Eubanks, Commissioner ORDER APPROVING REVISED TARIFFS On April 19, 2017, DTE Electric Company (DTE Electric) filed an application requesting authority to increase its retail rates for the generation and distribution of electricity by $231 million, and for other forms of regulatory relief including miscellaneous accounting authority. On April 18, 2018, the Commission issued a final order finding a jurisdictional revenue deficiency of $65,239,000, and authorizing DTE Electric to implement rates increasing its annual electric revenues by $65,239,000, on a jurisdictional basis, over the rates approved in the January 31, 2017 order in Case No. U-18014 (April 18 order). On April 27, 2018, the Commission issued an order adopting tariff sheets filed in accordance with the April 18 order. On May 21, 2018, DTE Electric, the Association of Businesses Advocating Tariff Equity (ABATE), and the Residential Customer Group (RCG) filed petitions for rehearing. On June 28,
2018, the Commission issued an order (June 28 order) granting in part and denying in part DTE Electric s petition, granting ABATE s petition, and denying RCG s petition. The decision on rehearing resulted in a final jurisdictional revenue deficiency of $74,412,000. The June 28 order further provided: D. DTE Electric Company shall file in this docket, and serve on all intervenors, revised tariff sheets and rate revenue summary sheets, as necessary to be consistent with all decisions in this order, along with supporting workpapers, no later than July 13, 2018. Intervenors may then file comments on the revised tariffs sheets no later than seven days from the date that the tariff sheets are filed and served. On July 9, 2018, DTE Electric filed Attachment A (cost of service study/production costs), Attachment B (present and proposed revenue by rate schedule), Attachment C (present and proposed revenue) and Attachment D (revised tariff sheets). DTE Electric also filed a proof of service on the parties to the proceeding. The Commission received one comment regarding the revised tariffs. ABATE agreed that the proposed rates prepared by DTE Electric are consistent with the Commission s prior orders. The Commission finds that Attachments A, B, C, and D, attached hereto, comply with the June 28 order and are approved. THEREFORE, IT IS ORDERED that DTE Electric Company is authorized to implement the rates set forth in Attachment D on a service rendered basis for service provided on and after August 1, 2018. Within 30 days of the date of this order, DTE Electric Company shall file tariff sheets substantially similar to those contained in Attachment D. Due to the size of Attachments A, B, C, and D, they are not physically attached to the original order contained in the official docket or paper copies of the order, but are electronically appended to this order, which is available on the Commission s website. The Commission reserves jurisdiction and may issue further orders as necessary. Any party desiring to appeal this order must do so in the appropriate court within 30 days after issuance and notice of this order, pursuant to MCL 462.26. To comply with the Michigan Rules of Court s requirement to notify the Commission of an appeal, appellants shall send required notices to both the Commission s Executive Secretary and to the Commission s Legal Counsel.
