2 I. SITUATION ANALYSIS 1. Objective The objective of this project is the preparation of a comprehensive HPMP (Stage-2) for Lebanon, which will incorporate the strategy and action plan for Lebanon for compliance with the post 2015 control targets, which is targeted for submission to the Executive Committee of the Multilateral Fund, at its 75 th Meeting in December Background ODS Phase-out Activities in Lebanon Lebanon is a Mediterranean country with a land area of 10,452 sq. km and a population of about 5.9 million (2014 est.) with an estimated GDP per capita of USD 7,080 in 2013, with the Agricultural sector accounting for 5% of GNP, the industry for 20 % and the service sector for 75 %. Population density is approx. 564 persons per sq km where urban population represents around 88 % of the total population. Lebanon s Country Programme Update was prepared in The Country Programme Update reassessed the ODS consuming sectors in Lebanon including, for the first time, in the south part of Lebanon which was adversely affected by war in the early nineties, reviewed the progress made in ODS phase-out and identified further activities, policies and strategic planning and actions required to complete phase-out of remaining ODS in the country, thus renewing Lebanon HPMP Preparation (Stage-2) UNDP Prodoc Page 2

3 Lebanon s commitment for complying with the Montreal Protocol control targets and obligations. All remaining CFC phase-out actions were addressed through the National Phase-out Management Plan for Annex-A, Group-I Substances (CFCs) in Lebanon (NPMP), which was approved at the 44 th ExCom Meeting in November 2004 as a performance-based agreement with annual consumption and phase-out targets and complete phase-out of all remaining consumption of Annex-A, Group-I Substances (CFCs) in Lebanon before 01 January The CFC consumption reduction schedule proposed in the NPMP is in advance of or in compliance with the control schedule of the Montreal Protocol. Accelerated HCFC Phase-out HCFCs, which have Ozone Depleting Potential (ODP) up to 15% of that of CFCs, are also classified as controlled substances under Annex-C, Group-I of the Montreal Protocol. HCFCs therefore, have use restrictions and would eventually have to be phased-out. The XIXth Meeting of the Parties to the Montreal Protocol in September 2007, through its Decision XIX/6, adopted an accelerated phase-out schedule for HCFCs. The first control is the freeze on production and consumption of HCFCs from 01 January 2013, at the Baseline Level (average of 2009 and 2010 consumption levels). The second control step is the reduction of 10% from the Baseline Levels on January 1, Subsequent control steps are 35% reduction by 2020, 67.5% by 2025, 97.5% by 2030 and complete phase out from January The decision also directed the Executive Committee of the Multilateral Fund to assist Article-5 Parties in preparation of HCFC Phase-out Management Plans (HPMP). As per this decision, Lebanon received funding for HPMP preparation for achieving 2013 and 2015 control targets in the year Lebanon prepared HPMP for Stage-I which was approved in the 64 th Meeting of the Executive Committee and is currently under implementation. For achieving HCFC phase-out control targets for the years after 2015, HPMP Stage-2 preparation funding guidelines were approved by the Executive Committee in the 71 st Meeting of the Executive Committee (Decision 71/42). Based on these guidelines, in the 72 nd meeting and at the request of Lebanon, the Executive Committee (Decision 72/47) approved funding aggregating to USD 150,000 as given below. 4 II. STRATEGY HCFC Phase-out Management Plan for Lebanon The Government of Lebanon has designated UNDP to be the lead agency for the development of the HCFC phase-out management plan in Lebanon. The proposed HCFC Phase-out Management Plan (HPMP) for Stage-2 for Lebanon would need to build on activities undertaken under HPMP of Lebanon in Stage-1 and present a strategy and action plan for achieving post 2015 targets. While the focus of HPMP Stage-2 of Lebanon would be achievement of 2020 targets, the project proposal may contain interventions needed beyond 2020 targets based on national context and priorities, technology evolution in different applications for HPMP and national policies relating to HCFC phase-out. Given the time required for initiation of implementation of HPMP project activities, the targeted date of approval of HPMP Stage-2, would be December HPMP Preparation Process The preparation of the national HCFC phase-out management plan would involve the following broad activities, similar to activities undertaken for Stage-1 preparation: Constituting the national team (Recruitment of International consultant and national Technical Assistance expert (s) and project staff) Consultation meetings with stakeholders (meetings with government agencies for policy review and meetings with industry representatives for sector-level approaches) Information dissemination