4 MONONA CITY COUNCIL November 5, 2018 Page 2 NEW BUSINESS A motion by Alder Speight, seconded by Alder Kuhr, to suspend the rules and take action on Resolution Requesting Exemption from County Library Tax was carried. Finance Director/Interim City Administrator Marc Houtakker explained that this is an annual exemption from county library tax for which Monona qualifies. A motion by Alder Speight, seconded by Alder Kitslaar, to approve Resolution Requesting Exemption from County Library Tax was carried. A motion by Alder Speight, seconded by Alder Grupe, to suspend the rules and take action on Resolution Approving an Addendum to the Intergovernmental Agreement to Fund a Position Responsible for Storm Water Information, Education and Outreach Coordination for the Madison Area Municipal Storm Water Partnership was carried. Project Manager Brad Bruun informed the Council that Monona s current agreement with MAMSWaP will expire at the end of this year, and this addendum will extend the agreement through These fees have been included in the 2019 operating budget. A new agreement with new fees will be drafted for A motion by Alder Speight, seconded by Alder Moore, to approve Resolution Approving an Addendum to the Intergovernmental Agreement to Fund a Position Responsible for Storm Water Information, Education and Outreach Coordination for the Madison Area Municipal Storm Water Partnership was carried. A motion by Alder Kitslaar, seconded by Alder Kuhr, to suspend the rules and take action on Resolution Approval to Enter into an Intergovernmental Agreement for a Crowd Control Unit was carried. Police Chief Ostrenga reported that the Monona Police Department is part of a training consortium which includes Verona, Oregon, Stoughton and Deforest. This consortium has received grants to form a crowd control unit. The purpose of a crowd control unit is to provide trained teams to respond in situations of civil unrest, as opposed to a standard mutual aid response. There are three other units in Dane County. Monona will contribute two members to the new unit. A motion by Alder Kitslaar, seconded by Alder Kuhr, to approve Resolution Approval to Enter into an Intergovernmental Agreement for a Crowd Control Unit was carried. Review of amendments to Resolution Adopting the 2019 Operating Budget and Establishing a Tax Levy: Amendment 19-01, to increase the salary for the Library Technical Services Position by $2,000. The total amendment with benefits is $2,284. Alder Wood added that this is the only library position besides the director which has an MLS degree. Amendment 19-02, to move $636 in the sustainability budget from Green Tier fees, which has already been budgeted and his not needed, to an additional allowance for intern wages. This will have no effect on the levy since it s an allocation within a fund. Amendment 19-03, to add $500 to the sustainability initiatives budget for a community survey for a 100% renewable energy pledge. Mayor O Connor questioned why this item wasn t included in the budget proposal for the sustainability committee and whether it has been vetted by the sustainability committee.

5 MONONA CITY COUNCIL November 5, 2018 Page 3 Alders Moore and Speight explained that it wasn t included because of timing issues but has been discussed with a smaller work group. Alder Wood clarified that the Council hasn t approved a 100% renewable energy pledge. Alder Speight explained that the survey would be a way to confirm that the pledge they will propose to the City Council is consistent with community feedback; then a resolution will be drafted and brought to the Council for approval. Amendment 19-04, to add $4,000 from fund balance to the sustainability initiatives budget for solar energy and finance services. Alder Moore explained that this money will be used to initiate one or two very specific solar energy and finance projects which have yet to be determined. These could include citysponsored and funded projects or things like solar bonds which would allow residents to purchase as a group and buy into a larger solar array. Alder Wood cautioned that attorney s fees could eat up a lot of money with a project like these. Alder Kitslaar added that the committee needs to take into account that the city s current solar panels will soon be up for purchase. Amendment 19-05, to add a second police officer starting on Nov. 1, 2019 and delay starting the officer included in the budget until March 1, The savings on delaying the officer start will have a zero impact on the 2019 budget. Alder Kuhr explained that the Public Safety Committee recommended three additional officers for 2019, but only one was included in the executive budget. A second additional officer would allow the sergeants and community relations officer to spend less time filling patrol slots. Alder Kitslaar asked if there would be other ancillary costs. Alder Kuhr responded that there would be a need for another squad car in Mayor O Connor expressed concern that this amendment would obligate us for an additional $92,000 in personnel costs for 2020, which could be half of the entire dollars available for Amendment 19-06, to add $20,000 from fund balance to increase the number of IT hours contracted by the City (half day per week). Alder Moore explained that this