The OECD has placed Jersey on its White List of approved jurisdictions, stating that the Island was adhering to the internationally agreed principles of transparency and co-operation for the exchange of taxrelated information. The IMF, in its Financial System Stability Assessment Update report, praised Jersey s high standards of regulation and supervision, stating that Jersey is in the top division of international financial centres, including those in the G20 and European Union. Jersey is classified as being compliant or largely compliant with 44 of the 49 general Financial Action Task Force (FATF) recommendations, more than many other jurisdictions. Leading Investor Establishing a 200 million closed ended fund for Capri UK Investments Ltd., investing in Indian luxury hotels, using a Jersey incorporated expert fund and investing through Mauritius subsidiaries. Advising a leading investor and private equity fund manager and its portfolio companies active in the energy sector in Russia, India and other transforming markets on a bridging facility of US$210 million for significant investment in oil and gas assets Real Estate Investor and Developer Acting for the largest real estate investor and developer in Central and Eastern Europe on a major restructuring, investment and subsequent conversion to listed fund status, the first Jersey unclassified fund to do so. Atrium European Real Estate Limited Securities Dual-listing Atrium European Real Estate Limited s Securities on Euronext Amsterdam and the Vienna Stock Exchange, the first dual listing of this nature for a Jersey company in the alternative funds sector in Western and Central Europe. Jersey Headquartered Investment Manager Establishing funds for a Jersey headquartered investment manager, primarily private funds investing in property acquisition and development in numerous jurisdictions, including Montenegro, the Czech Republic, Panama and the United States. Alchemy s Acting for Alchemy s, a British private equity company in relation to a 90 million management buyout of Noonan Services Group Limited, a Jersey-registered contract cleaning and facilities management group. Dispute Resolution Prince Jefri Bolkiah of Brunei Appearing on behalf of Prince Jefri Bolkiah of Brunei in what is now the leading case in Jersey on the question of enforcement of foreign judgments, raising important issues including comity and enforcement of public laws of a foreign state. Jersey Financial Services Commission Advising on various winding up and other options available in light of the insolvency of certain companies, including a consideration of director s duties and conflicts of interest and working closely with the Jersey Financial Services Commission. Jersey Financial Services Commission Representing the co-promoter of three collective investment funds in proceedings to wind up the funds. The application, brought by the Jersey Financial Services Commission, was the first of its kind in Jersey. 4
REPRESENTATIVE WORK Property Joint Administrators Working with the joint administrators of collapsed retailer Woolworths plc (in administration) on the sale of the leases of its Jersey store to the New Look fashion group and advice in relation to other Jersey property interests. Dandara Acting for Dandara in the completion of its Fourteen Gloucester Street development, a mixed-use scheme including 72 apartments and medical and dentists premises, and in its acquisition for residential development of the site of the existing Jersey Dairy. Leading Global Bank Advising a leading global bank on the sale and leaseback of a staff accommodation block, requiring careful structuring so as to accommodate the client s occupational needs during the term of the lease. Private Client & Trusts Jersey Trust Advising on the implementation of the separation of the interests of United States and United Kingdom beneficiaries of a Jersey trust with a view to restructuring their beneficial interests to best advantage. Ultra High Net Worth Client Establishing a private trust company for an ultra-high net worth client of Russian origin, the underlying trust company structure holding a variety of assets in numerous jurisdictions including Russia, Cyprus and the United Kingdom. Clients - Family Benefit Trusts Restructuring several family benefit trusts for clients to ensure their optimal tax position and to meet their strategic objectives, with one restructuring crucial in assisting with the completion of a corporate takeover.
