Credit Card Package Insurance This document sets out a summary of the cover, limits and exclusions applicable for HSBC Credit Card Package Insurance arranged under Master Policy Number 10CBN11-02208828 ( the Policy ) issued by AXA General Insurance Hong Kong Limited ( the Insurer ). Eligible Persons and Insured Persons Cardholders are individuals issued with a HK Dollar HSBC World Business MasterCard or HK/US Dollar HSBC Corporate MasterCard ( the Card ) by The Hongkong and Shanghai Banking Corporation Limited ( the Bank ) at its Hong Kong Special Administrative Region (HKSAR) Office. All Cardholders, their accompanying spouse and dependent children under 23 years of age shall be the Eligible Persons. Each Eligible Person shall be an Insured Person while having an Insured Journey, provided the fare/invoice of the scheduled departure from HKSAR to place(s) outside HKSAR has been purchased and charged to the Card. 'Insured Journey' means the journey in connection with the planned business or leisure trip commencing from the time when the Insured Person leaves his/her Place of Residence or Place of Business in the HKSAR, whichever is later, for the sole purpose of commencing the journey until the time of direct return to his/her Place of Residence or Place of Business in the HKSAR on completion of the journey or at the expiration of the maximum duration of Insured Journey of 7 calendar days, whichever is earlier. In any event, insurance shall not commence more than 3 hours prior to scheduled departure time and shall cease 3 hours after scheduled return to the HKSAR. Section 1. Personal Accident In the event of accidental injury being sustained by an Insured Person during an Insured Journey which shall result in death or disablement, the following benefit will be paid: Schedule of Benefits: Loss of life... HK$1,000,000 Loss of both hands or both feet... HK$1,000,000 Loss of one hand and one foot... HK$1,000,000 Loss of entire sight of both eyes... HK$1,000,000 Loss of entire sight of one eye and one hand or one foot... HK$1,000,000 Loss of one hand or one foot... HK$500,000 Loss of entire sight of one eye... HK$500,000 Medical Expenses... Up to HK$1,000 Provisions 1. The Benefits specified in this Section will be paid if while the Policy is in force an Insured Person suffers loss resulting, directly by accidental violent, external and visible means and independently of all other causes, from accidental bodily injury during an Insured Should the fare/invoice of the schedule departure from HKSAR to place(s) outside HKSAR charged to the Card Account be a partial payment of the full purchase price or charge only, the limit of benefit shall be prorated on the ratio that the partial payment bears to full purchase price or charge. 2. When injury results in loss of life of the Insured Person within 100 days after the date of accident, the Insurer will pay the loss of Life Accident Benefits as stated in the Schedule of Benefits. 3. When injury does not results in loss of life of the Insured Person within 100 days after the date of the accident but does result in any one of the losses stated in the Schedule of Benefits within 100 days after the date of the accident, the Insured will pay the respective amount but not exceed the specified Loss Accident Benefits stated in the Schedule of Benefits. If more than one Loss results from one accident, only the Specified Loss with greater amount of benefit will be paid. Loss, with reference to hand or foot, means complete severance through or above wrist or ankle joint and, as used with reference to eye, means irrecoverable loss of the entire sight thereof. 4. The Limit of Benefit for which the Insurer shall be liable for all losses to any one Insured Person arising out of any one accident is HK$1,000,000.00. 5. When, by reason of an accident covered by this Policy, an Insured Person is unavoidably exposed to the elements and, as a result of such exposure, suffers a loss for which Benefit is otherwise payable hereunder, such Loss shall be covered under the terms of this Policy. If the body of the Insured Person has not been found within one year of disappearance, sinking, wrecking of the public conveyance or hired vehicle in which the Insured Person was riding at the time of the accident, it will be presumed that the Insured Person suffered loss of life resulting from bodily injury caused by an accident at the time of such disappearance, sinking or wrecking. 6. No benefits will be payable for loss, fatal or non-fatal, caused by or resulting from (a) (b) (c) (d) Suicide or attempted suicide, willfully selfinflicted injury, insanity, alcoholism or selfexposure to needless perils (except in an attempt to save human life). Illegal acts of Insured Person or an Insured Person s designated beneficiary, executor(s) or administrator(s), legal heirs or personal representative(s). The Insured Person having more than the legally permitted level of alcohol in the blood whilst driving any kind of vehicle. The Insured Person having taken a drug, unless it is proved that the drug was taken in accordance with proper medical prescription and not for treatment of drug addiction. 