximum of fifteen (15) pages at 12-point font to address the RFP criteria specified in the narrative. Table of Contents, required forms, and section divider pages do not count toward the total page count. Resumes for each key team member shall be limited to no more than two pages. Either duplex or single-sided documents are allowed. All required forms shall be single sided. Adherence to the maximum page criteria is critical; each page side (maximum 8 ½ x 11 ) with narrative information will be counted. Pages that have photos, charts and graphs shall be clearly labeled and included within RFP. Appendix A will be counted toward the maximum thickness of the section. Failure to comply with the following criteria may be grounds for disqualification: Receipt of submittal by the specified cut-off date and time. The number of originals and/or copies of the submittal specified. Adherence to maximum page size/count/thickness requirements. Required Information Cover Letter: One-page maximum on company letterhead, containing at a minimum: firm name, contact name, address, phone number, fax number and address with the subject line containing the project number and project name. Statement of Qualifications General Information: Form shall be filled in as depicted. Any section left blank may be grounds for disqualification. If a section is not pertinent to the applicant, state Not Applicable and provide an explanation on following page provided. Insurance Requirements: Firms shall provide evidence of insurance, as described below. The certificates must be approved as to limit, form and amount by NOR. Statement of Qualifications Insurance Requirements sheet provided shall be included as cover sheet to required paperwork. Commercial General Liability ( CGL ; bodily injury, property damage, personal injury, advertising injury, products and completed operations) with a single limit of not less than $1,000,000 for a single occurrence; $2,000,000 aggregate and Vehicle Liability with a single limit of not less than $1,000,000 for a single occurrence. The vendor s insurance shall be primary as respects to any loss or liability arising directly or indirectly from the insured s operations. North of the River Recreation and Park District shall be listed as the certificate holder and as an additional insured by endorsement. Workers Compensation and Employer s Liability covering all persons whom the Contractor may employ in carrying out its services. Evidence of errors and omissions insurance for all professional/service companies. Workers Compensation and Safety Record: Interested Entity shall provide information concerning worker s compensation experience history and a worker safety program. Interested Entity shall also provide an acceptable safety record. A proposer s safety record shall be deemed acceptable if its experience modification rate for the most recent three-year period is an average of 1.00 or less, and its average total recordable injury or illness rate and

8 average lost work rate for the most recent three-year period does not exceed the applicable statistical standards for its business category or if the proposer is a party to an alternative dispute resolution system as provided for in Section of the State of California Labor Code. Workers Compensation and Safety Record sheet provided shall be included as cover sheet to required paperwork. Surveying & Engineering Team: Form shall be filled in as depicted. Firm shall list a consultant and an alternate for each professional/service company shown. Any section left blank may be grounds for disqualification. If a section is not pertinent to the applicant, state Not Applicable and provide a short, in-line explanation. Applicant shall complete additional forms for consultants which trades are not specifically listed, applicable to the project whom will be utilized as part of the Surveying & Engineering Team. Provide resumes for each of the key Surveying & Engineering Team, including Project Architect(s), Project Engineers, Project Consultant(s), and Project Manager(s), etc. herein described as Exhibit B. Resumes for each key team member shall be limited to no more than two pages. Proposed Subcontractors Form: Each Interested Entity shall set forth: (a) the required information for each Subcontractor who is anticipated to perform work or labor, fabricate a portion of the Project according to the Project Summary and/or a typical Project of similar scope or render service to the Interested in an amount in excess of one-half of one percent (½ of 1%) of the estimated project cost; and (b) the portion of the Project which will be done by each such Subcontractor. Narrative: Firm shall provide typed responses, providing no more than ten pages, to the following questions, herein described as Exhibit C. The provided sheet shall serve as a cover page for the Exhibit. Relevant Firm Experience Briefly describe each of the previously executed projects listed in the General Information form; include your firm s role, date construction commenced and completed (if applicable). For each project, include: contract value and construction value (original value plus contract amendments, if applicable); discuss contract amendment history, if applicable. Describe any litigation, arbitration, claims filed by your firm against any project owner as a result of a contract dispute, any claim filed against your firm, termination from said project; describe how each project is similar in size and scope to the proposed project. Describe any prior public works project(s) completed within the last five years. Project Management Describe you understanding of the Project. Identify and discuss any potential problems during survey and design. Identify and discuss methods to mitigate those problems. Describe your approach to change orders. Describe your quality control plan, dispute resolution and safety management policies.

9 Administration Applicant s capacity and intent to proceed without delay if selected for this work. List any concurrent commitments of the key individuals in your team during the design and construction of this project. Willingness to abide by NOR s standard form Agreements (see RFP Appendix B) with few or no objections or changes. Relevant factors impacting the quality and value of work. Non-Collusion Affidavit Provide statement regarding your assurance that this engagement will not result in a conflict of interest. Complete the Non-Collusion Affidavit. RFP EVALUATION PROCESS A panel consisting of District representatives will evaluate the RFP submittals. The opinion of the panel is final. Respondents will be notified of the panel s decision within two weeks after the RFP submittal due date. The evaluation process will consider the following criteria. The panel will score each criterion on a five-point scale (5 is the best score), and weighted relative to the multipliers noted to the left of each criterion. At the sole discretion of the panel, the RFP submittals will be reviewed by the Best Value approach, based on scores and evaluations of the following table. The District reserves the rights to further expand or limit the number of RFP submittals selected as finalists and/or award the contract. WEIGHT QUALIFICATIONS TO BE EVALUATED 20% Demonstrated breadth of experience during the past 5 years in actually performing the land surveys and the other related services requested in this RFP that the prospective Land Surveyor & Engineer proposes to actually provide to the District. Includes experience with parks, schools, public agencies and, if any, with government entities. 45% Price of services offered. 15% Demonstration that the prospective Land Surveyor & Engineer has actually provided high quality accurate land surveys including maps and plats, and has in fact provided the other related services it proposes to provide in its Proposal. 10% Demonstration that prospective Land Surveyor & Engineer actually has an effective quality control program in place and operational. 10% Breadth of Geographic Area in which prospective Service Providers will commit to providing Land Surveys and related services to the District. The submitted proposals will be reviewed and selected based upon factors in this RFP and including the following: (1) Experience on similar projects with references (name, title, address, phone, & fax numbers) within the last five years only; (2) Firm Information (size, location, history, resources, etc.); (3) Qualifications (resumes) or personnel assigned to work on the project (project team), organizational chart, etc.;

