Dated 19 th April, 2007 Subject: Payment of internal transport and freight charges on exports of domestically manufactured sugar In exercise of powers conferred by Clause (bbb) of Section 4 of the Sugar Development Fund Act, 1982, the Central Government has decided that exports made by a sugar factory itself or through an exporter or any third party exporter, of its domestically manufactured sugar, would, for the purposes of internal transport and freight charges (which would include ocean freight disadvantage and handling and marketing charges) on such exports, be eligible for the following payments from the Sugar Development Fund: a) For the sugar manufactured by the sugar mills located in the coastal States of India, the payment will be at a flat rate of Rs.1350 per tonne of sugar exported and b) For the sugar manufactured by the sugar mills located in other than the coastal States of India, the payment will be at a flat rate of Rs.1450 per tonne of sugar exported. 2.0 Exports made under OGL only (and not under advance license ) on or after 19 th April 2007 and within 18 th April 2008 or till further orders, whichever is earlier, would be eligible for payment of above charges. 3.0 Procedure for making claims for the payments and the documents required to be furnished with the claims will be notified shortly. Dated 27 th July, 2007 Subject: Payment of internal transport and freight charges on exports of domestically manufactured sugar In supersession of earlier Order of even No. dated 19 th April,2007 and in exercise of powers conferred by Clause (bbb) of Section 4 of the Sugar Development Fund Act, 1982, the Central Government has decided to reimburse to a sugar factory a part of the expenditure incurred for the purpose of internal transport and freight charges (which would include ocean freight and handling & marketing charges) on exports of its domestically manufactured sugar, which includes raw sugar, exported by a sugar factory itself, through an exporter or any third party exporter. On careful consideration of all the costs involved on such exports, the Government has decided to limit the payment as follows:- a) For the sugar manufactured by the sugar mills located in the coastal States in India, the payment will be Rs.1350 per tonne of sugar exported and b) For the sugar manufactured by the sugar mills located in other than the coastal States of India, the payment will be at a flat rate of Rs.1450 per tonne of sugar exported. Provided that the payment to the factory for the exports made to neighbouring countries like Bangladesh, Pakistan, Nepal etc. solely, by road and/or rail, not involving movement by sea/ocean, will be the actual expenditure incurred on the above mentioned charges or will be the above mentioned amount, whichever is less. 2.0 Exports made under OGL only (and not under advance license ) on or after 19 th April 2007 and within 18 th April 2008 or till further orders, whichever is earlier, would be eligible for payment of above charges. 3.0 Procedure for making claims for the payments and documents required to be furnished with the claims will be notified separately. Sir, As per SDF Rule 20 (A) notified on 7 th November,2007 sugar mills are required to submit their export assistance claims within 90 days from the notification date or from the date of issue of last BRC whichever is later. Deduction of 10% of the admissible amount would be made if claim is submitted after 90 days but within 180 days. Ninety days from the date of notification will expire on 4 th February,2008. 2. The applications for payment of export assistance are being registered and acknowledged on first-come-first served basis by this Department. A permanent registration number is allotted in case the claim is found to be complete but in case of incomplete claim a temporary number is allotted. The claims which are complete i.e. when a permanent registration number has been issued, would be processed further serially for consideration. 3. You are requested to advise concerned sugar mills to furnish their export assistance claim at the earliest for early payment. Please note that for BRCs issued before the time of notification of SDF Rule 20 A the claim should be submitted by 4 th February, 2008 to avoid any deductions or rejections. Sir, This is request you to provide details in respect of exported quantity and anticipated exports of sugar under Open General Licence (not under Advance Licence) by the sugar mills separately for the period from 19.4.2007 to end of January 2008, subsequently for the month of February and March 2008 (separately for both months) and further for the months of April to June,2008 and July to September,2008. The forward contracts entered into by sugar factories may be used as proxy for estimating future exports. This would enable this Department to provide sufficient funds for the export assistance scheme in this (2007-08) financial year as well in 2008-09 financial year. 2. It may be ensured that export assistance claims may be submitted by 25-26 th March, 2008 to facilitate payment during the financial year 2007-08 to cover exports upto January, 08 at the very least, so as to utilize the budgetary provision made for the purpose. On a review of export assistance claims submitted by sugar mills to this office, it has been observed that a large number of claims are pending for want of reply from sugar mills to the letters issued by this Department upto 1 st July, 2008 calling for necessary clarifications/documents/rectifications of mistakes etc. However, in a large number of cases, there has been no response from the mills to these letters. It has been decided that the sugar mills would be allowed to send their replies with required clarifications/documents to this office by August 31, 2008 only. The time limit will apply to the cases where such deficiencies/discrepancies can be rectified by sugar mills themselves and does not involve other Government Departments. In case they fail to submit aforesaid reply by August 31, 2008, their claims may not be processed further for settlement. You are requested to kindly give this wide publicity. Sir, The Central Government had announced an export assistance scheme and amended the SDF Rules, 1983 by insertion of SDF Rules 20A to provide financial assistance to sugar factories for exports of sugar made by them on or after 19 th April, 2007 and upto 18 th April, 2008. The scheme has since been extended for exports made upto 30 th September, 2008. In order to remove any confusion regarding consideration of the relevant date as the export date for the exports of sugar made by sugar factories, it is hereby clarified that the sugar for exports which have been handed over to the ship/vessel and the mate receipt issued for such exports by 30 th September, 2008 will be eligible for the export assistance under the SDF Rules 20A. Exports for which Mate receipts are dated after 30 th September, 2008 would not be eligible for the export assistance under the above scheme of the Central Government. You are requested to kindly give wide publicity of this clarification to all the concerned sugar factories. A copy of this letter is also being put up on the website of this Ministry.
