By entering, entrants accept these Conditions of Entry. All entrants must agree to their details being shared with the Perth Wildcats & Perth Lynx, and the Promoter in accordance with and for the purposes set out in the Conditions of Entry. All entrants must agree to being filmed without payment by the Promoter and the Perth Wildcats & Perth Lynx for promotional purposes as part of the notification method should they win the competition. Competition Period ENTRY Entry Method Friday, 10th August 2018 Friday, 24th August 2018, 3:00pm AWST To enter the Competition, an Eligible Entrant must, during the Competition Period: (i) visit www.knightcorp.net.au (Competition Website) and follow the directions to fully complete the "Perth Wildcats NBA Tour" competition form; tick the box agreeing to these Conditions of Entry; and Comply with the Entry Requirements Entries will be deemed received at the time that the Promoter is satisfied that the Entry Requirements have been met and not at the time of submission by the Eligible Entrant. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or delays or failures in any equipment or telecommunications service used to administer this Competition.
The Promoter reserves the right to require an entrant to verify the validity of their entry within the requested time, including but not limited to an entrant s identity, eligibility, age and address and to disqualify any entrant who does not satisfy any entry criteria in these conditions. Errors and omissions may be accepted at the Promoter s discretion. Proof considered suitable for verification is at the Promoter s discretion. Entries submitted using any form of automated entry device or software are ineligible. Entries not fully complying with these Conditions of Entry will be deemed invalid. Maximum Number of Entries DRAW AND PRIZES Draw Details Entrants can only enter the Competition in their own name. There is a limit of one entry per person. Any subsequent entry from the same person after the first valid entry is received will be deemed invalid. All valid entries received during the Competition Period will be entered into the draw. The winners will be randomly selected from all eligible entries. Draw Place: 249 Stirling Highway, Claremont WA 6000 Date: Friday, 24 th August 2018 Time: 5pm AWST *Please note that the winner will not be notified until Tuesday, 28 th August 2018, 7:00am AWST. Unclaimed Prize If: (i) a winner is unable or unwilling to take the prize as stated; or the Promoter has been unable (despite reasonable efforts) to successfully contact the winner on or before the Unclaimed Draw Date; or a winner is determined by the Promoter to be ineligible to win a prize in accordance with these Conditions of Entry, the relevant prize will be forfeited and instead awarded to another Eligible Entrant in a redraw. No compensation will be payable if a winner is unable to take any element of a prize as stated, or does not satisfy any conditions of use for any element of the prize (including conditions imposed by event organisers or staff, or other prize providers, such as health, behavior, age and safety requirements), for whatever reason. Any part of a prize that is unclaimed for any reason is forfeited and no compensation will be provided. If for any reason whatsoever beyond the reasonable control of the Promoter, the promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to:
(i) disqualify any entrant;or subject to any written directions from a regulatory authority, to suspend, modify, terminate or cancel the competition. Unclaimed Draw Date Prize Details If any Prize remains unclaimed, an unclaimed draw prize will be held at the same Draw Place as the original draw on Tuesday, 28 th August 2018 at 12:00pm AWST. The winners will be randomly selected from all remaining Eligible Entrants. There is one (1) prize to be drawn, comprising the following: (i) Economy flights for two people; from Perth to Utah, Utah to Denver, Denver to Perth; and A Perth Wildcats NBA Tour package (NBA Tour Package) for two people which include 8 nights accommodation and events to be held during the travel dates 28 th September 6 th October 2018 (Prize) All components of the Prize must be taken together and when offered or will be forfeited. The prize cannot be used in conjunction with other travel discounts or special offers, and frequent flyer points will not be accrued. The Prize is valued at $13,000 AUD including GST. A prize value is the recommended retail value as provided by the relevant supplier(s) and is subject to change. The Promoter takes no responsibility for any variation in a prize s value due to exchange rate changes or otherwise. Any additional costs not expressly stated, but which may be incurred in acceptance and use of a Prize, are the responsibility of the winner. This includes but is not limited to travel and transfer costs to and from all points of departure and arrival (airports, hotels, events), taxes, insurance, spending money, gratuities and any other costs in relation to the Prize and travel. Prize Conditions Notification Method The Prize is not transferable or exchangeable and cannot be redeemed for cash.the economy class flights, including the airline carrier and dates of any flights the subject of the Prize will be provided by the Promoter at its sole discretion. The Promoter reserves the right to elect the airline carrier and dates of travel for the purpose of the winner and a companion being able to have the benefit of the NBA Tour Package. The decision is final, the winner will be notified in person on Tuesday, 28 th August 2018 at 7:00am AWST. The notification method will be recorded for promotional purposes and by entering the competition the entrant agrees to being filmed without payment if named the winner. Further contact to the winner will be made by phone contact, and via email address on Tuesday, 28 th August 2018, or if there is a redraw for any unclaimed prize, on Tuesday, 28 th August 2018, 3:00pm AWST.
