TECHNICAL ENVELOPE (T1): First of all, Technical Envelope of the tenderer will be opened online through e- Tendering procedure to verify its contents as per requirements. COMMERCIAL ENVELOPE (C1): This envelope shall be opened online as per the date and time given in detailed tender schedule (if possible), through e-tendering procedure only, Conditions of Technical Tenders ( Form A ) A Earnest Money Deposit (ii) (iii.) A copy of PAN and a xerox copy of last three years income tax return statement should be enclosed with the Tender Form A I. An attested copy of the valid VAT or Central Sales Tax registration, clearance certificate up to March, 2012, should be enclosed with the Tender Form A. Or if concession is provided then tenderers should submit a xerox copy of certificate issued by relates sales tax office signed by authentic officer, If applicable. Tenders received without the VAT clearance certificate are liable to be rejected, excluding to the fisheries co-operative society of the state. Where it is not applicable they have to submit their request to M.D. MFDC to have relaxation from this clause. II. Last three years audited copies of balance sheet and P&L Accounts should be enclosed with tender-a. III. It is also mandatory to enclose a non defaulter certificate self declared An affidavit on Rs. 100/- stamp paper should be enclosed for the private entrepreneurs, declaring them to be non defaulter. Any defaulter of state government organizations, undertakings / and M.F.D.C, will not be entertained. IV. The self experience certificate should be enclosed with the Bid-A. Experience of trading of fresh fish will be counted on the basis of transaction of purchase and sale of fish for last three years which is reflected in their balance sheet & PL statement.
V. Validity of the offer should be mentioned in Form A Tenders. Tenders with less VI. (i) than 360 days Validity will not be considered. No rates should be quoted in the Technical Tender (Form A ). (ii)opening of Tenders : The bids that are submitted online successfully will be opened shall be opened online as per the date and time given in detailed tender schedule (if possible), through e-tendering procedure only in the presence of bidders. VII. If the highest tender, whose rates are finalised and approved, fails to remit the amount within stipulated time, MFDC has right to sale it any where in the market and no compemsation will be paid to him. VIII. The amount of the fish have to be paid by the cheque of any commercial bank and no cash transaction will be made for sale of fish. IX. If the fish is available on daily basis, daily cheque payment have to be made by the successful tenderer. X. If the participating tenderer tries to hide the facts or any false information is submitted by him then his tender shall be treated as cancelled and the Earnest Money Deposit shall be forfeited. XI. It is pertinent for the tenderer or his authorised representative to attend the Tender opening. XII. The Maharashtra Fisheries Development Corporation, Mumbai reserves the right to distribute the orders at acceptable rates amongst two or more tenderer or may accept or reject any tender without assigning any reasons thereto. XIII. Failure to observe any of the conditions mentioned above will result in the Tenders being summarily rejected. XIV. The M.F.D.C. reserves the rights to accept or reject any/all tender/s without assigning any reason thereof. XV. Any legal disputes shall be restricted to MUMBAI Jurisdiction only. XVI. That in the event of either party being rendered unable by "force majeure" to perform any obligation required to be performed by it under this agreement, the relative obligation of the party affected by such force majeure shall after notice under this clause be suspended for the period during which such clause lasts. The term Force Majeure as used herein shall mean act of god, war, strikes or riots, fire, floods, Cyclone and Earth Quack act or regulation of the Govt. of India / State Govt. or any of its authorised Agencies. Upon the occurrence of any force majeure
cause and upon its termination, the party alleging that it has been rendered unable as aforesaid, shall notify the other party in writing within Twenty Four (24) hours of the alleged beginning and ending there of giving full particulars and satisfactory explanation in support of its claim. Time for performance of the relative obligation suspended by the force majeure shall then stand extended by the period for which such cause lasts without any economical burden on Principal. XVII. The quantity of fish is depend on the growth of fish in cages. XVIII. The successful tenderer have to make his own arrangement for lifting of fish from the site. XVII Arbitration: Any dispute, claims or rights arising out of or in relation to this contract shall be referred for Arbitration to an Arbitrator appointed by the secretary, Department of Animal Husbandry, Dairying and Fisheries, Ministry of A.D.F., Govt of Maharashtra. Arbitration shall be conducted in accordance with the provisions of the Arbitration and Conciliation Act 1996 and the venue for the arbitration shall be at Mumbai.
TENDER FORM B INSTRUCTIONS TO TENDERS - TERMS & CONDITIONS 1. The rates should be quoted Separately for Common carp, Tilapia and Phangasious at Destination ( The list of the destination is enclosed as annexure-1 2. Tenderer are requested to quote rate as per the list of destination given in annexure-1. 3. Typed rates should be quoted both in words and figures. All corrections must be duly attested by the Tenderer. Tender Form No. & Name of Scheme, Code No. of items should be quoted on the envelope. 4. The payment will be on daily basis, on the same day before lifting the fish from site by cheque only. If the cheque bounces then the security deposit will be forfeited. 5. Validity less than 360 days of tender will be rejected. 6. More than one offer from one tenderer at each center will be treated as invalid. 7. Conditional offer will be rejected/ not considered. 8. Successful tenderer will be required to pay an amount of Rs. 3,75,000/- as security deposit and enter into an agreement for the due performance of the contract. In event of the order being placed against the tenderers, and the tenderers fail to lift up the fish then the amount of security deposit will be forfeited. The Managing Director, M.F.D.C., Mumbai in his sole discretion shall take action deemed fit as under. (i) The offer of the defaulting tenderer will be cancelled. (ii) The defaulting tenderer will be penalised to the extent of the difference of rate at which the remaining tenderer will be executed by next to H1 & respectively to complete the whole tender. 9. In the case of non-lifting of fish or delayed in lifting of fish against the production of fish, the M.D., M.F.D.C. reserve its right to impose such penalty in its sole discretion as it thinks fit. 10. The M.D., M.F.D.C. reserves the rights to accept or reject any/all tender/s without assigning any reason thereof. 11. If the defaulting tenderer fails to pay the penalty in that case his tender will not be considered by the M.F.D.C. in future as well as the same will be informed to the Government departments. 12. The seeds should be adequately acclimatized for transportation before effecting delivery to the required destination.
