STEP 4 of 9: Please Tell us about your ELECTRICAL needs: 4a) Each Vendor will have access to one electrical outlet. Check the amount of power you will need: None Under 10 Amps 10-20 Amps (1 small refrigerator, fan or equivalent) 20 Amps or More (1 Freezer, or equivalent) Check if 220 v plug is needed Initials: 4b) I understand that it is necessary to request enough power so that the festival is adequately prepared to supply everyone s electrical needs. I further understand that electrical power is provided at no charge, and that there is nothing to gain by under-reporting the amount of electricity I will need. Initials: 4c) I understand that the number one reason that fuses and circuits are blown is from the use of extension cords that are inadequate; and I further understand that any extension cords I bring for my own use will all be AT LEAST 12 gauge electrical cords. Initials: 4d) I understand that vendor booths will be checked to make sure we are not using more power than requested and that I will be asked to remove any inadequate extension cords that cause power failures! - STEP 5 of 9: Please review and acknowledge our insurance Policies: Initials: 5a) I understand that if I am selected as a vendor, America s Freedom Festival requires each vendor to provide a Certificate of Liability Insurance ($1,000,000 per occurrence / $2,000,000 aggregate), with America s Freedom Festival at Provo listed as a certificate holder valid July 1-4, 2016. Initials: 5b) I understand that All Certificates of Liability must be received by the deadline or vendor s booth location will be forfeited, and I further understand that the Freedom Festival will not be providing an insurance option this year. STEP 6 of 9: Please Review and initial our Standards: Initials: 6a) I understand that submitting an application does not guarantee me space in America s Freedom Day s Festival. I further understand that priority acceptance will be given to applicants with handmade or unique items, and/or to Booths with 4 th of July Themed items or displays, and/or to booths with an organized professional appearance. Initials: 6b) I understand that Vendors must have a physical presence in their booth during all posted Freedom Days hours. Initials: 6c) I understand that each Vendor must furnish his/her own canopy and furnishings. Initials: 6d) I understand that Booth security is the Vendor s responsibility. Initials: 6e) I understand that my Items/displays must be appropriate for ALL ages. I further understand that America s Freedom Festival reserves the right to deny the sale of any merchandise deemed inappropriate for ALL ages. Initials: 6f) I understand that Vendors will be assigned a specific time window for setting up, and that all Vendors must not set up their tent of booth display(s) at any time other than their assigned time window. Initials: 6g) I understand that Vehicles are not permitted as part of booth entry (except with advance permission from Festival Office) and that NO vehicles may be on the grass at any time. Initials: 6h) I understand that all sales must take place from within assigned booths, that no roving sales are allowed and that the flow of attendees/customers must not be impeded by any booth personnel handing out literature or samples outside of their assigned booth areas. Initials: 6i) I understand that America s Freedom Days Festival is not dependent on weather, and that fees will not be refunded in the event of inclement weather. Initials: 6j) I understand that Vendors must comply with the Utah State Tax regulations. (The Tax Commission will provide tax packets for each Vendor at check-in.) STEP 9 of 9: Please review and agree to our Rules and Regulations: 1. Authority and Compliance: Vendor represents to America s Freedom Festival at Provo (the Festival ) and its Freedom Days Committee (the Committee ) that he/she is fully authorized to sign for and bind the undersigned Vendor (the Vendor ) regarding the Application and Vendor s entry (the Entry ) in the 2016 Freedom Days event. Vendor agrees that Vendor s Entry and all persons associated with it shall comply with all rules, policies and procedures prescribed by the Festival and the Committee, as they deem necessary for the efficient, safe, and non-offensive conduct of the Freedom Days and related activities. Vendor agrees that neither the Entry nor any part thereof, including its employers 2. Promotion and Sale of Merchandise: Vendor agrees to exhibit and/or sell only those items listed on Vendor s Application and shown in Vendor s photographs, and which have been approved by the Committee. Vendor understands that it is the Committee s exclusive right and responsibility, in its sole discretion, or the discretion of the Committee s onsite representative during the Freedom Days activities, to remove any items that are inconsistent with or deviate from the content, style or quality of the works depicted in Vendor s photos and the final list submitted with Vendor s application, or which are otherwise not in compliance with the Freedom Days rules or policies, or which are too late, controversial, unlawful, or otherwise inconsistent with the historical standards, quality, theme, message or traditional purposes or values of the Festival. Vendor agrees that in any dispute over Festival policies, procedures or decisions, the Committee s final determination shall govern and shall be final and conclusive, and Vendor shall accept the same whatever the outcome. The Committee reserves the right to restrict or reject any Entry, even after preliminary acceptance, without any liability for any inconvenience, cost or damages on the part of Vendor, which prerogative may be exercised at any time in the Committee s sole judgment and discretion, consistent with the rules, policies, procedures and standards referenced herein. If any aspect of an Entry might be viewed as controversial or contrary to these policies and standards, or if Vendor has any doubt about Entry s acceptability or has any questions in this regard, Vendor acknowledges Vendor s duty to fully disclose the same and promptly resolve any such question or problem with the Committee well before the Freedom Days begins. 3. Indemnification: As a condition to being a participant in the Freedom Days, Vendor agrees to assume full responsibility for Vendor s conduct (which for purposes of this paragraph 3 includes the conduct of all employees, subcontractors, suppliers, guests and customers of Vendor and any other persons associated with Vendor or participating in Vendor s Entry), and for the content and presentation of Vendor s Entry, and to indemnify and hold harmless the Festival, the Committee, its members, and all individuals having any responsibility therefore, from and against any and all liabilities, claims, damages, losses and expenses (including attorney s fees) incurred or suffered by the Festival, the Committee, and/or such responsible individuals that is caused by or arises from (a) any negligent act or omission by Vendor or any person associated with Vendor or the Entry, (b) any breach of Vendor s representations, warranties, or obligations herein, (c) any claim by any of Vendor s employees, subcontractors, suppliers, guests or customers, or (d) any infringement or violation by Vendor or Vendor s associates of the rights of others. 4. Weather: Fees will not be refunded in the event of inclement weather. Vendor is responsible for any damages to or from your booth and/or product. 5. Right of Termination: If Vendor violates any material term of the Rules and Regulations contained in this Agreement, the Committee shall have the right to terminate this Agreement, immediately close Vendor s booth(s), and retain all prior payments by Vendor.
