Fee: Pages: 8 Record this document with the Register of Deeds Name and Return Address Timothy F Umland Mohs, MacDonald, Widder & Paradise 20 North Carroll Street Madison, WI * See Exhibits "B" and "B-1" WITNESSETH: (Parcel Identification Number) WHEREAS, Don Simon Homes, Inc as Developer, caused to be executed and recorded that certain Declaration of Conditions, Covenants and Restrictions for Door Creek, recorded in the office of the Dane County, Wisconsin, Register of Deeds on the 27 th day of March, 2000, as Document Number (the "DECLARATION"), which Declaration was subsequently amended by the amendments described in Exhibit "A", attached hereto and incorporated herein by reference (collectively the "AMENDMENTS"), and WHEREAS, the real property affected by the Declaration, Amendments and Current Amendment is described in Exhibit "B" and Exhibit "B-1," attached hereto and incorporated herein by reference, and and WHEREAS, control of the Association has transferred from Developer to the Owners, n 26
2 WHEREAS, pursuant to the vote of the Association, in which a quorum of Owners eligible to vote in Association matters was present, the Association voted to amend the Declaration as set forth herein NOW, THEREFORE, Association does hereby amend the Declaration as follows 1) Capitalized Terms. Capitalized terms which are not otherwise defined herein shall be defined as set forth in the Declaration and the Amendments ; 2) Fence Stain. Article B-13 of the Declaration is hereby amended to allow all fences to be stained a natural wood color in addition to the grey color currently allowed 3) Certain Above-Ground Swimming Pools Allowed. Article B-3 of the Declaration is hereby amended in part and now reads as follows (underlined language is new language) "No above-ground swimming pools shall be permitted, except temporary, softsided, inflatable pools which are no deeper than thirty (30) inches and no larger than eighty (80) square feet" The remaining portions of Article B-3 shall remain unchanged 4) Additional Fence Style and Criteria Allowed. In addition to any and all other fence design standards set forth in Declaration and Amendments, the fence design standards described in Exhibit "C", attached hereto and incorporated herein by reference, shall be and hereby are permitted 5) Amendment. Except as amended herein, all other terms, covenants and conditions of the Declaration and the Amendments shall remain unchanged This Current Amendment shall be effective upon the date it is recorded in the office of the Register of Deeds for Dane County, Wisconsin 2
