2 COMMISSION IMPLEMENTING DECISION of on the Annual Action Programme 2016 for Nuclear Safety Cooperation to be financed from the general budget of the Union THE EUROPEAN COMMISSION, Having regard to the Treaty establishing the European Atomic Energy Community, Having regard to Council Regulation (EURATOM) No 237/2014 of 13 December 2013 establishing an Instrument for Nuclear Safety Cooperation 1 (hereinafter referred to as "INSC") and in particular Article 7(1) thereof, Whereas: (1) The Commission has adopted the Nuclear Safety Strategy Paper and the Multiannual Indicative Programme for the period , points 1 (1), (2) and (3) of which provide for the following priorities: (a) (b) (c) promotion of an effective nuclear safety culture and implementation of the highest nuclear safety and radiation protection standards, and continuous improvement of nuclear safety; responsible and safe management of spent fuel and radioactive waste (i.e. transport, pre-treatment, treatment, processing, storage and disposal), decommissioning and remediation of former nuclear sites and installations; establishment of frameworks and methodologies for the application of efficient and effective safeguards for nuclear material in third countries. (2) The objectives pursued by the Annual Action Programme 2016 to be financed under the Instrument for Nuclear Safety Cooperation are to enable beneficiary countries to improve the safety of their nuclear installations and their operations. (3) The Annual Action Programme 2016 is constituted of eleven actions: 1. "Enhancing the capabilities of the Armenian Nuclear Regulatory Authority Support to the Nuclear Operator of Armenia Provision of on-site assistance to the Armenian nuclear power plant". The expected outcome is to enhance the capabilities of the Armenian Nuclear Regulatory Authority (ANRA), and Armenia more generally, in improving the regulation of nuclear installations' safety and to provide assistance to the Operator of ANPP in order to promote nuclear safety and in particular to assist during the implementation of safety enhancement measures decided after the completion of the EU stress tests; 2. "Support and assistance to strengthen the capabilities of the Belarusian Nuclear Regulatory Authority". The objective of this project is to strengthen the capabilities of the Belarus nuclear safety regulator (GosAtomNadzor) in regulatory assessment OJ L 77, , p. 109 C(2014) 3763 of C(2014) 3764 of EN 2 EN

3 of the nuclear power plant under construction, commissioning and trial operation concerning complex and specialised regulatory activities related to nuclear safety; 3. "European Commission Contribution to the Chernobyl Shelter Fund on behalf of the European Union". The objective of the action is the EU contribution to the EBRD (European Bank for Reconstruction and Development) Chernobyl Shelter Fund in order to close the current financial gap for the completion of the projects under Shelter Implementation Plan (SIP); 4. "Enhancing the capabilities of the Iranian Nuclear Regulatory Authority (INRA)". This action is the EU contribution to the implementation of Annex III of the Joint Comprehensive Plan of Action (JCPoA) agreed between the E3+3 and Iran in July The objective of this action is to enhance the capabilities of the Iranian Nuclear Regulatory Authority (INRA), and support the implementation of the EU stress tests of the Bushehr Nuclear Power Plant in accordance with the EU stress test methodology; 5. "Support to the Management of the Instrument for Nuclear Safety Cooperation (INSC) in Ukraine". The action continues the existing assistance to the governmental organisations and local stakeholders involved in the project cycle management of the INSC nuclear safety programme in Ukraine; 6. "Enhancing emergency preparedness and response (EP&R) in ASEAN for radiological and nuclear emergencies through regional cooperation: technical support for decision making". The objective of this action is to enhance preparedness and response (EP&R) for radiological and nuclear emergencies in ASEAN countries through regional cooperation; 7. "Multinational and regional Training and Tutoring for experts of the National Regulatory Authorities and their Technical Support Organisations for developing or strengthening their regulatory and technical capabilities". The objective of this action is the provision of training and tutoring to the staff of the Regulatory Authorities and their Technical Support Organisations in the partner countries; 8. "Support to the Regulatory Authority of Turkey". The proposed action aims to strengthen the managerial and technical capabilities of the Nuclear Regulatory Authority in Turkey; 9. "Emergency Measures for the Prydniprovskiy Chemical Plant". The action will implement a number of urgently required safety improvement measures, at the former Uranium Processing Plant, Pridneprovskiy Chemical Plant, which is located at Dneprodzerzhinsk in Ukraine. The emergency measures are required to improve the immediate safety of workers and local citizens, as well as the security of a number of radiological hazards located around the site; 10. "Support measures 2016 for the INSC management" The support measures will be used as a framework for funding activities under the Instrument for Nuclear Safety Cooperation (INSC). Such measures (audits, evaluations, identifications, studies, meetings, information sessions, special events for awareness-raising, publications, training activities and any other administrative or technical assistance expenditure, including interests for late payments, etc.) contribute to the sound management of the programme, to the achievement of its expected results and objectives and to the measurement, analysis and reporting on the impact; 11. "Technical support by the Joint Research Centre for the project cycle management of nuclear safety projects". The overall objective of this project is the provision of technical and scientific expertise, know-how and other forms of technical and scientific support to Commission services for nuclear safety projects of the INSC programmes, in order to support and assist DEVCO in ensuring an efficient and EN 3 EN

4 effective INSC programme preparation and successful project preparation, tendering, contracting and implementation. (4) It is necessary to adopt a financing decision the detailed rules of which are set out in Article 94 of Commission Delegated Regulation (EU) No 1268/ (5) The Commission should be able to entrust budget-implementation tasks under indirect management to the entities specified in this Decision, subject to the conclusion of a delegation agreement. In accordance with Article 60(1) and (2) of Regulation (EU, Euratom) No 966/2012, the authorising officer responsible needs to ensure that these entities guarantee a level of protection of the financial interests of the Union equivalent to that required when the Commission manages Union funds. (6) The EBRD is currently undergoing the assessment under Regulation (EU, Euratom) No 966/2012. In anticipation of the results of this review, the authorising officer responsible deems that, based on the entities positive assessment under Council Regulation (EC, Euratom) No 1605/2002 and on the long-standing and problem-free cooperation with them, budget-implementation tasks can be entrusted to these entities. (7) It is necessary to allow the payment of interest due for late payment on the basis of Article 92 of Regulation (EU, Euratom) No 966/2012 and Article 111(4) of Delegated Regulation (EU) No 1268/2012. (8) The measures provided for in this Decision are in accordance with the opinion of the Nuclear Safety Cooperation Committee set up under Article 11 of the Regulation (Euratom) No 237/2014, HAS DECIDED AS FOLLOWS: Article 1 Adoption of the measure The following Annual Action Programme 2016 for Nuclear Safety Cooperation to be financed from the general budget of the European Union, as set out in the Annexes, is approved. The programme shall include the following actions: 1. A3.01/16 A1.01/16 Enhancing the capabilities of the Armenian Nuclear Regulatory Authority - Support to the Nuclear Operator of Armenia Provision of on-site assistance to the Armenian nuclear power plant; 2. BY3.01/16 Support and assistance to strengthen the capabilities of the Belarusian Nuclear Regulatory Authority; 3. European Commission Contribution to the Chernobyl Shelter Fund on behalf of the European Union; 4. IRN3.01/16 Enhancing the capabilities of the Iranian Nuclear Regulatory Authority (INRA); 5. U4.01/16 Support to the Management of the Instrument for Nuclear Safety Cooperation (INSC) in Ukraine; 6. REG3.01/16: Enhancing emergency preparedness and response (EP&R) in ASEAN for radiological and nuclear emergencies through regional cooperation: technical support for decision making; 4 Commission Delegated Regulation (EU) No 1268/2012 of 29 October 2012 on the rules of application of Regulation No 966/2012 of the European Parliament and of the Council on the financial rules applicable to the general budget of the Union (OJ L 362, , p. 1). TK3.01/16 Support to the Regulatory Authority of Turkey; 9. U4.02/16 Emergency Measures for the Prydniprovskiy Chemical Plant; 10. Support measures 2015 for the INSC management; 11. REG 01/16 Technical support by the Joint Research Centre for the project cycle management of nuclear safety projects. Article 2 Financial contribution The maximum contribution of the European Union authorised by this Decision for the implementation of this Annual Action Programme is set at EUR to be financed from budget line and of the general budget of the Union for The financial contribution provided for in the first paragraph may also cover interest due for late payment. Article 3 Implementation modalities The implementing measure was submitted to the committee established under the existing basic act for informal consultation. Budget-implementation tasks under indirect management may be entrusted to the entities identified in the attached annexes 3 and 9 subject to the conclusion of the relevant agreements. The section "Implementation" of the Annexes to this Decision sets out the elements required by Article 94(2) of Delegated Regulation (EU) No 1268/2012. Article 4 Non-substantial changes Increases or decreases of up to EUR not exceeding 20% of the contribution referred to in the first paragraph of Article 2, or cumulated changes to the allocations of specific actions not exceeding 20% of that contribution and not representing more than EUR shall not be considered substantial, provided that they do not significantly affect the nature and objectives of the actions.
