K (UK) (2015) (For use on Consumer Insurance Contracts) LMA3132 14 July 2015 [AMENDED] The insurance contract In return for payment of the premium shown in the schedule, we agree to insure you, subject to the terms and conditions contained in or endorsed on this contract of insurance, against accidental death in the manner and to the extent provided in this contract during the period of insurance. Eligibility criteria In order to be eligible to purchase this insurance you must: be between the ages of 18 years and 75 years at the time of purchase; be permanently resident in the UK or in the European Union; and intend to fly in, and seek insurance for flying in, an aircraft operated by an airline that has an IATA code, and is listed on the www.million-aircover.com website. Definitions Wherever the following words appear in bold they will have the meanings shown below. Accident / Accidental means a sudden, unexpected, unusual, specific, external event which occurs at an identifiable time and place during the period of insurance. Air Accident Bodily injury Chesterfield Insurance Brokers Ltd Coverholder Flight number IATA Illness Insured Flight means an accident which occurs as a direct result of an occurrence associated with the operation of an aircraft which takes place between the time the insured person undertaking an Insured Flight boards the aircraft with the intention of flight but before such time as all passengers have disembarked, in which either, a person suffers bodily Injury as a result of: o being in the aircraft, or o direct contact with any part of the aircraft, including parts which have become detached from the aircraft, or o direct exposure to jet blast, except when the bodily Injury is self-inflicted or, the aircraft is missing or is completely inaccessible. means identifiable physical injury which is caused by an air accident, and solely and independently of any other cause (except sickness or disease directly resulting from, or medical or surgical treatment rendered necessary by such injury) results in death within twelve months from the date of the accident. Chesterfield Insurance Brokers, established in 1999, is a Lloyd s insurance, reinsurance broker and a Lloyd s Coverholder. Authorised by the Financial Conduct Authority (FCA) and an accredited Lloyd s broker, Chesterfield operates actively in all the major international markets. Financial Conduct Authority Reference Number 309345 means a broker, company or partnership authorised to enter into a contract or contracts of insurance to be underwritten by the members of a syndicate at Lloyd s. means the term in common use by the general public to denote a particular flight from airport A to airport B, and, as used in this insurance, by incorporating letters identifying the airline together with a sequence of numbers it corresponds to the official term flight code. means the International Air Transport Association means sickness or disease of the Insured Person means a scheduled commercially operated flight with a published flight number on a specific date corresponding to an airline that has an IATA code which the insured person o has previously successfully purchased insurance for through the www.million-aircover.com portal, and, o holds a valid boarding pass to travel upon on that specific date. Notwithstanding the foregoing, Insured Flight shall also mean any alternative commercially operated flight with a published flight number corresponding to an airline that has an IATA code that is offered by the original airline following cancellation of the original flight and occurs within 24 hours of the original flight. Should such alternative arrangement within those 24 hours obligate the insured person to make a transfer over land then solely in these circumstances Insured Flight shall also mean all travel up to a maximum of 250 miles in a properly licensed commercially operated mechanically powered vehicle operated by a MAC_UK_EN_V2.3 3

million aircover Missing Period of insurance Schedule We / us / our You / your party other than the insured person. Means the website www.million-aircover.com and any associated email addresses operated on behalf of Chesterfield Insurance Brokers Ltd means when the official search for an aircraft has been terminated and the wreckage has not been located. means the period for which this insurance is in place as shown in the schedule. the pages of this document showing your name, the beneficiary s name, the sums insured, the flight details and the period of insurance. the Underwriters at Lloyd's who have a share in this insurance. the person named in the schedule as the policyholder. Important information This document, the schedule, and any endorsement(s) attached form your insurance. This insurance sets out the conditions of the contract of insurance between you and us. Please read the whole document carefully and keep it in a safe place. It is important that: you check that the information contained in the schedule is accurate and that the schedule reflects the coverage sections you have requested (see the Information you have given us section below); you notify us of any inaccuracies in the information contained