7. Medical Expenses means the actual expenses paid by the Insured Person to a duly qualified and registered medical practitioner, physician, nurse or hospital for medical, surgical or nursing treatment including the cost of medical supplies and ambulance hire, but excluding the cost of dental treatment unless such treatment is caused by accidental injury. Provided that in the event of the Insured Person becoming entitled to a refund of all or part of such expenses from any other source, the Insurer will only be liable for the amount not recoverable from such other insurance policy or other source. Section 2. The Benefits specified in this Section will be paid if the Travel Inconvenience occurs during an Insured Journey and while the Policy is in force. Insured Journey has the same meaning as defined in Section 1 Personal Accident. 2. Missed Connection means if the Insured Person s confirmed onward connecting schedule flight is missed at the transfer point due to the late arrival of the Insured Person s incoming confirmed connecting schedule flight and no alternative onward transportation is made available to the Insured Person within 4 hours of the actual arrival time of his or her incoming flight, the Insurer will make cash settlement direct to the Insured Person according to the fixed amount as stated in this Section. 2.1 No benefit will be payable under this item if payment has been made for the same loss under Travel Delay. 3. Luggage Delay means if the Insured Person s accompanied check-in luggage is not delivered to him or her within 6 hours of the Insured Person s arrival at the scheduled destination of his or her flight, such luggage will be assumed to be delayed and the insurer will make cash settlement direct to the Insured Person according to the fixed amount as stated in this Section. 3.1 No benefit will be payable: (1) if the delay arises from detention or confiscation by customs or other officials or authorities. (2) unless the delay is certified by a Baggage Irregularity Report from the airline or with a letter from the tour operator. 4. Luggage Loss means if the Insured Person suffers loss or damage to his or her luggage owned by him or her taken, sent in advance or purchased on an Insured Journey (including clothing and personal effects, worn by or carried on by the Insured Person, in trunks, suitcase and receptacles), occurring during an Insured Journey, the Insurer will pay up to the limit specified in this Section. 4.1 Benefit will only be payable: (1) if the Insured Person observes ordinary and proper care for the safety of the luggage and personal effects, including examination of luggage when received. (2) if the Insured Person is aware of any destruction, loss or damage and gives immediate notice: i. to the police, in the case of theft, loss or willful damage by a third party, and ii. to the carrier, in the case of loss or damage in transit. 4.2 The Insurer may, at its discretion, opt to replace or repair any item instead of paying cash benefit. 4.3 No benefit will be payable: (1) for the first HK$300 of each and every claim (2) for normal wear and tear, gradual deterioration, mechanical or electrical breakdown or derangement. (3) for loss or damage arising from delay, confiscation, detention, requisition or destruction by customs or other officials or authorities. (4) for loss or damage to money, plastic money (including credit cards, Octopus cards etc) and other instruments of payment, bonds, coupons, stamps, negotiable instruments, title deeds, manuscripts, securities, travel documents or documents of any kind. (5) for breakage of or damage to fragile articles, glass, portable electronic entertainment devices, television apparatus, musical instruments, sculptures, household goods or equipment unless occasioned by an accident to the conveyance in which the baggage is being carried. (6) for loss or damage to any business goods or samples. (7) for damage to or replacement of any electronic data or software. (8) in respect of loss or damage whilst in the custody of an airline or other carrier, unless reported immediately on discovery and in the case of an airline, a Baggage Irregularity Report obtained. (9) in respect of losses not reported to the police within 24 hours upon discovery and unless a police report obtained. (10) under this item if payment has been made for the same loss under Luggage Delay. 5. Legal Expenses shall mean any amount incurred for reimbursement during the Insured Journey for the following: 5.1 if the Insured Person is detained by authorities. 5.2 if the Insured Person is otherwise in need of legal assistance. The insurer will pay up to the limit specified in this Section. 