City of Charlevoix ADVERTISEMENT FOR BIDS Tree Trimming The City of Charlevoix will accept sealed proposals for the removal and disposal of hazardous limbs, dead trees and stump grinding until 10:00 am EDT October 23, 2018, with bid openings at that time in the office of the City Clerk, 210 State Street, Charlevoix, MI 49720. All bids shall be clearly marked Tree Trimming. Bid packages are to be directed to Joyce Golding, City Clerk. All questions are to be directed to Pat Elliott, Superintendent, Department of Public Works at 231-547-3276 Bid specs may be viewed on the City website www.cityofcharlevoix.org or the City Manager s Office during normal business hours. A copy of the City of Charlevoix s Local Bidder s Preference Policy can be viewed at the City s website www.cityofcharlevoix.org. The City of Charlevoix reserves the right to accept or reject any or all proposals, to waive irregularities and to accept the proposal deemed to be in the best interest of the City of Charlevoix. The City of Charlevoix is seeking sealed bids from licensed professional tree services for the coarse pruning of approximately 100 more or less trees, the removal and disposal of approximately 20 more or less dead trees and the grinding of stumps from new removals. Bid proposals shall be made on the form provided. Bidders shall submit costs for pruning, tree removal and stump removal separately. Incomplete bids will be rejected. Sealed bids will be received until October 23, 2018 at 10:00 a.m. at the Office of the City Clerk, City Hall, 210 State Street, Charlevoix, MI 49720. At that time, the bids will be publicly opened and read. The agreement between the City of Charlevoix and the successful bidder will commence on November 1, 2018 and expire on October 31, 2020. This is a two-year agreement. If acceptable to both parties, at any time during this agreement it is determined to be in the best interest of the City/Contractor the terms of this agreement can be extended for an additional two years. Questions regarding this work may be addressed to: Pat Elliott Superintendent Department of Public Works (231) 547-3276 INFORMATION FOR BIDDERS Bids will be received by the City of Charlevoix (herein called "OWNER"), at the City Clerk's Office until 10:00 a.m. October 23, 2018 EDT and then at said office publicly opened and read aloud. QUALIFICATIONS OF BIDDERS It is the intention of the OWNER to award this contract to the BIDDER most fully capable, both financially and as regards to experience, to perform and complete all work in a satisfactory manner. Evidence of such competency must be furnished, if requested, including a list of similar projects which the BIDDER has satisfactorily undertaken and completed. All bidders shall be competent tree specialist and be able to comply with the pruning standards set forth by the National Arborist Association, as required by class III, Hazard/Course pruning specifications. METHOD OF BID EVALUATION AND AWARD OF CONTRACT It is the intention of the OWNER to award this contract to the lowest qualified bidder. The project will be awarded to the bidder with the lowest total contract amount as shown on the proposal form, based upon the prices shown for pruning, removal of trees, stump grinding. In case of a discrepancy between total amounts shown and unit prices, the unit price shall apply.