and industry interaction (sector-level workshops) Data Collection Data Analysis Draft document preparation Stakeholder interactions/consultations (Thematic workshops) Finalization of the HPMP (Stage-2) proposal 1. Constituting the National Team This would cover recruitment of National - Level Technical Assistance consultant (s) and project staff as required. The terms of reference are attached in Annex-II. Consultation Meetings with Stakeholders The consultation meetings with government stakeholders will cover review of existing policy and regulatory framework used under Stage-I and identifying additional interventions needed for post 2015 targets. Specifically, these would relate to HCFC phase-out in SMEs, prohibition of manufacturing specific HCFC consuming products and HCFC phase-out in servicing. 5 The consultation meetings with the industry stakeholders will aim to obtain commitment and cooperation in providing information and active participation in the HPMP preparation process for achievement of post 2015 targets. 2. Information Dissemination This would include the following: - Dissemination of information on HCFC phase-out, particularly alternative technologies, their availability, feasibility, environment impact and costs - Documentation/reports 3. Data Collection/updating Data on industry profiles, baselines, consumption, etc. will be collected for various HCFCconsuming sectors at enterprise level, through national expert(s). The data collection activities will use HPMP Stage-1 preparation survey outputs as the basis and update the data collected earlier. This would include the development of appropriate questionnaires and formats for reporting the information and data collected. The data collected pertaining to date of establishment, Article-5 ownership and exports to non Article-5 countries, would be cross-checked and verified through NOU/MOE whenever required. 4. Data Analysis The data analysis would include the following: Present and historical HCFC consumption by enterprise, sector, sub-sector and application for the period and if necessary, 2014, List of HCFC users segregated by sector/sub-sector, Projected growth trends and required reductions in HCFC consumption for meeting post 2015 targets. 5. Preparation of draft proposal Based on the data collected, sector-wise draft proposals containing sector-specific challenges, opportunities and strategies for compliance with the post 2015 control targets, would be prepared by the national experts and submitted to NOU and UNDP for review and inputs. UNDP will collate and integrate these sector-wise strategies into an overall draft national HPMP (Stage-2) proposal. The draft integrated HPMP (Stage-2) proposal will be prepared focusing on compliance with the post 2015 reduction targets (i.e., 2020 or beyond) and would be forwarded to NOU for circulation among national stakeholders. This would take into consideration commitments already made by Lebanon under HPMP Stage-1 beyond the year Lebanon HPMP Preparation (Stage-2) UNDP Prodoc Page 5

6 6. Stakeholder Consultations The draft HPMP (Stage-2) document will be circulated by NOU to the various national stakeholders for comments. In addition, a national stakeholder consultation workshop will be arranged with participation from all national stakeholders. The comments and recommendations of the stakeholders shall be collected and collated by NOU and sent to UNDP for final revisions. 7. Finalization of the HPMP Proposal (Stage-2) UNDP will incorporate the required revisions and comments into a final draft HPMP (Stage- 2) proposal. The finalized draft proposal will be sent to Government for final approval. Any further revisions, if required, would be done by UNDP. NOU will then arrange for the final government endorsement and the final HPMP (Stage-2) document would thereafter be submitted to the MLF Secretariat through UNDP. 8. RESULTS AND RESOURCES FRAMEWORK The main result expected from this project is the preparation and submission of Lebanon s HPMP (Stage-2) document containing the strategy and action plan for compliance with the 2020 control targets for HCFC consumption. As the project activities are limited to project preparation, no full-fledged strategic results framework is being presented herewith. 9 V. MANAGEMENT ARRANGEMENTS i. Execution Modality The project will be managed in accordance with standard UNDP procedures as support to nationally implemented project (NIM) through its National Ozone Unit at the Ministry of Environment. A letter of agreement will be signed with the Ministry of Environment and UNDP detailing the collaboration arrangements between the two partners and defining the exact roles and responsibilities of each. The UNDP will monitor the progress towards intended results, and will ensure high- Quality managerial, technical and financial implementation of the project, and will be responsible for monitoring and ensuring proper use of administrated funds to the assigned activities, timely reporting of implementation progress as well as undertaking of mandatory and non-mandatory evaluations. Furthermore, the procurement of goods and services and the recruitment of personnel shall be provided in accordance with UNDP guidelines, procedures and regulations The National Ozone Unit (NOU) within the Ministry of Environment (MOE) was established in 1998 by the Government for the overall coordination of ODS Phase-out programme in Lebanon and to act as a national focal point for the implementation of the Montreal Protocol. The NOU regularly seeks the advice of representatives from governmental authorities, NGOs, the private sector and academia. 