was the number one recommendation of the recent communications assessment. The intention would be to look at what we need for the future without tying our hands now. Amendment 19-07, to add $200 to the emergency communications/dispatch budget for uniform allowance. This number was underestimated in the budget. Lt. Deuman clarified that dispatchers can use uniform allowance funds to purchase approved business casual clothing. Finance Director/Interim City Administrator Houtakker reported that these seven amendments will require $26,984 from fund balance. With this amount, there will be $737,000 remaining in fund balance. REPORTS Alder Grupe reported that the Library received a One Community/Many Stories grant for $10,000. Alder Moore reported that the City received an Office of Energy Innovation Grant and thanked Project Manager Bruun for his work on the grant application. Alder Wood reported that there will be a public information meeting on Wednesday, Nov. 7 at 6:00 p.m. regarding the citywide architectural survey which is being conducted by Mead & Hunt for the Landmarks Commission. Alder Kuhr reported that the Community Media Committee, which now has a full membership, will meet on Thursday, Nov. 8. Alder Grupe urged everyone to vote on Tuesday.

6 MONONA CITY COUNCIL November 5, 2018 Page 4 Finance Director/Interim City Administrator Houtakker reported that there are 1,323 absentee ballots for tomorrow s election. In 2016, there were 1,985 and in 2014 there were 841. Mayor O Connor reported that interviews for the city administrator position have been scheduled, and alders will receive their packets for those interviews later this week. APPOINTMENTS A motion by Alder Kitslaar, seconded by Alder Grupe, to approve the following, was carried: Joyce Hornburger Election Inspector (effective immediately Dec. 31, 2019). 7 Resolution No Monona Common Council APPROVAL OF A 3-LOT CERTIFIED SURVEY MAP (CSM) FOR LOT 5 OF THE SOUTH TOWNE ASSESSOR S PLAT SHOPKO LOT WHEREAS, the proposed 3-Lot CSM divides the existing Shopko Lot to create two additional lots that are proposed for development; and, WHEREAS, the land division includes Lot 5 of the South Towne Assessor s Plat in the City of Monona, located in part of the NW ¼ - NE ¼ and NE ¼ - NE ¼ of Section 30, all in Township 07 North, Range 10 East, City of Monona, Dane County, Wisconsin; and, WHEREAS, approval of any land dedication for a street must be reviewed by the Plan Commission pursuant to State Statute 62.23(5) and accepted by the City Council; and, WHEREAS, the proposed CSM complies with the Land Division Ordinance standards in Section requiring lots to front on a dedicated street at least sixty (60) feet in width; and, WHEREAS, the Public Works Committee reviewed the proposed 3-Lot CSM at their meeting November 7, 2018 and found it consistent with the City of Monona Official Map and approved it; and, WHEREAS, the Plan Commission held a public hearing on the proposed 3-Lot CSM at their meeting on October 8, 2018 and conditionally approved the CSM. NOW, THEREFORE, BE IT RESOLVED, that a 3-Lot Certified Survey Map (CSM) for Lot 5 of the South Towne Assessor s Plat Shopko Lot as proposed and according to Section Land Divisions of the Monona Municipal Code is hereby approved as conditionally approved by the Plan Commission. 8 Draft Minutes from Public Works Committee Meeting Nov. 7, 2018: 6A: Discussion and consideration for approval of a 3-Lot Certified Survey Map (CSM) to divide Lot 5 of the South Towne Assessor s Plat, Shopko Lot at 2101 W. Broadway into three separate parcels. Interim city planner, Kory Anderson explained the information in the packet. The CSM was approved in early 2017 by the City, but the applicant failed to record the CSM in the proper amount of time. Plans were submitted to divide the existing Shopko site into three separate parcels. Lot 1 and 2 would be the new parcels, and Lot 3 is the current Shopko property. Each parcel will have public road frontage, and designed not to interfere with existing traffic patterns in the parking lot. The Plan Commission provided approval with conditions at the October 8, 2018 meeting. The conditions include an easement for cross access on Lot 3 benefitting Lot 1 and 2 shall be provided to staff for review and approval prior to recording the CSM; future developments of Lot 1 and 2 shall meet the minimum requirements for site plan review as required by all applicable Ordinances; the label on the CSM be revised to read West Broadway Frontage Road; an easement for storm water utilities across all lots shall be provided to staff for review and approval; and that the Public Works Committee and City Council review and approval is required prior to recording the CSM. Mr. Stolper stated that there should be a requirement that the current property owner agrees not to avail themselves of the dark store exemption, and would like to make that a condition of the committee recommendation. A motion was made by Mr. Stolper, and seconded by Mr. Podell to recommend approval on condition that the property owner of the three parcels agree not to avail themselves of the dark store loophole or exemption. Roll Call Vote: Alder Kuhr - abstain, Ms. Piliouras - no, Mr. Stolper - yes, Ms. Gundlach - abstain, Mr. Podell - yes. Motion carries.

