The Katy Area Safety Fest s purpose is to familiarize residents with useful safety information, as well as the daily responsibilities of your local Fire, EMS, and Law Enforcement agencies through a variety of fun and high energy activities. Event Volunteer Information & Waiver Dear Volunteer: Welcome and thank you for volunteering with the 3 rd Annual Katy Area Safety Fest ( KASF ) and helping make this event another successful year. It is vital that we continue to keep our community informed about safety awareness. A well-informed community is better able to prepare for any potential disaster affecting the area. Volunteers must sign in at the Volunteer check-in booth. Volunteer assignments will be given at the time of checkin, and volunteer t-shirts will be handed out. (Please keep in mind the day of event volunteers may be reassigned if needed to fill spots. Please be patient as this is a possibility). The purpose of this information is to provide KASF volunteers with an understanding of their responsibilities regarding volunteer assignments, along with site safety and management throughout the KASF s duration. The rules outlined below must be followed. All KASF Volunteers: All volunteers must agree to comply with the following Code of Conduct: (Please read carefully) No smoking within the KASF area. (Smoking is not permitted within twelve (12 ) feet of the event). All volunteers are welcome to take fifteen (15) to twenty (20) minute breaks in the hospitality tent (ensure coverage has been arranged to cover your area of responsibility while out on break). KASF will provide snacks, beverages, and lunch in the hospitality area. All volunteers must be courteous to all guests, vendors, and fellow volunteers. If an issue arises from unruly, abusive, or dangerous conduct, contact security or a KASF staff member. (KASF security will be on-site to ensure safe and orderly conduct during KASF). In case of non-compliance with this Code of Conduct, safety rules, and guidelines, KASF officials reserve the right to demand any volunteers to exit and leave the KASF event. Volunteers should not speak with media unless authorized. Volunteers are to direct media to KASF staff or the public relations team. Follow agency rules. Act professionally. Complete tasks. Participate in training. Volunteer Attire: All volunteers must wear a KSAF t-shirt to be easily identified. All volunteers are allowed to wear jeans, khakis, or appropriate shorts. Please wear comfortable shoes no open-toed shoes. Hats and sunglasses are permitted (no vulgar offensive language, art work, or photos displayed on hats or other wearable items will be tolerated). We reserve the right to request a volunteer to remove any inappropriate attire. If the volunteer refuses, he/she will be asked to leave the KASF event. Volunteers are required to sign the Volunteer Release and Waiver of Liability form on the reverse side to participate in the Katy Area Safety Fest.
VOLUNTEER RELEASE AND WAIVER OF LIABILITY FORM This Release and Waiver of Liability (the Release ) executed on this day of, 2018, by (Volunteer s name) hereby releases the following Persons and Entities, and otherwise agrees as follows: Persons and Entities Released: Harris County Emergency Services District No. 48 ( ESD 48 ), which includes, but is not limited to all Committee personnel, ESD 48 Commissioners, ESD 48 employees, ESD 48 volunteers (other than the volunteer named herein), and all others, jointly, severally, and individually whom are under the control of ESD 48. The Volunteer desires to provide volunteer services for ESD 48 s Annual Katy Area Safety Fest ( Safety Fest ) and engage in activities related to serving as a volunteer. Volunteer understands that the scope of Volunteer s relationship with ESD 48 is limited to a volunteer position, and that no compensation is expected in return for services provided by Volunteer. ESD 48 will not provide any benefits traditionally associated with employment to volunteers and that Volunteer is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of Volunteer s services with ESD 48 at Katy Area Safety Fest. 1. WAIVER AND RELEASE: I, the Volunteer, HEREBY RELEASE AND FOREVER DISCHARGE AND HOLD HARMLESS ESD 48 and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from the services I provide to ESD 48. I UNDERSTAND AND ACKNOWLEDGE THAT THIS RELEASE DISCHARGES ESD 48 FROM ANY LIABILITY OR CLAIM THAT I MAY HAVE AGAINST ESD 48 WITH RESPECT TO BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM THE SERVICES I PROVIDE TO ESD 48 OR OCCURRING WHILE I AM PROVIDING VOLUNTEER SERVICES WITH ESD 48. 2. INSURANCE: Further, I understand that ESD 48 does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. I expressly waive any such claim for compensation or liability on the part of ESD 48 beyond what may be offered freely by ESD 48 in the event of injury or medical expenses incurred by me. 3. MEDICAL TREATMENT: I hereby release and forever discharge ESD 48 from any and all claims whatsoever which arise or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my tenure as a volunteer with ESD 48. 4. ASSUMPTION OF RISKS: I understand that the services I provide to ESD 48 may include activities that may be dangerous or hazardous to me and I am aware of such risks. Moreover, I understand and agree that if I do not want to engage in an activity, I am not required to participate in any activity, the Safety Fest or any activity related to Safety Fest. I HEREBY EXPRESSLY ASSUME RISK OF INJURY OR HARM FROM THESE ACTIVITIES AND DO HEREBY RELEASE ESD 48 FROM ANY AND ALL LIABILITY. 5. PHOTOGRAPHIC RELEASE: I grant and convey to ESD 48 all rights, titles, and interests in any and all photographs, images, video, and/or audio recordings of me or my likeness or my voice made by ESD 48 in connection with my providing volunteer services to ESD 48. 6. OTHER: As a volunteer, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Texas, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Texas. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected. ESD 48 does NOT waive any liability protection or immunity it has as a political subdivision of the State of Texas. I UNDERSTAND AND AGREE TO THIS RELEASE AND WAIVER OF LIABILITY AND DO SO WILLINGLY.
