PROFORMA-III ENVELOPE-II OFFICE OF THE REGISTRAR :: TEZPUR UNIVERSITY :: NAPAAM: 784028 Terms and conditions for contract of Catering services of the Men s and Women s hostel of the University within Napaam, Campus (To be signed on each page and returned with the tender submitted) 1. i) The Hostel catering services will be operated from the morning of 31st -07-2010 ii) The Hostel will be allotted to a qualified quotationer. Party may quote rates hostel wise. A single party may not get allotment for all the hostels. Earnest money must be deposited @ Rs. 20,000/- for each hostel quoted. 2. The contractor shall engage specified numbers of staff for preparing breakfast, morning / evening tea, lunch and dinner. They will have to serve in the dining hall as per the time schedule of the hostel. 3. Maintenance of cleanliness and the hygiene of the kitchen, dining hall and the store will be the responsibility of the contractors. The Contractor s responsibility will also include the cleaning, washing and proper maintenance of all utensils, cooking accessories and equipment etc. used for the catering service. 4. The Hostel Mess shall be controlled by the Mess Secretary (Student) and the staff of the contractor shall act as per the instructions of the Warden / Mess Secretary of the Hostel. 5. i) The University shall decide the number of Cook and Menial (Staff) to be engaged by the Contractor in each Hostel. ii) The contractor will maintain the agreed engagement of staff on all days of the month. iii) The contractor shall ensure presence of correct number of staff on duty. Staff suffering from sickness / diseases shall be replaced with substitute immediately. 6. In the event of the illness of any of the staff engaged by the Contractor or any of the staff not discharging the assigned duties properly, the contractor will place substitutes immediately on his/ her own expense with intimation to the Warden. Proportionate deductions shall be made from the payment towards such staff. 7. The University shall deduct the income tax as per rule. Service Tax will be paid as per rules and on submission of bills and other relevant documents. 8 i) The university shall provide utensils, cooking stoves and other necessary equipment and accessories to the contractor. ii) The contractor shall be wholly responsible for any misuse, abuse, damage and destruction of any university property assigned for providing the catering service.
9. There are 4 nos of Women s Hostel and 4 nos Men s Hostel in the University Campus. Requirement of staff (cooks and menials ) is given below. The accommodation provided to the staff, shall be handed over to the university on termination of the contract or at any time earlier at the instruction of the university. In case the possession is not handed over in the manner referred to herein above, the university will take possession of the unauthorized accommodation by the use of such force as may be required. Staff engaged at the hostel will not loiter / move around the residential area /guest house without permission. The contractor shall provide uniform for the staff engaged for catering and cleaning services with Navy Blue Shirt Trousers for male workers and Navy Blue bordered Light Blue Saree or Blue Salwar with white Kameej for the female workers. Wearing of uniform is compulsory while on duty. The cloth material of the uniforms shall be of cotton. The cooking staff must wear head gear while in the kitchen. Apron is also a must for the cook and hand towels must be supplied to all mess workers. 11. University shall be on vacation from 1 st to 15 th January and 1 st June to 31 st July during which hostels will remain closed. During this period some of the staff will be retained for running hostel mess and others will be released. The released staff will not be entitled for any payment. 12. The contractor(s) shall have to deposit a refundable interest free security deposit of Rs. 20,000/- (Rupees twenty thousand) only per hostel to the university at the time of taking charge of the service. The security deposit will be forfeited if the contractor fails to render services to the satisfaction of the University authority. In case of any loss or damage of the university property, the cost will be recovered from the security deposit. The earnest money deposit may be converted to security deposit if the party desires. 13. The contractor shall have to submit full particulars of the staff employed by the contractor. The competent authority of the university will issue passes with photo identity cards allowing them to work in the hostel. 14. The staff engaged by the contractor must act decently without involving in drinking of alcoholic beverages or picking up quarrel with fellow employees or students in the Hostel and in the campus.
15. i) The contractor shall be held responsible for misuse or loss of University property issued to the Hostel Mess. ii) The University shall not be involved in any way, whatsoever, in case of any violation of any law by the contractor. The contractor shall be wholly responsible and the university can not be called or dragged into litigation in any manner. In case, due to violation of any law, including labour law, etc, any liability is placed upon the university, the contractor must indemnify the University completely. 16. The contract agreement shall be valid for a period of one year from the date of commencement of offering the service. The agreement of the contract may be terminated within the contract period on either side by giving three months notice. 17. The contractor shall be responsible for payment of claims for compensation due to loss of life/injury, etc., of any labour engaged in the University work. Life Insurance coverage of the labour engaged by the contractor shall be the responsibility of the employer (contractor). Payment of minimum wages as fixed by the Labour and the Employment Department, Govt. of Assam on contract labourers for Eating Houses (Please refer to Notification of 2001.or modified from time to time by Commissioner & Secretary, Govt. of Assam, Labour & Enforcement Department) must be ensured by the contractor. Payment to the staff engaged, must be made within the first week of the billing month in the presence of concerned hostel Warden and all payment must be recorded in a proper register. The register must be produced to the Warden concerned for counter signature every month.the contractor will also submit a certificate confirming compliance of statutory obligations such as adherence to minimum wages Act as enforced and all other statutory requirement along with the monthly bill for payment. Quarterly submission of payment records for EPF, ESI, TAN/PAN, and Service Tax shall be necessary for every contract of hostel(s). 18. Any staff, who does not perform his/her duties satisfactorily and whose conduct is not good must be withdrawn immediately with substitute. 19. For the Women Hostels, only female menials are to be engaged. 20. The contractor must be available on call and for this purpose he/she must have a Cell Phone.