10 It is proposed to utilize the existing structure for HPMP (Stage-1) preparation with adaptation as needed. Roles and Responsibilities This section outlines the roles and responsibilities of key stakeholders in the activities involved in the preparation of the HPMP (Stage-2). National Ozone Unit (NOU)/Ministry of Environment (MOE) The NOU/NOU will have the following roles and responsibilities in the preparation of the HPMP: Overall responsibility for monitoring and supervision of activities Coordination of activities among various stakeholders Coordination of review of policy/regulatory framework among related Government agencies Validation of enterprise-level, sector-level and national-level baseline HCFC consumption data and reconciliation / comparison with Stage-1 data collected earlier Lebanon HPMP Preparation (Stage-2) UNDP Prodoc Page 10

11 Facilitate industry consultation Communicate and disseminate public information and conduct awareness/outreach initiatives/programmes Review and endorsement of draft and final HPMP Stage-2 document UNDP UNDP has been designated as the Implementing Agency for preparation of the HPMP for Lebanon, by the MoE. The roles and responsibilities of UNDP during the preparation of HPMP (Stage-2) would be as below: Recruitment of expert (s) and project staff as required Support NOU/MOE in ensuring an effective and smooth process in preparation of the sectoral projects/plans/activities and the integrated HPMP (Stage-2); Support NOU/MOE in review and endorsement process on the draft sectoral projects/plans/activities and integrated HPMP, for timely finalization and submission to the ExCom; Provide assistance with policy/regulatory, management and technical support to NOU as and when required Assist NOU in the process of consultations with industries on the technical and logistical aspects of the preparation of the HPMP (Stage-2); Assist NOU and the industries on identification and selection of alternative technologies, technology transfer and related incremental costs; Work in close cooperation and coordination with NOU on finalization of the integrated HPMP (Stage-2); Submit the integrated HPMP (Stage-2) to the MLF Secretariat Undertake consultations and clarifications with MLF Secretariat on HPMP guidelines and HPMP preparation process to facilitate effective preparation; Assist NOU in responding to comments on HPMP from MLF/ExCom International Consultants / National Consultants / National Level Technical Assistance It is proposed to engage a team of international consultants as well national level technical assistance consultants for assisting in the HPMP preparation process, particularly for data collection and analysis. The national team would work under the supervision of the NOU and carry out the data collection and analysis at the enterprise and sector level. iii. Direct Project Costs (DPC) and Management Fees (GMS): The UNDP country office will provide, at the request of the designated institution, the following support services, covered by Direct Project Costs (DPC), for the activities of the project; related description is further detailed in annex III: 1. Payments, disbursements and other financial transactions 2. Recruitment of staff, project personnel, and consultants 3. 12 4. Organization of training activities, conferences, and workshops, including fellowships 5. Travel including visa requests, ticketing, and travel arrangements 6. Shipment, custom clearance, vehicle registration, and accreditation 7. Security management service and Malicious Acts Insurance Policy 8. External access to ATLAS for project managers and other staff, Payroll management services and Medical Clearance Services for all staff The UNDP country office will also provide the following general oversight and management services for the activities of the project which include the following: 1. General oversight and monitoring, including participation in project reviews 2. Briefing and de-briefing of project staff and consultants 3. Resource management and reporting 4. Thematic and technical backstopping However, the General Management Support Services (GMS) fee is managed centrally at BDP-HQ, and is not part of the project budget. It will be credited directly to the CO XB income based on delivery. iv. Audit The audit of NIM projects is made through the regular external (UN Board of Auditors) or internal audits (audits managed by UNDP s Office of Audit and Investigations). v. Visibility UNDP will ensure that the Ministry of Environment and respective donors to the project will receive the maximum visibility possible. UNDP will be responsible for determining when its name and logo are to be displayed and prior written authorisation must be granted by the UNDP Resident Representative on a case by case basis. 