5 Treaty on the Functioning of the EU (TFEU) - Article 4.3 Article 4.3 confers upon the EU a shared competence in space. However, it stipulates that the exercise of the EU competence in these areas may not result in Member States being prevented from exercising theirs, excluding thereby the preemptive effect normally caused by the primacy of EU law in the case of shared competences. 5

6 Treaty on the Functioning of the EU (TFEU) - Article 189 (1) Art. 189(1): "To promote scientific and technical progress, industrial competitiveness and the implementation of its policies, the Union shall draw up a European space policy. To this end, it may promote joint initiatives, support research and technological development and coordinate the efforts needed for the exploration and exploitation of space." 6

7 Treaty on the Functioning of the EU (TFEU) - Article189 (2) (3) Article 189 (2) contains an express exclusion of harmonisation of the laws and regulations of the Member States. Article 189 (3) contains a requirement for the EU "to establish any appropriate relations with the European Space Agency. 7

8 2004 Framework Agreement between EU and ESA The agreement provides the general legal framework for the EU-ESA cooperation and institutional relations; Under this agreement concomitant meetings of EU Competitiveness Council and ESA Council are being held regularly. 8

9 2011 Communication Towards a Space strategy for the EU that benefits its citizens (1) Sets out the Commission s vision and main priority areas for EU action in Space; Confirms the priority given to completing Galileo and GMES/Copernicus and outlines also additional areas where EU intervention could add value. 9

10 2011 Communication Towards a Space strategy for the EU that benefits its citizens (2) In addition to confirming priority to GMES and Galileo it sets out priorities and possible line of action for the future EU space policy: Exploitation of the possibilities of European space assets to support the EU s external and internal security policies; Protection of our critical space infrastructures by setting up a European Space Situation Awareness (SSA) system; Continuation to support Space research and innovation as drivers of competitiveness in the larger European economy; Development of Space Industrial policy in close collaboration with the European Space Agency and Member states. 10

The follow up: Communication on the Space Industrial Policy Legislative initiative on Space Surveillance and Tracking (SST) 11

12 2012 Communication Establishing appropriate relations between the EU and the ESA Identifies a set of structural issues that need to be addressed on the evolution of EU-ESA relations: Mismatch of financial rules; Membership asymmetry; Asymmetry in security and defence matters; Absence of mechanisms for policy coordination; Missing political accountability for ESA. Proposes a way ahead which, for the long term, means a rapprochement of ESA towards the EU. Several options are considered and will be further analysed. 12

14 2013 Commission proposal for a Decision Establishing a space surveillance and tracking (SST) support programme An SST system would allow monitoring the position of satellites and space debris and tracking their movements in order calculate the risk of collisions and warn satellite operators. informing European and national services concerned with civil security about the risks of re-entries of space debris or satellites that are out of function or control into the Earth's atmosphere and the risk of a potential crash into the Earth's surface. Essential tool to ensure the protection of satellite infrastructures including European infrastructures such as Galileo and Copernicus. 14