INSURANCE The CONTRACTOR shall purchase and maintain such insurance as will protect him from claims set forth below which may arise out of or result from the CONTRACTOR'S execution of the WORK, whether such execution be by himself or by any SUB-CONTRACTOR or by anyone directly or indirectly employed by any of them, or by anyone for whose acts any of them may be liable. Claims under workmen's compensation, disability benefit and other similar employee benefit acts; Claims for damages because of bodily injury, occupational sickness or disease, or death of his employees; Claims for damages because of bodily injury, sickness or disease, or death of any person other than his employees; Claims for damages insured by usual personal injury liability coverage which are sustained (1) by any person as a result of an offense directly or indirectly related to employment of such person by the CONTRACTOR, or (2) by any other person; and Claims for damages because of injury to or destruction of tangible property, including loss of use resulting therefrom. Certificates of Insurance acceptable to the OWNER shall be filed with the OWNER prior to commencement of the work. These Certificates shall contain a provision that coverages afforded under the policies will not be canceled unless at least fifteen (l5) days prior WRITTEN NOTICE has been given to the OWNER. The CONTRACTOR shall procure and maintain, at his own expense, during the CONTRACT TIME, liability insurance as hereinafter specified. CONTRACTOR'S General Public Liability and Property Damage Insurance including vehicle coverage issued to the CONTRACTOR and protecting him from all claims for personal injury, including death, and all claims for destruction of or damage to property, arising out of or in connection with any operations under the CONTRACT DOCUMENTS, whether such operations be by himself or by any SUBCONTRACTOR under him, or anyone directly or indirectly employed by the CONTRACTOR OR SUBCONTRACTOR under him. Insurance shall name City of Charlevoix as co-insured. Insurance shall be written with a limit of liability of not less than $2,000,000 for all damages arising out of bodily injury, including death, at any time resulting therefrom, sustained by any one person in any one accident; and a limit of liability of not less than $2,000,000 aggregate for any such damages sustained by two or more persons in any one accident. Insurance shall be written with a limit of liability of not less than $200,000 for all property damage sustained by any one person in any one accident; and a limit of all liability of not less than $1,000,000 aggregate for any such damage sustained by two or more persons in any one accident. The CONTRACTOR shall procure and maintain, at his own expense, during the CONTRACT TIME, in accordance with the provisions of the laws of the state in which the work is performed, Workmen's Compensation Insurance, including occupational disease provisions, for all of his employees at the site of the PROJECT and in case any work is sublet, the CONTRACTOR shall require such SUBCONTRACTOR similarly to provide Workmen's Compensation Insurance, including occupational disease provisions for all of the latter's employees unless such employees are covered by the protection afforded by the CONTRACTOR. In case any class of employees engaged in hazardous work under this contract at the site of the PROJECT is not protected under Workmen's Compensation statute, the CONTRACTOR shall provide, and shall cause each SUBCONTRACTOR to provide, adequate and suitable insurance for the protection of his employees not otherwise protected.

WORK DESCRIPTION/GENERAL CONDITIONS The City of Charlevoix will allow the successful bidder of this contract to remove dead trees located on City-owned property in accordance with the guidelines given in this document. 1. The City will furnish the successful bidder with a list of marked trees. 2. Aerial lift devices shall be used for tree removal. 3. The adjoining property owners have first right to the wood. 4. All branches 6 and smaller will be chipped. 5. The City will provide a location for dumping unwanted wood and chips. 6. Stumps will be removed to a minimum depth of 12 inches below the mean grade between the curb and nearest edge of sidewalk. 7. Stump holes will be leveled to prevent accidents. 8. The tree removal site will be swept, raked and left in clean condition on the same day as the removal. 9. The successful bidder shall notify the City when "no parking" signs are required and when closing a street is necessary so that prior agreement can be reached for the safety and convenience of the public. 10. All trees 6" in diameter and smaller will be removed by the City. WORK DESCRIPTION AND GENERAL PROVISIONS Amount of work to be completed Approximately 100 trees have been identified with dead branches needing removal. Approximately 20 dead trees have been marked for removal and their stumps are to be ground as stated above. Trees identified with hazardous limbs or for removal The City will furnish the contractor with a list and map of trees painted for removal. Trees with hazardous limbs will be identified with paint or some other agreed upon means and a list and map of these trees will also be provided to the Contractor. Equipment Aerial lift devices shall be used for tree removal and most hazardous limb removal. Changes The City shall have the right to increase or decrease the number of trees to be trimmed or removed as it may deem necessary and such changes shall be paid according to the prices set forth in the bid.

