GENERAL AGREEMENT ON TARIFFS AND TRADE RESTRICTED COM.TEX/SB/1227* 23 February 1987 Special Distribution Textiles Surveillance Body ARRANGEMENT REGARDING INTERNATIONAL TRADE IN TEXTILES Notification under Article 4:4 Bilateral Agreement between Canada and Bangladesh The Textiles Surveillance Body received a notification from Canada of a bilateral agreement concluded with Bangladesh for the period 1 April to 31 December 1986 with respect to pants» trousers, shorts, overalls and coveralls. The TSB, pursuant to its procedures regarding bilateral agreements notified under Article 4, has examined the relevant documentation and is forwarding the text of the notification to participating countries for their information. Page 2 BILATERAL RESTRAINT AGREEMENT BETWEEN THE GOVERNMENTS OF CANADA AND THE PEOPLE'S REPUBLIC OF BANGLADESH ON THE EXPORT OF PANTS, COVERALLS, OVERALLS AND SHORTS Delegations of the Governments of Canada and the People's Republic of Bangladesh met in Dhaka on April 6 and 7, 1986 to discuss the export of pants, shorts, overalls and coveralls from Bangladesh to Canada. These consultations were held pursuant to an MFA Article 3 request made by Canada in November 1985 and followed an earlier round of negotiations held on February 10 and 11, 1986, in Ottawa. 2. The two delegations, after a number of sessions, concluded an agreement under Article 4 of the MFA. It was agreed that Bangladesh would restrain its exports to Canada of cants, shorts, overalls and coveralls to an annual level of 825,000 units of which no more than 225,000 shall be trousers, pants, slacks or jeans (M3WG) as defined in Item 3A"of Annex II to this Agreed Record. This arrangement shall take effect from April 1, 1986. In the period April 1, 1986 to December 31, 1986 the Government of the People's Republic of Bangladesh will restrain its exports to Canada of pants, shorts, overalls and coveralls to a level of no more than 618,7 50 of which no more than 168,750 shall be trousers, slacks, pants or jeans (MBWG). 3. The two sides agreed that the above restraint agrser.ent will be subject to the following terms and conditions: i) The quantity of pants, shorts, overalls and coveralls to be exported to Canada under this agreement shall be counted from the date of shipment of exports from 3angiadeshi starting from 1.4.86 ii) The Government of Canada will admit imports of pants, shorts, overalls and coveralls, provided such imports are covered by an original copy of a Bangladesh Export Licence issued by the Export Promotion Bureau. The Bangladesh authority shall communicate to the Government of Canada specimen signatures of the officials of the Export Promotion Bureau authorized to sign the Export Licence. iii) The Export Licences issued by the Government of the People's Republic of Bangladesh in respect of pants, shorts, overalls and coveralls will contain the following information:

Quantity expressed in units 8. F.O.B. or C.I.F. value except for noncommercial consignments 9. Certification by the Bangladesh authority that the quantity has been debited against the agreed restraint level for exports to Canada 10. Quota year. A specimen copy of the Export Licence form is attached as Annex III., There shall be a swing limit of 6% between the category covered by this arrangement and a category or categories subject to restraint in other arrangements agreed to between the Government of Canada and the Government of the People's Republic of Bangladesh. Subject to any specific limitations set out in this or any other relevant arrangement between Canada and Bangladesh and following notification to the Canadian authorities, any restraint level may be exceeded by 6i provided that an equivalent amount is deducted from the other res.raj.nt level. When any restraint level is exceeded by the application of swing, the government of the People's Republic of Bangladesh will so indicate in sub.aeqaent quarterly returns. For the purpose of implementing the swing provisions mentioned in sub-para (iv) above, the conversion factor will be 1.9 sq metre/unit. The Government of Canada will, so far as possible, inform the Government of the People's Republic of Bangladesh when imports into Canada of pants, slacks, overalls and coveralls subject to this arrangement are subsequently re-exported from Canada. Where such re-exports have been debited by the Government of th2 People's Republic of Bangladesh to quantitative limits, the Government of the People's Republic of Bangl idesh may then credit the amount involved to the ajpropriate quantitative limits.

Gender - Unless otherwise indicated, all definitions of garments apply to garments for men, boys, women, girls, children and infants. Children's and infants' garments include all garments sized 0-6X. 2. All garment items include partially manufactured garments, i.e., garments which have been cut and sewn, or otherwise assembled, but which require further manufacture or processing. 3. Garments of indeterminate gender, including unisex garments, are to be counted as of male gender. 4. "Wholly or mainly" is 50 percent or more in all items unless otherwise indicated. Description of Product Category CLOTHING 3. Trousers, Shorts, Overalls and Coveralls Note: A. Trousers, pants, slacks and jeans wholly or mainly by weight of cotton, man-made fibres, or wool or blends thereof, being garments which do not extend above the waist but extend to the knee or below. Included are jodhpurs, knickers, footless tights, gauchos. Men's and boys' garments in this item manufactured of fabric containing five percent or more by weight of wool or hair are considered to be woolen garments. B. Overalls and coveralls wholly or mainly by weight of cotton, man-made fibres or wool, or blends thereof. Overalls and coveralls are onepiece garments, as either pants or shorts but extending above the waist in the form of a bib (or permanently affixed straps) or other structure which partially or fully covers the upper part of the body. One-piece jumpsuits are included. C. Outershorts, wholly or mainly by weight of cotton, man-made fibres or wocl, or blends thereof. Shorts are garments similar to pants but not extending to the knee.

Page 8 ÇfoMjfof iiiuil (Ëummisxurini bu ( annua NOTE WO. 106 The Canadian High Commission presencs its compliments to the Ministry of Foreign Affairs of the People's Republic of Bangladesh and wishes to refer to the agreed record of discussions signed by representatives of Canada and Bangladesh in Dhaka on 7 April 1986 relative to the restraint of exports of pants, shorts, overalls, and coveralls to Canada from Bangladesh. Pursuant to the provision of paragraph 3(ix) of the agreed record, Canadian authorities wish lu confirm chat Canadian Ministers have given approval to the provisions contained in the agreed record. Canadian authorities, therefore, propose that this note, together with the reply from Bangladesh authorities confirming acceptance by their government, give effect to the arrangement restraining the quantity of pants, shorts, overalls, and coveralls originating in Bangladesh and exported to Canada. The Canadian High Commission wishes to advise the Ministry of Foreign Affairs that, immediately following receipt of the Bangladesh note confirming Bangladesh acceptance of this arrangement, thé Government of Canada will advise the textiles surveillance body that a settlement has been reached under Article A of the Multi-Fibre Arrangement. The Canadian High Commission avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the People's Republic of Bangladesh the assurances of its highest consideration. Page 9 The Ministry of Foreign Affairs, Government of the People's Republic of Bangladesh, presents its compliments to Canadian High Commission in Dhaka and has the honour to refer to the Embassy's Note Verbale No. 106 dated June 10, 1986 regarding acceptance of the arrangement as made in the provisions of the agreed record of discussions signed by the representatives of Canada and Bangladesh in Dhaka on April 7, 1986, in respect of export of pants, shorts, overalls and coveralls from Bangladesh to Canada. The Ministry has further the honour to inform that the concerned authorities in Bangladesh have accorded approval to the provisiois of paragraph 3(IX) of the agreed record and have also requested the authorities in Canada to give effect to the arrangements.