16 Resolution No Monona Common Council AWARD OF CONTRACT FOR CONSTRUCTION OF RIVERFRONT PARK PLAZA CONCESSION STAND AND PUBLIC RESTROOM FACILITY WHEREAS, the Yahara Riverfront development design includes a 0.6-acre public park plaza with a restroom/concession/storage building and water access; and, WHEREAS, an ad hoc steering committee was assembled to work with the City s consultant, Strand & Associates, to develop design plans for the park plaza and streetscape; and, Aro & Eberle Architects designed the park concession stand and restrooms; and, WHEREAS, bids for the project were opened on October 19, 2018, with the low bid of $391,000 submitted by T2Contractors; and, WHEREAS, Parks & Recreation Board recommended acceptance of the low bid by T2 Contracting in the amount of $391,000 and included an additional $40,000 for contingency, signage of the concession stand, and owner direct purchases for equipment in the concession stand; and, WHEREAS, the City has been approved to receive $150,000 from the DNR Knowles-Nelson Stewardship Fund for this project. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Monona, Dane County, Wisconsin, that a contract for construction of the concession stand / public restroom facility at the Riverfront park plaza be awarded to T2 Contracting in an amount not to exceed $391,000. 18 PARK & RECREATION BOARD (Agenda Item 5A) Meeting Date: November 13, 2018 AGENDA ITEM: River Front Concession Project Contract Award Recommendation REQUESTED BY: Jake Anderson POLICY ANALYSIS STATEMENT: 11 bids were received for the River Front Concession/Restrooms project on October 19, The bid tab is attached to this file. The low bid of T2 Contractors has been reviewed, references checked, and an onsite meeting to discuss the project. Aro Eberele and Director Anderson are recommending the bid award go to the lowest qualified bid in T2 Contractors. It s expected work to begin after January 1 st and final approval of the DNR Stewardship Grant Funding. The final opinion of probable cost was $400,000 for the project and the bid from T2 Contractors was $391,000. Anderson is recommending including a contingency fund of $40,000 for the project. FISCAL IMPACT: $400,000 was included in the last budget report for the building out of the concession stand/restrooms. There are additional owner direct purchases including a sign for the exterior of the building, chairs, rental skates, and additional concession equipment. 24 Ordinance No Monona Common Council AN ORDINANCE RELATING TO VAPING IN CITY PARKS WHEREAS, the Common Council finds it in the public interest to protect public health, safety and welfare to prohibit smoking by use of electronic delivery devices in City parks; and NOW, THEREFORE, the Common Council of the City of Monona, Dane County, Wisconsin, do ordain as follows: SECTION 1. Subsection 21 of Section of the Code of Ordinances is hereby amended to read as follows: (21) Smoking. No person shall smoke or hold a lighted cigarette, cigar or pipe within any park, or portion thereof, where notices prohibiting smoking are posted. The Park and Recreation Board is authorized to designate the parks, or portions thereof, where smoking is prohibited and to implement the installation of appropriate notices. The term smoke includes the use of any electronic delivery device containing or delivering nicotine or any other substance intended for human consumption that may be used by a person to simulate smoking through inhalation of vapor or aerosol from the product. This includes any such device, whether manufactured, distributed, marketed, or sold as an e-cigarette, e-cigar, e-pipe, e-hookah, or vape pen, or any other product name or descriptor. Electronic delivery device does not include any product that has been approved by the United States Food and Drug Administration for sale as a tobacco cessation product and is being marketed and sold solely for such an approved purpose. 26 Ordinance No Monona Common Council AN ORDINANCE RELATING TO EXPULSION FROM CITY PARKS FOR RULE VIOLATIONS WHEREAS, the Common Council it appropriate to authorize the Parks & Recreation Director to expel individuals from City parks for violation of park rules or other disturbing actions while on park property. NOW, THEREFORE, the Common Council of the City of Monona, Dane County, Wisconsin, do ordain as follows: SECTION 1. Section of the Code of Ordinances is hereby created to read as follows: Expulsion. The Parks & Recreation Director may expel from any park for a period up to 180 days any individual found to be violating, or reasonably suspected based on credible reports to have violated, any provisions of this Chapter 321, or any provision of Chapter 335 while in any park. An individual so expelled may request an administrative review of the decision of the Parks & Recreation Director in accordance with Chapter 68 of the Wisconsin Statutes. The Park and Recreation Board shall be the decision maker in any proceeding pursuant to section 68.11, Wis. Stats. The expulsion order of the Parks & Recreation Director shall remain in force during any administrative review proceedings. SECTION 2. Comparing the approved PIP documents to the submitted revisions, there are some minor revisions and enhancements to bring to the City s attention related to exterior materials. 