Details of the Bid REQUEST FOR BID: THE ROAD ACCIDENT FUND HEREBY REQUESTS PROPOSALS FROM LEGAL COST CONSULTANT (S)/ SERVICE PROVIDER(S) SUITABLY QUALIFIED AND EXPERIENCED TO NEGOTIATE/SETTLE OR TAX PARTY AND PARTY LEGAL COST ON BEHALF OF THE ROAD ACCIDENT FUND IN THE NINE PROVINCES OF SOUTH AFRICA. Evaluation Criteria Mandatory Requirements The following specific requirements must be met by the bidders and it will be expected of bidders to supply proof or confirm their commitment where applicable. The Legal Cost Consultant must have Right of Appearance in the High Court with 2 years experience in Legal Cost OR to have only 5 years experience as a legal cost consultant with a law degree without Right of appearance. Please furnish documentary proof in the name of the Legal Cost Consultant such as: Certificate of admission as attorney with Right of Appearance in High Court and Other Courts with 2 years experience; and CV with detailed experience Three (3) reference letters stating the Legal Costs experience. NB: The RAF will not accept a list of references and/or references listed on a table. The reference letters must be in the form of individual letters from respective customers.
Evaluation Criteria Mandatory Requirements The bidder must have presence in the province for which the tender is submitted. Please furnish documentary proof in the name of the bidder such as: Municipal service statement; Lease agreement/invoice, etc. Where the documentary proof does not clearly match the identity of the bidder, the bidder may submit an explanation on affidavit for consideration by the RAF. If you are bidding for more than one province, proof of presence must be provided for each province you bid for. The bidder confirms that they had read and understand the terms and conditions set out in attached Service Provider Agreement (Annexure H) which terms and conditions the bidder accepts, in the event the RAF awards a contract to the bidder pursuant to this bid.
Evaluation Criteria Mandatory Requirements Failure by the successful bidder to conclude a contract within twenty one (21) days following the issuing by the RAF of the award letter to the successful bidder, will result in the bid being deemed to be non-responsive which will then entitle the RAF to consider other responsive bids and award the tender to another bidder or bidders.
Technical / Functional Requirements Technical criterion will be evaluated against the following detailed requirements: Bidder must demonstrate and deliver on the following (66 pts.): Skills and experience in attending to Party and Party Bill of Costs (20) Mark, Check, Verify and Assess bills (Tax) (20) Negotiation/Settlement (6) Attend to taxations (20) Infrastructure (14 pts.) Internet Capability (Proof in every region) (5) Printing Capability (Proof in every region) (5) Email capabilities (Proof in every region (4) NB: Sits visits will be conducted to confirm the above. If the above cannot be verified during the site visit, points will be deducted from the bidder.
Technical / Functional Requirements Bidders scoring 55 out of 80 will be considered for reference checks. Reference / track record (20 pts.) Furnish three (3) reference questionnaires where similar work was done in the past three (3) years. No RAF references will be accepted. SPECIFICATION The RAF require the following services from the bidder: Mark, Inspect, Verify and Assess bills (Taxing) Formal objections to bill of costs Negotiation/Settlement Attend to taxation Delivery of settled or taxed bill of costs Draw bills of costs
SPECIFICATION Bidders skills and experience: Admitted Attorney with Right of appearance in Court with 2 year Legal Cost experience or 5 years experience as a Cost Consultant (not required to be an admitted attorney) Skills and experience relating to party and party costs Skill and knowledge to effectively assess and tax bills of costs Negotiation Skills Attend taxations Drawing of Bills of Costs Knowledge of RAF Act as amended Knowledge of Judicial Reviews, Case Law, High Court and Magistrate Court Acts/Rules Knowledge of Court Practice Directives
SPECIFICATION Service Level: The Legal Cost Consultant must deliver the settled / taxed bill of cost to the RAF within 24 hours of the date of settlement / taxation. A penalty of 2% of the fee charged per day up to a maximum of 10% of the fee charged will be implemented.
SPECIFICATION Tariff: Cost Consultant will be entitled to charge a fee equal to 10% of the savings of the bill as drawn and settled to a maximum of R8 250.00 plus VAT. A minimum fee of R150.00 plus VAT may be charged. No travelling fees or disbursements will be allowed for legal cost consultants when travelling to Court, unless the court is more than 100 Kilometers from the office of the Cost Consultants. Travelling fees will be charged at R3.00 per kilometer. Where a bill of cost is drawn and finalized on behalf the RAF, an amount will be allowed equal to 10% plus VAT if applicable, on the amount of the fees on the bill of cost as settled or taxed as well as the actual attendance fee as allowed.