Cleanup All limbs, branches and other debris temporarily placed at the work site shall be placed in such a manner as to eliminate any obstruction to motor vehicles and pedestrians. Upon completion of work and before moving to a new location, all leaves, twigs, branches, bark, logs, wood chips, or any other form of debris shall be removed and the area left broom clean. Exceptions to this shall be granted by the Project Supervisor. In no case shall debris be left over a weekend or holiday. Stumps Stumps will be removed to a minimum depth of 12 inches below the mean grade between the curb and nearest edge of sidewalk. Stump holes will be leveled to prevent accidents. Damage The Contractor shall be responsible for all damages or injury to any public or private property, resulting from any act, omission, neglect or misconduct in the manner or method of executing the work, or at any time due to defective work or materials. The Contractor shall restore, or have restored at their own expense, such property to a condition similar or equal to that existing before the damage or injury was done, by repairing or rebuilding the same, or by otherwise making good such damage or injury in a manner acceptable to the owner and the City. All repair or rebuilding shall be accomplished as soon as possible after the date the damage or injury occurred. Any damage noted, or seen, by the Contractor, that has occurred by any means other than during the performance of the Contractor's work, whether by vandalism or any other means, shall be promptly reported to the Project Supervisor. Trees larger than six inches that are damaged will be evaluated according to the most recent standards set forth by the International Society of Arboriculture. Trees six inches in diameter and smaller that are damaged will be replaced, at the appropriate planting time, with another tree of the same species and size, and at the Contractor's expense. Ownership of Wood and Other Debris Adjoining property owners have first right to the wood if they request it. The City reserves the right to take, remove and use any of the debris material should such material be required by the City for its own use or for use by others. In such an event, the City shall segregate and remove the desired trimmings from the work site. City will remove trunk portion of trees, if contractor does not want trunks. Contractor to chip or remove all limbs. Disposal Sites The City will designate a disposal site for all tree material and debris removed by the Contractor. Inspection All contract work will be subject to the continuous inspection and approval of the Project Supervisor. The Contractor shall be notified in writing of any performance shortcomings during the course of this contract and corrective action shall be taken as soon as possible.

In case of any dispute arising between the Contractor and the Project Supervisor concerning work performance, the Project Supervisor shall have the authority to suspend the work until the question at issue can be resolved. The Project Supervisor shall in no case act as foreman or perform other duties for the Contractor. Public Relations The Contractor shall endeavor at all times to maintain good public relations. The Contractor shall at all times have its personnel and equipment present and neat in appearance. All contacts with the public shall be made in a helpful, courteous and professional manner. Complaints of any nature from property owners shall receive immediate attention and proper adjustment by the Contractor. Such complaints shall immediately be reported to the Project Supervisor. Obstruction of Streets and Rights of Ways The Contractor shall arrange to keep sidewalks open for traffic when possible, and to block portions of the street only when deemed necessary to protect private property. The Contractor will notify the City when "No Parking" signs are necessary or street closure is required so that prior agreement can be reached for the safety and convenience of the public. The Contractor shall remove all surplus materials and debris from the streets as the work progresses so that the public may have the use of the streets a maximum amount of time. When deemed necessary the Contractor will erect warning signs and furnish adequate barricades. Accident Prevention The Contractor shall exercise every precaution at all times for the protection of persons and properties. Any practice obviously hazardous in the opinion of the Project Supervisor shall be immediately discontinued by the Contractor upon request by the Project Supervisor to discontinue such practice. Observance of Laws, Ordinances, and Regulations The Contractor shall abide by all OSHA and EPA safety standards and regulations, and by all Federal, State and local laws related to the work and associated processes of this contract. The Contractor shall procure at their own expense all necessary licenses and permits in connection with the work of this contract. When working within the highway right-of-way, all State highway signage standards shall be met. All contractor equipment shall meet all current safety standards. Extensions and Delays Extensions will be granted on a one to one day basis as an allowance due to missed work only for adverse weather conditions. Delays due to improper work or otherwise due to the Contractor's operation, are not cause for extension of time. If deemed necessary by the City, the Contractor shall agree to work Saturdays, Sundays, holidays or

longer than the normal working day at no additional cost, in order to meet the completion date. The City may at its discretion, extend the completion date for just cause. An extension request must be submitted, in writing, ten (10) days prior to the completion date. Utilities The Contractor shall notify all public service companies whose wire, poles, and other structures may be affected by their operations, including contacting Miss Dig for removal of stumps. Any costs arising from moving, relocating or damaging such utility shall be at the Contractor's expense. Trimming Specifications All trimming will be done in accordance with the standards set forth by the National Arborist Association most recent addition, as required by Class III Hazard/Course Pruning.
