Paradip Port invites applications in two-cover system from interested and eligible Iron Ore Exporters with valid export/import license to participate in the tender for allotment of 19 nos. of Mechanical iron ore plots for convergence and export of Iron ore. The Tender Papers will be on sale in the office of Traffic Manager, PPT during office hrs. on all working days from 27.01.2014 to 17.02.2014 on payment of Rs.1,000/- in the form of Demand Draft/Banker s cheque drawn in favour of FA&CAO, PPT payable at Paradip which is non-refundable. Tender Call Notice can also be down loaded from our web site www.paradipport.gov.in or www.tenders.gov.in and such tenderers need to pay the cost of the tender paper in non-refundable demand draft/banker s cheque for Rs.1,000/- drawn in favour of FA&CAO, P.P.T. The bid opening date is 18.02.2014 at 1600 hrs. The available 19 nos. of mechanical iron ore plots put to tender have been standardized to 5000 sqmtr each and are located at Iron ore Handling Plant as per the sketch map attached as Annexure-II. An applicant is eligible to apply for one plot only for a maximum period of 11 (eleven) months. 2. An applicant who wants to participate in the tender should have the following eligibility criteria: (i) A valid export/import license issued by Director General of Foreign trade under Ministry of Commerce & Industry, Govt. of India. A notarized copy of the valid import/export license has to be enclosed along with the application. (ii) The parties those who have exported/imported through Paradip Port /existing plot holders in possession of manual iron ore plots at Paradip Port shall have to submit no dues certificate upto 31.12.2013 from the competent authority. 3. The bidders should submit the tender in two separate sealed envelopes clearly superscripted on the top side of the envelope Tender for Allotment of Mechanical Iron Ore Plots Envelope 1. The envelope-1 should contain the following: (i) The notarized copy of the valid import/export license. (ii) Bank draft/banker s cheque of Rs. 1,000/- towards cost of tender paper incase of tender document downloaded from web site. 1

(iii) Bank draft/banker s cheque of Rs. 48,21,761/- (Rupees Forty eight lakhs twenty one thousand seven hundred sixty one) only towards wharfage charges for the Minimum Guaranteed Traffic of 1,83,000 MT for 11 months including service tax @ 12.36% [(1,83,000 MT x Rs. 23.45) + S.Tax @12.36%]. (iv) The parties those who have exported/imported through Paradip Port /existing plot holders in possession of manual iron ore plots at Paradip Port shall have to submit no dues certificate upto 31.12.2013 from the Traffic Manager and Sr. Asst. Estate Manager,PPT. The 2 nd envelope containing only the price bid as at Annexure-III and should also be superscripted as Tender for Allotment of mechanical iron Ore Plots Envelope 2. The two sealed envelopes as mentioned above shall again be put together in one common cover, to be sealed again and the sealed cover shall be addressed to Traffic Manager, Paradip Port Trust and shall be superscripted as Tender for Allotment of Mechanical Iron Ore Plots. 4. The Port Trust reserves the right to allot the plots to the successful bidders. The allotment will be effective from the date of issue of allotment order by the Port to the successful bidder. The allotment of the Mechanical Iron Ore plots will be made to bidder who offers the highest price. 5. The detailed terms and conditions of the tender is enclosed as Annexure-I which should be carefully read before submitting the bids. 6. The tender documents duly filled in and completed in all respects are required to be submitted latest by 1300 hrs. on 18.02.2014 in the office of Traffic Manager, in Administrative Building, Paradip Port Trust, Paradip -754142 and the techno-commercial bid shall be opened on 18.02.2014 at 1600 hrs. in presence of Tenderers or their authorized representatives and the committee members. The price bid of the eligible bidders shall be opened separately under intimation to the bidders. 7. The Port reserves the right to discharge the Tender Call Notice at any stage without assigning any reason. Traffic Manager (I/c) Paradip Port Trust Copy to: 1. All HODs/CVO, PPT for information. 2. ANNEXURE-I TERMS AND CONDITIONS OF THE TENDER FOR ALLOTMENT OF MECHANICAL IRON ORE PLOTS 1. The bidders will be required to quote their price bids for one mechanical plot only. All the available plots will be treated alike and the successful bidders will be required to match the price with that of H-1 bidder. The total amount quoted in words in the Price bid shall be considered as the final quoted price. 