BOILER AND PRESSURE VESSEL FEES B-5 REG 1 3 CHAPTER B-5 REG 1 The Boiler and Pressure Vessel Act Title 1 These regulations may be cited as The Boiler and Pressure Vessel s Regulations, 1981. Interpretation 1.1 In these regulations, Act means The Boiler and Pressure Vessel Act. 19 Feb 88 SR 8/88 s3. Survey and registration fees 2(1) The fees payable to the department for surveying, registering or rejecting boiler or heat exchanger designs are those set out in Table 1 or Table 2 of the Appendix, as the case may require. (2) The fees payable to the department for the surveying, registrating or rejecting of pressure vessel designs, other than a boiler or heat exchanger design, are those set out in Table 3 of the Appendix. (3) The fees payable for the survey of fittings to be used on boilers, pressure vessels or pressure piping are: (a) for each size submitted for separate registration, $60; (b) for a range of sizes shown on one drawing for collective registration, $100; (c) for a range of sizes and types listed in a catalogue or similar publication, $195; (d) for each addition or revision to a registered catalogue, $60. (4) Where any boiler or pressure vessel is not properly stamped or identified as required by Canadian Standards Association Code B51 or by any regulations made under The Boiler and Pressure Vessel Act, the fee payable for stamping by an inspector is $60, plus: (a) a per diem fee of $320; and (b) any expenses incurred by the inspector in stamping the boiler or pressure vessel. (5) The fee payable for an engineering survey of boiler, pressure vessel or heat exchanger that is delivered into the province without the prior approval of the chief inspector is $260, plus any fees payable pursuant to subsection (1) or (2). (6) Where the chief inspector considers that it is appropriate, he may waive any part of the fees specified in clause (3)(b) or (c) and all or part of the fee specified in subsection (4).

Refrigeration system and boiler fees 3(1) The fee payable for an inspection of a refrigeration system of a capacity of: (a) 30 tonnes or less, is $50; (b) more than 30 tonnes, is $95. (2) The fee payable for an inspection of: (a) a traction boiler used exclusively for agricultural demonstrations or exhibits, is $20; (b) a high or lower pressure boiler, other than a boiler described in clause (a), is the fee set out in Table 4 of the Appendix. (3) Where a high or low presure boiler, other than a boiler described in clause 2(a), is being fabricated, altered or repaired, the fee payable for a first shop inspection is the fee set out in Table 5 of the Appendix. (4) No fee is payable for a second or subsequent shop inspection under subsection (3). Pressure vessel registration and fees 4(1) The owner of every pressure vessel, other than an air receiver with a multiple of 1.5 or less, shall register the vessel with the department not later than April 30 in each year. (2) The fee payable for the registration of a pressure vessel is the fee set out in Table 6 of the Appendix. (3) Where a pressure vessel is being fabricated, altered or repaired, the fee payable for a shop inspection is the fee set out in Table 7 of the Appendix. BOILER AND PRESSURE VESSEL FEES B-5 REG 1 5 Inspection of registered pressure vessels 5(1) The fee payable for inspection of an unregistered pressure vessel is the fee set out in Table 6 of the Appendix. (2) Repealed. 29 Mar 85 SR 18/85 s5. (3) The fee payable for the inspection of the pressure plant, piping, fittings and valving in a new installation under construction, or of alterations made to existing installations, is: (a) (b) $40 per hour to a maximum of $320 for an eight-hour day; and $80 per hour for every hour in excess of eight hours per day. 8 Oct 82 SR 137/82 s6; 9 Mar 84 SR 17/84 s6; 29 Mar 85 SR 18/85 s5; 10 May 91 SR 32/91 s6. Installation and repair fees 6(1) No person shall install any boiler or pressure vessel or refrigeration plant or perform any work with respect to a boiler or pressure vessel or refrigeration plant unless he holds a valid and subsisting general contractor s licence that is issued by or acceptable to the chief inspector. (2) No general constractor s licence is to be issued to a person unless he furnishes to the department a guarantee bond in the penal sum of $5,000 in any form and subject to any conditions that may be specified by the chief inspector. Installation, repair permits 7(1) All work of installation or repair to a boiler or pressure vessel or refrigeration plant is to be reported to the department on permits supplied by the department. (2) All permits remain the property of the department and are not transferable. (3) When a permit is cancelled by the chief inspector or has expired, the holder of a permit shall return all copies of the permit to the department. (4) Subject to subsection (7), the fees payable for a permit are those set out in Table 8, 9, or 10 of the Appendix, as the case may require. (5) The fee required pursuant to subsection (4) covers the first inspection but where more than one inspection is required before a boiler or pressure vessel or refrigeration plant may be put into service, the fee for the second and each subsequent inspection is: (a) (b) $40 per hour to a maximum of $320 for an eight-hour day; $80 per hour for every hour in excess of eight hours per day.