1. The metal panel color has changed from a Navy Blue to a dark grey/matte black Millennium Forms Zalmeg pre patina. The team feels this is a higher quality, more timeless panel selection. 2. Pergolas have been added at the northeast elevated patio for Buck & Honey s, above the patio doors at the northwest for the True Coffee and Forage Kitchen storefront as well as at the breezeway on the south to help call out identity for the Buck and Honey s entrance. 3. The brick color has changed at the JLA office space and The Current Lobby and entrance to a pebble grey color to help differentiate commercial uses at the surface parking lot level. 4. The brick color has changed at the Forage Restaurant to a white color to help with their brand identity. We have also balanced this on the other side on the bay between JLA and The Tasting Room. 5. The south facing façade of The Tasting Room has added a two sided fireplace in the center structural bay as well as a material change to wood tone fiber cement panels to balance the wood tone fiber cement panels on the west end at True Coffee. Although there have been other minor adjustments as details have refined, these summarize the most impactful visual changes to the building. 43 Resolution Monona Common Council APPROVING A MEMORANDUM OF UNDERSTANDING WITH DANE COUNTY FOR 911 DISPATCH SERVICES WHEREAS, Dane County Public Safety Communications provides 911, fire, EMS and police emergency call taking and dispatch services to municipalities in Dane County; and, WHEREAS, a study group of Monona staff and residents thoroughly examined Monona s existing police, 911 and fire, EMS, and police dispatch services; and, WHEREAS, the Monona Dispatch Center only receives a few hardwired 911 calls each day, as the majority of 911 calls are received from cellular phones at Dane County and transferred to the Monona Dispatch Center; and, WHEREAS, the current 911 equipment for the City of Monona has outlived its useful lifespan, which will require a major capital investment that is not justified for the number of hardwired 911 calls received; and, WHEREAS, allowing Dane County Public Safety Communications to accept all incoming Monona hardwired and cellular 911 calls would provide consistent service across Dane County municipalities, enhance effectiveness, increase efficiency of Monona s dispatch of police calls, and have no effect on the City s tax levy; and, WHEREAS, Dane County Public Safety Communications is willing and capable of taking all hardwired and cellular 911 calls for the City of Monona. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Monona, Dane County, Wisconsin, the attached memorandum of understanding with Dane County for 911 dispatch services is hereby approved. 44 MEMORANDUM OF UNDERSTANDING BETWEEN DANE COUNTY AND THE CITY OF MONONA TO CONSOLIDATE CERTAIN DISPATCH SERVICES This Memorandum of Understanding ( MOU ) is made by and between the County of Dane ( County ) and the City of Monona ( City ). The MOU shall become effective upon mutual agreement of the County PSC Director and the City Police Chief, but not prior to January 1, A. Purpose. The purpose of this MOU is to set forth the agreements and understandings between the City and the County regarding the consolidation of some identified dispatch services and to establish the operating practice and policy procedures for such services. B. Services. In order to further streamline the dispatch services in Dane County, the County agrees to assume the responsibility for all the wireline 911 calls that are currently routed to the City ( Services ). 1. County shall not be responsible for any additional dispatch services that are not specifically referenced in this MOU. City acknowledges that it shall remain responsible for any additional services. 