AR-RIHLA TOURS زروت ةلحرلا ةكرش AGREEMENT BETWEEN AR-RIHLA TOURS ( AR-RIHLA ) and HAJJ PILGRIM (PILGRIM) TERMS & CONDITIONS OF LIABILITY 1. AR-RIHLA Tours and all its affiliates or subsidiaries are collectively referred to as AR-RIHLA Group. AR-RIHLA Group s affiliates and subsidiaries include, but are not limited to: 1.1. DESTINATIONS UNLIMITED, LLC 1.2. DAR AL-GHUFRAN FOR HAJJ 1.3. INTERNATIONAL HAJJ AGENCY 2. ACCEPTANCE OF THE CONTRACT: 2.1. Upon purchase of the Hajj 2018 package, these terms and conditions become a binding contract between the Pilgrim and AR-RIHLA Group. Acceptance of this contract occurs when the deposit of at least $2,500.00 is received by AR-RIHLA and/or this signed agreement is received by AR-RIHLA. 3. DEFINITIONS: 3.1. AR-RIHLA is only acting as an agent in arranging the airlines, accommodations, ground transportation, or any service in connection with the Hajj trip. 3.2. Confirmation of Travel Arrangements: Travel Arrangements are not confirmed until AR-RIHLA has received the required deposits and Pilgrim has received formal confirmation from AR-RIHLA. 3.3. Transfer refers to transportation from one location to another, generally between the airport and the lodge and, unless otherwise stated on the itinerary, refers to a seat in a van, bus, car, or other vehicle. Determination of the appropriateness of vehicles shall be determined by the provider of the service. 4. RESERVATIONS AND PAYMENT: 4.1. For a Pilgrim to reserve space on Hajj trip, a deposit of $2,500.00 per person is required, due upon signing and submitting of this agreement. Early reservations are essential to guarantee your accommodations on the date you wish to travel. 4.2. Second deposit payment is due May 1st, 2018 and final payment is due on June 1st, 2018. If payments are not paid when due, AR-RIHLA reserves the right to treat the reservation as cancelled. 4.3. Full balance payment, including additional surcharges, must be paid by the given deadline, unless agreed to otherwise in writing by AR-RIHLA. 4.4. All payments must be made by personal checks, money orders or cashier s checks and made payable to AR- RIHLA Tours. 4.5. All payments must be mailed to the address provided, with required documents list, by AR-RIHLA. 4.6. Pilgrim is advised to use secured mail (at the very least, certified mail) to send payments. AR-RIHLA assumes absolutely no liability for damage or loss resulting from, but not limited to, loss or delay of payments, returned or voided checks, and/or failed or denied transactions. 4.7. Reservations made within 90 days of the departure require full payment, and any additional charges for expenses incurred due to special mailing, fax charges, etc. 4.8. All payments must be made exactly as per the amount agreed with AR-RIHLA for all requested services before given deadlines. 5. PILGRIM OBLIGATIONS: 5.1. Pilgrim will ensure that you: 5.1.1. are in good medical health and are physically fit as of the Date of Departure specified; 5.1.2. have cooperated and provided AR-RIHLA with all of the necessary documents for visas to enter and remain in the country or countries in which the Hajj will take place; 5.1.3. have a passport valid and acceptable for travel to the country or countries in which the Hajj will 1
take place and valid for at least six months beyond the Return Date; 5.1.4. have a passport valid and acceptable for travel to the country or countries, upon returning from Hajj; 5.1.5. make your own arrangements to travel to the Departure Point and from the Return Point; 5.1.6. arrive at the Departure Point no later than at least 4 hours before the Departure Time (AR-RIHLA assumes no responsibility for changing any aspect of the Hajj trip to accommodate late arrivals); 5.1.7. schedule onward trip no earlier than at least 4 hours after the arrival time at return point (AR- RIHLA assumes no responsibility for changing any aspect of the Hajj trip to accommodate late arrivals); 5.1.8. will bring with you on the Hajj sufficient quantities of your prescription medicines and documentation from your doctors authorizing you to take such medicines (this may be necessary when entering certain countries), and 5.1.9. Pilgrims must attend Hajj presentation at time and place to be determined by AR-RIHLA Staff. 