The matter was successfully resolved at the commencement of trial. Successfully advised senior executives in the negotiations with Deutsche Bank after the original developer of the Cosmopolitan Casino Resort in Las Vegas, NV defaulted, and the bank took over the project. Developed and implemented company s information management policy and procedure and information management department to address auditor s concern with respect to preservation of company documentation, including electronic documents and s. Policy and procedure was later challenged at trial during a spoliation dispute. After a +1-year trial, judge ruled in favor of the company. Successfully resolved multiple +$40M construction defect cases with plaintiffs and company s carriers who contested coverage. Successfully resolved multiple employee actions against the company and certain senior executives. Successfully managed risk management department and associated claims mitigation/management efforts during a 4-year time period where the company completed in excess of $10B of projects with less than $2M of general liability claims. Successfully worked with the company s IT department to review, select and implement systems to manage company electronic information and

6 s. Implemented company owned platforms to manage e-discovery efforts in a cost-efficient manner. While a project engineer in 1996, developed a computer system to track the placement of concrete on a +200,000 C.Y. concrete project to ensure concrete crews remained on budget. System is still used by project management personnel to track concrete quantities on large selfperformed concrete operations. Successfully represented two ENR Top 50 contractors on large claims against DFW Airport following 9/11. Successfully represented ENR Top 5 contractor against the Southern Nevada Water Authority in relation to the design and construction of the Lake Mead pump stations and water treatment plant.
