TERMS AND CONDITIONS Preferred Current Account/ Account-i Acquisition Campaign with Cash Reward RM188 1. The Preferred Current Account/ Account-i Acquisition Campaign with Cash Reward RM188 ( Campaign ) is jointly organized by CIMB Bank Berhad (13491-P) ( CIMB Bank ) and CIMB Islamic Bank Berhad (671380-H) ( CIMB Islamic ). CIMB Bank and/or CIMB Islamic shall herein collectively be referred to as ( CIMB ). Campaign Period 2. This Campaign shall run from 23 July 2018 to 31 October 2018, both dates inclusive ( Campaign Period ). 3. CIMB reserves the right to change the duration and/or the commencement and/or expiry dates of the Campaign Period by giving fourteen (14) calendar days prior notice. Eligibility 4. The Campaign is open to all existing and new CIMB Preferred individual customers who do not have an existing Preferred Current Account ( PCA ) maintained with CIMB Bank or Preferred Current Account-i ( PCA-i ) maintained with CIMB Islamic at the start of the Campaign Period; (hereinafter referred to as Eligible Customer(s) ). 5. The following persons/entities shall NOT be eligible to participate in this Campaign: a) Sole-proprietorships, Partnerships, Charitable/Non-profit Organizations/ Societies, Public Companies, Private Limited Companies, Clubs, Association and Co-operatives; and/or b) Individuals below the age of eighteen (18) years. Campaign Offer 6. To be entitled to the RM188 cash reward ( Cash Reward ), the Eligible Customer(s) must be a CIMB Preferred individual customer who opens a PCA/PCA-i ( Participating Account(s) ) during the Campaign Period, deposit fresh fund of RM10,000 to the Participating Account and maintain the minimum monthly average balance of RM10,000 in the Participating Account on the month immediately following the date of account opening. For example, a) If PCA/ PCA-i opened on 23 July 2018, minimum RM10,000 monthly average balance to be maintained from 1 August 2018 to 31 August 2018. b) If PCA/ PCA-i opened on 2 August 2018, minimum RM10,000 monthly average balance to be maintained from 1 September 2018 to 30 September 2018.
7. The term Fresh Funds referred to herein shall be defined to mean monies or funds not originating from CIMB, but transferred, credited or paid into the Participating Account of the Eligible Participant(s) from other bank(s) and/or financial institutions(s) through whatsoever means including but not limited to: a) Placement of Cash; and/or b) Interbank Giro Transfers (IBG) / Instant Funds Transfer (IBFT); and/or c) Telegraphic Transfer / Real Time Electronic Transfer of Funds and Securities (RENTAS); and/or d) Local cheque / banker s cheque, and the monies or funds transferred, paid or credited into the Participating Account(s) of the Eligible Participant(s) are deemed to be duly deposited by the Eligible Participant(s) for purpose of this Campaign pursuant to the Terms and Conditions herein provided that such monies or funds are transferred, paid or credited into the Participating Account(s) of the Eligible Participant(s) directly or indirectly from other bank(s) and/or financial institutions(s) within three (3) business days. 9. Each Eligible Customer is only entitled to a maximum of one (1) time Cash Reward regardless of the number of PCA/PCA-i that is opened under his/her sole name. In relation to joint accounts, the Cash Reward will only be credited one (1) time to the PCA/PCA-i of the joint accountholders. For avoidance of doubt, the entitlement of the Cash Reward for joint accountholders is as illustrated below:- Eligible Customer A has opened a PCA/PCA-i under his/her sole name and opens a joint PCA/PCA-i with Eligible Customer B during the Campaign Period. This joint PCA/PCA-i is entitled to only one (1) time Cash Reward provided that Customer A is not the primary accountholder of the joint PCA/PCA-i and Customer B has not opened any PCA/PCA-i under his/her sole name.