2. The Dane County Public Safety Communications Center ( PSC ) shall be the County department to provide the Services to the City, 24 hours a day, every day of the year. 3. City acknowledges and agrees that the PSC shall provide the Services in conformance with all applicable operating and policy procedures. C. Consideration. County s assumption of the responsibility to provide the Services referenced herein is premised on the understanding that the provision of the Services shall not necessitate an increase in staff, overtime or other expenses for the PSC. If at any time after December 31, 2019, the PSC determines that additional staff, overtime or other expenses are necessary to continue providing the Services, the PSC shall provide (90) days written notice to the City of the additional cost. Pursuant to Wis. Stat (3), County shall then increase its levy limit to reflect that the Services were transferred to it. City acknowledges that it must decrease its levy limit in a corresponding amount. D. Termination. Either party may terminate this MOU provided that ninety (90) days written notice is given to the other party. E. Miscellaneous. 1. Indemnification. Neither party will indemnify the other party. Each party shall be responsible for the consequences of its own acts, errors or omissions and those of its employees, boards, commissions, agencies, officers and representatives and shall be

45 responsible for any third-party losses, claims, and liabilities which are attributable to such acts, errors or omissions including providing its own defense, of any third party. In situations including joint liability, each party shall be responsible for the consequences of its own acts, errors, or omissions and those of its employees, boards, commissions, agencies, officers and representatives. No section of the MOU is intended to create a waiver of the provisions of Wis. Stats or or any other applicable immunity, protections, or limitations of liability applicable to either party which may be provided by law. 2. Limitation. This MOU is intended to be solely between the parties hereto and for their benefit only. No part of this MOU shall be construed to add to, supplement, amend, abridge or repeal existing duties, rights, benefits or privileges of any third party or parties, including but not limited to employees of either of the parties. Notwithstanding the terms of the Agreement, if County enters into an agreement with any other municipality for dispatch services under different terms or conditions than set forth herein, the County shall offer said terms or conditions to the City as an amendment to this Agreement and City shall accept or reject said terms in a timely fashion. Rejection of said terms by the City shall not constitute a breach of this Agreement which shall continue in full effect under the current terms. 3. Requirement. It is understood that this agreement requires an automated Computer Aided Dispatch ( CAD ) component. The CAD system maintained by County shall transfer information to the CAD system maintained by the City in an automated manner. In addition, this agreement requires a mutually agreed upon operating procedure be established to allow for the transfer of 911 callers to the City in certain situations. 4. Entire Agreement. The entire agreement of the parties is contained herein and this MOU supersedes any and all oral agreements and negotiations between the parties relating to the subject matter hereof. 53 MONTHLY DEPARTMENT HEAD REPORT TO COUNCIL DEPARTMENT: Public Works & Utilities MONTH OF: November Accomplishments: The crew continued to collect leaves throughout the City in November. All three trucks have been in service. Staff will collect into December, as weather allows. The crew put up the holiday snowflake lights on Monona Drive and on Broadway. The crew completed the final round of street sweeping for the year. The crew prepared the snow plowing fleet for winter operations. The crew coordinated and removed sandbags from the street in Belle Isle. Dumpsters will be provided until December 3 rd, and will be brought back in the spring. The crew coordinated work at the water tower with Verizon for their cell phone antenna upgrades. The crew assisted Homburg with water main work at the Riverfront Development site. The crew rebuilt the booster pump check valve at Well 1. The crew ensured all fire hydrants were winterized for the season. The crew assisted the generator installation contractor as needed. Several manholes throughout the City were rebuilt to match the road surface. This project has been completed. A small section of sanitary sewer was lined near the Gunderson Funeral Home. The white water tower has been drained and winterized for the season. Major Projects / Issues: The automatic transfer switch has arrived, and installation still needs to be coordinated. The project is expected to be substantially completed in Staff has been working with the three fiber boring crews who