2. The successful bidders will have choice to select the plot as per preference depending on the original bid price, i.e. the H-1 bidder will have first preference followed by H-2 and so on. In case any successful bidder declines to match the offer price with that of the H-1 bidder, the other bidder in seriatim will be given chance to match their offer. A sketch of the plots (not to scale) is enclosed as Annexure-II for ready reference. 3. The price towards License fee for one mechanical iron ore plot is fixed at base price of Rs. 12/- per sqmtr. per month as per SOR and premium of Rs. 525/- (Rupees five hundred twenty five) only per sqmtr/month. 4. The price offered should be over and above the reserve price fixed by the Port i.e Rs. 525/- (Rupees five hundred twenty five) only per sqmtr/month in addition to the license fee of Rs. 1200/-(twelve hundred) per month or part thereof for 100 sqmtr or part thereof excluding service tax. 5. The bids will be evaluated on the basis of highest offer received towards license fee. The Port will allot one plot to each of the successful bidders. From among the applicants, highest bidder (H-1) will be selected for allotment, subject to the condition that the bidders other than H-1 have to match their price with that of the H-1 bidder. 6. Out of the total no. of mechanical iron ore plots put to tender, 02 nos. of each shall be kept as reserved for PSUs and coastal shipment respectively provided they match to the H-1 price. 7. In case the plots kept as reserved for PSUs falls vacant then the same plot will be added to the nos. of plots kept reserved for coastal shipment. Similarly if the plots kept as reserved for coastal shipment falls vacant then the same will be added to the no. of plots kept reserved for PSUs. In case the plots which are kept reserved in both the categories falls vacant then the same shall be added to the list of plots in the general category (unreserved). 3

8. The bids will be opened for the purpose of evaluation in presence of the bidders or their authorized representative on the aforementioned date and time. The successful bidders will be informed in writing by the Port about allotment of one mechanical iron ore plot in their favour along with the terms and conditions of allotment. A successful bidder has to submit in writing that he is accepting the plot allotted to him as per the terms and conditions of the tender and the allotment order. The plot will be deemed to be in possession of the bidder from the date of issue of allotment order by the Port. Once a plot is allotted, a successful bidder cannot decline to accept the allotment of the plot. In case, a plot is allotted and for some reason or other, same is declined by the successful bidder, the full MGT and license fee paid to Paradip Port Trust will stand forfeited. 9. On account of the tender condition, the bidders other than H-1 bidder have to match the License fee with that of H-1 price and submit the total license fees for 11 months along with applicable Service Tax in shape of Bank Draft/banker s cheque within 7 (seven) days of intimation which is Non-Refundable. 10. The tender is for allotment of land for handling of iron ore. The successful bidders of the tender will be permitted to converge and store iron ore for exports or for coastal shipment and will be required to pay to the Port wharfage and other charges as applicable as per Scale of Rates of this port. 11. The wharfage charges paid by the successful bidders towards the Minimum Guaranteed Traffic (MGT) will get adjusted towards wharfage charges against the shipments to be made by the iron ore exporters and incase the actual shipment of iron ore falls short of the target fixed by the Port, the Port will forfeit the balance amount deposited by the successful bidder towards MGT. In case, actual handling exceeds the MGT of 1,83,000 MT, the allottees will be required to pay the differential amount to the Port over and above 1, 83,000 MT. 12. The allotment of the iron ore plots is for a period of 11 months and same shall not be renewed further. 13. The allottees will be required to handle iron ore using these plots after observing all statutory formalities. The cargo in the plot should be converged and evacuated in such a manner that minimum cargo is left out at the end of license period. 4

