FESTIVAL CONTEST RULES: Krinos Contest- Win a Trip to Greece or Saint Lucia TRIP TO GREECE 1. SWEEPSTAKES/CONTEST This Sweepstakes/contest is being conducted by Krinos Taste of the Danforth and the GreekTown on the Danforth BIA, with prizes provided by Transat Holidays and Kinetta Beach Resort & Spa, hereinafter collectively referred to as Sponsors. The GreekTown on the Danforth BIA is located at: 699 Danforth Avenue, Suite #201 Toronto, Ontario M4J 1L2 NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. NOT OPEN TO RESIDENTS OF QUEBEC. This Sweepstakes/contest runs from August 7th, 2015 until August 24 th, 2015 at 9:00 pm, the Sweepstakes/contest Window". Participants must answer a number of survey questions; provide their name, email address and other information. Any entry by the participant constitutes consent to participate in this Contest and agreement with the Rules. All entries will be the property of the Sponsors. The Sponsors are not responsible for lost, late, incomplete, or otherwise misdirected entries that are processed late or incorrectly or are lost due to computer or electronic malfunction or other error. Only one entry per person is permitted. Multiple entries will result in disqualification. NO PURCHASE IS NECESSARY FOR ANY PART OF THE CONTEST. 2. ELIGIBILITY APPLICABLE LOCAL, PROVINCIAL, FEDERAL, AND INTERNATIONAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED BY LAW. SWEEPSTAKES/CONTEST IS NOT AVAILABLE TO RESIDENTS OF QUEBEC. Sweepstakes/contest is open to any living persons in Canada, excluding residents in the province of Quebec, who are 18 years of age or older at the time of entry. By entering into this Sweepstakes/contest, the participant shall be deemed to have read and agreed to be bound by these terms and conditions, and by the decisions of the Sponsors and their affiliated entities, which shall be final and binding in all respects.
In order to claim the prize and be declared a winner, the selected entrant will be required to complete and sign a declaration and release statement, in order to; confirm compliance with the rules and regulations, accept the prize as awarded, without substitution, release the Sponsors and their affiliated companies from any liability, as described more fully below. Where required by law, you may be required to correctly answer, without assistance of any kind, a mathematical skill- testing question to be administered by email or telephone at a pre- arranged mutually convenient time. Failure by any selected entrant to complete, sign and return any of the aforementioned documents within 14 business days after notification is sent to the email address on the selected entrant s entry, or fail to return of prize documents, may result in forfeiture of the prize. At the sole discretion of the Sponsors, an alternate winner may be selected or the prize award may be cancelled. If a selected entrant cannot be contacted in a timely fashion, or if for any other reason the prize cannot be awarded, another Sweepstakes/contest entry may be randomly selected by draw until the prize has been awarded. Where required by law, failure to correctly answer the skill- testing question will result in disqualification, the forfeiture of his or her interest in the prize, and at the sole discretion of the Sponsors, the random selection of a substitute winner from among all remaining eligible entries. 3. DISCLAIMERS The Sponsors and their subsidiaries and affiliated entities are not responsible or liable for entries that are entered by other than human means (such as by an automated computer program or any non- human mechanism, entity, or device), in excess of the stated limit, or for entries that are illegible, late, destroyed, lost, misplaced, stolen, misdirected, tampered with, deleted, damaged, incomplete, or otherwise not in compliance with these official rules, and all such entries will be disqualified. By participating in the Sweepstakes/contest, each registrant/entrant agrees and acknowledges: to be bound by these official rules, all Sponsor- related terms and conditions, as well as the decisions of the Sponsors which are final and binding in all respects; to waive any rights to claim ambiguity with the official rules; and that the Sponsors and their affiliated entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in the Sweepstakes/contest; acceptance/possession (including, but not limited to, delays by shipping companies), defects, and/or use/misuse of a prize (including, but not limited to, cancellation/postponement); discontinued prizes; human error; incorrect or inaccurate transcription of registration and/or account information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or internet service provider utilized by the Sponsors; interruption or inability to access the Sponsors, their affiliated entities and their respective websites, or any online service
via the internet due to hardware or software compatibility problems; any damage to participant's (or any third person's) computer and/or its contents related to or resulting from any part of the Sweepstakes/contest; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of the Sponsors or any one of their affiliated entities. Each participant further agrees to indemnify and hold harmless the Sponsors and their subsidiaries and affiliated entities from and against any and all liability resulting or arising from the Sweepstakes/contest and to release all rights to bring any claim, action or proceeding against the Sponsors or their affiliated entities, and hereby acknowledge that the Sponsors and their subsidiaries and affiliated entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a prize supplier that may be sent along with a prize. The Sponsors and/or their subsidiaries and affiliated entities shall in no event be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of the prize suppliers or any of their agents, servants, employees or independent contractors, (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Sponsors, or (3) by any other cause, condition or event whatsoever beyond the control of the Sponsors or their parents, subsidiaries and affiliated companies. Title of this Sweepstakes/contest may change during the Sweepstakes/contest. ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES/ CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Additionally, any attempt to cheat the Sweepstakes/contest, as determined at the sole discretion of the Sponsors, may result in immediate disqualification of the entrant, as well as other possible consequences, including disqualification from any and all existing and future offers. Any attempt to cheat by creating fake profiles will be looked upon very seriously, and can result in immediate and permanent ban, and possible further action. Irrelevant entries, as deemed irrelevant at the sole discretion of the Sponsors, and those using copyrighted content may be removed and disqualified from the Sweepstakes/contest. In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the username submitted at time of concept. "Authorized account holder" is defined as the natural person who is assigned to an email address entered into the Sponsors' system. If, for any reason, the Sweepstakes/contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures,
