PRODUCT DISCLOSURE SHEET (Read this Product Disclosure Sheet before you decide to take out the Bank Guarantee. Be sure to also read the terms in the letter of offer. Seek clarification from your institution if you do not understand any part of this document or the general terms). Bank Guarantee Date: 1. What is this product about? A written undertaking by UOB at the request of the applicant (yourself), in favor of a third party (the beneficiary) guaranteeing payment. 2. What do I get from this product? The type of guarantee that can be offered to you under Bank Guarantees (BG) are summarized as follows: Tender/Bid Bond - support of the customer s bidding/tendering on a project - covers risk of seller withdrawing bid, fail to accept a contract if awarded - fail to provide performance bond - typically 2% - 5% of contract value - duration of 3 6 months Advance Payment - support of advance payments when the Contractor who has been awarded the project begins work - usually required for materials, startup costs or general working capitals - from 10% of contract value upwards - until date of contractual delivery being made Performance Guarantee - support of the customer s obligation to fulfill a contractual commitment in accordance with the terms and conditions of the contract - Normally given upon successful of a tender - Typically 10% of contract value - Until completion of performance Warranty Maintenance Guarantee - given in support should the Contractor fail to honor Warranty obligation (during the maintenance or defects liability period) - Typically 5% of the contract value - Until defect liability period Retention Guarantee - support of contract which requires a certain percentage of payment to be withheld until the project is completed and accepted by contracting buyer - claim in the event contractor is unable to fulfill his obligations - typically 5% of contract value - Until final verification of satisfactory of performance 1

3. What are my obligations? Pay UOB upon demand of money. 4. What are the fees and charges I have to pay? Commission BG: Creation Amendment (amount/ tenor) Amendment (others)/ Reissuance Non-cancellation of BG (3 months after expiry/ claim date) From 0.106% p.m. inclusive of any claim period with minimum RM106.00 (inclusive GST) From 0.106% p.m. on extension of expiry or increase of amount with minimum RM106.00 (inclusive GST) RM106.00 flat (inclusive GST) From 0.106% p.m., depending on commission rate charged (inclusive GST) PG or FG: Subject to customer requirements and suitability, to be reflected in Letter of Offer issued by UOB. Stamp Duties As per Stamp Duty Act 1949 (Revised 1989). Other Charges Please refer to our Letter of Offer and our Corporate website at www1.uob.com.my for further details. The Bank can revise the commission, interest rate, fee and charges from time to time at its absolute discretion, subject to the Bank giving you advance notice of 21 days. 5. What if I fail to fulfill my obligations? Default interest at 3.5% per annum above the Bank s Base Lending Rate on such sum paid by the Bank pursuant to any Bank Guarantee issue by the Bank. The Bank has the right to charge additional fee for non-return of original instrument. Your facilities may be recalled. Right to set-off: We have the right to set-off any credit balance in your account maintained with us against any outstanding balance in this loan account. The Bank may exercise its rights and start its recovery process / legal action. Right to sell non-performing loan: We have the right to sell a non-performing loan to a third party. We have the right to cancel the loan and to require you to fully settle the loan if you, your partner or your co-borrower dies (For sole proprietorship and partnership). IMPORTANT NOTE: THE PROPERTY CHARGED MAY BE FORECLOSED IF YOU DO NOT KEEP UP WITH THE REPAYMENTS OF YOUR FACILITIES. 6. What if I fully settle the loan before its maturity? Not applicable. 7. Do I need any insurance / takaful coverage? No. 2

8. What are the major risks? Bank Guarantee bears no expiry date and no liability amount. Release of liability is upon discharge by the beneficiary. Request for payment against Performance Guarantee or Financial Guarantee is upon presentation of written demand by the beneficiary without UOB determining that default has actually happened by the applicant. 9. What do I need to do if there are changes to my contact details? It is important that you inform us of any change in your contact details to ensure that all correspondences reach you in a timely manner. Please inform us of any change in your contact details to the nearest UOB branch or the Business Banking Service Center or contact your UOB Account Relationship Manager. 10. Where can I get assistance and redress? If you have difficulties in making repayments, please contact the bank earliest possible to discuss repayment alternatives.
