CORRIGENDUM Tender no.: CON/NR/TECH/O&M of HYSTER RST at ICD/TKD & MB/2017 The tender and the issue raised during pre-bid meeting on 08.09.2017 by respective bidders and clarification/amendments to the respective are as follows: - Sr. Clause no. 1. Terms and condition (section-ii) Clause- 7.0: 7.0 It may be noted that if any RST being declared temporarily decommissioned in a particular month, payment will not be made for that particular RST for that month or part thereof. A notice period of 7 days will be given before decommissioning a machine. Any decommissioned machine will not be part of the contract and for its re-commissioning CONCOR will be free to take quotes from others also. 2. Terms and condition (section-ii) Prices, Clause- 8.0: 8.1 The bidder should quote monthly rate per loaded reach stacker/per month for O&M of Reach Stackers for location as specified in para 1.0 in Indian National Rupee (INR) only as per enclosed Price Form in Annexure-2B & 2C. The Bidder should quote rate for per Reach Stacker per month and bidder shall indicate all applicable as on date State and Central Statutory taxes etc. with clear quantum/percentage. GST applicable will be reimbursed on proof of having deposited as per provision of law to with concerned Authorities. Any other Tax details if not mentioned in offer will deem to be included in the basic cost and will be borne by the Bidder. The bidder should also give the break-up of the quoted rate as per Annexure-2A, 2B & 2C. Query of M/s Excellent Engg. & Allied services This Point is not clear. Where CONCOR is going to float separate tender. In future if new tax is made applicable, what will be the scenario. Clarification/Amendment proposed Provision of shall prevail CONCOR will be free to take quotes from others for recommissioning of decommissioned machine.. It is very clear in the note No.(v) of the price bid. If any new tax is levied subsequent to opening of the tender, reimbursement of the same may be considered by the Competent Authority based on documentary evidence regarding imposition of new tax..

3. 11.0 Award of contract Clause-11.3, Section-II,(Page- 22) The reach stacker will be treated as under contract from the day on which the first machine is handed over by CONCOR to the contractor for operation and maintenance,but payment for each machine will be made only from the date on which the contractor actually put the machine in operation 4. Section-II Terms and Condition 11.0 AWARD OF CONTRACT 11.4 CONCOR may increase the quantity of machine in this contract by 50%. The contractor will have to start the O&M within 15 days from the date of issue of letter for doing so, on the same rates terms and condition if required. The no. of days gap between machine is handed over by CONCOR to the contractor to the actual date of operation should not considered and no deduction will be affected to this ground. 30 days time should be given from the issue of LOI instead of 15 days The day when the machine will be handed over to the contractor, the payment will only be made from the date of actual operation. If contractor does not start the work after handing over of the machine then the period from the time of handover to the actual time of operation will be treated as breakdown and deduction will be made as per contract provision. Hence no change is proposed in the. This is for those machines whom CONCOR may want to increase in the middle of the contract, to cater the increased container traffic, if arises. Hence no change is proposed in the. 5 Section-II, Terms and condition, Clause no.-14.0 Successful bidder (Contractor) shall be provided with the uncovered space for the exclusive use of the reach stacker maintenance activities. The area would be provided with cess free water and electricity for maintenance as considered adequate by CONCOR. Working area will be large enough in size to accommodate the tools, equipment s, and spares for servicing reach stackers. CONCOR would provide 20 / 40 containers for stacking of spares and consumables such as lubricant, greases, brake fluids etc. in the earmarked area. The contractor will arrange all other facilities including tools and tackles etc. required for operation & maintenance. The contractor shall be responsible for maintaining proper cleanliness of areas provided for maintenance purpose. Covered space should be provided for maintenance specially at the rainy & summer season. No change in the tender.