unavailable funds or any other causes beyond the control of the Sponsors, then the Sponsors reserve the right at their sole discretion to cancel, terminate, modify, extend or suspend the Sweepstakes/contest. 4. PRIZES; ODDS; SELECTION OF WINNERS; USE OF INFORMATION: One winner will be selected to win one roundtrip charter seats for (2) two adults and eight (8)- day/ seven (7)- night accommodations at the Kinetta Beach Resort & Spa in Athens, Greece, courtesy of Transat Holidays and Kinetta Beach Resort & Spa. This package includes roundtrip transfers at destination and roundtrip economy airfares from Toronto to destination won via Transat Holidays. Winners must make their request for travel to Transat Holidays, prior to November 30, 2015 and is subject to availability at the time of booking. The prize is valid from August 20, 2015 to July 20, 2016. Travel must be taken in the time period specified and cannot be extended beyond that date. Travel cannot be taken during Christmas and New Year from December 17, 2015 to January 06, 2015 & Easter 2016. Also please keep in mind subject to availability and operation of the charter series. The packages DO NOT INCLUDE TAXES, gratuities, and travel insurance, items of a personal nature and any optional tours or sightseeing. Note: it is currently estimated that the cost of the winner in tax for the airfare to Athens would be approximately $554.01 per person. All transportation related taxes and fees are payable to Transat Holidays by the prize winners. The purchase of medical, accident and baggage insurance are recommended, which the prize winners may purchase through Transat Holidays. All bookings are subject to 100% cancellation penalties. Once the booking has been confirmed, no changes can be made to the passenger names and/or date of travel. The prize is subject to the terms and conditions located in the Transat Holidays 2015-2016 Europe brochure with inclusions indicated. The winner and his/her travel companion must travel together both ways. The winner and his/her travel companion must reside in Canada and have the legal right to leave Canada and to return to Canada; and must have the legal right to enter and leave the destination country to which they are bound. They are fully responsible for obtaining, at their own expenses, all documentation necessary for the trip as required by the authorities concerned, including, but not limited to, visas, passports, vaccinations and certificates. These shall be obtained before departure. Failing to provide the required documents may result in denied boarding by the air carrier and/or entry by immigration authorities. Transat Holidays are not responsible in this respect. The winner and his/her travel companion shall comply with the contest validity dates and accept the alternatives proposed by Transat Holidays, if this proves necessary. No extension of stay will be permitted and prize cannot be exchanged, transferred or substituted for cash. The winner shall not be entitled to receive, in cash, certificate or otherwise, the balance
of any amount representing the difference of the Grand Prize retail value and actual cost. Transat Holidays reserves the right to offer a comparable prize if a program is cancelled in the case of force majeure or in the case of any other irresistible and unforeseeable circumstances. No frequent flyer miles will be available. All of the personal expenses and taxes of the winner and his/her travel companion are their sole responsibility. All applicable taxes must be paid to Transat Holidays prior to ticket release. All travel arrangements are to be made through Transat Holidays Interline department. A minimum of one person, either the Grand Prize winner or one of the travel guests, must hold a valid credit card to cover any incidentals or any other requirement that may be required at the hotel. The winner and his/her travel companion are responsible for their own transportation upon departure and arrival at the selected airport of departure, as determined by Transat Holidays. Transat Holidays shall assume no responsibility of any nature whatsoever for any postponement, delay or cancellation of the flight or any other component of the packages or of any other transportation which is part of the prize for any reasons whatsoever, including, but not limited to, weather conditions, equipment breakdown or failure. Air travel to the destination where the hotel is located will be exclusively on flights sold by Transat Holidays. The total value of the prize varies depending on departure dates, but is estimated at approximately $3000. Your odds of winning depend upon the number of eligible entries received. For example, if 1000 eligible entries were received, your odds of winning would be 1:1000. The Sponsor cannot accurately estimate how many eligible entries will be received during the Sweepstakes/contest Window. Following the end of the Sweepstakes/contest Window, the Sponsor shall schedule the prize selection at its own discretion and within the time period allowed by Law. ALL INTERNATIONAL, FEDERAL, PROVINCIAL AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. All costs and expenses not specified herein are the sole responsibility of the winner. No substitutions, except at Sponsor's sole discretion, in the event of prize unavailability. Prize is not transferable, has no cash value for the winner and the duration cannot be extended, except at discretion of the Sponsor. Unused travel services are not exchangeable for alternate arrangements. The information that you provide in connection with the Contest may be used for internal purposes and to send you information about the Sponsor's products and special promotions but will not be provided to third parties, except as necessary for the administration of the Contest or as required by law or legal process. Entry constitutes permission to post winner's names on Sponsor s Website and to use winner's name, and/or likeness for purposes of advertising and promotion without further compensation unless prohibited by law.
Entry also constitutes agreement to provide a photo of winners, which will be posted on the Sponsor s website. In the event a prize winner is unable to redeem the prize as awarded, Transat Holidays or any parties associated with this prize will provide neither compensation nor substitutions. The prize offered is subject to the operation of the Charter Series and/or the Tour Package Program. Prize winner must return a signed copy of the congratulations letter within 14 days of its receipt to confirm their understanding of the conditions stipulated above. 5. APPLICABLE LAW The Sweepstakes/contest and these official rules shall be construed and governed in accordance with the laws of the Province of Ontario, Canada.