5.2. Pilgrims are required to submit the exact documentation specified by AR-RIHLA. 5.2.1. Please remember, document requirement may change for each individual traveler. 5.2.2. AR-RIHLA assumes no responsibility or liability for any loss or damage resulting from, but not limited to, lost documents, delayed documents, or otherwise incomplete documents, due to PILGRIM error and no negligence on AR-RIHLA s part. 5.2.3. AR-RIHLA maintains the right to cancel any reservation or travel package, with a penalty fee, if it does not receive the proper documents by the given deadline. AR-RIHLA recommends using secured and track able mailing options, such as FedEx, UPS, Certified Express, or Priority Mail to send payments, documents, and return shipments to us. 5.2.4. AR-RIHLA assumes absolutely no liability for damage to or loss of your documents by shipping companies, the Saudi Arabian consulate(s), and all the agencies of the Ministry of Hajj in Saudi Arabia involved in this process, and any inconvenience, loss, or damage resulting from it. 5.2.5. All documents must be mailed to the address provided by AR-RIHLA, with required documents list. 5.2.6. Travel, hotel, and transportation reservations are subject to cancellation with penalties in case correct payments are not received by the given deadline. 6. NON-OPTIONAL SERVICES [ Masha er or Mandatory Hajj Services]: (Pilgrim may not be able to opt out of these provisions or the contract is voided.) 6.1. Hajj visa: AR-RIHLA will process Hajj visas for each pilgrim. 6.2. Masha'er: AR-RIHLA will make arrangements for Mina, Muzdalifah, and Arafat portion of trip for each pilgrim. 7. OPTIONAL SERVICES [Expanded Hajj Package Service]: (Pilgrim who selected standard advertised packages may not be able to opt out these provisions or the contract is voided. Other pilgrims, if already agreed by AR-RIHLA, may include these services in his/her Hajj package or he/she may OPT-OUT of these travel arrangements.) 7.1. International Airline Travel: AR-RIHLA will provide international travel arrangements and itinerary for Hajj Pilgrims as advertised. arrange airfare itinerary for Hajj attendees. 7.1.1. Airline carriers have the ultimate authority to change and/or cancel the airline booking at their convenience. AR-RIHLA assumes no liability for damage or loss of any kind resulting, directly or indirectly, from schedule changes, re-routing of flights, service delays, voluntary or involuntary service cancellations, loss of luggage, delayed luggage, or change of carriers due to Airline carriers and due to no negligence on behalf of AR-RIHLA. 7.1.2. In all cases, the airline carrier follows its own policies for compensation or allowing changes or refunds with or without penalties. Travelers are encouraged to deal with the airline carrier directly 2
in any such cases. Travelers must notify AR-RIHLA of any missing information or discrepancies in an airline booking within 24 hours of receipt of the itinerary. AR-RIHLA is unable to add or amend any information after this 24-hour Void Window has passed, with NO EXCEPTIONS. 7.1.3. AR-RIHLA will assume no liability after this Void Window has passed. Travelers must follow the airline carrier s policies for any changes, amendments, or cancellations thereafter. 7.1.4. AR-RIHLA will make reasonable effort to assist the Pilgrim in transferring to the destination (BEFORE) itinerary is made for Hajj, but Pilgrim is responsible for any additional expenses incurred in making this transfer. 7.2. Lodging Accommodations (Non-Masha'er Arrangements): AR-RIHLA will arrange for hotel stays in Makkah and Madinah as advertised. arrange lodging for Hajj attendees. 7.3. Ground Transportation: AR-RIHLA will either arrange a private transportation for each listed sectors or opt out to help pilgrims utilize the transportation services provided by the competent authorities in the Kingdom of Saudi Arabia. arrange ground transportation for Hajj attendees. 7.3.1. AR-RIHLA strictly follows guidelines and policies set forth by the Ministry of Hajj in Saudi Arabia, and its affiliate or subsidiary agencies and/or accommodation and ground service provider partners, in arranging accommodation and ground services for its customers and AR-RIHLA assumes absolutely no liability, due to no negligence of their own, for damage or loss resulting directly or indirectly from policy changes, changes in service, delays in service, or cancellation of service. 