13 MONITORING FRAMEWORK AND EVALUATION UNDP CO will undertake periodic monitoring of the implementation progress through regular meetings with the project team. This will allow parties to take stock and to troubleshoot any problems pertaining to the project in a timely fashion and to ensure smooth implementation of project activities. Furthermore, UNDP CO will be responsible for financial monitoring and reporting on all disbursements of the programme, and will ensure continued reporting to the Government of Lebanon/Lebanon Recovery Fund and the Donor Country. Financial disbursements and auditing, as well as the procurement of goods and services, and the recruitment of personnel shall be based on UNDP procedures and guidelines. Monitoring will be a continuous and systematic process review of the various activities and will be intended to (i) measure input, output, and performance indicators; (ii) provide regular and upto-date information on the progress towards meeting the overall Project Objectives; (iii) and alert the implementing partners with problems in implementation, and provide basis on which performance may be improved, and (iv) determine whether the relevant stakeholders are responding as expected. In accordance with the programming policies and procedures outlined in the UNDP User Guide, the project will be monitored through the following: Within the annual cycle On a quarterly basis, a quality assessment shall record progress towards the completion of key results, based on quality criteria and methods captured in the Quality Management table below. An Issue Log shall be activated in Atlas and updated by the Project Manager to facilitate tracking and resolution of potential problems or requests for change. Based on the initial risk analysis submitted (see section VIII), a risk log shall be activated in Atlas and regularly updated by reviewing the external environment that may affect the project implementation. Based on the above information recorded in Atlas, a Project Progress Reports (PPR) shall be submitted by the Project Manager to the Project Board through Project Assurance, using the standard report format available in the Executive Snapshot. a project Lesson-learned log shall be activated and regularly updated to ensure on-going learning and adaptation within the organization, and to facilitate the preparation of the Lessons-learned Report at the end of the project a Monitoring Schedule Plan shall be activated in Atlas and updated to track key management actions/events Annually Annual Review Report. An Annual Review Report shall be prepared by the Project Manager and shared with the Project Board and the Outcome Board. As minimum requirement, the Annual Review Report shall consist of the Atlas standard format for the QPR covering the whole year with updated information for each above element of the Lebanon HPMP Preparation (Stage-2) UNDP Prodoc Page 13

14 QPR as well as a summary of results achieved against pre-defined annual targets at the output level. Annual Project Review. Based on the above report, an annual project review shall be conducted during the fourth quarter of the year or soon after, to assess the performance of the project and appraise the Annual Work Plan (AWP) for the following year. In the last year, this review will be a final assessment. This review is driven by the Project Board and may involve other stakeholders as required. It shall focus on the extent to which progress is being made towards outputs, and that these remain aligned to appropriate outcomes. Donor reporting: The Project will comply with the Donor reporting requirement and submit to the MLF Secretariat the Article 7 ODS Data Report through the UNDP Country Office. Furthermore, a number of timely milestone review events will be undertaken in the presence of project donors, national counterparts and all concerned stakeholders and beneficiaries. These events will include: i) a Project Inception workshop, ii) an Annual Project Board Meeting, and iii) a Terminal Project workshop. Lebanon HPMP Preparation (Stage-2) UNDP Prodoc Page 14