First name and suburb of the winner will be published on Knightcorp Insurance Brokers Facebook, Instagram and LinkedIn social media channels and Perth Wildcats & Perth Lynx website and social media channels. Prize Delivery GENERAL Promotional Activities Personal Information The winners will need to collect their prize from the Perth Wildcats offices, Bendat Basketball Centre, 201 Underwood Avenue, Floreat to transfer the prize (flights and tour package) into the winners name. In consideration for awarding a Prize to a winner, winners agree to participate in any promotional activity regarding winning the Prize and consent to their name and image being used in promotional material without payment. The Perth Wildcats & Peth Lynx and the Promoter collect personal information to conduct the Competition and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this personal information. The winner s first name and suburb will be published on the Competition Website, Promoters social media channels and Perth Wildcats website and social media channels. Entrants Information a) By entering the Promotion, you give the Perth Wildcats & Perth Lynx and the Promoter consent to use your personal information for further purposes and promotions unless you say otherwise. b) All entries become the property of Perth Wildcats & Perth Lynx and the Promoter. c) All entries will be entered into a database and the data provided may be used for future promotional, marketing and publicity purposes by Perth Wildcats & Perth Lynx and the Promoter. d) Perth Wildcats & Perth Lynx and the Promoter may, unless you advise otherwise, use your personal information for future promotional and marketing activities. General Conditions and Exclusions These Conditions of Entry should be read in conjunction with the Perth Wildcats NBL x NBA Tour Packages Terms and Conditions applicable to the NBA Tour Package. The Promoter has no control over flights or any items listed in the NBA Tour Packages and has no responsibility for problems associated with them, including any delays or cancellations. The winner and their companion are solely responsible for ensuring that they have all necessary documents and permissions to travel to the relevant destination (including a current passport and any visas that may be required). The winner and their companion are solely responsible for all risks associated with travelling and use of the Prize, and for obtaining any travel insurances in relation to those risks. All hotel accommodation and events are at the discretion of the Perth Wildcats in their discretion may add or remove events during the travel period 28 th September 2018 6 th October 2018. If for any reason this promotion is not capable of running as planned or if the administration, security, fairness, integrity or proper conduct of this promotion is affected for any reason, the Promoter may in its sole discretion cancel, terminate, change or suspend the competition. The Promoter may disqualify any individual who tampers (or benefits from the tampering) with the entry process or the conduct of the competition or who has, in the Promoter's opinion, engaged in conduct which is fraudulent, misleading or generally damaging to the reputation of the Promoter or has breached these Conditions of Entry. The Promoter and its related companies or agencies will not be liable for any loss (including without limitation, consequential or indirect loss), cost or damage, personal injury or death which is suffered (whether due to the negligence of any person) in connection with: (i) entering the Competition; the winner and any companion using the Prize; and the winner and any companion noting being able to use the Prize in part or whole, for any reason, except any liability which cannot be excluded by law (and if so, that liability is limited to the minimum allowable by law). The Promoter assumes no responsibility, and accepts no risk or liability for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with
(iv) (v) (vi) communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise; any theft, destruction or unauthorised access to, or alteration of such communications; any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); any delay in delivery (when not directly caused by the Promoter or its supplier), or failure of safe delivery of a prize; the acts or omissions of any third party, including airlines, hotels, venue operators. All of the Promoter's decisions in relation to all aspects of this Competition are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. A winner accepts a prize at their own risk. Any tax or legal liability arising as a result of accepting a Prize is the responsibility of the winner. Independent legal and financial advice should be sought by the winner in relation to the operation of these Conditions of Entry prior to entering into the Competition.