7.3.2. Travelers are responsible for their personal belongings and must cover all expenses resulting from any cases, in which their personal belongings are damaged and/or lost, with no exceptions. 8. CHANGES IN ITINERARY BY AR-RIHLA: 8.1. AR-RIHLA reserves the right to: 8.1.1. make changes or cancellations in services where such changes are made necessary by circumstances beyond AR-RIHLA s control, including changing airline carriers, substituting hotel accommodations and restaurant or meal locations from those designated in the itinerary, 8.1.2. if an itinerary change is made; AR-RIHLA will make reasonably efforts to ensure substituted carrier or venue is equal to or greater than the original accommodations, IF such accommodations are available and affordable, without any additional cost to Pilgrim, and 8.1.3. cancel any trip due to inadequate attendance, which makes the trip economically infeasible to operate. In such cases, a full refund of the cancelled trip cost is the limit of AR-RIHLA s liability. 9. ASSUMPTION OF RISK: 9.1. Despite precautions, accidents and injuries can occur. I understand the activities I may undertake may be potentially dangerous and that I may be injured and/or lose or damage personal property or suffer financial loss as a result of use of the facilities, equipment or Trip participation. Therefore I ASSUME ALL RISKS RELATED TO THE ACTIVITIES including but not limited to: 9.1.1. Death, injury or illness from accidents of any nature whatsoever, including but not limited to bodily injury or illness of any nature whether severe or not, temporary or permanent, which may occur as a result of participating in an activity or contact with physical surroundings, equipment or other persons. 9.1.2. Loss or injury as a result of a crime or criminal act by third parties, terrorism, war, civil unrest, riot, detention by a foreign government, arrest or other act of any government or authority. Theft or loss of personal property during the Hajj or any Hajj related travel. 9.1.3. Loss or death or injury as a result of any natural disaster or event or extreme weather conditions or 3
events. 9.1.4. Alteration including delay, extension or cancellation of the Hajj due to natural disaster, civil unrest, war, terrorist attack, medical quarantine or any other disturbances or causes. I further acknowledge that the above list is not inclusive of all possible risks associated with the Trip or facilities, equipment, or services in association with the Trip, and that the above list in no way limits the extent or reach of this release and covenant not to sue. I,, understand that participating on this Hajj trip and use of AR-RIHLA Staff and trip facilities in Saudi Arabia is an acceptance and assumption of risk of injury. (please initial). 10. REFUND POLICY: 10.1. All refund or reimbursement requests must be submitted in writing by email to info@arrihlatours.com or by mail to the Accounts address mentioned in this document. Airline tickets are non-refundable in all cases. A refund penalty will be charged on all payments towards land packages to cover the administrative fees as per the following timeline: 10.1.1. $500.00 penalty per person will be charged if the cancellation request is received after accepting payment on or before 1 st of May 2018. 10.1.2. $1000.00 penalty per person will be charged if the cancellation request is received between 1 th of May 2018 and 30 th of May 2018. 10.1.3. A 100% payment, including payments for additional services requested by the traveler, is nonrefundable if the cancellation request is received on or after 1 st of June 2018. 10.1.4. A 100% payment, including payments for additional services requested by the traveler, is nonrefundable if the cancellation request is received after the trip departure date or if the package is utilized partially. 10.1.5. A 100% payment, including payments for additional services requested by the traveler, is nonrefundable if the cancellation request is not received by AR-RIHLA Group at any time before or after the departure. 10.2. The policy and the date of the next deadline are applicable if a payment is made after a deadline has already passed. 