SUMMARY OF APPEARANCE PROTECTION PLUS OVERVIEW Appearance Protection Plus is a limited product warranty for a vehicle s paint, fabric, vinyl, and leather. It is designed for both franchise and independent dealers. It was created to work in concert with Appearance Protection Basic as an up sell. However, there is not a price reduction since the price of Appearance Protection Plus is still less expensive than the price of similar products sold by our competitors. VEHICLE ELIGIBILITY New vehicles up to four (4) years old with any mileage are eligible. Used vehicles up to ten (10) years old with any mileage are eligible. COVERAGE Paint Protection will prevent weather-induced fading, oxidation, cracking, peeling, loss of gloss, and permanent stains from bird droppings, insects, tree sap, hard water etching, acid rain, and industrial fallout. Fabric Protection will prevent weather-induced fading and permanent stains from food, lipstick, makeup, crayons, chewing gum, and oil or water-based spills. Vinyl & Leather Protection will prevent weather-induced fading, cracking, and permanent stains from food, lipstick, makeup, crayons, chewing gum, and oil or water-based spills. TERMS ADDITIONAL BENEFITS The Agreement has blank terms contingent upon the corresponding rate card. The provisions of this warranty begin on the vehicle date of sale and end when the time for the selected term has elapsed. MONTHS WHAT IS COVERED The provisions of this Warranty apply only to the customer, hereinafter referred to as You, and the vehicle listed above. PAINT PROTECTION: The Warrantor ensures that the approved appearance protection product, when applied to the painted exterior surfaces of Your vehicle, will prevent weather induced fading, oxidation, cracking, peeling, loss of gloss, and permanent damage from bird droppings, insects, tree sap, hard water etching, acid rain, and industrial fallout. NOTE: Painted exterior surfaces include bumpers and spoilers. FABRIC, VINYL, AND LEATHER PROTECTION: The Warrantor ensures that the approved appearance protection product, when applied to the interior fabric/vinyl/leather of Your vehicle, will prevent weather induced fading, cracking and permanent stains from food, lipstick, makeup, crayons, chewing gum, and oil or water based spills (e.g. dye, grease, oil, juice, beverages, wine, and any similar non-corrosive or non-volatile liquids). WHAT IS NOT COVERED Anything not listed under BENEFITS or ADDITIONAL BENEFITS is not covered. In addition, this Warranty does not apply to any of the following items: 1. Any repair that has not received prior authorization from the Warrantor 2. Any damage existing prior to the vehicle date of sale (i.e. pre-existing conditions) 3. Any surface damaged by surface rust, road stones, debris, foreign objects, fires, or natural disasters (e.g. hail, sandstorms, and tornadoes) 4. Any repair covered by an insurance policy or the manufacturer s warranty 5. Grilles, decals, truck beds, wiper assemblies, molding, trim, headliners, floor mats, and any surface not normally treated with the Warrantor approved appearance protection product 6. Stains that are the result of paint spills, bleach, blood, vomit, acid, or other corrosives 7. Any interior suede, saddle or split grain leather, metal, or plastic 8. Any tears, punctures, scratches, or burns 9. Any damage resulting from vandalism, accident, alteration, neglect, or abuse 10. Material defects or flaws that occurred when the vehicle was manufactured 11. Any area that can be successfully cleaned using suggested methods provided by the manufacturer of the vehicle 12. Vehicles used for plowing snow, competitive driving, municipal services, professional emergency services, police services, public hire, transferring people for hire, or other commercial purposes 13. Incidental, consequential, or punitive damages 14. Any costs associated directly or indirectly from forgery or any dishonest or fraudulent act AUTHORIZATION MUST BE OBTAINED FROM THE WARRANTOR PRIOR TO THE COMMENCEMENT OF REPAIRS. You must regularly inspect and maintain the paint, fabric, vinyl, and leather of Your vehicle as recommended by the manufacturer. 2. You must remove damaging substances from the paint, fabric, vinyl, and leather as soon as possible (failure to do so may be considered neglect). HOW TO OBTAIN SERVICE 1. If the affected area is damaged or cannot be successfully cleaned, then contact the selling dealer within 30 days of the incident to arrange a time to have the affected area inspected. 2. Take a copy of this Warranty with You when You have the affected area inspected. Upon inspection, the selling dealer will contact the Warrantor with Your Warranty information. 3. If a valid claim is presented, the Warrantor will determine and authorize the appropriate repair of the affected area(s) and the reapplication of the applicable protection treatment, free of charge. There is no deductible. This protection plan does not provide for any other remedies, including directly paying You money. NOTES: (1) If You are unable to return to the selling dealer, then contact the selling dealer for further instructions. (2) The Warrantor reserves the right to inspect any affected area prior to the approval of any repair. If, upon inspection, any damage is covered by this plan, then the Warrantor will authorize payment for the appropriate remedy. LIMITS OF LIABILITY The Warrantor s liability for used vehicles (vehicles 5 years or older at the time of sale) is limited to the following repairs: cleaning, dyeing, polishing, or detailing only the damaged portion of the treated surface. The Warrantor s liability for new vehicles (vehicles 4 years or newer at the time of sale) is limited to the following repairs: cleaning, dyeing, polishing, detailing, restoring, replacing, or repainting only the damaged portion of the treated surface. When repairing, replacing, or repainting the interior or exterior of any treated surface, it may not always be possible to exactly match the color and/or texture of the undamaged treated surfaces. These discrepancies are not covered. For all vehicles, the Warrantor s liability per repair visit, under any circumstances, shall not exceed the NADA clean trade-in value of the vehicle listed above, immediately prior to repair. In addition, the total of all benefits paid or payable under this Warranty shall not exceed the price of the vehicle at the time of sale (excluding tax, title and license fees). SAMPLE ONLY TRANSFER OF VEHICLE OWNERSHIP If You sell Your vehicle or if there is any change in the ownership of Your vehicle, this Warranty will terminate. However, You may request to transfer the remaining coverage of this Warranty to the new owner within 30 days of the change in vehicle ownership. You must notify the Warrantor in writing and include the following: a transfer fee of $25, the name and address of the purchaser, a copy of the bill of sale or sales contract showing the date and mileage of Your vehicle at the time of sale, and proof that You transferred the remaining manufacturer s warranty (if available) to the purchaser of Your vehicle. The Warrantor has the discretion to approve or reject Your request. This Warranty may not be transferred more than once, may not be assigned to another vehicle, and may not be transferred to a new or used vehicle dealer or anyone other than an individual purchasing Your vehicle for personal use. John was here! OTHER IMPORTANT INFORMATION The Warrantor may cancel this Warranty for material misrepresentation or substantial breaches of contractual duties, conditions, or warranties. This Warranty cannot be cancelled or renewed by the customer. The duration of any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, is limited to the duration of this Warranty. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to You.
