IN THE MATTER OF THE INSOLVENCY ACT 1986 AND IN THE MATTER OF ERIKA ANDERTON CHAIRMAN'S REPORT OF MEETING OF CREDITORS REGARDING THE PROPOSED VOLUNTARY ARRANGEMENT I, Michelle Bennett of Creditfix Limited, the duly authorised Chairman of the meeting of creditors held on 28 October 2016 at 4 West Regent Street, Glasgow, G2 1RW, United Kingdom under section 257 of the Insolvency Act 1986 hereby report as follows : i That the following resolution was duly passed: RESOLUTION "That the proposed Voluntary Arrangement of Erika Anderton under Part VIII of the Insolvency Act 1986, set out in her proposal dated 28 October 2016, as modified by this meeting, be and is hereby approved." ii iii I attach a schedule of creditors with their respective values who were present or represented at the meeting, stating how they voted. The proposal for a Voluntary Arrangement was approved with the following modifications: 1 The supervisor fee will be equivalent to 15% of all further realisations and drawn proportionally as funds are received. 2 No Category 2 disbursements are to be charged by the Nominee or Supervisor 3 Variation fees shall not be considered or agreed as part of the arrangement until a variation meeting is called by the IP. Consideration of the fee required to vary the IVA will be made at the creditor meeting based upon the debtor circumstances and work undertaken or required by the IP. 4 The Nominee Fee must not exceed 1000. Once this payment has been paid to the nominee the first dividend shall be paid quarterly as a minimum thereafter. 5 The Debtor must seek full time employment, which is expected to be 35 hours per week, unless the Debtor can provide evidence to the Supervisor that this will be financially detrimental. Any additional surplus income must be introduced to the Arrangement for the benefit of the Creditors. Failure to comply with this will constitute a breach of the Arrangement 6 6. A copy of the chairman s report must be sent to dlc via email at OPS.Support@dlcuk.com within 4 working days of the creditors meeting being held. This report should outline any changes to the dividend and the Nominee and Supervisor fees. 7 The customer must immediately notify the Supervisor of any changes of address. If the customer fails to do this and the Supervisor is unable to locate the customer, a Certificate of Termination must be issued and any funds available within the arrangement distributed to creditors.
8 Not less than 28 days notice must be given to creditors should a variation meeting be convened. 9 Should the customer be required to obtain a mortgage as part of the IVA proposal the Supervisor must secure the creditors interest in the property and any other property in which the customer may have beneficial interest. To facilitate this, the customer must provide the Supervisor with a signed RX1 form within 3 months of the approval of the IVA 10 Should the customer be required to obtain a mortgage and is unsuccessful in doing so, a meeting of creditors should be convened.