are in the City installing neighborhood fiber optics. Staff has been responding to resident complaints, and the many Diggers Hotline locate requests that have come in. Homburg Contractors has finished water main installation at the Riverfront Project site. They will continue working into December as the weather allows. In Progress / Routine Duties: The utility crew completed meter changes and meter readings for the month. The utility crew completed the daily rounds at the wells and lift stations, collected required water samples, and complete diggers hotline locates for the month. The crew cleaned floor drains at the shop, completed inventory of shop items, and completed shop maintenance for the month. Project coordination continues with our city engineers. The monthly DNR water pumpage report was completed and sent in per the requirements of the State. Upcoming Objectives / Events: 2019 Project coordination. 55 MONTHLY DEPARTMENT HEAD REPORT TO COUNCIL DEPARTMENT: Library MONTH OF: October 2018 Accomplishments: - Over 16,000 visits - Over 19,500 items circulated study room uses patrons attended 27 programs people attended Monona History Club program people attended Seasonal Chef program attended school bus storytime Major Projects / Issues: Vestibules Met with the construction crew and architect regarding the vestibule and Nichols Rd. side entrance. The delays with this project were due to the flooding in the summer (limiting access to main supplier), and adjusting project to meet the angles of the roofline when they got to the outer wall of the vestibule. Anticipating completion date of late November. One Community: Many Voices Stories Project The Monona Public Library was awarded $10,000 from the Wisconsin Humanities Council for our application for the One Community, Many Voices project. We will use funding from this grant for equipment and to hire an LTE project coordinator to handle scheduling and coordination of volunteers for this project. We also hired Kevin Wilmott II, a local musician and storyteller who won a local Moth competition, will emcee the event. We also had Troy Reeves, Head of the UW-Madison Oral History program, teach a workshop to MG21 students, staff, and library staff on best practices in conducting oral history interviews. Programs We had a Monona History Club featuring arborist R. Bruce Allison discuss the history through the lens of historic trees of the area, and we had a Seasonal Chef Fall Flavors featuring Chef Jonny Hunter from Willy St. Co-op. We also had Val Edwards of Pulled 2 Gether Consulting do a program on organizing work and home life, and an Eco-Action Tuesday discussing the book Life and Death of the Great Lakes. The library had a babysitting clinic for teens that was very well received, hearing from those who attended that the skills and tips shared was useful for those who came or their children who will soon be entering the babysitting arena. 56 MONTHLY DEPARTMENT HEAD REPORT TO COUNCIL For Children s Programs we our School Bus storytime featuring a school bus parked by the library. We also had STEAM Saturday which is always popular, along with several Spanish storytimes mixed in with our other storytimes. We featured many class visits in October, including Winnequah Kindergarten class and Neustro Mundo. Wisconsin Library Association Annual Conference The Wisconsin Library Association (WLA) held their annual conference in La Crosse this year in late October. Ryan Claringbole and Karen Wendt each presented at the conference, one on lessons learned in being a director/supervisor of a library, and another on how to start and implement Sensory Storytimes in the library. Both sessions In Progress / Routine Duties: - Strategic plan preparation - Scheduling committee meeting - Vestibule construction - Planning and organizing the One Community, Many Voices initiative. Received video studio lighting trusses from Aldo Leopold Nature Center as well as a couple of microphones, at an extremely reduced price. Major Projects / Issues: Began production and postproduction work on Monon Grove Education Foundation videos. Continuing to track down alders and gather b roll of each of you in your daily life! Secured sponsorship for the broadcast of two Monona Grove football playoff games from October. Routine Duties: Cleaning out/organizing video studio and storage at Monona Grove High School. Continuing to record and produce content for the radio station, including the senior center, library, Aldo Leopold, and various organizations and groups. Working with volunteers to organize WVMO s future goals. YouTube broadcasts of council meetings, plan commission meetings and girls and boys varsity basketball.