6. Section-II Clause-18.0 (pg no. 26) 18.0 The equipment are the property of the CONCOR and CONCOR has already covered all its equipment under companies Insurance policy. However any loss or damage to the equipment while in the custody of the Service Provider due to Service Provider s negligence and claim of which is not accepted by the Insurance Company, shall be on the part of Service Provider Contractor s performance security or part thereof shall be utilised towards such claim also. Further any loss or damage to other property to CONCOR due to negligence / acts of omission by the service provider will be made good by the service provider. In case of any accident, a departmental enquiry will be done and the decision of the committee will be binding on the contractor. (i) It is mentioned the concor has already covered all his equipment under company s insurance policy. Tender say any loss or damage to the equipment while in custody of the Service Provider due to Service Provider s negligence and claim of which is not accepted by the Insurance Company, shall be on the part of Service Provider Contractor s performance security or part thereof shall be utilised towards such claim also. Further any loss or damage to other property to CONCOR due to negligence / acts of omission by the service provider will be made good by the service provider. (II) If all the property is covered under insurance why this is deducted from service provider Provision of 18.0 (section-ii) If the machine is getting damage due to the contractor s fault/ negligence the contractor has to take the machine good. If the insurance company found the damage are not manageable under the insurance the same will be on the part of services provider. Hence there is no change in the tender. 7. Section-III, Scope of work, Clause no 2.3 Scope of maintenance work All type of maintenance including preventive, corrective etc., according to service instructions and schedules of equipment as stipulated by the Original Equipment Manufacturer (OEM) or accepted to CONCOR except maintenance activities stipulated in exclusion at Clause 4.0 Note It is expected that technical support of OEM may not be available. CONCOR shall not arrange for technical support for the OEM for the purpose of fault diagnosis and troubleshooting, which is the responsibility of the Contractor. The time taken for fault diagnosis and troubleshooting shall be on Contractor s account. For a new machine technical support is very much necessary till the machine is under warranty. Ever OEM extends technical supports to the customer why CONCOR cannot arrange technical support from the OEM CONCOR has to arrange training for the skilled electrician of the service provider from the OEM. Bidder should consider the no. 2.3.1 of section-iii, Scope of work under warranty period.

8. Section-III, Scope of work no. 2.3.1 Scope of maintenance work under warranty period: - In addition to the above the contractor will also be responsible for technical support to CONCOR for coordination with the OEM/supplier for maintenance related issue and warranty related issue. However, the first claim of warranty issue will be made by the CONCOR 9. Section-III, Scope of work Clause no, 2.3.2 Scope of maintenance work after warranty period The contractor shall be responsible for maintenance troubleshooting fault diagnosis etc. of the reach stacker after the expiry of warranty period. However, AMCs if any required to be entered into with OEMs will be done by CONCOR on bidder cost. Supply of all material for preventive maintenance/breakdown maintenance will be done by CONCOR. All repairs required to be done at site/on machine will have to be done by the contractor (material will be supplied by CONCOR) and all items requiring repairs by sending a subassembly outside will be done by CONCOR. E.g. A job welding work on the machine will be responsibility of the contractor the manpower required for it. An engine and Transmission requiring periodic repair will be dismantled/fitted by contractor however its repair from an outside agency will be the responsibility of CONCOR. In what way contract will be responsible technical support under warranty i) Bidder cost means? ii) Welding electrodes? For maintenance related issue contractor may coordinate with the OEM/supplier directly for technical support to resolve it. However any warranty claim is done by CONCOR i) This tender is for providing professional services for operation as well as maintenance also. No separate AMCs will be done by CONCOR from OEM in order to provide any extra maintenance. If done, on bidders cost only. ii) Consumables will be provided by CONCOR as per tender 7.0 of section-iii, scope of work.