in the schedule, or of any changes to that information (see the Notifying us of any changes or inaccuracies section below); Failure to comply with the above could adversely affect your insurance or any claim you make. Information you have given us In deciding to accept this insurance and in setting the terms and premium, we have relied on the information you have given us. You must take care when answering any questions we ask by ensuring that all information provided is accurate and complete. If we establish that you deliberately or recklessly provided us with false or misleading information we will treat this insurance as if it never existed and decline all claims. If we establish that you carelessly provided us with false or misleading information it could adversely affect your insurance and any claim. For example we may: treat this insurance as if it had never existed and refuse to pay all claims and return the premium paid. We will only do this if we provided you with insurance cover which we would not otherwise have offered; or amend the terms of your insurance. We may apply these amended terms as if they were already in place if a claim has been adversely impacted by your carelessness; or charge you more for your insurance or reduce the amount we pay on a claim in the proportion the premium you have paid bears to the premium we would have charged you; or cancel your insurance in accordance with the Cancelling this insurance section below. We will write to you if we: intend to treat this insurance as if it never existed; or need to amend the terms of your insurance; or require you to pay more for your insurance. MAC_UK_EN_V2.3 5

Notifying us of any changes or inaccuracies If you become aware that information you have given us is inaccurate or has changed, you must inform Chesterfield Insurance Brokers Ltd as soon as practicable by email to admin@millionaircover.com or via the Get in Touch page on www.million-aircover.com. When we are notified that information you previously provided is inaccurate, or of any changes to that information, we will tell you if this affects your insurance. For example we may amend the terms of your insurance or require you to pay more for your insurance or cancel your insurance in accordance with the Cancelling this insurance section below. If you fail to notify us that information you have provided is inaccurate, or you fail to notify us of any changes, this insurance may become invalid and we may not pay your claim, or any payment could be reduced. Cancelling this insurance You may cancel this insurance in respect of each insured flight until three hours before each scheduled departure time by logging into your account and clicking on the delete flight button. You will receive a full refund for the cancelled insured flight. We can cancel this insurance in writing up to 30 days but no less than 24 hours before the scheduled departure time of each of your insured flights. We will only do this for a valid reason, for example if you provide false information such as a false date of birth in order to qualify for this insurance. Inheritance Tax Benefits payable under this policy may be subject to Inheritance Tax. MAC_UK_EN_V2.3 6

What is covered This insurance only covers claims which fall within the definition of bodily injury and does not cover any claim caused or contributed to by illness, except as provided for in a limited way in that definition of bodily injury. We will pay the benefit shown in the schedule of benefits if you suffer bodily injury during the period of insurance which results in your accidental death as a direct result of any air accident. Conditions 1. If the accident results in your death after twelve (12) months following the date of the accident, then no claim will be payable. 2. This benefit will also be payable in the event of your disappearance. We will only provide this benefit if: a) your body is not found within twelve (12) months of your disappearance, and sufficient evidence is produced, that leads us inevitably to the conclusion that you have sustained bodily injury and that such injury has caused your death; and b) the person or persons to whom such sum is paid will sign an undertaking to refund such sum to us if you are subsequently found to be alive. What is NOT covered A. This insurance does not cover claims in any way caused or contributed to by: 1. the actual or threatened use of pathogenic or poisonous biological or chemical materials by any person(s), committed for political, religious, ideological or similar purposes with the intention to influence any government and/or to put the public or any section of the public in fear unless restricted to within the confines of the aircraft the insured person is flying; 2. nuclear reaction, nuclear radiation or radioactive contamination; 3. your engaging in or taking part in armed forces service or operations; 4. your engaging in flying of any kind other than as a fare-paying passenger; 5. your suicide or attempted suicide or intentional self-injury; 6. your deliberate exposure to exceptional danger (except in an attempt to save human life); 7. a criminal, warlike or terrorist act by you, a