Examination fee 8(1) The fee payable for an examination, including the fee for the appropriate certificate, is the fee set out in Table 11 of the Appendix. Certificate fees 9(1) The fee payable for the periodic registration of a final certificate pursuant to section 27 of the Act, including the fee for the appropriate registration certificate, is: (a) for a first class engineer s certificate, $120; (b) for a second, third, fourth or fifth class engineer s certificate, $60; (c) for a refrigeration engineer s certificate, $60; (d) for a refrigeration plant operator s certificate, $43. (2) The fee payable for the renewal of a temporary certificate pursuant to section 27 of the Act is: (a) for an engineer s special certificate, oilfield, $100; (b) for a fireman s certificate, $43; (c) for an engineer s special certificate, traction engine, $43. (3) The fee payable for a duplicate certificate is: (a) for a first, second, third, fourth or fifth class engineer s certificate, refrigeration engineer s certificate or engineer s special certificate, $15; (b) for a fireman s or refrigeration plant operator s certificate, $4. (4) The fee payable for a permit issued pursuant to section 29 of the Act is: (a) for a 30-day permit, $40; (b) for a 90-day permit, $120.

BOILER AND PRESSURE VESSEL FEES B-5 REG 1 7 (5) Where: (a) the holder of a second, third, fourth or fifth class engineer s certificate has paid the registration fee prescribed in subsection (1); and (b) subsequently obtained a certificate of a higher class; he may submit a written request to the department for a refund pursuant to this subsection and, on receipt of that request, the department may grant the holder a refund of: (c) 75% of the fee paid if the higher certificate is obtained in the first year of registration; or (d) 50% of the fee paid if the higher certificate is obtained in the second year of registration. 19 Feb 88 SR 8/88 s4; 31 Jly 92 SR 65/92 s2; 10 Jan 2003 SR 125/2002 s4. Welder s test fee 10(1) The fee payable for a pressure welder s qualification test, including the issue of the authorization, is the fee set out in Table 12 of the Appendix. (1.1) The fee payable for the registration of an out-of-province welder is $60. (1.2) The fee payable for a weld procedure test or review is the fee set out in Table 13 of the Appendix. (1.3) Coupons required in tests mentioned in this section are supplied at cost. Anhydrous ammonia storage plants and distributors 11(1) The fee payable to the department for a licence for an anhydrous ammonia storage plant, including, subject to subsection (2), the fee for a distributor s licence, is the fee set out in Table 14 of the Appendix. (2) The fee payable to the department for a licence for an out-of-province anhydrous ammonia distributor is $130 per year. (3) A distributor who purchased a five-year licence and who is no longer carrying on business as a distributor may request a refund of: (a) (b) 2/3 of the fee paid, if the refund is requested in year one; 1/3 of the fee paid, if the refund is requested in year two. 8 Oct 82 SR 137/82 s10; 9 Mar 84 SR 17/84 s12; 29 Mar 85 SR 18/85 s10; 10 May 91 SR 32/91 s11. 12 Repealed. 10 May 91 SR 32/91 s12.

8 B-5 REG 1 BOILER AND PRESSURE VESSEL FEES Manufacturer s licence 13(1) No person shall manufacture or assemble any boiler, pressure vessel or pressure piping system unless the person holds a valid and subsisting manufacturer s licence. (2) Subject to subsection (4), no manufacturer s licence is to be issued to a person unless the person: (a) submits to the department a written manual that: (i) sets out the details of the manufacturer s quality control system; and (ii) is acceptable to the chief inspector; and (b) demonstrates to the satisfaction of the chief inspector or the authorized representative of the chief inspector that the quality control system mentioned in subclause (a)(i) is in operation at the place of manufacture or assembly. (3) The fees payable for a manufacturer s licence are: (a) $185 for review of the manual; and (b) $45 per hour or portion of an hour for an assessment of the quality control system pursuant to clause (2)(b). (4) The holder of a valid and subsisting general contractor s licence pursuant to section 6 who: (a) meets the requirements of clause (2)(a); and (b) pays the fee set out in clause (3)(a); may obtain a manufacturer s licence. (5) A manufacturer s licence expires three years after the date of its issue. (6) A subsisting certificate of authorization within the meaning of the Canadian Standards Association standard B51 Boiler, Pressure Vessel, and Pressure Piping Code that was issued by the department before the coming into force of this section is deemed to be a manufacturer s licence. 10 May 91 SR 32/91 s13; 10 Jan 2003 SR 125/ 2002 s5. Issue of certificate 14(1) No inspection certificate or registration certificate shall be issued until the fee for the certificate is paid. (2) Notwithstanding subsection (1), when the payment of fees for inspection or registration is made by cheque, the issue of an inspection certificate or registration certificate is provisional until the cheque is honoured by the financial institution on which it is drawn. (3) If a cheque given in payment of fees is not honoured by the financial institution on which it is drawn, a certificate that was issued provisionally pursuant to subsection (2) is invalid on and from the date on which the chief inspector receives notice that the cheque has not been honoured. 9 May 86 SR 43/86 s6.
