Equity Release customers enjoy three levels of protection, encompassing a structured financial advice process, face-to-face legal advice and product safeguards set out in the Equity Release Council Rules and Guidance. All our members have agreed to abide by these Council rules and have signed up to the Statement of Principles which outline Council members will: Ensure that all their actions promote public confidence in equity release as a potential retirement solution Act at all times in utmost good faith Communicate high expectations for equity release outcomes in all their dealings Ensure conflicts of interest are managed fairly and reduced to the lowest practical level Exercise due skill, care and diligence in all that they do and uphold the standards set out by their professional bodies at all times Always act with the best interests of their clients being paramount, treating customers fairly in all their actions If you are considering taking out an equity release plan, you should firstly speak to a financial adviser who is qualified and knowledgeable in equity release. This is a key step that is central to the process of considering, evaluating and entering a contract in equity release. There are two main advice options available to you, face to face and telephone advice, both aimed at protecting the interests of the customer leading to the most appropriate and correct solution for each individual enquiry. If via your discussions with your financial adviser, you go on to choose an equity release plan from a Lender (also known as a Provider) who are also members of the Council, you will have the right to use a legal adviser of your choice. Using a legal adviser who is also a member of the Council will also mean that your case is dealt with by someone who is familiar with modern equity release products and who will act in your interests to ensure you fully understand the risks and benefits of the plan you have chosen. The Equity Release Council puts in place these safeguards for consumers to ensure that you can have confidence in Equity Release Council members and their products and services. There is a vast array of products now available to suit many variable requirements you may have as a consumer. The Equity Release Council recognises this spread of product features but has a specific set of product standards it endorses and Provider members may only indicate that a product meets the Equity Release Council standards if that product meets all the product standards. If an equity release product is offered that does not meet all the product standards the product provider must state prominently in their literature in what areas the product does not meet the standards and must give an illustration of the types of benefits and the risks this may pose to a borrower. The standards include elements such as the right to remain in your own home for the rest of your lives or until you enter long-term care or pass away, and the no negative equity guarantee means that no matter what happens to the housing market, you will never owe more than the value of your home.
