1 Made by the Monash University Council Version incorporating amendments as at 3 November Interpretation In these regulations unless the contrary intention appears - 'authorised staff member' means a library staff member authorised for the particular purpose by a library officer; 'library' means the branch libraries, divisions and administrative unit of Monash University Library; 'library officer' means the university librarian, a library director and the librarian in charge of a branch library; 'late return' means the failure to return library materials as required by section 6; 'library staff member' means a person appointed to the library staff on a full-time, parttime or casual basis; 'published' means made known publicly through notices or advertisements. 2. Availability of library facilities Subject to these regulations, the facilities of the library are available to members of Council, members of staff and students of the university; and other persons as determined by the university librarian from time to time. 3. Removal of library materials 3.1 A person must not remove from the library library materials kept in a reference, reserve, rare books or special collections area of the library and so catalogued, without the written permission of a library officer or, in the case of rare books, the rare books librarian; any other library material -

2 unless the loan has been recorded in accordance with current library procedures; or without permission in writing from a library officer. 3.2 Subject to subsection 3.3, periodicals must not be removed from the library. 3.3 Periodicals specified as available for borrowing may be borrowed, but only by a member of staff or a graduate student or, in circumstances deemed exceptional by a library officer, a final year undergraduate student. 4. Borrowing limits The university librarian must from time to time determine in respect of library materials in any category the number that a borrower may have on loan; and the period for which they may be borrowed. 5. Borrower responsibility During the period of a loan, the borrower of library materials is responsible for their care and safekeeping. 6. Return of library materials 6.1 Library materials on loan must be returned prior to the library closing time on the due return date; forthwith on demand made to the borrower personally by a library officer; or as required by notice to the borrower from a library officer or an authorised staff member. 6.2 A library officer or an authorised staff member may, in accordance with procedures determined from time to time by the university librarian, require the return of library materials. 7. Reserve material 7.1 Reserve material may be used by a person in the library only for a determined maximum period and thereafter only when the material is not sought by another user, and in any case for only the determined maximum period; and with permission from a library officer, be borrowed overnight. 3 7.2 A maximum period for the purposes of this section must be determined and published by the university librarian. 8. Inspection 8.1 Where so required by a library officer or an authorised staff member, a person, prior to leaving the library, must open for inspection any bag, folder or other container which, in the opinion of the officer or staff member, has the capacity to conceal library materials. 8.2 A person leaving the library with library materials must produce them for inspection on demand by a library staff member on duty at the exit or at the loans desk. 9. Restrictions on library use 9.1 Except with the authority of a library officer, a person in the library must not in a signed quiet area make any noise or cause any noise to be made; or be in possession of a mobile phone set otherwise than to off; in an area other than a signed quiet area make, or cause to be made, more than a moderate level of noise or noise that disturbs or has the potential to disturb any library user; or be in possession of a mobile phone set otherwise than to vibrate or silent; eat or be in possession of hot food; in a reserve, special collections or signed quite area or near a computer, eat or display cold food; drink, or be in possession of, an alcoholic drink; in a reserve or special collections area or near a computer, drink from or be in possession of a drink container without a lid; smoke; or secrete, hide, conceal or intentionally mis-shelve any library materials. 9.2 A person in the library must comply with any published instruction issued by the university librarian. 10. Sanctions for failure to comply Page 3

4 10.1 An authorised staff member or a library officer who is of opinion that a person has failed to comply with a provision of these regulations may request the person to produce his or her identity card; and order the person to leave the library In subsection 10.1 'identity card' means the university's official identity card or any other means of identification required to borrow library materials. 11. Fines for late return 11.1 The university librarian may, from time to time, determine fines, including accumulating fines, for late return and must cause any such determination to be published In a case of late return, the university librarian must cause notice requiring payment of the resulting fine to be sent to the borrower concerned. 12. Replacement or repair liability 12.1 Where library materials are not returned as required by notice under paragraph 6.1.3; or are returned in a damaged state - irrespective of any fine payable under section 11, a library officer or an authorised staff member may issue a notice requiring the borrower to pay an amount determined by the university librarian to be the cost of replacing or repairing the library materials, including a processing charge The university librarian may, in any particular case, reduce or remit an amount payable under this section. 13. Payment An amount payable, and specified in a notice, under section 11 or 12 must be paid by the borrower concerned within 14 days of the notice date. 14. Entry or borrowing prohibition Where a person has repeatedly returned library materials after the due return date; returned library materials in a damaged state; or failed to return library materials as required by section 6; Page 4

5 refused to comply with a request or order under section 10; or not paid an amount within the time required by section 13 - the university librarian, after giving the person reasonable opportunity to be heard, may forbid the person to enter the library or to borrow library materials or both, for such period and on such conditions as the university librarian determines. 15. Notice requirements A notice to a person under these regulations must be given or sent to the person and if sent, must be sent Delegation by post or hand delivery to the person's last known residential address or, during an academic term, residential term address; or in the case of a member of staff of the university, to the staff member's university address; or by to the person's university account; or account recorded by the library. The university librarian may delegate all or any of the powers and functions of the university librarian to any other library officer or to a library staff member. Page 5