LEGAL CONTEXT This project document shall be the instrument referred to as such in Article 1 of the Standard Basic Assistance Agreement (SBAA) between the Government of Lebanon and the United Nations Development Programme, signed by the parties on 10 February Consistent with the Article III of the Standard Basic Assistance Agreement (SBAA), the responsibility for the safety and security of the Implementing Partner and its personnel and property, and of UNDP s property in the Implementing Partner s custody, rests with the Implementing Partner. To this end, the Implementing Partner shall: a) put in place an appropriate security plan and maintain the security plan, taking into account the security situation in the country where the project is being carried; b) assume all risks and liabilities related to the implementing partner s security, and the full implementation of the security plan. UNDP reserves the right to verify whether such a plan is in place, and to suggest modifications to the plan when necessary. Failure to maintain and implement an appropriate security plan as required hereunder shall be deemed a breach of the Implementing Partner s obligations under this Project Document. The Implementing Partner agrees to undertake all reasonable efforts to ensure that none of the UNDP funds received pursuant to the Project Document are used to provide support to individuals or entities associated with terrorism and that the recipients of any amounts provided by UNDP hereunder do not appear on the list maintained by the Security Council Committee established pursuant to resolution 1267 (1999). The list can be accessed via This provision must be included in all sub-contracts or sub-agreements entered into under/further to this Project Document. 18 ANNEX-I Guidelines for development of HPMP Stage-2 (ExCom Decision 71/42) 155. The Executive Committee decided: (a) To note document UNEP/OzL.Pro/ExCom/71/55 on the draft guidelines for funding the preparation of stage II of HCFC phase-out management plans (HPMPs); (b) That, guided by the need to ensure compliance with the control measures of the Montreal Protocol for HCFC phase-out, in particular the 2020 reduction step, and the need to facilitate continuity of implementation of HPMP activities between stages, requests for project preparation funding for stage II of a country s HPMP could be submitted no earlier than two years before the end date of the approved stage I of its HPMP as contained in paragraph 1 of its Agreement with the Executive Committee, unless otherwise indicated in the decision of the Executive Committee approving stage I of its HPMP; (c) To request bilateral and implementing agencies, when submitting a request for project preparation for stage II of an HPMP, to demonstrate that substantial progress in the implementation of stage I of the HPMP had been achieved, and to provide: (i) For the overall stage II strategy: a. An indication of the activities that needed to be undertaken for project preparation, with specific costs clearly identified (i.e. surveys, consultation meetings, etc.); b. A description of the information that needed to be gathered and updated and an explanation of why it had not been included in stage I; (ii) For investment projects in line with decision 56/16: a. The number of enterprises for which funding was being sought; b. If the request was for a sector where project preparation had been approved for stage I but had not been included in the HPMP already submitted, an explanation of why additional funding was required and a list of activities with corresponding costs to support the request; (d) To provide project preparation funding for stage II of HPMPs for individual countries up to the following levels: (i) US $30,000 for Article 5 countries with remaining HCFC consumption eligible for funding of 0 to 5 ODP tonnes; (ii) US $40,000 for Article 5 countries with remaining HCFC consumption eligible for funding of 5.1 to 10 ODP tonnes; (iii) US $60,000 for Article 5 countries with remaining HCFC consumption eligible for funding of 10.1 to 50 ODP tonnes; (iv) US $70,000 for Article 5 countries with remaining HCFC consumption eligible for funding of 50.1 to 100 ODP tonnes; (v) US $90,000 for Article 5 countries with remaining HCFC consumption eligible for funding of to 1,500 ODP tonnes; (vi) To be decided on a case-by-case basis for countries with remaining eligible consumption above 1,500 ODP tonnes. 19 (f) To provide funding for any Article 5 country with a manufacturing sector using HCFCs that had not been addressed in stage I of their HPMPs, according to the number of manufacturing enterprises to be converted as per decision 56/16(d) and (f), based on their remaining eligible consumption, as follows: (i) One enterprise to be converted in a manufacturing sector: US $30,000; (ii) Two enterprises to be converted in a manufacturing sector: US $60,000; (iii) Three to 14 enterprises to be converted in a manufacturing sector: US $80,000; (iv) Fifteen or more enterprises to be converted in a manufacturing sector: US $150,000; and (v) To limit the maximum funding provided for the preparation of the investment component for any country according to the table below: (g) To request Article 5 countries to include in the development and finalization of the strategic plan for stage II of the HPMPs, as a minimum, the control target of the Montreal Protocol subsequent to that committed