6. Personal Money and Travel Documents means if the Insured Person suffers accidental loss of personal money or travel documents taken on an Inured Journey, the Insurer will pay up to the limit specified in this Section. Such Loss must be reported to the police having jurisdiction at the place of loss, within 24 hours of the loss, or discovery of the loss. Any claim must be accompanied by written documentation from such police. Personal Money shall mean cash, bank notes, cheques, travelers cheques and money orders. Travel Documents shall mean the documents of identity belonging to the Insured Person including passport, visa and the like necessary and solely for immigration clearance of the Insured Journey 6.1 No benefit will be payable for: (1) shortages due to error, omission, exchange or depreciation in value. (2) loss of travelers cheques not immediately reported to the local branch or agent of issuing authority. (3) the first HK$200 of each and every claim.. 7. Travel Delay means if, during an Insured Journey, the departure of the public conveyance in which the Insured Person has arranged to travel is delayed for at least 6 hours from the time specified in the travel itinerary supplied to the Insured, due to strike or industrial action, hijack, adverse weather conditions, mechanical breakdown and derangement of that aircraft or sea vessel or due to grounding of an aircraft as a result of mechanical breakdown or structural defect, the Insurer will pay HK$250 for first full 6 hours delay and for each subsequent full 12 hours delay (the delay being calculated from the departure time of the aircraft or sea vessel specified in the itinerary) up to a maximum limit as specified in this Section. 7.1 No benefit will be payable for a delay: (1) arising from failure of the Insured Person to check in with the carriers (or their handling agents) according to the itinerary supplied to him/her. (2) arising from strike or industrial action already existing at the time of booking the scheduled Insured Journey (3) arising from late arrival of the Insured Person at the airport or port after check-in booking-in time (except for the late arrival due to strike or industrial action). 7.2 No benefit will be payable unless the Insured Person obtains written confirmation from the carriers (or their handling agents) of the number of hours of delay and the reason for such delay. 7.3 No benefit will be payable under this item if payment has been made for the same loss under Missed Connection. 8. Loss of Deposit or Cancellation means if the Insured Person suffers loss of tour or airfare deposits or payments made with respect to the cancellation of a scheduled Insured Journey before it is commenced, which are irrecoverable from the tour operator or airline, the Company will indemnify up to the limit as specified in this Section. 8.1 Benefit will be paid under item 8 only for cancellation losses arising from: (1) the death, illness or serious bodily injury of the Insured Person, Insured Person s spouse, parent, parent-in-law, grandparent, child, sister, brother, fiancé, fiancée or close business associate resident in the HKSAR. (2) a witness summons, jury service or compulsory quarantine of the Insured Person; (3) the unexpected outbreak of riot or civil commotion [notwithstanding General Exclusion 2] or strike at the planned destination arising out of circumstances beyond the control of the Insured Person; (4) the serious damage of the Insured Person s principal residence or business premises from fire, flood, or similar natural disaster (typhoon, earthquake, etc.) within one week before the departure date which requires the Insured Person s presence at his/her principal residence or business premises on the departure date. (5) the issuance of Black Alert concerning the planned destination. 8.2 No benefit will be payable for : (1) loss arising from Black Alert, medical conditions or circumstances in existence prior to the date of booking the scheduled Insured (2) the first HK$200 of each and every claim. (3) loss arising directly or indirectly from government regulation or Act, delay or amendment of the booked itinerary or failure in provision of any part of the booked holiday (including error, omission or default) by the provider of any service forming part of the booked holiday as well as of the agent or tour operator through whom the holiday is booked. (4) loss arising directly or indirectly from the disinclination to travel or the financial circumstances for any Insured Person. (5) loss resulting from any unlawful act or criminal procedure of any person on whom the travel plans depend. (6) loss arising directly or indirectly from failure to notify the travel agent/tour operator or a provider of transport or accommodation immediately it is found necessary to cancel or curtail the travel arrangement. (7) loss that is covered by any other existing insurance scheme, government programme or loss which will be paid or refunded by a hotel, airline, travel agent or any other provider of travel and/or accommodation. Travel Alert is the alert issued by the Government of HKSAR under the Outbound Travel Alert (OTA) System. There are 3 levels of Travel Alert: Amber Alert, Red Alert and Black Alert. The Insurer may amend the definition of Travel Alert from time to time based on any change to the OTA System made by the Government of HKSAR. 