The Promoter is the Australian Rugby Union Ltd (ABN), PO BOX 800, Surry Hills NSW 2010. The competition starts at 11.00 (AEDT) on 07/12/17 and ends at 11.59pm (AEDT) on 21/12/17 (the Competition Period). You can only enter if you are an Australian resident aged 18 or over who can take the prize on dates specified by the Promoter between 26 January and 28 January 2018 (inclusive), unless you are: (a) (b) (c) management, employees, directors and contractors of the Promoter, its related entities and other agencies, firms or companies associated with the competition (including suppliers of the prize); a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in (a) above; or persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter. The persons referred to in (b) above includes natural and nonnatural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is eligible in its absolute discretion. The second valid entry chosen will win 2 seats into the HSBC Beach Club on Sunday 28 January 2018. The third valid entry chosen will win 2 seats into the HSBC Beach Club on Saturday 27 January 2018. The fourth valid entry chosen will win 2 seats into the HSBC Beach Club on Friday 26 January 2018. How and when will the winners be informed? If I win, when must I claim my prize? What if I don't claim my prize on time? Only one entry per individual. Hospitality for two people at the HSBC Sydney 7s on Saturday 27 January and two seats in the HSBC Beach Club at the HSBC Sydney 7s on Sunday 28 January. Interstate winners will receive two economy flights to Sydney. Flights must be on a Qantas operated route and will be booked by Rugby Australia at the most suitable time as agreed with the winner (One winner) Prize 2: Two seats in the HSBC Beach Club (Three winners) Prize 3: Behind the scenes tour at the HSBC Sydney 7s for up to 4 people (Two winners) Once notified the winners must accept their prize by Friday, 22 December 2017 The winner of prize one is responsible for all other costs related to the prize, additional meals; additional transfer costs (e.g. between a traveller s residence and the departure airport, or to any other destination in Sydney other than the InterContinental Hotel Sydney or Allianz Stadium ); any overnight accommodation while travelling to the departure airport or destination; The winners or prizes two, three, four, five and six are responsible for all other costs related to the prize, including any travel to and from the game, additional meals; additional transfer costs (e.g. between a traveller s residence and the departure airport); any overnight accommodation while travelling to the departure airport or destination; Tickets can only be used once and will be deemed invalid if copied. You must keep your tickets safe and the Promoter will not replace lost or stolen tickets. The Promoter accepts no responsibility if any of the 2018 HSBC Sydney 7s matches are abandoned, called off or postponed for any reason and you will not be given any cash. Alternate 2018 Sydney 7s tickets may be given as a substitute. General 4 If you are a winner, you (and your companion, if applicable) must take part in all publicity, photography and other promotional activity as the Promoter requires, without any 3
compensation. You (and your companion, if applicable) consent to the Promoter using your names and images in any promotional or advertising activity. 5 If you or your entry are deemed by the Promoter to breach these Terms and Conditions including if you are unable to take the prize on the dates specified by the Promoter between 26/01/18 and 28/01/18, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights. The prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction. In the event that you cannot provide suitable validation or verification, you will forfeit your right to a prize and no substitute will be offered. 6 You must not: (a) (b) (c) (d) (e) (f) tamper with the entry process; engage in any conduct that may jeopardise the fair and proper conduct of the competition; act in a disruptive, annoying, threatening, abusive or harassing manner; do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition; breach any law; or behave in a way that is otherwise inappropriate. 7 The Promoter s decision in connection with all aspects of this competition is final. 8 Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities. 9 By accepting or participating in any prize, your companion accepts these Terms and Conditions. 10 If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities. 11 The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office s stated view that where the parties are at arm s length, goods and services exchanged are of equal GST inclusive market values. Liability 12 Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth). 13 Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss 4
(including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law). 14 Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prizes. Prizes will only be delivered to addresses in Australia. 15 The Promoter may communicate or advertise this competition using Facebook or Instagram. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You completely release Facebook and Instagram from any and all liability.