10 (4) Ability to meet project deadlines (availability of staff to perform services); (5) Completeness of project approach (detailed scope of services/tasks, etc.); (6) Any additional services/tasks not identified in this RFP that the consultant believes will improve the project, reduce costs and time, etc.; (7) NOR staff s prior experience working with the Proposer; and (8) Overall not-to-exceed cost Follow-up discussions may be conducted with several firm(s) to resolve any questions, finalize the scope of work and service agreement on final not-to-exceed cost as a means to recommend final selection to the Board of Directors if necessary. RFP SUBMITTAL PROCEDURE Sealed proposals will be received until 2:00 pm local time on December 3, Proposals shall be delivered to NOR s Administrative Complex which is located at: North of the River Recreation & Park District Attention: Planning & Construction Department 3825 Riverlakes Drive Bakersfield, CA Proposals received after the time specified above will be unopened. Please submit two (2) bound paper copies in a sealed envelope plainly marked as follows: Proposal for Professional Surveying Services RiverLakes Ranch Community Park Consultant s full legal name Clarifications & RFI s NOR reserves the right to make clarifications, corrections, or changes in the RFP at any time prior to the time proposals are opened. Questions and requests for information must be submitted before 5:00 p.m. local time on November 27, 2018 to Bid Administrator at bids@norrecreation.org. All prospective Consultants will be informed of said clarifications, corrections, or changes via an addendum posted to the NOR website with notification. All proposals submitted must acknowledge receipt of all addenda issued by NOR. RIGHT TO REJECT RFP SUBMITTALS The District reserves the right, at its sole discretion, to reject all RFP submittals and to waive any nonmaterial defects in any RFP submittal.

11 QUESTIONS Questions shall be submitted on the form attached as Appendix A to Bid Administrator by at bids@norrecreation.org with subject heading RL No phone or direct communication regarding response to the RFP is permitted. An RFP Respondents Conference has been scheduled to provide an opportunity for direct questions. Answers to all questions will be published as Addenda to the RFP and distributed on the NOR website by November 28, 2018 at 5:00 p.m. PST. Written questions submitted through November 27, 2018 at 5:00 p.m. PST are assured a response, questions received after that date will be answered at the discretion of the District. 18 To: NORTH OF THE RIVER RECREATION AND PARK DISTRICT SECTION BID FORM Name of Bidder: Business Address: Business Telephone: Place of Residence: The work to be done is in the State of California, County of Kern, and is to be pursuant to and in accordance with the Plans and Specifications, General Conditions, Special Provisions, Contract and other Contract Documents referred to in the notice published by NOR and shall consist, in general, of: The undersigned, as Bidder, declares: That only persons or parties interested in this Proposal as principals are those named herein; the Bidder has no connection with any other parties bidding on the proposed Work (except for a corporate division of the undersigned which may submit an independent bid); that this bid has been prepared and submitted without any collusion, fraud, misrepresentation, or deceit; the Bidder has examined carefully the location of the proposed Work, the proposed form of Agreement and the Plans and Specifications hereinabove referred to; Bidder agrees that if this Proposal is accepted by the NOR s Board of Directors, Bidder will contract with NOR, provide all necessary machinery, tools, apparatus and other means of construction, and do all work and furnish all the materials specified in the above documents in full accordance with the Contract Documents (all within the Contract completion time provided by or agreed to by NOR) and that the Bidder will accept as full payment the amounts set forth in Exhibit A attached hereto. For each item contained in Exhibit A, the Extension Price has been calculated by multiplying the Estimated Quantity by the Unit Price. The Bid Total is the sum of all Extension Prices. Bidder agrees that in case of any discrepancy between the Unit Price(s) and the respective Extension Prices (s) and/or the Bid Total, the Unit Price(s) shall prevail, and the bid submitted shall be the correctly computed sum of all correctly computed Extension Prices provided. However, if the amount set forth as a Unit Price is unintelligible or omitted, then the amount set forth in the Extension Price column for the item shall be used to determine the correct Unit Price in accordance with the following: (1) As to lump sum items, the amount set forth in the Extension Price column shall be the Unit Price. (2) As to unit basis item, the amount set forth in the Extension Price column shall be divided by the estimated quantity for the item and the price thus obtained shall be the Unit Price. If this Proposal is accepted and the undersigned fails to execute the aforesaid Contract and to provide surety bonds and evidence of insurance acceptable to NOR as required within fifteen (15) calendar days after the Bidder receives notice that the Contract is ready for signature, NOR s Board of Directors may, at its option, determine that the Bidder has abandoned the Bid Proposal and the Bidder s security shall be forfeited and shall become the property of NOR. NOR shall then be free to accept the Bid of another Bidder.