10. The Cash Reward will be credited to the Eligible Customer s Participating Account opened during the Campaign Period, within 8 to 10 weeks after the account opening month. 11. At the time of crediting the Cash Reward to the Participating Account, the Participating Account MUST be in good standing and MUST NOT be in breach of any of the terms and conditions of CIMB Current Account/ Current Account-i Agreement, and/or be invalid of cancelled within CIMB s definition, otherwise, the Cash Reward will be forfeited. 12. CIMB will not entertain any request from the Eligible Customer to credit the Cash Reward to other accounts belonging to the Eligible Customer. General Terms and Conditions 13. By participating in this Campaign, the Eligible Customer(s) are deemed to have read, understood and agreed to be bound by the Terms and Conditions herein. The Eligible Customer (s) Participating Account (i) MUST not be in breach of terms and conditions governing PCA/PCA-i or CIMB Clicks Internet Banking Agreement or CIMB Clicks Mobile Banking Agreement AND (ii) MUST not be terminated or closed or be made subject to any attachment, adverse orders made by the Court of any authorities sanctioned by laws, delinquent, and/ or be invalid or cancelled as determined by CIMB, otherwise the Eligible Customer(s) will be disqualified from participating in this Campaign and shall not be entitled to receive the Cash Reward. 14. Decision of CIMB in relation to every aspect of the Campaign shall be final, binding and conclusive provided always that the decision must appear to be fair and reasonable. No further correspondence, appeals, protests or attempts to dispute the same would be entertained. 15. All terms and conditions governing CIMB Preferred membership and Current Account/ Current Account-i shall continue to apply save and except if or where the same are expressly varied or amended by the Terms and Conditions herein. In the event of any inconsistency between the Terms and Conditions herein and the terms and conditions governing CIMB Preferred membership and/or Current Account/Current Account-i, the Terms and Conditions herein shall prevail for the purposes of this Campaign. 16. CIMB shall not be responsible or held liable in any manner whatsoever in respect of technical failures of any kind, whatsoever intervention, interruptions, and/or electronic or human error in the administration and/or processing of the transaction performed via CIMB Clicks unless the same is due to the gross negligence or willful default of CIMB. 17. CIMB reserves the right to suspend, cancel, terminate or withdraw this Campaign in whole or part and/or substitute the Cash Reward with rewards of similar or equivalent cost, by giving the Eligible Customer(s) prior notice of fourteen (14) calendar days. For the avoidance of doubt, suspension, cancellation, termination or withdrawal of this Campaign and/or substitution of the Cash Reward shall not entitle the Eligible Customer(s) to any claim or compensation against CIMB for any losses or damages suffered by the Eligible Customer(s) or any party as a direct or indirect result of the act of
suspension, cancellation, termination or withdrawal and/or substitution of the Cash Reward unless the same is due to the gross negligence or wilful default of CIMB. 18. CIMB reserves the right upon giving prior notice of twenty-one (21) calendar days to vary (whether by addition, deletion, modification, amendment, or otherwise howsoever) ( Amendment ) any of the Terms and Conditions herein. Notification to the Eligible Customer(s) in respect of the Amendment shall be effected at CIMB s absolute discretion through any one of the following means of communication namely, by ordinary mail to the Eligible Customer(s) last known address or by posting a notice regarding the Amendment at each of CIMB s branches or by effecting an advertisement regarding the Amendment in one newspaper of CIMB s choice, or via CIMB s website or by any other means of notification which CIMB may select and the Amendment shall be deemed as binding as from the date of notification of the Amendment or from such date as may be specified by CIMB in the notification. Eligible Customers acknowledge and agree to access CIMB s website at regular intervals to view the Terms and Conditions and to ensure that they are kept up-to-date with any changes or variations to these Terms and Conditions. 19. These Terms and Conditions as may be amended from time to time shall prevail over any provisions or representations contained in any other promotional material advertising the Campaign. 20. By participating in the Campaign, the Eligible Participant(s) hereby agree not to hold CIMB liable in the event that CIMB is unable to perform in whole or in part of any of its obligations herein, attributable directly or indirectly to the failure of any mechanical or electronic device, data processing system, transmission line, electrical failure, industrial dispute, any act beyond CIMB's control or due to any factor in a nature of a force majeure. 21. By acceptance of receipt of the Cash Reward, the Eligible Customer(s) agrees to hold harmless CIMB and its affiliates and their respective directors, officers, employees and agents from and against any claim, action, proceeding, judgement, damage, loss, expense or liability suffered by CIMB and its affiliates and their respective directors, officers, employees and agents in connection with such Eligible Customer(s) participation in the Campaign or receipt, redemption or use of the Cash Reward. 22. CIMB shall not be liable to any party, including the Eligible Customer(s), for any loss or damage of whatsoever nature suffered by the Eligible Customer(s) or any party (including but not limited to any injury or death, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the Eligible Customer s participation or non-participating in the Campaign including arising from the Eligible Customer s receipt, non-receipt and/or delayed receipt of the phone call or Short Message Service (SMS) or e-mail by the selected Eligible Customer unless the same is due to CIMB s willful default or gross neglect. 23. CIMB accepts no responsibility for any tax implications that may arise from the Cash Reward of the use thereof. Any tax filing obligation or any tax payment due to any authority as a results of receipt of the Cash Reward remain the sole responsibility of the Eligible Customer(s). It is the responsibility of each Eligible Customer to seek independent advice on the possible implications this may have on his/her own financial situation. 24. By participating in the Campaign, the Eligible Customer(s) hereby consent to and agree that CIMB shall be entitled to publish and/or display at no costs to the Eligible Customer(s), materials and/or
information, including but not limited to the names, identification number, city of residence and photographs of Eligible Customer(s) who received the Cash Reward for this Campaign for advertising and publicity purposes in any manner it deems appropriate. 25. In the event of any inconsistency(ies), conflict(s), ambiguity(ies) or discrepancy(ies) between the Bahasa Malaysia and English version or versions in other languages of these terms and conditions, the English version of these terms and conditions shall prevail. Notwithstanding the aforementioned, where request had been made by the Eligible Customer(s) and noted and acknowledged by CIMB in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the PCA/PCA-i, then the Bahasa Malaysia version of the terms and conditions herein shall prevail. 26.