9. Curtailment of Trip means if the Insured Person suffers loss in respect of unused irrecoverable prepaid transport costs or accommodation charges included in the contracted Insured Journey and additional hotel and repatriation costs to the HKSAR incurred due to the necessary and unavoidable curtailment of an Insured Journey, the Insurer will pay up to the specified limit in this Section as a direct result of : (a) the death, bodily injury, illness or sickness of the Insured Person, a travelling companion, Insured Person s spouse, parent, parent-in-law, grandparent, child, brother, sister, fiancé, fiancée or close business associate resident in HKSAR. (b) riot or civil commotion [notwithstanding General Exclusion 2] or hijack occurring outside the HKSAR which first occurs during the Insured (c) Black Alert concerning the planned destination first issued during the Insured 9.1 Benefit will only be paid under this section when any event giving rise to a claim did not exist at the time of booking the scheduled Insured 9.2 No benefits will be payable : (1) for claims arising from Black Alert, medical condition or circumstances known to exist at the time of booking the scheduled Insured (2) if the person whose condition gives rise to any claim was receiving in-patient treatment in a hospital, or had received a terminal prognosis at the time of issue of travel related documents or the like for the Insured (3) for the first HK$200 of each and every claim. Curtailment means abandonment of the planned Insured Journey after arrival at the booked destination as shown on the booking invoice by return to place or residence in the HKSAR. 10. Golfing Hole-in-One means if the Insured Person achieves a Hole in One whilst playing golf at any recognised golf course in the world, the Insurer will make the cash settlement direct to the Insured Person according to the fixed amount as specified in this Section. 10.1 Benefit will be paid under this Section on submission of a signed/countersigned score card recording the event. General Policy Provisions 1. Duplicate or multiple issues of the Card by The Hongkong and Shanghai Banking Corporation Limited shall not obligate the Insurer in excess of the limits stated in this Policy. 2. The Insured Person shall take all reasonable precautions to prevent loss or damage. 3. Benefit for Loss of Life will be payable in accordance with the Insured Person s designation and the provisions respecting such payment which may be prescribed herein and effective at the time of payment. If no such designation or provision is then effective, such benefit shall be paid to the surviving person or persons in the first of the following classes of successive preference beneficiaries : (a) spouse; (b) children, including legally adopted children; (c) parents; (d) brother and sisters; (e) executor or administrator or legal heirs or personal legal representative. In determining such person or persons, the Insurer may reply upon an affidavit by a member of any of the classes of preference beneficiaries. Payment made in reliance upon such affidavit shall be good discharge for the Insurer hereunder unless, before such payment is made, the Insurer has received written notice of a valid claim by some other persons. If two or more persons become entitled to benefit as preference beneficiaries, they shall share equally. Any other accrued benefits unpaid at the Insured Person s death will be paid to such beneficiary. All other benefits will be payable to the Insured Person. 4. The Policyholder shall, at the expense of the Insurer, do and concur in doing, and permit to be done, all such acts and things as may be necessary or reasonably required by the Insurer for the purpose of enforcing any rights and remedies, or of obtaining relief or benefit from other parties to which the Insurer shall be or would become entitled or subrogated, upon its paying for or making good any loss or damage under this Policy, whether such acts and things shall be or become necessary or required before or after his or her indemnification by the Insurer. 5. Payment of Benefit under this Policy shall be in the currency of Hong Kong dollars only. General Exclusions The insurance under this Policy does not cover : 1. Loss or damage arising from detention, seizure, confiscation, destruction or requisition by act or order of Customs or other Official bodies or Authorities. 2. Claims arising directly or indirectly as a result of riot, civil commotion, war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolutions, insurrection or military, usurped power or confiscation or nationalisation or the act or order of any government or public or local authority. 