14. The tender process for allotment of these plots will again start prior to expiry of the initial license period of 11 months and the previous allottees will be required to hand over the plot to the Port in vacant condition on the date of expiry of license period. Incase of failure to handover the plot in vacant condition, the Port would initiate action as deemed fit. 15. The allottee can not sublet the plot to other firms. If found so, the plot allotted shall be cancelled with immediate effect, the licensee fee and MGT submitted by the allottee shall be forfeited. It shall be the responsibility of the allottee to shift the cargo in his own risk, cost and expense within fifteen days of such notification. 16. Paradip Port Trust reserves the right of cancellation of the plot allotted within the allotment period without citing any reason thereof giving one month advance notice to the allottee. 17. Watch and ward of the cargo at the siding plot is under the scope of the firm. 18. The unsuccessful bidder will be entitled for refund of money deposited with the tender except cost of the paper. 19. All disputes are subject to exclusive jurisdiction of courts at Kujang only. 20. Bidders are strongly advised to inspect the plots before submission of their bids. After allotment of the plot, no complaint towards conditions of the plot or exchange of the plots for whatsoever reason shall be considered. 21. On allotment of plot, if any party does not make minimum shipment of 47,000 MT within four months from the date of issue of allotment order, the plot of the concerned party will be treated as cancelled and dues i.e MGT and Bid price paid in connection with the allotted plot for the year will be forfeited. 22. The participants already in possession of plots on account of previous order of Hon ble Supreme Court of India, which now stands vacated by the order of Hon ble Supreme Court of India dated 17.12.2013 and the existing allottees fail to vacate their plots before dropping the tender, should give an undertaking in the form of an affidavit before an executive magistrate that they will vacate their plot in case they fail to get any new plot/shift their cargo to the new plot allotted, as the case may be, within 45 days from the date of issue of allotment order, failing which their newly allotted plot through this tender will cancelled. The existing plot holders during this 45 days will not be permitted to 5

converge any cargo in the plot allotted to them. The existing plot holders if allotted another plot through this tender, they have to vacate their plot within the stipulated time period as specified in their allotment order. But they have to pay MGT and license fee from the date of allotment of new plot. The date of allotment of new allottees will start from the actual date of occupation. This is done to deter the plot holders to unnecessary block the plot and prevent export of iron ore by other parties. 23 In case of any grievance by any allottee through this tender before going to any Honorable court, the allottee shall make representation to Traffic Manager, PPT who shall dispose of the said petition within a month of receipt of the letter. If the allottee is not satisfied with the order of Traffic Manager, PPT he shall appeal to Chairman, PPT who shall dispose of the same within a month of receipt of letter. If still the allottee is not satisfied, it may approach any Honorable court of law. 24. A list of firms shall be prepared who matches to the H-1 price basing on their bid seniority. This list shall be valid for a period of six months from the date of issue of allotment order. After allotment of the existing plots put to tender, the remaining firms in the list may take back their MGT value submitted along with their bid. Paradip Port may allot some of the balance Mechanical plots of non-standard size beyond 19 nos. based on the rate and to the firms enrolled in the list. For allotment of balance mechanical plots,the firms who have been enrolled in the list prepared by Paradip Port will be given seven days time from the date of intimation to submit the MGT value along with the total license fee. On submission of all requisite fees, the allotment order shall be issued in favour of the firm. In case they fail to submit the requisite fees within the stipulated time period the next firm in the list will be given option towards allotment of the plot and so on. 25. a) In the Iron Ore Handling Plant if stacking is not possible due to ship loading, then stacking will be done either in accessible common plot or vacant plot. In that case, the Party has to shift their cargo manually to their allotted plot immediately. b) The cargo owners have to ensure that a gap of 1.5 Mtr is maintained from the track line at Iron Ore Handling Plant for smooth movement of equipments. In case the cargo is spilled over to the track line, the cargo owners have to clean the track line immediately for movement of equipments. 26. Paradip Port Trust reserve the right to reduce the number of plots for allotment as against the 19 nos. of plots for which tender have been invited. 6