family member or a member of your travelling party; 8. Bodily Injury during flights for which the www.million-aircover.com portal either does not offer a quote, or flights where it does offer a quote but for which the insured person does not purchase insurance UNLESS the flights fall within the provisos following cancellation of an original flight in the definition of Insured Flight. Clauses The following Clause(s) will be deemed to be Operative only if shown within the Policy Schedule and relating to a particular flight. PassiveWar Exclusion Clause This insurance does not cover claims in any way caused or contributed to by: War and warlike acts resulting in an air accident where the insured flight originates, terminates, or both, in any of the following countries or regions: Afghanistan, Algeria, Azerbaijan, Burundi, Cameroon, Central African Republic, Colombia, Democratic Republic of Congo, Egypt, Ethiopia, Iran, Iraq, Jammu & Kashmir, Lebanon, Libya, Mali, Mauritania, Nigeria, North Korea, Pakistan, Peru, Somalia, The Republic of Sudan, South Sudan, Syria, Ukraine, Yemen MAC_UK_EN_V2.3 8

How to make a claim In the event of a loss, underwriters and/or their representatives will contact your beneficiary to confirm the existence of a policy and whether your estate has a valid claim as soon as practicably possible. How we deal with your claim Once your claim is accepted, we will pay your estate the amount stated in the schedule of benefits. The name of the beneficiary requested in your policy will be advised to your executors. Fraudulent claims If you, or anyone acting on your behalf, make a claim knowing it to be false or fraudulent in amount or in any other respect, this insurance will become invalid. This means we will not pay the false or fraudulent claim, or any subsequent claim. How to make a complaint Our aim is to ensure that all aspects of your insurance are dealt with promptly, efficiently and fairly. At all times we are committed to providing you with the highest standard of service. If you remain dissatisfied after Lloyd s has considered your complaint, or, in any event, after a period of eight weeks from making your complaint, you may refer your complaint to the Financial Ombudsman Service (FOS). The FOS is an independent service in the UK for settling disputes between consumers and businesses providing financial services. Under the terms of the Financial Ombudsman Services Scheme Lloyd s must: (i) reply to you within four weeks; and (ii) resolve your complaint within eight weeks; of the date of your original complaint. If Lloyd s fail to do so or if you remain dissatisfied after Lloyd s has considered your complaint, you may have the right to refer your complaint to the Financial Ombudsman Service. This is in addition to any other action you may subsequently wish to take including legal action. An application to the Financial Ombudsman Service must be made within six months of being notified of a final decision about your complaint. If you were sold this product online or by other electronic means within the European Union (EU) you may refer your complaint to the EU Online Dispute Resolution (ODR) Platform. Upon receipt of your complaint the ODR will escalate the complaint to your local dispute resolution service- this process is free and conducted entirely online. You can access the ODR platform on HTTP://ec.europa.eu/odr. Making a complaint does not affect your right to take legal action. Compensation Lloyd's insurers are covered by the Financial Services Compensation Scheme. You may be entitled to compensation from the Scheme if a Lloyd's insurer is unable to meet its obligations to you under this insurance. If you were entitled to compensation under the Scheme, the level and extent of the compensation would depend on the nature of this insurance. Data Protection Any information you have provided will be dealt with by us in compliance with the provisions of the Data Protection Act 1998. For the purpose of providing this insurance and the handling of any claims or complaints, we may need to transfer to other parties certain information which you have provided to us. Sanctions We will not provide any benefit under this insurance to the extent of providing cover, payment of any claim or the provision of any benefit where doing so would breach any sanction, prohibition or restriction imposed by law or regulation. Choice of law You and we are free to choose the law applicable to this contract of insurance. Unless specifically agreed to the contrary this contract of insurance will be governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales. Rights of third parties A person who is not a party to this insurance has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this insurance but this does not affect any right or remedy of a third party which exists or is available apart from that Act. In this contract of insurance, our syndicate numbers and proportions are shown in the attached table. We bind ourselves severally and not jointly, that is, in the event of a claim, each of us (and our Executors and Administrators) is liable only for their own share of their syndicate's proportion of the risk.