to in stage I of their HPMPs; (h) To request bilateral and implementing agencies to ensure that the following information was included in project proposals for stage II of HPMPs, in addition to the information required by decision 54/39 and by the guidelines for the preparation of HPMPs, consistent with decision XIX/6: (i) A description of how the HPMP strategy had considered the range of non-ods, technically proven, and commercially available alternatives, including climate-friendly alternatives to HCFCs; (ii) A qualitative description of how the strategy for the servicing sector had taken into account climate aspects; (iii) The proportion of foreign ownership and exports to non-article 5 countries in the manufacturing sector; (iv) An indication of the project disbursement modality that would be used to implement the HPMP; (v) Date of establishment of enterprises, taking into account decision 60/44(a) on the cut-off date, including enterprise names and consumption data, where available; and (i) To request bilateral and implementing agencies to return any balances from project preparation funding provided for stage I of HPMPs to the Multilateral Fund before a request for stage II project preparation funding might be considered. 20 Terms of Reference for National Level Technical Assistance ANNEX-II Nature of Work: Providing technical assistance and expert services at the national level, for preparation of Lebanon s HCFC Phase-out Management Plan (HPMP), Stage-2 Duration: 12 months Starting Date: (1 October 2014) Location: Beirut with inland travel in Lebanon as required Responsibilities: Under the direct supervision of the National Ozone Unit (NOU) and in close coordination with the Ministry of Environment and the UNDP Country Office, the Contractor should undertake the following tasks: a) To interact with various chemical and equipment suppliers/importers and/or their representatives and relevant industry associations, and review of data collected under HPMP Stage-1: Identify all current manufacturers of HCFC-based products in the Foams, Refrigeration, Air Conditioning, and any other manufacturing sectors where HCFCs are used, to maintain continuous contact with these users and maintain an updated list of all such users. Review and evaluate the availability, maturity and prices of alternatives to HCFCs for each application along with the techno-economic advantages and disadvantages of each alternative. Establish patterns of historical and projected unconstrained growth in HCFC consumption in various sectors/sub-sectors until 2025 Assist NOU and UNDP in obtaining commitment from the enterprises in participating in HPMP Stage-2 project activities for conversion b) With the prior approval of the NOU, undertake Site visits to selected users and collect enterprise baseline information and other documentation as may be required by UNDP and NOU from the users, in accordance with the pro-forma/questionnaire provided by the NOU for this purpose. 21 Collect and compile the following data on HCFCs, segregated by substance at the national level: Historical export data preferably from 2007 and segregated by destination countries Historical import data preferably from 2007 and segregated by originating countries d) In collaboration with the NOU, prepare a draft strategy and action plan for each sector, containing the technological and financial interventions needed, in order for the sector to comply with the 2020 control targets for HCFC consumption e) Assist UNDP and NOU in arranging workshops or similar information dissemination activities as may be requested, including assistance for ensuring participation of HCFC users selected for participating in such activities f) Assist in obtaining any other confirmations, documentation or information from the identified HCFC users as may be required by UNDP and/or NOU from time to time. g) Arrange as required for UNDP/NOU designated international experts and/or representatives, meetings with key managerial and technical personnel from the HCFC users and for plant visits as required, in line with their mission schedules in the country. h) Provide the NOU and UNDP with interim progress reports on activities on a monthly basis and a final report incorporating the expected outcomes as mentioned above, at the end of the contract period. i) Participate in meetings arranged by NOU/UNDP and the MoE in context of the HPMP Stage-2 preparation. Required qualifications and experience: Wide contacts and experience in the HCFC consuming sectors/industrial sector in Lebanon Demonstrated experience in Montreal Protocol activities in Lebanon Knowledge and understanding of the Montreal Protocol programme in Lebanon and relevant policies and regulations Prior experience in working with government departments and international organizations Ability to prepare substantive reports related to technology and policy in a clear and concise manner in English Lebanon HPMP Preparation (Stage-2) UNDP Prodoc Page 21