10.3. For example, if the first payment is made on 1 st of May 2018 and a cancellation request is submitted before 30 th of May 2018, the payment is subjected to a minimum penalty of $1000.00, since the first cancellation deadline on 1 st of May 2018 has already passed. 10.4. If Pilgrim is requesting refund due to denial of visa by Saudi Arabia government and no negligence on behalf of AR-RIHLA, then refund policy is in effect. 10.5. If pilgrim is denied, visa due to inaccurate documents or missed deadlines and/or pilgrim error no guarantee of any refund whatsoever. 11. TRAVEL VISAS: 11.1. I,, understand that AR-RIHLA does not issue visas, or in any way determine or control the issuance of, or terms and conditions of, visas, all of which is determined and controlled solely by the consulates of the Royal Embassy of Saudi Arabia. 11.2. I agree that AR-RIHLA is not, and cannot be responsible for any determinations, acts or omissions by the consulates and that all consular fees and processing fees are NONREFUNDABLE even if a visa is denied or if a visa is issued for a shorter period of time or otherwise issued or returned at a time or on terms and conditions that vary from those sought by the applicant, due to no negligence on AR-RIHLA s part. 11.3. Saudi Consulates does not provide reason for denial of visa. 12. WARRANTY DISCLAIMER: 12.1. No guarantees or warranties, express or implied are made that the Hajj trip will meet all of the traveler s expectations, specifically regarding weather, time delays or conditions or productiveness of trip. 13. GENERAL RELEASE: 13.1. AR-RIHLA, its affiliates and agents act only in the capacity of agents in all matters of transportation and trip operation, and their liability is limited to the terms of the airline tickets and land accommodation contracts. Group organizers, Pilgrims, travelers and tour participants, individually and jointly, release AR- 4
RIHLA from any and all liability and responsibility, known or unknown, present or future, for any and all loss, injury to person, expenses, direct or consequential damages, damage to property, or accident, or which may be the result of any delay or change of itinerary, or irregularity connected with the trip purchased, including but not limited to, acts of God, transportation problems, fire, machinery or equipment malfunction or failure, government actions, wars, civil disturbances, labor disputes, riots, thefts, sickness, negligence by any service suppliers in the trip package, or weather. This release is binding upon group organizers, Pilgrims, tour participants, travelers, their representatives, heirs and assigns. 13.2. AR-RIHLA Group will not be responsible for any person(s) missing any part of the program due to individual negligence or delay or absenteeism for any time during the tour and will not be responsible for any reimbursement or additional expenses for the participant(s) to rejoin the tour. 14. CHOICE OF LAW AND VENUE: 14.1. In the event of any dispute amongst either party based on any claim arising under or as a result of this contract or based on the Hajj trip of which it is a part,, the parties agree to submit such dispute to a mediator; if the dispute cannot be solved through mediation, the parties agree to submit to binding arbitration to be held in College Park, Maryland, the purpose of which shall be to resolve the dispute in a fair manner at minimum cost. By proceeding in this manner, the parties agree to waive any right to a court or jury trial. 15. MISCELLANEOUS: 15.1. Accommodation and ground services partners may impose additional penalties based on their policies. Commonly, all airline tickets for Hajj are non-refundable, unless authorized otherwise by the carrier s policies. All refund requests involving airline tickets are processed based on the airline carrier s policies and must be pursued directly with the airline carrier. Advertised package prices only include the services as advertised by AR-RIHLA. 15.2. Package price does not include Ministry of Hajj fees and sacrifice. 15.3. All pilgrims must pay an additional $350.00 to AR-RIHLA, to cover the cost of United Agents Office. 15.4. Pilgrims may choose to pay an additional $125.00 per person, for Hady (sacrifice), to AR- RIHLA. By signing below, I willfully agree to the above terms and conditions of liability.