Decision on whether a sub-assembly or work can be attended at site/on machine lies with Representative of CONCOR and the decision will be binding on the contractor. 10. Section-III,scope of work 2.4. Maintenance activities specified shall include, - 2.4.5 Washing and cleaning of the equipment during the daily maintenance / preventive maintenance schedule time and also painting of rusted parts/scratches on the body. 11. 5.0 Equipments for Day-to-Day maintenance 5.1 The following service supported equipment shall be provided by contractor for maintenance of Reach stackers. Air Compressor for day-today air filling in tyres. Welding Rectifier, Pneumatic Grease Gun Hydraulic Jacks, Water jet cleaning Machine, Battery Charging system. Arrangement of equipment like crane, fork lift, sling ropes etc., Arrangement of Gas cutting set with tools and tackles inclusive of Gas (Only cost of gas will be paid by CONCOR). 12. CONCOR will provide all spares, consumable, POL etc. required for machine as under: Spare / service parts for regular and scheduled preventive maintenance. Spare Parts for break down maintenance, Spare Parts for repairs, Who will provide the paint? Clause is not clear. Tyre puncture removal and fitment time should be cover under available hour like diesel filling Consumables will be provided by CONCOR as per tender 7.0 of section-iii, scope of work. Clause is self-explanatory CONCOR will pay charges of Gas only on submission of valid bill. Other tools and tackles will be arrange by contractor itself. The address by the bidder in his doubt is not related to the available hours. In this tender, there is a provision of giving 16 Hrs exigency (Free Hrs) per machine which covers all such minor breakdown.

Spare Parts for corrections/modifications, of machine Spare Parts for consumption during the normal uses Spares parts for overhauling of machine. However, the responsibility for mounting, dismounting and repairs shall be with the contractor. For example, tyres will be provided by CONCOR; and removal and fitment is to be done by contractor. 13. 8.0 Technical Personnel (Section-II Pg no. 35)- Technical Personnel-The maintenance schedule shall be performed under the supervision of competent personnel at each nominated Terminals of CONCOR. In addition, the contractor should post as many experienced technicians at each nominated CONCOR Terminal as deemed fit to give the satisfactorily performance. However, he will ensure that Two electrical/electronic technician for ICD/TKD; One electrical/electronic technician for ICD/MB and Two mechanical fitter ICD/TKD; One mechanical fitter ICD/MB conversant with the hydraulic and pneumatic systems also are at least available at each nominated CONCOR Terminal to undertake the breakdown/ Troubleshooting maintenance of equipment round the clock. Contractor should post the trained operator having minimum experience of one year with the valid HMV license. Evidence should be submitted to the satisfaction of CONCOR. Helpers are to be provided for the purpose of operation of each Reach-stacker and also separately for the maintenance of the Reach Stackers. 13. Section-III, Scope of Work, Clause no. 11.5, Availability Availability is The number of Technician and electrician have been increased from one to two. This will have an effect on total costing. a measure of the percentage of time any unit is actually available to perform its function as compared to the planned portion of time for which it shall be available. For the purpose of this contract, the availability of machines shall be calculated by excluding the periods for which the machine is not available for reasons attributed to CONCOR. If machine is seized by the local police, Liasioning / Release of machine from police to be arranged by contractor, CONCOR will provide required documents if needed for completing the formalities. 14. Section-III, Scope of Work, Clause no.-11.6, Note: CONCOR will hold monthly meetings with the O & M Contractor to review the actual availability being achieved in the months and to review proposals and programs by which the maintenance contractor intends to achieve or maintained the desired availability, if it is below the target. The meeting will be attended by not less than the director of the successful bidder. CONCOR will also set a reasonable target for the improvement factor for the availability. This is the contractors responsibility to maintain the machine efficiently so that maximum availability of machine can achieve and shall not be below the level specified as above subjected to break down on account of CONCOR. court of law once it is seized by the police. 15. Section-III, Scope of work, no. 16.0 Moves per Hour It is expected from the contractor to perform a minimum level of 12 moves per machine per hour per day for the period of deployment of machine for operations and shall be calculated as under: No. of moves per hour = M W Where M = Number of moves in a day & W = Number of effective working hours in the day (=24 - maintenance hours - breakdown hours - idle hours- break down hours on account of CONCOR) Average Moves by a machine (n) shall be calculated as defined under 18.1(b). The failure to achieve the average of 12 moves per hour for the month shall attract deductions. Further, the failure to achieve the daily average of 12 moves per hour of operations may also attract Damage charges. These would be regulated as per 18. It may also be noted that no additional payment shall be admissible for exceeding the minimum prescribed moves per hour. 16.