3. Any consequence of : 3.1 loss or destruction of or damage to any property whatsoever or any loss or expenses whatsoever resulting or arising therefrom or any consequential loss; 3.2 any legal liability of whatsoever nature directly or indirectly caused by or contributed to or arising from (a) ionising radiations or contamination by radioactivity from any unclear fuel or from nuclear waste from any process of nuclear fission, or from any nuclear weapons materials. (b) the radioactive toxic explosive or hazardous properties of any nuclear assembly or unclear component thereof 4. Loss, destruction or damage directly occasioned by pressure waves caused by aircraft or other aerial device travelling at sonic or supersonic speeds. 5. Claims arising directly or indirectly as a result of: (i) any venereal disease or Acquired Immunodeficiency Syndrome (AIDS), AIDS related complex or infection by Human Immuno-deficiency Virus (HIV); (ii) childbirth, pregnancy or miscarriage notwithstanding that such injury may have been accelerated or induced by an accident; (iii) engaging in : (a) professional sports (b) racing other than on foot (c) deep water diving (that is diving to a depth of greater than 40 metres) (d) motor rallies and competitions (e) sports or activities involving financial gain or payment other than reimbursement of reasonable travel or out of pocket expenses (f) aviation other than as a fare-paying passenger in a licensed aircraft operated by a recognised airline or air charter company which is duly licensed by the relevant authorities for the regular transportation of fare-payment passengers. (g) military service, armed forces and police (h) works as ship crews (iv) engaging in duty with the fire, naval, airforce or military services or any armed force of any country or international authority; (v) engaging in offshore or mining aerial photography 6. Violation or attempted violation of the law or resistance to arrest. 7. Claims in respect of any property otherwise insured. If the Insured Person is entitled to payment under any other insurance policy or other source in circumstances where he or she would be entitled to claim under this Policy (except Section 1 Personal Accident, Missed Connection, Luggage Delay, Travel Delay, and Golfing Hole in One under Section 2 Travel Inconvenience), the Insurer will only be liable for amounts not recoverable from such other insurance policy or other sources. 8. Claims arising from incidents not notified in writing to the Insurer within 21 days of the expiry of such Insured 9. Any pre-existing condition. 10. Notwithstanding any provision to the contrary within this Agreement/Policy or any Addendum/endorsement thereto it is agreed that this policy excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any act of terrorism regardless of any other cause or event contributing concurrently or in any other sequence to the loss. For the purpose of this exclusion an act of terrorism means an act, including but not limited to the use of force or violence and/or the threat, of any person or group(s) or persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s), committed for political, religious, ideological or similar purpose including the intention to influence any government and/or to put the public, or any section of the public, in fear. This exclusion also excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to any act of terrorism. If the Insurer alleges that by reason of this exclusion, any loss, damage, cost or expense is not covered by this Policy, the burden of proving the contrary shall be upon the Insured Person. notify the Police immediately of any loss by deception, theft, malicious acts, riot and civil commotion. 2.2 In the event of a claim the Insured Person must disclose to the Insurer details of all other insurance cover under which the Insured Person is entitled to claim and a claim must first be made under that insurance and the Insured Person must do all things necessary and proper to pursue that claim. Governing Law and Jurisdiction This Policy shall be governed by and interpreted in accordance with the HKSAR laws and all parties hereto agree to submit to the non-exclusive jurisdiction of the HKSAR Court. The above shall be read in accordance with and shall not be construed so as to modify, add to or in any way vary the full Terms, Conditions and Exclusions endorsed on the Master Policies. In the event any portion of this exclusion is found to be invalid or unenforceable, the remainder shall remain in full force and effect. Claims 1. Proof of Claim All information and evidence required by the Insurer or its agents shall be furnished at the expense of the Insured Person or his or her personal representatives and shall be in such form and of such nature as the Insurer may prescribe. 2. Claims Procedure 2.1 Telephone the Insurance Hotline on (852) 3070 5000 (Monday to Friday, 8:45 to 17:35) for policy coverage and Claims Hotline on (852) 3070 5002 (Monday to Friday, 9:00 to 18:00 and Saturday, 9:00 to 13:00) for claims enquiry or written notice of all claims must be given by or on behalf of the Insured Person as soon as possible but not later than 21 days after the event giving rise to the claim to AXA General Insurance Hong Kong Limited.
